The exhibition shall continue for fifteen days. Speaking on the occasion, Ganai appreciated the efforts of the Handicraft department for providing genuine products to the buyers without exploita- tion of the middlemen. The Financial Commissioner Industries and Commerce said that state’s handicrafts and han- dlooms are linked to its ancient civilization, heritage and culture and they have enjoyed the privi- lege and patronage of the royal Kings and Mughals in the past. He asked the offices of the department to explore modern marketing channels in interna- tional market to promote sale of Dogri and Kashmiri handicrafts. Earlier, Cultural Wing of Information Department orga- nized a programme to mark the inaugural day of the exhibition. The artists presented Dogri, Punjabi, Sufiana and Kash- miri songs which were highly applauded by the audience. GK NEWS NETWORK Srinagar, Jan 10: Unbundling of Power Development Department (PDD) is a “legal requirement” that will facilitate “revenue generation from consumers”, Development Commissioner, Power, Asgar Ali Majaz, said. He, however, cleared that there is no proposal of priva- tization as of now. “Unbundling is a legal require- ment under J&K Electricity Act, 2010. The generation, transmis- sion and distribution functions in almost all other states in India are being carried out by autonomous organizations,” Majaz said in an official handout. “These utilities have evolved from government departments to electricity boards and then to the corporations. Few states like Delhi and Orissa have privatized. J&K Power Development Department is still at the first step of this evolu- tion, it is still a government depart- ment,” the statement said. “Generation utility in J&K was carved out of JKPDD in 1995 and corporatized. Since then genera- tion is looked after by J&K Sate Power Development Corporation (JKSPDC),” he said. “However, the transmission and distribution are still vertically integrated. Post corporatization of Transmission and Distribution functions, the successor utilities in other states have improved consid- erably. T&D losses have reduced and quality of power has improved. It has also helped in capacity build- ing as corporations specialize in single function against three as in bundled organizations,” he said. He said reforms were badly needed in the PDD. “The existing structure of JKPDD is not suitable for the reforms. The Transmission and Distribution functions of the department are clubbed together due to which distribution does not receive sufficient attention. Further, J&K Power Development lacks functional autonomy due to which (resolution of) important issues get delayed,” he said, adding that as a government department the JKPDD also does not qualify for certain investments. “Post corporatization/unbun- dling of the department, there will be a total of four successor compa- nies: Two distribution companies, one each for Jammu and Kashmir provinces. They will look after dis- tribution system at 66kV voltage level and below and collect revenue from the consumers; One transmis- sion company for the entire state which will look after transmission of power at 220kV and 132kV level. The transmission company shall also look after State Load Dispatch Centre (SLDC) at Gladni, Jammu and Sub SLDC at Bemina Srinagar. Besides, there will be one Holding Company which will buy power for the two distribution companies. It will have equity in two distribu- tion companies. Each company will be headed by a Managing Director,” he said. “All the companies will be state- owned. “The proposal has been prepared with the assistance of consultant M/S PWC and has been approved by the state cabinet. All companies already stand registered. However, the companies will start function- ing once notification to this effect is issued by the government and Managing Directors are appoint- ed,” he said. “This will, however, be the sub- ject to consultation with all stake- holders including employees of the department. As it is the employ- ees of the department who have to make successor companies func- tion successfully.” ICICI Bank opens branch in Sopore Srinagar, Jan 10: ICICI Bank today com- missioned a branch in Sopore. Mr. Nasir, learned counsel for respondent No.7, sought time to file response. 2/ The issues raised in this PIL are of significant importance from the public point of view. This petition has been filed with the benign hope of regulating the working and functioning of the tuition centres. Serious allegations have been made in this PIL about the functioning and working of the tuition centres/coaching centres. It is stated in the petition that neither the Government nor the owners of these tuition centres/coaching centres are complying with the Jammu & Kashmir Regulation Of Private Tuition Centres Rules of 2010 (for short Rules of 2010), notified vide Government Order No. 435-Edu of 2010 dated 30th April, 2010. 3/ Mr. Naik, learned Sr.AAG, in all fairness, stated at the bar that most of the tuition centres/coaching centres are not complying with the Rules of 2010. 