EXPLANATION With Rhode Island politicians approaching the 2016 election with claims of support for thorough investigation of the 38 Studios scandal and public release of related documents and with the continued unlikelihood that any elected officials will force those actions to be taken, the RI Center for Freedom & Prosperity wanted to provide Rhode Islanders with an objective look at how legislators actually voted. The scorecard above grades representatives and senators on their relevant votes when the opportunity arose.

Methodology

1) Determine weighting: Each selected bill received a weight ranging from +3 to -3 based on whether they advanced the smooth cover-up of the scandal or sought to protect taxpayers or force investigation.

2) Determine vote: Each legislator received a +1 or -1 vote factor, depending on whether he or she voted FOR or AGAINST a particular bill or amendment. Legislators who were in office at the time but didn’t vote “yea” or “nay” on a bill for any reason received 75% credit for the final result.

3) Calculate weighted vote: Multiplying the weighting factor and the vote factor produced a weighted vote score for each legislator for each bill.

4) Calculate the legislator score: The cumulative score for all bills for each legislator determined that legislator’s overall score.

5) Calculate Freedom Index: Dividing each legislator’s total score by the maximum possible for that legislator provided his or her 38 Studios

Freedom Index, or a percentage of the best possible score he or she could have achieved.

6) Assign grades: Because the resulting scale runs from -100 to 100, grades are assigned according to the score ranges in the following table. Four senators had relevant votes on only the two most recent budgets, with no 38 Studios–specific amendments and therefore have not been graded; three representatives and one senator were absent for the vote approving the loan guarantee program and had no additional votes. These eight legislators are marked as “N/A” on the scorecard.
