PART I - INTRODUCTION

1. In 2009, the Government of the Republic of Uzbekistan (the Government) signed a

Financing Framework Agreement (FFA) with the Asian Development Bank (ADB) for a

Multitranche Financing Facility (MFF) to finance the Water Supply and Sanitation Services

Investment Program (WSSSIP). On 29 September 2009, the ADB Board of Directors approved

the MFF Program with the Uzbekistan Agency “Uzkommunhizmat” (UCSA) as the Executing

Agency (EA).

2. MFF consists of four tranches which are covering whole territory of Republic of

Uzbekistan. Tranche 1 “Modernization of Damkhodja interregional trunk mains with connection

of district centers of Navoi and Bukhara provinces. Reconstruction of wastewater systems of

Termez city” (Loan 2564-UZB) was approved for $60 million on 8 October 2009, became

effective on 21 April 2010 with initial loan closing date of 30 June 2015. Due to delay of project

implementation, the loan was extended and its current closing date is 30 June 2017.

3. Tranche 1 had two core components: (i) water supply and sanitation infrastructure

improvement, which includes rehabilitation, improvement and expansion of water supply and

sanitation/sewerage systems, and a sanitation and hygiene program; and (ii) capacity

development and program management, which includes project management and

implementation support, assistance on regulatory reforms in institutional and financial

development/ management of water service providers.

4. 8 construction contracts under Tranche 1 were awarded for implementing civil works: 1

for Termez city, 3 for Bukhara province (including Samarkand province – Damkhodja water

intake), 4 for Navoi province:

networks of Galaasiya city

• 2564/ICB/3.6. Reconstruction of WDS and water supply networks of Romitan city

• 2564/ICB/3-7. Reconstruction of WDS and water supply networks of Karmana city

• 2564/ICB/3-3. Reconstruction of WDS and water supply networks of Kiziltepa and

Beshrabot cities

• 2564/ICB/3-11. Reconstruction of WDS and water supply networks of Konimekh city

5. As of the date of the report preparation, all civil contracts were awarded and completed.

The State Accepting Committee’s Acts were issued, but the contracts 2564/ICB/3.3 and

2564/ICB/3-4 nowadays are in Liability period.

6. In according with FFA all contracts need to be implemented in compliance with

environmental requirements, described in Initial Environmental Examinations conducted for

each sub-project. Each IEE includes Environmental Management Plan.

7. NBT (the Consultant) was contracted by ADB to assist to UCSA in preparing

Environmental Monitoring Report (EMR) for period July – December 2015 with further

conducting hands-on training on proper implementation of ADB Environmental Safeguards for

UCSA staff and contractors.

1. GENERAL INFORMATION

1.1 Objectives, Scope and Methodology

8. The main objective of this report is to provide information about progress on

implementation of Site-Specific Environmental Management Plans (SSEMPs) including

environmental monitoring, to report any environmental concerns occurred during projects

implementation, to suggest correction actions and analyses of status of recommended earlier

ones within previous EMRs and aide memoire of ADB missions during reporting period.

9. The report is also prepared to review compliance with environmental safeguards of the

Government of Uzbekistan and ADB Safeguards Policy Statement (SPS), (2009) as well as to

fulfill the Loan covenant as described in Loan Agreement UZB 2564 between ADB and

Uzbekistan.

10. To achieve the objective the following activities were undertaken: (i) revision of the

available program documentation related to environmental performance and institutional set up,

(ii) conduction sites inspections, and (iii) EMR preparation including proposing

recommendations on IEEs implementation.

11. The location of sub-projects under Tranche 1 is given in Figure 1 below.

1.2. Construction activities and project progress during the reported period

12. Information about civil works performed under the Tranche 1 by the reported period

is given in Table 1. As it mentioned above, all construction works were completed and one

of them is being in liability period.

13. Per national legislation completed project works have to be accepted by State

Accepting Commission prior hand over to UCSA and starting operation. All objects of

Tranche 1 were examined and accepted by the Committee that is confirmed by Acts.

