The Rules speclfies various provilions like Right of Leave, Earning of Leave, Commencement andTermination of Leave. absence f.om dutv, admissible leave and admissibility of leave, etc.Along with this,employee canavail different types of leave during hk/her service. Earned Leave The leave account of an empioyee (non-vacation department) shall be credited with30 days earned leave in calendar year. Thisshallbe done in advance in two installmentsof 15 days each on the 1't ofJanuary and 1'tofluly, every year:

The earned leave so carried forward plusthe creditfor that half-year shallnot exceed300 days.

Maximum earned leave that can be grantedto an employ€e at a time shall be 180 daysThe employees, workinS in vdcationdepartment, shall not be entitled to anyearned leave in respect of duty performedin any year in which he avails himself theful l vacation. 8ui i f in any year thegovernment employee does not avail anyvacation, earned Ieave shall be adm:s5ibleto him in respect of that year as per Rule-46

2 Half Pay Leave The half pay leave account shall be creditecwitF hatt piy leav. in advance in twoinstallments of ten days each on the 13tJanuary and f i Ju'y ofevery calendar year-

3 58 Commuted Leave Commuted leave not exceeding half theamount of half pay leave due may begranted on medical certificate to anemployee subject to the condition tl-attwice the amounl of such leave shall bedebitable to the half pay leave due.

4 59 Leave not due lf the competent authority, to g.ant leaveis satisf ied thar thera is reasonable prospectof the Government employee of returningto duty on expiry of the leave, Leave notdue may be granied to a Governmentemployee in permanent employmentsubiect to the conditions in the Rule- 59.

60 €xtra OrdinaryLeave

Extraordinary Leave not exceeding thirty sixmonths in agg-egate during the entireservice may be granted to a Governmente-nployee in special circumstances a5prescribed in Rule60

69 'Maternity Leave A competent authority may, subject to theprovisions of this rule, grant to a femaleGovernm€nt employee in. permanentefiploy, who goes not have two or moreliving children at the time the maternityleave asked for, is actually sa nctioned: leavefor a period of one hundred and eightydays from the date of its commencement.Such leave 5hall not be debited to the Ieaveaccount.

During such period, she shall be paid leavesalary equal to the pay drawn immediatelybefore proceeding on leave.

6e{A) Ctild Adoption A competent Authority may, subject to thep.'visians of th's rulF, grant to a femaleGovernnent cmployee, with fewer thantwo surviving cl ' i ldren, on val 'd adoption ofa child below the age of one year, ChildAdoption Leave for a period of one hundredand eighty davs immediately after the dateof valid adoption on the lines of maternityleave admissible to natural mother.

Child Adoption leave shall not be debitedagainst the leave account.

8 70 Paternity leave A Male Government employee (including anapprehtice) with less than two survivingchildren may be granted paternity leave fo-a period of 15 days during confinement ofhis wife. During the period of such leave, heshall bb paid leave salary equal to the paydrawn immediately before proceeding onleave. Paternity leave shall not be debitedagainsl the ieave account and may becombined wirh any other hind of leave {asin the case of maternity leavel. t t may notnormally be refused under anyclrcumstances.

7! Leave in case ofmrscarflage or

abort ion

Leave in case of miscarriage includingabortion is admissible subject to thecondition that such leave shall not be morethan forty five days during the entireservice and such leave shall be supportedby a medicake.tificate.Such leave shall not be debited to the leaveaccount.

Dlring stridy leave, a Governmentemployee shall draw leave s?lary equal tothe amount admissible during half pa,leave.

3. As the employees of Government of Gujarat are governed by lie relevant GCS(Leeve) Rules. 2002, the above mentioned details may be considered as to createawareness amongst the ernployees of the Government of Gujarat and as readyreference in nature. When an employee applies for any leave, such requesq/casewould be considered as per the provisions, laid down in the GCS {Learul nrfu., ZOOiiresolutions / circulars.
