In line with Council’s Public Consultation Policy, CONSULT was selected as the appropriate level of community engagement for seeking Community feedback. Consideration was also given to the community consultation requirements in the Local Government Act 1999, Section 194 - Revocation of classification of land as community land. A Community Engagement Strategy was developed and implemented over a four week period from Monday 7 September to Friday 2 October 2015. This report provides the outcomes to the engagement with the Community. Discussion Staff have undertaken an extensive public consultation process over a four week period including: 273 Information Sheets and Feedback Forms sent to ratepayers and residents within approximately a 300m radius of the property; visits to occupants of five adjacent properties including East Torrens Primary School; encouraging the East Torrens Primary School to promote the revocation consultation process to the school community; notifications in the East Torrens Messenger, at Council Office and Campbelltown Library, on street banners, on a sign at the property, on Council’s website and via social media. 91

The Information Sheet sought to ensure the Community understood Council’s proposal for the property, what it intends to do with the property if the revocation of the Community Land Classification is approved, and the impact of the proposal on the Community. It also advised readers of the various ways to provide feedback, where to obtain further information and next steps including the decision making process. Full details of the Community engagement process, an analysis of the feedback and all responses are presented verbatim in the Attachment ‘Proposed Revocation of Community Land Classification Allotment 34 Henry Street (Reserve) Hectorville – Community Engagement Outcomes’. A total of 34 Community Members provided feedback by completing feedback forms (4 online and 27 hard copy) representing a 12.5% return rate. In addition, verbal feedback was received from visits to residents at three properties adjacent to Allotment 34 Henry Street, Hectorville, and the Principal and Senior Staff from the neighbouring East Torrens Primary School also provided an email response. Most of the respondents who completed a feedback form were from Hectorville (82%) and within walking distance (approx 300 metres) from the property (76%). The following chart clearly shows a very high level of support for the revocation of Community Land classification at 34 Henry Street, Hectorville (known as the Pigeon Club) to enable Council to sell the property.

Similarly, as shown in the following chart, there was a high level of support for quarantining the proceeds of the sale for the purchase of additional open space somewhere more suitable in the Hectorville Ward, if the sale proceeds.

Visits to occupants at adjacent residences also found a high level of support for the proposal. The general view of those few who provided comments during the consultation (in the feedback forms and from visits to adjacent properties) was that the property was an ‘eyesore’, it was better being sold to allow it to be developed in keeping with the surrounds (residential properties) and that there was larger open space areas nearby that were better for residents to use. Only one respondent completing a feedback form did not support the proposal, expressing a desire for Council to ‘Give [the property] to East Torrens Primary School to add to their garden scheme. Please give it to ETPS.’ During discussions with Staff at the East Torrens Primary School it was revealed that the school had plans drawn up to provide a ‘garden & natural play area & bike track’ on the DECD (Department of Education and Child Development) land between the school administration building and Allotment 34 Henry Street, Hectorville. A suggestion was made by the Principal that Council could develop Allotment 34 Henry Street for complementary community use. The Principal advised that the DECD would not have the resources to assist in undertaking the work on Allotment 34 Henry Street or resources to oversee the management and its use by the community. Although reminders were sent by Staff encouraging the School to put in writing their feedback for consideration, the Principal’s email response to Council (refer page 18) only acknowledged Council’s proposal for Allotment 34 Henry Street and did not formally submit an alternative in line with the suggestion put forward during the discussions. If after considering this feedback, Council decides to proceed with the revocation of Community Land Classification process, the next step (in accordance with Section 194 (3) (a) of the Local Government Act 1999) is to submit to the Minister for Local Government the proposal with a report that includes all submissions made on it as part of the public consultation process, for consideration and approval of the revocation of the Community Land Classification.