4/ Acquiring knowledge through the process of education is one of the important and basic human rights of an individual. Education plays a vital role in taking an individual from the darkness to light. A society, which is educated, can be said to be a most developed society. The persons, who are charged with the duty of imparting education have, in fact, an onerous duty to discharge. The teachers, who impart education, are more respected members of the society. In their hands lies the future of a nation. Unfortunately, in present times, in some cases, this profession of teaching has been converted into a commercial activity. 5/ The State Government, being repository of rights of the people, is duty bound to ensure that quality education is provided to the students and all the facilities, which are required for providing such education, have to be provided by the owners of tuition centres, who, in common parlance, are called coaching centres. 6/ The State, on its part, has accorded sanction for framing of Rules of 2010 but unfortunately these rules have not been implemented at the ground level. It is alleged that even unregistered tuition centres/coaching centres are functioning and no authority is bothered to deal with them when they have authority to take action, in terms of Rules of 2010. 7/ The learned State counsel could not inform the Court as to whether the Competent Authority and Monitoring Committee has been appointed by the Government in terms of Rules of 2010. In this backdrop, we, at this stage, issue the following directions : "a/ A Committee of Officers, comprising of Divisional Commissioner, Kashmir, Director, School Education, Kashmir & Inspector General of Police, Kashmir, is constituted. This Committee will be headed by the Divisional Commissioner, Kashmir and it will function till such time, the Competent Authority and Monitoring Committee, in terms of Rules of 2010, are appointed. It is however, made clear that in case the Competent Authority and Monitoring Committee stands already appointed, even then, the aforestated Committee shall function till further orders from the Court to give effect to the Rules of 2010; b/ The aforestated Committee shall forthwith close down all unregistered tuition centres/coaching centres, wherever functioning in the Kashmir Division; c/ The Committee shall ensure that in the vicinity of these tuition centres/coaching centres, CCTV cameras are installed; d/ The Committee shall also forthwith ensure keeping of police personnel on duty in the areas where the tuition centres/coaching centres are located and are functioning ; e/ The Committee shall immediately direct all the Deputy Commissioners of Kashmir Division to visit all the tuition centres/coaching centres along with Chief Education Officers of the respective Districts and find out as to whether appropriate facilities, in terms of Rules of 2010, are being provided to the students. They shall also be directed to ensure that the tuition centres/coaching centres notify and display monthly tuition fee charged from the students, subject-wise/ class- wise/ course-wise. It shall also be ensured that all the tuition centres/coaching centres notify and display the detailed particulars of its faculty members including their qualification and experience; f/ The Committee shall also ensure that all the registered tuition centres/coaching centres provide free admission up to 10% of its total intake capacity in each class/course for the students, who happen to be destitute, orphans or who belong to the families living below the poverty line. In order to give effect to the aforesaid directions, the Committee shall get a notice published in two Daily News Papers informing this class of students about the benefit to which they are entitled in terms of this order for seeking admission in these tuition centres/coaching centres; g/ The owners of tuition centres/coaching centres shall take all necessary steps in maintaining moral values in and around the tuition centres/coaching centres. It is further provided that any untoward incident which may happen within the premises of the tuition centres/coaching centres or in their close vicinity will make the owners/managers of the tuition centres/coaching centres liable of the legal action, which will be initiated against them, including closing down of the tuition centres/coaching centres ; h/ The tuition centres/coaching centres functioning in the Kashmir Division shall file Undertaking before the Registrar Judicial of this Court, within seven days from today, that they will comply with the mandate contained in Jammu and Kashmir Regulation Of Private Tuition Centres Rules of 2010 and the directions contained in this order; 8/ The Registrar Judicial shall inform the Divisional Commissioner, Kashmir - Head of the aforementioned Committee, about compliance of this order, who shall, thereafter, undertake an exercise as to how many tuition centers/coaching centres have not complied with the directions of this order and shall immediately close down such tuition centers/coaching centres till further orders from the Court. 004 GOVERNMENT OF JAMMU AND KASHMIR DIRECTORATE OF AGRICULTURE, KMR Subject: Select list of candidates for Class-IV posts in Agriculture Department (Divisional Cadre) Kashmir appointment thereof. Jammu, Jan 10: Financial Commissioner, Industries and Commerce, Khurshid Ahmed Ganai inaugurated a State-level Exhibition-Cum-Sale at Dusseh-ra Ground, Gandhi Nagar, here this afternoon. The exhibition shall continue for fifteen days.

