Make social media your friendSocial media is our best friend and worst enemy. It
is where we want people to say nice things about us and where we receive the first threat when someone is upset at us. It is hard not to feel helpless when someone writes a negative review. You can respond but you can’t change or remove the comments. Google, Yelp, Houzz and Facebook are the main places online where people go to read and post reviews. How we manage these can gain or lose a job/client for you.
First thing we need to know is when a review is posted. I suggest working with an SEO company who can help your page ranking but also help you manage your reviews. FSPA members can use 5 Star Impressions for free. These companies can immediately identify a review which allows you to address a negative one right away. They also can help drive your happy customers to post positive reviews which can bury the negative ones. It is worth the money in today’s online society to invest in a company

Let’s face it, we all know that most happy customers don’t post online while the small percentage of your customers who may not be happy will post. Our goal should be to get ahead of a possible negative review before someone feels the need to post something. We have started sending surveys out to customers to give them a vehicle other than social media to list their comments and allow us to address areas where we may have fallen short. This allows us to contact a customer should they be less than satisfied. As an owner, we don’t always know when or why someone felt their expectations weren’t met. In today’s world we need to get this feedback before it shows up online.

There are always special people within an organization that year after year go above and beyond the call of duty and are an exemplary role model for others in the industry.
This year’s inductee into the FSPA Hall of Fame is Kenneth Parker. He began in the pool business 1973, moving from a desk job in Atlanta to Tequesta to pursue his dreams of building pools. As soon as he joined NSPI-Florida he became active in the Treasure Coast chapter with safety awareness and other committees and
served as chapter president multiple times over the years. He has served on the state board for 26 years in varying roles such as builder council chairman in 1994 and 1995, on the bylaws taskforce, existing pool taskforce and the subcontractor licensing workgroup. He is a volunteer whom the association can always count on to be monitoring a class at the show and has probably timed more swimmers at the FSPA meet than any other member.

FSPA Hall of Fame Inductee
Each year, the FSPA Chapter presidents selected a “Person of the Year” for the Florida Swimming Pool Association. It is based on the individual effort and effectiveness of the individual in providing the FSPA with leadership, commitment and service.
David Pruette is recognized as the 2016 Person of the Year. David is an electrical contractor who has assisted the association in navigating recent challenges made to the swimming pool contractor scope of work. His comprehensive understanding of pools and
the electrical components has been an invaluable resource to FSPA Government Relations Consultant Jennifer Hatfield and the workgroup FSPA established to address this issue and draft language for the Construction Industry Licensing Board to consider which would allow pool contractors to continue work they are tested on and trained to complete. His knowledge and expertise has provided field-based information without which we would not have made the great progress on this critical issue.
David Pruette has been in the pool industry since 1994, working exclusively on swimming pool electrical since 1999. He is president / owner of David Pruette’s Electric Services in Orange Park, Florida. David is a certified electrical contractor and has been active in the Northeast Florida Chapter for many years. He has served on the Executive Committee as an at-large director, treasurer, and is currently secretary.

A great start to 2017The Everything Under the Sunsm Expo last month, in
early data review, seems to have had the most attendees than we’ve seen in several years. The aisles were full and exhibitors are happy with the Show.
The annual event is the cornerstone of the Florida Swimming Pool Association’s programs which serve the pool and spa industry in Florida. A full 100% of the proceeds of this annual event are reinvested in the Florida market. You see results in our advocacy programs in Tallahassee as well as the FBC and CILB; a quality continuing education course program; up to the minute news and information through social media and newsletters; and numerous member benefits helping your business succeed in Florida.
The annual event also allows us to recognize members of our association. In this issue of Florida Pool Prosm you will find information about these winners. Take a minute to congratulate your peers on these awards and consider how

Don’t just stand there, volunteer
Have you volunteered lately? Were you one of the monitors or ID checkers at the pool show this year? If you were, chances are you probably were last year and the year before that. I haven’t found any research online but I’ve been doing a little bit of studying on my own, in my own little bubble of life. What I have noticed is the same small group of people volunteering over and over
again. It seems like a very small group of people make up the majority of the volunteers.
We have a fairly big church that we attend with a pretty big children’s ministry. Every Sunday they need adult volunteers to help each grade level. Every Sunday, they are struggling to fill those spots. With the number of kids attending, it doesn’t seem like it would be that hard to find a few adults each Sunday, but it is. Every Sunday I tend to see the same people helping out;

the same core group of adults is volunteering.Our kids are involved in sports. The teams rely on volunteers to coach and
to referee. We sometimes struggle to get coaches for all of the teams and refs for all of the games. The coaches and refs I see in my league are mostly the same coaches and refs I saw last year and the year before that. The same core group of adults is volunteering.
Our company is a member of the FSPA. The FSPA relies on companies like ours to get involved. Each local chapter needs volunteers. Sometimes it is a struggle to get someone to volunteer for a position or to even be on the board. It seems like the same core group of adults is volunteering.
Volunteering takes time but that time can be so rewarding. What if instead of a small group of people volunteering 100% of the time, 100% of the people volunteered a small amount of time? Just that little bit of change would amount to so much!
Do you have kids who are involved in something? Volunteer to help! Do you have a passion for animals? Call your local humane society. I’ll bet they would love any and all help they could get. When you are signing up for your classes for the pool show next year, sign up to be the ID checker or the monitor for one or more of those classes. Are you on your local FSPA board? When it comes time for nominations, throw your name in the bucket. You don’t have to be the president or the treasurer, just volunteer to be on the board. Just volunteer!