Example of State Accepting Committee’s Acts for all objects of Tranche 1 are presented in

Attachment 1. In accordance with Uzbek national regulations, the presence of Environmental

Specialist in Accepting Committee’s Commission is obligatory to confirm that completed

project works meets national environmental requirements.

1.3. Changes in project organization and environmental management team

14. “Uzkommunkhizmat” Agency (USCA) is the project Executive Agency which is based

in Tashkent. According to Facility Administration Memorandum (FAM) (2009), PPMU is

responsible for managing, executing and monitoring project implementation and should be

staffed with safeguards unit. Safeguards unit has to consist of environmental and social

specialists. PPMU needed to be staffed within the environmental and social specialists within

3 months of the Effective Data. The PPMU needs be supported by Consultant under Project

Management Facility.

15. As per FAM, in term of environmental aspects, PPMU is responsible for:

a) monitoring and evaluating the implementation progress and impact,

b) checking and guiding safeguards compliance,

c) coordinating among government agencies, and

d) consolidating and preparing required reports.

16. Covenants # 15, Schedule 5 of Loan Agreement, between ADB and Republic

Uzbekistan (2009) states, that progress reports on implementation of mitigation and

monitoring measures for subprojects shall be submitted to ADB on a semi-annual basis.

17. During reported period (July – December 2015) two Environmental Specialists had

been worked in PPMU: first during July-September 2015 and second one during November-

December 2015. In February 2016 PPMU appointed new Environmental Specialist from own

staff and now she combines duties of several positions, such as Social Specialist, Office

Manager and Interpreter.

18. A program implementation unit (PIU) was set up in each participating province and it

is responsible for day-to-day implementation of the Investment Program and the subprojects

within that province. Three PIUs in Bukhara, Navoi and Surkhandarya provinces were

established for implementation of the Tranche I. In term of environmental performance, the

major responsibilities of the PIUs involve:

a) coordinating the activities of consultants and contractors in the province;

b) overseeing construction activities;

c) monitoring social, gender, and environmental impacts of the subproject

activities;

d) supervising local institutional reform and capacity development activities; and

e) preparing and consolidating subproject accounting, auditing, and monitoring

reports for submission to the PPMU. Support will be provided from the

program management facility to assist PIUs in fulfilling their responsibilities.

19. At the time of Environmental audit conducted in November 2013, auditors noted that

such practices of the combining of the specialist – Environmental Specialist with the other

specialties is not efficient. In these cases, the specialist does not have the adequate

professional qualification in environmental field, combining of two specialties leads to the

time deficiency and, respectively, to the quality degradation of the professional duties.

20. Within Program Management Facility, the PPMU hired a Consultant – consortium –

Eptisa Servicios de Ingenieria S.L. (Eptisa) (Spain) and UBI Consulting, LLC (Uzbekistan) to

support Investment Program in: (i) implementation and management of approved

subprojects under the Investment Program; and (ii) preparation and appraisal of the

proposed subprojects to be financed under the Investment Program. The contract between

PPMU and Eptisa was signed only in March 12, 2013. Before this, related to Tranche 1, the

responsibility on technical supervision was carried out by National Individual Consultants

team hired by PPMU.

21. According to the Terms of Reference, the Consultant has to provide technical support

to PPMU in the bidding documentation preparation, project management and development

reports for submission to ADB.

22. The Consultant’s team is supposed to comprise Environmental Specialist responsible

for above mentioned tasks, particularly, as described in TOR, for:

a) preparation an overall environmental monitoring work plan;

b) updating, as necessary, requirements under the water supply and wastewater effluent standards;

c) monitoring and assessment compliance with the environmental safeguards of the project;

d) training PPMU, PIU, and various project consultants on environmental issues;

e) supporting the PIUs in establishing an environmental monitoring program; and

f) provision inputs on environment safeguards for preparation of the quarterly project progress report.

23. Consultant’s Environmental Specialist had been worked until June 2014. Since that

time the Consultant performs without Environmental Specialist and as consequences, no

more support was provided from Consultant side in part of environmental aspects.

