Dear Creditor,Re: Account Number__________

I appreciate the fact that your company is willing to negotiate with me for settlement of my debt. This letter is to make a counter offer in response to the amount your customer service representative wants me to pay for payment of debt in full. The amount that I wish to offer you for payment of my debt is $__________.

While I settle the debt, I'd request you to help me remove any negative listing (late payment, charge-off etc) on this account from my credit file. In fact, I'd be willing to offer you more money if you can report my account status as "Paid in full" to the credit bureaus.

If you find these terms agreeable, please sign the attached letter of agreement and return a copy to me. Upon receipt of this signed acknowledged agreement, I will send you a money order in the amount as stated above.

Dear Creditor,Re: Account Number__________

In response to my recent conversation with your customer service representative, I'd like to present a complete assessment of my financial situation.

Unfortunately, I have a lot of debt and not enough funds to pay all my creditors. So, I'll be able to negotiate and settle debt with a few creditors only. I have enclosed a copy of my financial statement with details of my monthly income and expenses. This will help you assess my financial situation and give you an idea as to why I have requested a debt settlement.

The final debt amount that we agreed upon is $_________. As part of the settlement agreement, I request you to co-ordinate with the credit bureaus in order to remove negative entry (late payment, collections etc) on my account from the credit report.

Given my situation, I hope you'll refrain from taking further action against me as payment will be maintained as decided in the agreement. I shall review my financial situation on a regular basis and inform you about any change, positive or negative.

I hope you'll understand my situation and co-operate with me in this hour of financial crisis. I look forward to receiving a written confirmation from your end regarding the debt settlement agreement.

Dear Creditor/Collection Manager,Re: Account Number__________

This letter is in response to your call/letter/credit report entry on [date] for the debt account listed above. I would like to pay off or settle this debt in full and save our time and efforts.

I'd like to notify that I'm not acknowledging or accepting that I owe this debt. This is because the debt hasn't been verified yet. This letter also doesn't imply a promise to pay the debt unless you provide a response as detailed below.

I am aware of the fact that your company can report the debt to the credit bureaus as you find necessary. Moreover, you have the ability to change the account status since you are the information provider.

I am willing to offer $__________ as payment or settlement of the debt in full in return of your agreement to remove all information on this account from my credit report within 10 calendar days. If you agree to the terms, I shall send you a certified payment of the amount stated above in exchange to have all information on this debt account deleted from my credit report.

I hope you'll also agree to not discuss this offer with any third party (except the original creditor). If you find my offer acceptable, please send me a letter agreeing to the terms. It will be convenient for me if the letter is signed by your authorized agent. The letter should be subject to the laws of my state and treated as a contract.

Sample Debt Validation Letter

Dear Collection Manager,Re: Account Number__________

This is to inform you that I've recently pulled my credit report and noticed that there's a collection from your agency on my credit report. I have never been notified of this collection. However, this letter does not imply that I refuse to pay this debt. Rather, I would like to dispute your claim.

As per the FDCPA, I have the right to request a validation of this debt. I request you to prove that I am indeed the party who is by contract obligated to pay off this debt.

I hope you are aware of the fact that reporting any invalidated information to major credit bureaus may constitute defamation of character, as negative listing on credit report does not allow me to enjoy the benefits of good credit. In addition, you must also be aware that until you validate this debt, you can neither continue collection activities nor report this information on my credit report. I'm sure your legal staff will agree that non-compliance with this request is likely to put your company in serious legal trouble with the Federal Trade Commission (FTC) and other state/federal agencies.

Please attach copies of the following documents:

Agreement with your client that authorizes you to collect on this alleged debt.

Agreement that bears signature of the alleged debtor wherein he promises to pay the creditor.

Complete payment history on this account so as to prove that the debt amount you wish to collect is correct.

Debt Validation Follow-up Letter to collection agency

Your NameYour AddressYour Phone #

Collector's NameCollector's Address

Dear Collection Manager,Re: Account Number__________

I have sent you a written request to validate my debt having account no.__________ on [date].

According to the Fair Debt Collection Practices Act (FDCPA), I have the right to claim a validation of this debt and you are obliged to provide me with relevant documentation should you carry on your collection activities. Unfortunately, I have received no reply from you except the confirmation (by mail) that you did receive my request for validation of debt on [date]. However, the credit bureaus have already sent in their "verified" documents.

As per an opinion letter published by the FTC, reporting this collection is considered as collection activity. I hereby notify that you are now in violation of the FDCPA and subject to a fine of $1,000 (refer to the Act for the updated value), which I can collect by filing a claim in the small claims court. I intend to follow through with the claim if I don't hear back from you within the next 15 calendar days.