2017 Legislative Bill Tracking Report
Bills continue to be filed as the legislature gets closer to the March 7 session start date with a few new bills of interest to the FSPA being added to this week’s report. In addition, this week saw the release of the Associated Industries of Florida’s (AIF) proposal to address the workers’ compensation rates that have skyrocketed since the Florida Supreme Court rulings. AIF’s task force members included
the National Federation of Independent Business and many construction trade groups, of which FSPA was a part of. The proposed bill would eliminate the limits on attorney fees, requiring injured workers to be responsible for paying their attorney fees and not allowing judges to award attorney fees that would have to be paid by employers or insurance carriers. Priority BillsFlorida Building CommissionSB 7000 by Community AffairsSummary: Requiring the commission to use the 6th edition, and subsequent editions, of the Florida Building Code as the foundation for the development of and updates to the code; requiring the commission to review, rather than update, the Florida Building Code every three years; deleting a provision that specifies how long amendments or modifications to the foundation remain effective, etc.Comments: This bill revises how the Florida Code is updated.Effective date: July 1, 2017Status: Referred to Appropriations Subcommittee on General Government and Appropriations on February 9.**FSPA expects to see a second Building Code bill that will address specific code and licensure issues, following the normal building code bill seen each year. Another priority bill(s) FSPA expects to see will be related to workers’ compensation.

Legislative Days March 22-23Legislative Days for 2017 is quickly approaching. This is an
excellent opportunity for you to get involved in something that really matters! FSPA is holding its annual Legislative Days event March 22-23. Legislative days is where members come to Tallahassee to voice industry concerns to legislators and the agencies that regulate us, and to continue to cultivate relationships with those in government. FSPA Government Relations Consultant Jennifer Hatfield has set up meetings for FSPA members with both the Department of Health and the Department of Business & Professional Regulation. Jen has also arranged for members to meet with their elected State House and Senate members from their chapter area.

Construcation LiensHB 685 by Representative Leek/ SB 734 by Senator PowellSummary: Revises requirements relating to the recording of a notice of termination of an improvement to real property.Comments: This proposal allows for the termination of a notice of commencement in cases where construction is ongoing without the requirement that all construction cease before recommencement and eventual completion of the project as current law requires. Per the proponents, under this amendment the owner remains obligated to pay in full or pro rata all contractors and lienors who have given notice to the owner for all work done to the date of the notice of termination and nothing changes the right of lienors to file liens for unpaid work for a period of up to 30 days after the notice of commencement is terminated.Effective date: July 1, 2017Status: HB 685 – Filed on February 7. Actions Founded on Real Property ImprovementsHB 377 by Rep. Leek / SB 204 by Senator PassidomoSummary: Specifying when a contract has been completed between a professional engineer, registered architect, or licensed contractor and his or her employer, etc.Comments: This section of law deals with statute of repose and how long someone has to commence action against the contractor, engineer, etc. The language being added clarifies when a contract has been completed when determining when the 10-year limitation begins.Effective date: July 1, 2017Status: HB 377 – filed on January 23. SB 204 – Referred to Judiciary; Regulated Industries; Rules on January 12.
Renewable Energy Source DevicesSB 90 by Senator BrandesSummary: Revising the definition of the term “renewable energy source device”; prohibiting the consideration of just value of property attributable to a renewable energy source device in determining the assessed value of any real property; exempting a renewable energy source device from the tangible personal property tax, etc.Comments: This is the Amendment 4 (passed on the ballot under the August Primary) implementation bill. Employment Practices Liability Insurance (EPLI) covers companies against lawsuits or claims filed by employees, former employees and employment candidates. The insurance coverage protects the company, its directors, officers and other employees. A company can use this type of insurance to cover expenses associated with employee rights violations, such as alleged acts of discrimination and wrongful termination. Both general liability and workers’ compensation
insurance policies specifically exclude these claims.Before we get into the coverage details let’s consider why we recommend it:• Over $2 million of insurance premiums were paid for EPLI in 2016• US employers have an 11.7% chance of having an employment charge filed
against them• 75% of litigation against corporations involve employment disputes• 40% of those involve smaller employers (15-100 employees)• The average cost of an out-of-court settlement is $40,000• The median compensatory award for a case that goes to trial is $218,000• 67% of litigated cases result in judgement for the plaintiff• The average defense cost (through trial) is $45,000
Types of Lawsuits and Claims EPLI InsuresEPLI insures against claims of discrimination (based on age, sex, race, religion,
color and national origin), sexual harassment claims, wrongful termination, infliction of emotional distress or stress and breach of contract, among others. The insurance covers claims and lawsuits filed against directors and officers regarding allegations of misconduct in how they treat employees, shareholders and decisions that affected the company. The instances of these claims are rising and rising quickly.
Benefits an EPLI Policy ProvideIf a business receives a lawsuit or claim, the insurance company will both defend
and indemnify the policy holder. The defense and legal expenses will be covered regardless of the outcome of the case. The policy will also cover the indemnification (cost of any settlements or judgments entered against the company). EPLI policies do not usually cover criminal fines, civil fines, penalties or punitive damages. EPLI