Social Implications The Campbelltown Homing Pigeon Club has been the sole tenant at Allotment 34 Henry Street, Hectorville since 1965. With the Club winding up its affairs and the site being vacated for some time the sale of the property would allow for future residential development and an improved integration of the land into the current streetscape. Should the sale of this property proceed then there will no longer be open space at this site. However Council has resolved that should the property be sold, then the proceeds be quarantined for the purpose of purchasing more appropriately located additional open space in the Hectorville Ward in accordance with Council’s Open Space Directions and Strategic Report, thus keeping the proceeds within the local area for improvements to the area’s open space. Environmental Implications There are no environmental implications in relation to this report. Asset Management Implications There may be asset management implications should Council decide to not proceed with the revocation of the Community Land Classification and retain the site. As Council may be required to demolish the existing building or make significant structural improvements should Council decide to retain the building, any redevelopment of the site would need to comply with the requirements of the existing Community Land Management Plan. A decision to sell the site would remove any asset management implications. Governance / Risk Management The Community Land Revocation process is being undertaken in accordance with legislative requirements. Community Engagement Council has undertaken an extensive consultation process as part of the revocation process as required by legislation and Council’s Public Consultation Policy. Financial Implications The proposal to dispose of the property through sale would generate significant one-off income for Council. If the revocation of Community Land Classification is approved, Council may choose to sell the site as is, which may impact on the sale proceeds as the purchaser will need to upgrade or demolish the existing building. Should Council decide to demolish the building prior to sale, this expense would have a negative effect on the operating result, but may generate additional sale proceeds. Any net sale proceeds would be allocated to an Accounting Reserve for future Open Space purchases in Hectorville.

1. INTRODUCTION This report presents the findings from engagement with the community on the proposal to revoke the Community Land Classification at Allotment 34 Henry Street, Hectorville (known as the Pigeon Club) to enable Council to sell it, and if sold, to quarantine the proceeds from the sale for the purchase of open space in a more suitable location in the Hectorville Ward. The report to Council on the proposal is provided in APPENDIX C: Council Report 19 May 2015. The aim of the engagement was to promote to the wider Campbelltown City Council population the proposal and ways to provide feedback, engage specifically with those most affected to obtain their views, and identify the overall level of support for the proposal. A total of 37 Community members provided feedback during the community engagement period as well the adjacent East Torrens Primary School.

2. KEY OUTCOMES The following are the key outcomes from the community engagement: There is a very high level of support for:

revoking the Community Land Classification and selling Allotment 34 Henry Street, Hectorville,

and a high level of support for:

if the land is sold, quarantining the proceeds from the sale for the purchase of open space in a more suitable location in the Hectorville Ward.

There was only one objection to the proposal from a Community member who preferred the land be given to the East Torrens Primary School to “add to their garden scheme”. Unfortunately, even though the School Principal was given assurances that Council would consider any alternative for the land, no formal proposal was received.

3. METHODOLOGY 3.1 EXPLANATORY NOTES ‘participants’ refers to all who provided feedback regardless of how the feedback was provided ‘respondents’ refers to those participants who completed either a hard copy or online feedback form (n=.....) in the graphs refers to the number of respondents 3.2 COMMUNITY ENGAGEMENT STRATEGY In line with Council’s Public Consultation Policy, CONSULT was selected as the appropriate level of community engagement for seeking community feedback on the proposal. Consideration was also given to the community consultation requirements in the Local Government Act 1999, Section 194 - Revocation of classification of land as community land. The consultation period was open for a four week period from Monday 7 September to Friday 2 October 2015. The community engagement strategy included: Promotion and invitation to the Community to participate via:

sign at the property, advertisement in the East Torrens Messenger (Wednesday 9 September), notice on Council’s website, at Council’s Office (including a notice on the digital TV

screen) and Campbelltown Library, East Torrens Primary School were encouraged to promote to the school community notice on 2 x street banners(rotated around the Council area), posts on Facebook (8, 24 and 29 September), and tweets on Twitter (7, 26 September and 1 October).

Copies of the Information Pack and surveys were made available:

at Council’s Office and Campbelltown Library, and on Council’s website.

The Community were invited to provide feedback by:

completing a Feedback Form in hard copy or online, sending a submission by email or letter, sending a comment via Facebook or Twitter, or telephoning Council.

Residents visited and the School were invited to provide feedback verbally during the visit, by completing a Feedback Form, or by email or letter.