Speaking on the occasion, Ganai appreciated the efforts of the Handicraft department for providing genuine products to the buyers without exploita-tion of the middlemen.

The Financial Commissioner Industries and Commerce said that state’s handicrafts and han-dlooms are linked to its ancient civilization, heritage and culture

and they have enjoyed the privi-lege and patronage of the royal Kings and Mughals in the past.

He asked the offices of the department to explore modern marketing channels in interna-tional market to promote sale of Dogri and Kashmiri handicrafts.

Earlier, Cultural Wing of Information Department orga-nized a programme to mark the inaugural day of the exhibition.

The artists presented Dogri, Punjabi, Sufiana and Kash-miri songs which were highly applauded by the audience.

Srinagar, Jan 10: Unbundling of Power Development Department (PDD) is a “legal requirement” that will facilitate “revenue generation from consumers”, Development Commissioner, Power, Asgar Ali Majaz, said. He, however, cleared that there is no proposal of priva-tization as of now.

“Unbundling is a legal require-ment under J&K Electricity Act, 2010. The generation, transmis-sion and distribution functions in almost all other states in India are being carried out by autonomous organizations,” Majaz said in an official handout.

“These utilities have evolved from government departments to electricity boards and then to the corporations. Few states like Delhi and Orissa have privatized. J&K Power Development Department is still at the first step of this evolu-tion, it is still a government depart-ment,” the statement said.

“Generation utility in J&K was carved out of JKPDD in 1995 and corporatized. Since then genera-tion is looked after by J&K Sate Power Development Corporation (JKSPDC),” he said.

“However, the transmission and distribution are still vertically integrated. Post corporatization of Transmission and Distribution functions, the successor utilities in other states have improved consid-erably. T&D losses have reduced and quality of power has improved. It has also helped in capacity build-

ing as corporations specialize in single function against three as in bundled organizations,” he said.

He said reforms were badly needed in the PDD. “The existing structure of JKPDD is not suitable for the reforms. The Transmission and Distribution functions of the department are clubbed together due to which distribution does not receive sufficient attention. Further, J&K Power Development lacks functional autonomy due to which (resolution of) important issues get delayed,” he said, adding that as a government department the JKPDD also does not qualify for certain investments.

“Post corporatization/unbun-dling of the department, there will

be a total of four successor compa-nies: Two distribution companies, one each for Jammu and Kashmir provinces. They will look after dis-tribution system at 66kV voltage level and below and collect revenue from the consumers; One transmis-sion company for the entire state which will look after transmission of power at 220kV and 132kV level. The transmission company shall also look after State Load Dispatch Centre (SLDC) at Gladni, Jammu and Sub SLDC at Bemina Srinagar. Besides, there will be one Holding Company which will buy power for the two distribution companies. It will have equity in two distribu-tion companies. Each company will be headed by a Managing

Director,” he said. “All the companies will be state-

owned. “The proposal has been prepared

with the assistance of consultant M/S PWC and has been approved by the state cabinet. All companies already stand registered. However, the companies will start function-ing once notification to this effect is issued by the government and Managing Directors are appoint-ed,” he said.

“This will, however, be the sub-ject to consultation with all stake-holders including employees of the department. As it is the employ-ees of the department who have to make successor companies func-tion successfully.”

ICICI Bank opens branch in SoporeSrinagar, Jan 10: ICICI Bank today com-missioned a branch in Sopore. District Devel-opment Commissioner Baramulla Farooq Ahmad Bhat inaugu-rated the branch.

1/ Despite opportunities, response has not been � led by respondents 1 to 6. Mr. Nasir, learned counsel for respondent No.7, sought time to � le response.

2/ The issues raised in this PIL are of signi� cant importance from the public point of view. This petition has been � led with the benign hope of regulating the working and functioning of the tuition centres. Serious allegations have been made in this PIL about the functioning and working of the tuition centres/coaching centres. It is stated in the petition that neither the Government nor the owners of these tuition centres/coaching centres are complying with the Jammu & Kashmir Regulation Of Private Tuition Centres Rules of 2010 (for short Rules of 2010), noti� ed vide Government Order No. 435-Edu of 2010 dated 30th April, 2010.