also excludes coverage for claims that are covered by other insurance policies, such as property damage or bodily injury claims.
Further, the insurance company often includes free consulting for employment-related questions.
Factors That Affect the Cost of EPLI CoverageSome factors that affect the cost of EPLI include the size of the company, the
type of business it is, the number of employees, where the business is located, the number of claims and lawsuits previously filed and the length of time the company has been in business. Insurance companies may also take other factors into consideration when deciding the cost of the premium and structuring a policy best suited for the company.
How a Company Can Reduce Exposure to LawsuitsDocumentation, documentation, documentation. To reduce the likelihood of
being sued for an employee rights violation, the company should review and update its employee manual to make sure it is in full compliance with the most recent federal and state laws. The company should educate employees on actions and conduct that is considered illegal in the workplace. Employees should be informed of company procedures for handling complaints of employee rights violations. The company should keep a record of any complaints filed by employees and document how those complaints were handled.
How to Decide if the Company Should Obtain EPLI CoverageFrankly, every business should consider this insurance. The policy will not
respond to any existing issues or claims but it can be structured to provide coverage for alleged acts committed in the past. An insurance company can tailor a policy that would be most beneficial for a business and its needs.
Be careful, however, because there may be coverage and policies available at what seems like an affordable premium. However, often you get what you pay for and these “cheap” policies have significant restrictions and exclusions. Always make sure the coverage is purchased from a carrier which specializes in this insurance.
Dealing with employment lawsuits can be extremely costly for a company that does not have the proper insurance coverage. You should consider adding this coverage to your insurance program. The application is short and turn around time is almost immediate.

45th anniversary show was dy-no-miteThe celebration of the 45th Everything
Under the Sunsm Expo drew a crowd to Orlando February 17-18 for another great industry trade show. More than 230 exhibitors, and preliminary numbers show, more than 4,000 people mingled for two days in the exhibit hall. The aisles were full of people, information, new products and friendly faces.
The Nights in White Satin Welcome and Awards Reception on Thursday evening drew a crowd dressed in white. Design Awards were presented to winning pool companies as industry professionals applauded their work. David Pruette was recognized as Person of the Year and Ken Parker was inducted into the FSPA Hall of Fame. Chapter Directors of the Year were thanked and Chapter Service Professional of the Year recognitions were presented. Indigo Swimming Pools & Spas of Venice took home the Tops-In-Trucks Award.
Friday, after a busy day in education and the exhibit hall, everyone made their way to the Gettin’ Groovy Friday Night Party at Howl at the Moon. Live music, open bar, dinner buffet and desserts made for an exciting evening. Thank you to Pentair and Gorman for sponsoring the event.
Education courses on Thursday, Friday and Saturday were popular. Numbers are still being finalized but more than 900 pool industry professionals registered for classes. FSPA members were able to take classes for free. More than 630 FSPA members took education at no charge.
The FSPA membership booth received quite a few new member applications and fielded questions about membership, licensing and how to win the cash drawings. Among other cash winners, one attendee took home $600 in cash! The Splash Zone gave away hundreds of prizes.
The Product Showcase display showed some great products and the ballots showed Jack’s Magic Products’ Super Pacs were chosen as the Best Showcased Product.

Design Award winners announcedThe 2017 Design Awards winners were honored February 16 at the Orange County Convention
Center in Orlando. During the Welcome and Awards Recption for the Everything Under the Sunsm Expo, winners received their plaques and applause as their entries were viewed. These awards are a way to celebrate and recognize the great work done in the swimming pool industry in Florida.
These are not just good looking pools, they are properly built as well. Entries include a summary of goals and accomplishments, a plumbing diagram and a photo of the pool. All company and client information is removed from materials prior to judging and entries are identified only by number. Industry professionals serve as judges and assess the quality of workmanship and design. Challenges, technical achievements, design and aesthetic value are all taken into consideration.

It began with the FSPA state Board meeting on January 20-21 in Orlando, and next was the sweetest holiday of the year, Valentine’s Day, and then everyone enjoyed the Everything Under the Sunsm Expo February 17-18. The annual Palm Beach Pool Show will be held August 23 at the Palm Beach Marriott. Chairing the event this year are Jim Stevens, Crystal Blue Pools, and Robbie Frederick, Red Rhino Leak Detection. Those who desire to attend local education classes will be able to attend an expanded program for 2017. More classes, more instructors and more education will be offered. Instructors are encouraged to contact the Chapter office to participate. Classes will be held prior to the show floor opening at 6:30 p.m. Continuing education classes are free for members. Employees of member companies may attend these classes even if they are not license holders. Non-members may attend for free if a membership application is submitted at or prior to the show.