Copies of the promotional and consultation material are provided in APPENDIX A: Promotion and Consultation Material. During the visits to residents adjoining the property, a language aide was provided at one to ensure the residents (an elderly Italian couple) understood the information on the proposal, could ask questions and were able to provide verbal feedback. Their feedback is included in this report. 3.3 DATA COLLATION AND ANALYSIS Feedback in the surveys, the email and in person from the visits has been collated to produce this report. Where identifiable, any submission received from those owning property or residing within 300 metres of Allotment 34, Henry Street, Hectorville, have been separately analysed to extract any differences to the combined responses from others. The survey contained an open-ended question asking for any other comments. Any comments are presented verbatim in APPENDIX B: Feedback (verbatim) to this report.

4. PARTICIPANTS This section provides details of the number of people who participated during the engagement period and participant characteristics pertinent to this consultation. 4.1 NUMBER The following displays the level of community participation by the conclusion of the consultation.

After the visit and several follow up reminder emails, a written response was also received from the East Torrens Primary School. 4.2 FEEDBACK FORM - RESPONDENTS Of the respondents who completed a feedback form, there was approximately as equal split male to female (47%, 50%) and most were aged between 35-54 years (44%) or between 65-84 years (32%), as shown in the following tables.

The feedback form not only asked respondents to identify the suburb where they live, it also asked more specifically if the respondent lived within walking distance (approximately 300 metres) from Allotment 34 Henry Street, Hectorville. The majority of respondents (82%) indicated they were from the suburb of Hectorville as shown in the following table.

Of the six residing elsewhere, three were from other suburbs of the Council area, and three were from outside the Council area. One of these indicated they were a ratepayer of property near Allotment 34 Henry Street, Hectorville but did not live there (suggesting the response was prompted from the letter distribution to local ratepayers and residents at the commencement of the consultation), and one indicated support for giving the property to the school (suggesting the response was prompted through promotion of the proposal to parents from the school). A high 76% of respondents also indicated that they lived within walking distance of the property. This high response rate from those living near Allotment 34 Henry Street is directly attributed to the letter distribution to ratepayers and residents around the property at the start of the consultation.

4.3 ADJOINING RESIDENTS AND SCHOOL During the visits, discussions were held with occupants at three of the four adjoining residences and with the Principal and Senior Leadership Team at the East Torrens Primary School. At the fourth residence where there was no discussion, a relative indicated the owner/residents were ‘never available’ as they left early and arrived home late. A second copy (in addition to the one sent by mail) of the Information Pack and Feedback Form was left with the relative to hand on to the owner/residents.

5. COMMUNITY FEEDBACK The community was asked to answer a series of questions aimed at identifying their support or otherwise for the proposal to: revoke the Community Land Classification at Allotment 34 Henry Street, Hectorville to allow

the property to be sold, and, if the sale proceeds, for quarantining the proceeds of the sale for the purpose of purchasing

more appropriately located additional open space in the Hectorville Ward. This section of the report indicated the support or otherwise for these two questions. 5.1 LEVEL OF SUPPORT – REVOCATION OF COMMUNITY LAND CLASSIFICATION

AND SALE OF THE PROPERTY The following pie chart shows there is a very high level of support (31 out of 34 or 91% of respondents) for the revocation of the Community Land Classification and sale of Allotment 34 Henry Street, Hectorville by the respondents who completed a feedback form.

Supporting Comments were provided by only a few respondents however some of these give a bit of an insight as to why the proposal was supported.

Not appealing within the community. Support this 100% Agree with Council, street scape would be greatly improved. The building is an eyesore to the area.

Discussions with three of the four adjoining residents revealed that the occupants at all three supported the revocation of the Community Land Classification and sale of Allotment 34 Henry Street, Hectorville. Verbal feedback at these visits was consistent with the above comments, with these residents stating that the property “does not look nice” and “would be better if it was demolished and the property developed in keeping with the surrounding residential area”. One neighbour also indicated that it would be good if sold as they were worried about the anti-social and inappropriate behaviour around the back of the building.

Only one comment was provided in the feedback forms in relation to this:

It is sad to see the demise of the Pigeon Club. I feel strongly that another piece of land should be provided as a green space for community use, to offset the concrete jungle of urban infill!

The discussions with adjacent residents found all supported Council’s proposal to utilise the proceeds from the sale in the local area and stated that the property was “too small and tucked away” indicating that it would not be considered a safe place to go to play. One resident indicated that children wouldn’t use it as they prefer to go to the school oval or nearby Denis Morrisey Park which are both large for children to “kick a ball around”.