3/ Mr. Naik, learned Sr.AAG, in all fairness, stated at the bar that most of the tuition centres/coaching centres are not complying with the Rules of 2010.

4/ Acquiring knowledge through the process of education is one of the important and basic human rights of an individual. Education plays a vital role in taking an individual from the darkness to light. A society, which is educated, can be said to be a most developed society. The persons, who are charged with the duty of imparting education have, in fact, an onerous duty to discharge. The teachers, who impart education, are more respected members of the society. In their hands lies the future of a nation. Unfortunately, in present times, in some cases, this profession of teaching has been converted into a commercial activity.

5/ The State Government, being repository of rights of the people, is duty bound to ensure that quality education is provided to the students and all the facilities, which are required for providing such education, have to be provided by the owners of tuition centres, who, in common parlance, are called coaching centres.

6/ The State, on its part, has accorded sanction for framing of Rules of 2010 but unfortunately these rules have not been implemented at the ground level. It is alleged that even unregistered tuition centres/coaching centres are functioning and no authority is bothered to deal with them when they have authority to take action, in terms of Rules of 2010.

7/ The learned State counsel could not inform the Court as to whether the Competent Authority and Monitoring Committee has been appointed by the Government in terms of Rules of 2010. In this backdrop, we, at this stage, issue the following directions :"a/ A Committee of O� cers, comprising of Divisional Commissioner, Kashmir, Director, School

Education, Kashmir & Inspector General of Police, Kashmir, is constituted. This Committee will be headed by the Divisional Commissioner, Kashmir and it will function till such time, the Competent Authority and Monitoring Committee, in terms of Rules of 2010, are appointed. It is however, made clear that in case the Competent Authority and Monitoring Committee stands already appointed, even then, the aforestated Committee shall function till further orders from the Court to give e� ect to the Rules of 2010;

b/ The aforestated Committee shall forthwith close down all unregistered tuition centres/coaching centres, wherever functioning in the Kashmir Division;

c/ The Committee shall ensure that in the vicinity of these tuition centres/coaching centres, CCTV cameras are installed;

d/ The Committee shall also forthwith ensure keeping of police personnel on duty in the areas where the tuition centres/coaching centres are located and are functioning ;

e/ The Committee shall immediately direct all the Deputy Commissioners of Kashmir Division to visit all the tuition centres/coaching centres along with Chief Education O� cers of the respective Districts and � nd out as to whether appropriate facilities, in terms of Rules of 2010, are being provided to the students. They shall also be directed to ensure that the tuition centres/coaching centres notify and display monthly tuition fee charged from the students, subject-wise/ class-wise/ course-wise. It shall also be ensured that all the tuition centres/coaching centres notify and display the detailed particulars of its faculty members including their quali� cation and experience;

f/ The Committee shall also ensure that all the registered tuition centres/coaching centres provide free admission up to 10% of its total intake capacity in each class/course for the students, who happen to be destitute, orphans or who belong to the families living below the poverty line. In order to give e� ect to the aforesaid directions, the Committee shall get a notice published in two Daily News Papers informing this class of students about the bene� t to which they are entitled in terms of this order for seeking admission in these tuition centres/coaching centres;

g/ The owners of tuition centres/coaching centres shall take all necessary steps in maintaining moral values in and around the tuition centres/coaching centres. It is further provided that any untoward incident which may happen within the premises of the tuition centres/coaching centres or in their close vicinity will make the owners/managers of the tuition centres/coaching centres liable of the legal action, which will be initiated against them, including closing down of the tuition centres/coaching centres ;

h/ The tuition centres/coaching centres functioning in the Kashmir Division shall � le Undertaking before the Registrar Judicial of this Court, within seven days from today, that they will comply with the mandate contained in Jammu and Kashmir Regulation Of Private Tuition Centres Rules of 2010 and the directions contained in this order;

8/ The Registrar Judicial shall inform the Divisional Commissioner, Kashmir - Head of the aforementioned Committee, about compliance of this order, who shall, thereafter, undertake an exercise as to how many tuition centers/coaching centres have not complied with the directions of this order and shall immediately close down such tuition centers/coaching centres till further orders from the Court.