This letter is to remind you that reporting such invalidated information to the credit bureaus can result in defamation of character, as any negative marking on my credit report would adversely affect my credit. I hope your legal staff will agree that non-compliance with this request could lead your company to serious legal trouble with the FTC and other state/federal agencies.

Debt Validation Follow-up Letter to credit bureau

Credit Bureau NameCredit Bureau Address

Dear Sir/Madam,Re: Account Number__________

This letter is to dispute the debt account referred to above. There is a serious misunderstanding with the collection agency. While you are able to validate my debt, the collection agency has not been able to verify that I owe this debt. This is really strange! The debt is not mine.

I am enclosing copies of my requests to the collection agency wherein I have requested them to validate my debt. I'm also attaching receipts showing that I have sent these letter certified signature request. This debt is not mine and I have received no evidence of my obligation to pay this debt to the collection agency.

As per the FCRA, you need to verify the validity of this item within 30 days. If you cannot verify the validity, you are obligated by the law to remove this item before I am forced to take any sort of legal action.

In case you cannot verify the item as per the FCRA, and you continue to list the disputed item on my credit report, I may find it necessary to sue you for actual damages and declaratory relief under the FCRA. According to this regulation, I may sue you in a qualified state or federal court including small claims court in my area.

While I would prefer to not litigate, I may use the courts as required to enforce my rights under the FCRA.

Looking forward to an uneventful resolution in this matter.

Dear Creditor,Re: Account Number__________

This letter is to dispute the account referred above. I have already disputed this account information as inaccurate with the credit bureaus [insert names of credit bureaus]. But I find that you have been able to verify this debt. However, I would like to say that I was not late on this account and I have been only an authorized user.

In case you cannot verify this item pursuant to the FCRA and it continues to show up on my credit report, I shall find it necessary to sue you for actual defamation damages and declaratory relief under the FCRA. As per this regulation, I may sue you in any qualified state or federal court, including small claims court in my area.

As per court rules and regulation, a creditor has the responsibility to investigate and make sure that correct information is being reported to the bureaus. At the same time, the consumer has the right to sue under the FCRA, should his/her rights are violated.

I am writing this letter in order to request your help and understanding. Back in [year when the negative item was listed], I lost my job and made a couple of late payments, even though I hated paying late. I do feel bad about it even now. However, I did get current on the account (listed above) as soon as my financial standing improved. I have in fact made timely payments since then. I've been working hard to make financially responsible decisions and get better control of my money.

Letter to dispute account status

Dear Sir/Madam,

Re: List of creditors and Account numbers of each

I am writing to dispute inaccurate account status on my credit report. The above referred accounts are listed as "bankruptcy" whereas they should have been shown in the credit report as "charge-off", "past due" and "delinquent" respectively. Such incorrect listing have lowered my credit score and prevented me from buying a home of my own.

I have attached a copy of my bankruptcy discharge order as proof. Please take a note of the dates and update the account status at the earliest.

Yours sincerely,

Follow-up Letter after initial contact with credit bureaus

Dear Sir/Madam,

This letter is a formal notice that you have failed to respond to my dispute letter dated __________. I have sent the initial letter via registered mail and enclosed a copy of the return receipt that you've signed on __________.

As per Federal Law, you are expected to respond within 30 days. However, it's been over 30 days you have received my dispute letter. You must be aware that failure to comply with this is an act of violation of the Fair Credit Reporting Act and thus, it may be investigated by the FTC.

I am also aware that you may have misplaced my letters or have failed to respond to my letter because of an oversight as you already receive high volume of dispute letters on a daily basis. However, I'm sure you would like to handle this issue asap and help me out. I have attached a copy of my original request and proof of the inaccurate item placed on my credit report. Please verify the information and send me your response at the earliest.

Dear Sir/Madam,

I have sent you a letter requesting you to remove inaccurate information from my credit report. But I find that the disputed item still remains. So, I am sending you this formal notice asking you to describe the procedure adopted to verify this claim. I would also like to know about the business names, addresses and phone numbers of those who have been contacted for the process. This is my right according to the Fair Credit Reporting Act.

It is really disappointing to find a credit bureau not following the procedures and not maintaining the accuracy norms. I would request you to comply with the laws and furnish me the information I've asked for within a period of 15 days.

Through this letter, I am resubmitting my request to make the reinvestigation and verification processes faster.

(State the reasons for disputing this negative mark).

Yours sincerely,