APPENDIX C: COUNCIL REPORT 19 MAY 2015 11.10 Campbelltown Homing Pigeon Club, Henry Street, Hectorville TRIM Reference: B401 Property Officer, Mario Scalzi’s Report Purpose of Report To advise Council of the procedures required to consider the revocation of the Community Land status of the Campbelltown Homing Pigeon Club property with a view to disposing the property. Strategic Plan Link Strategy 2.5.6 Provide timely and relevant financial information to help make informed

decisions. Background The Campbelltown Homing Pigeon Club property has been owned by Council for considerable time, and was noted in 1964 correspondence from Council to the Pigeon Club as being the portion of land in the Montacute Road Reserve which later was named Robson’s Reserve and then finally the portion of land was named the Henry Street Reserve. Up until recently the Campbelltown Homing Pigeon Club have leased the site and building from Council to run its sporting activities. In recent discussions during a site meeting between Staff and the remaining members of the Club, Council was provided with advice that the Campbelltown Homing Pigeon would cease to exist. The Club has since vacated the property which was due mainly to current membership being reduced to three (3) active members. The Campbelltown Homing Pigeon Club was a vibrant and popular sporting locale for nearly thirty (30) years. Unfortunately as membership has dwindled significantly since the mid 1990s, the building has deteriorated to a point where significant funds would need to be allocated to restore the building to its former glory. The small club room building is approximately 6.2 metres wide and 12.4 metres long and is constructed of concrete blocks, comprising a gabled corrugated iron roof, lean-to extension, basic and outdated toilet facilities and a side veranda with a paved base. The building was described by the GHD building conditions audit as being of low standard and generally aged, dirty and in very average condition. On a recent inspection Staff have confirmed the building has deteriorated even further. The property’s legal description is Certificate of Title Volume 3043 Folio 1, Allotment 34, DP 8059 Henry Street, Hectorville and it is noted as having a trust as being held as a reserve and has no Dedication or Reservation noted for the property.

The land is a rectangular shaped holding with the land having a frontage of approximately 17.2 metres, a depth of 36.6 metres and a total site area of approximately 628 square metres. The property lies within an area zoned ‘Residential’ and in these zones developments such as affordable housing, domestic structures and dwellings are envisaged in the Campbelltown Council Development Plan. Within the zone a variety of dwelling options are available including detached dwelling, semi detached dwelling, group dwelling, row dwelling and residential flat building as the property is within 400 metres of a major public transport corridor being Montacute Road, Hectorville. Discussion Since the property has been vacated with removal of furniture and other items associated with the Pigeon Club it has been noted that structural inadequacies exist. The building requires stabilising with underpinning should it be retained and renovated for future use. Currently the condition of the building can be considered as modest at best and remediation works will be required to bring the building up to an acceptable standard. The works would include renewing the toilet and kitchen facilities as well as the need to meet current building and fire safety standards. The property is currently listed in Council’s Community Land Register and is listed in Table 5- Council Operational and Community Facilities in the Community Land Management Plan. Facilities located on land under this category may include libraries, volunteer centres, Community buildings, facilities for emergency services, clubrooms and theatres and is operated by Council or made available to the Community through lease, licence or short term hire arrangement. Members who visited the site during Council’s recent bus tour may have noted the structural concerns and current state of the building. Staff sought advice from Tagara Builders who were asked to provide advice and basic costings to repair the building and/or demolish the building. Advice received and approximate costs associated with repairs are as follows: 1. Underpinning as required $16,000

2. Paving around building and running downpipes from building $ 5,700 3. Repairs to wall cracks all round the building, inside and out. $ 3,600

4. Levelling the floor, in the first instance by removing top row of blocks and re packing $ 8,800

5. Remove existing floor and underpin from inside and tie to new poured floor (using fill or waffle pods to reduce volume of concrete required for new floor) $17,500

Total approximate cost of structural repairs $ 51,600

These approximate costs do not include renewal of the toilet and kitchen services and whilst not quoted can be anticipated to add a further $5,000 to the overall renewal of the building totalling approximately $56,600. Approximate costs associated with a possible demolition of the building has been quoted at approximately $15,000 including removal of the existing olive trees. Council’s consideration of disposing this building or vacant land is considered a viable option for the future of the site. Whilst not obtaining a valuation report at this stage it can be assumed based on sales of vacant land in Pinneri Court that potentially a sale of the land could return in the order of $400,000 to Council. For this to occur however Council must seek to revoke the classification of this property of its Community Land status and follow steps outlined in Section 194 of the Act (Local Government Act 1999). These steps include the following requirements:

(a) prepare a report on the proposal containing-

(i) a summary of the reasons for the proposal; and (ii) a statement of any dedication, reservation or trust to which the land is

subject to; (iii) a statement of whether revocation of the classification is proposed with a

view to sale or disposal of the land and, if so, details of any Government assistance given to acquire the land and a statement of how the council proposes to use the proceeds; and

(iv) an assessment of how implementation of the proposal would affect the area and the local community; and

(v) if the council is not the owner of the land- a statement of any requirements made by the owner of the land as a condition of approving the proposed revocation of the classification; and

(b) the council must follow the relevant steps set out in its public consultation

policy. For Council’s consideration the following report would comply with the above requirements. ‘Revocation of Community Land Classification

Prepared in accordance with Section 194(2) of the Local Government Act 1999. The City of Campbelltown is seeking to revoke the Community Land Classification of the property known as Henry Street, Hectorville Reserve, Allotment 34 Henry Street Hectorville.

Hectorville. 3. Purpose for which Acquired The property was acquired by Council as part of a large reserve for community

use and since 1965 was leased to the Campbelltown Homing Pigeon Club who constructed a small club room building on the site however has now ceased operations.

4. Nature of Dedication or Trust The land was acquired by Council as part of a larger Reserve and is not subject

to a reserve or trust as prescribed by section 194(2) (iii) of the Act and does not preclude Council from seeking to revoke the community land classification.

5. Purpose of Revocation The property is to be sold as Council considers this property as surplus to

requirements and would benefit from public sector investment in continuing the line of existing residential buildings in Henry Street and adjoining streets which would best serve the amenity of the immediate area.

6. Community Impacts The sale of the property would have minimal impact on the area or local

community as the potential and benefit for future residential development would be greater than Council’s available financial commitment to the property and integrate the land into the current streetscape.’

The above report would form part of the public consultation process and would be provided to the Minister for Local Government together with any submissions which may be received in response to the proposal for the Minister’s consideration and approval. Should revocation approval be granted by the Minister then the land is freed of its Community Land status enabling Council to proceed with a potential sale of the site. Social Implications A decision to proceed with the procedures required for the revocation of the Community Land status of the property and the required public consultation process would provide the community with an opportunity to have input into a best case scenario for the property.

Environmental Implications There are no environmental implications in relation to this report. Asset Management Implications There may be asset management implications should Council decide to retain the site. One option would be to renew the existing facility, while another would be to redevelop the site with a different facility (ie playground, building, etc). Should one of these options be selected, there would be ongoing depreciation and maintenance expenses. A decision to sell the site would remove any asset management implications. Governance / Risk Management There are no governance / risk management implications in relation to this report. Community Engagement Should Council consider the sale of the property then prior to any further progress being made Council must proceed with the correct public consultation as per its policy and Community Land revocation requirements which under normal circumstances would require advertising the proposal in the East Torrens Messenger allowing for a 28 day response period notification by signage at the Site and to notify all affected properties surrounding the site. Financial Implications The proposal to dispose of the property through sale would generate significant income for Council. Council may choose to sell the site as is, which may impact on the sale proceeds as the purchaser will need to upgrade or demolish the existing building. Should Council decide to demolish the building prior to sale, this expense would have a negative effect on the operating result, but may generate additional sale proceeds. Should Council decide to keep the site and upgrade the existing building, this could possibly be funded from the Renewal & Replacement Reserve depending on the nature of the replacement. Council would then be in a position to lease the facilities, generating additional income. Recommendation That Council authorise the Chief Executive Officer to proceed with obtaining the required valuation reports and marketing strategies for a potential sale of the property and that Council resolve that the Henry Street, Hectorville property is surplus to Council’s requirements and that the revocation process of the land’s Community Land Status be commenced with appropriate public consultation procedures.