24. The ADB Missions (June and October 2015) raised its concern on hiring Consultant

environmental specialist, however no actions have been taken and the position still remains

vacant.

25. Concerning the Contractor’s composition, almost in all subprojects Contractor’s

Engineers, who are responsible for H&S and environmental safeguards implementation at

construction sites, implement Ecologists’ role. They conduct an environmental monitoring on

project site and trainings for workers (Figure 2).

26. Noticeable changes in institutional set up took place after optimization process which

was implemented within Decree of Cabinet of Ministers of Republic of Uzbekistan # 334

dated November 23, 2015 on “Arrangements on improvement of investment projects

implementation mechanism with participation of International Financial Institutions”

27. Main changes were made in PIUs organization. Currently, no PIUs function in

provinces, only PPMU regional Coordinators work in each province where the WSSSIP is

being implementing. So there are no Environmental Specialists in PIUs from January 1,

2016. PPMU itself was renamed as “Project Coordination Unit” (PCU) and as it was

mentioned above new Environmental Specialist was hired

1.4. Relationships with contractors, owner, lender

28. Sub-projects’ organization for awarded contracts under Tranche 1 is given in the

Table 2.

29. Environment protection covenants were included in contracts with Contractors

(section В – Special Terms, paragraph 63). The documents describe requirements on

observance of the environment-related national laws and statutory instruments. The

Contractor’s responsibilities include the following covenants on: (а) approval of the functional

system on environmental impact management, (b) implementation of the monitoring and

mitigation measures specified in EMP, enclosed as the Annex 1, and required funds

distribution. They also include the requirements on submission of semiannual reports on

these measures implementation.

30. Two types of the reports supposed to be submitted by Contractors’ specialists

designated for environmental performance. Despite absence of requirements on

development SEMP in contract documents, Contractors prepared Quarterly Environmental

Monitoring Reports.

31. These reports provided brief description of construction activities planned within the

project, information about organizational structure of project management and implementers,

Contractor’s implementing of SEMP, status on environmental monitoring system and EMP

as to date of reporting.

32. Besides these reports Contractors submitted monthly progress reports which also

content information on environmental protection activity. All reports were submitted to

relevant PIUs. PIUs prepared quarterly reports based on the Contractors’ reports for PPMU.

Last EMR was submitted by Termez PIU for January – July 2015. No EMRs were submitted

by Galasiya PIUs for the reporting period.

33. Due to absence of Environmental Specialist in Consultant’s team, environmental

monitoring had been conducted only by Contractor’s and PIU’s relevant Specialists.

34. ADB missions have visited project sites in June and November 2015 and noted that

hiring Consultant’s Environmental Specialist by the Consultant is crucial for all tranches

within Investment Program. Number of comments were provided by ADB Environmental

Officers for project sites with on-going and completed construction works. More details on

given comments are provided in Chapter 3.3 “Environmental Management”. Moreover, a

checklist which needed to be filled at all completed sites was given to PPMU. At the date of

conduction this audit, Environmental Specialist was not hired and checklists were not used.

1.5. Project permitting status

35. Environmental expertise for each subproject of Tranche 1 was conducted at the

Republican and province levels by Environmental Expertise Departments of State Nature

Protection Committee and Environmental Appraisal were received for all sub-projects

(Example is provided in Attachment 2).

36. In accordance with Uzbek Environmental Legislation (Cabinet Ministries Resolution

#491 from December, 2001; #152 from June 5, 2009 — Statement on State Environmental

Expertise, Annex 2), subprojects under Tranche 1 are classified as:

• Modernization of Interregional Damkhodja Trunk Main – Category 2 (average risk of

environmental impact);

• Reconstruction of water supply systems of district centers of Navoi province with their

connection to the Damkhodja Trunk Main – Category 3 (low risk of environmental

impact);

• Reconstruction of water supply systems of Bukhara, Romitan, Yangibozor, Vobkent,

Gijduvan district centers of Bukhara province with their connection to the Damkhodja

Trunk Main – Category 3 (low risk of environmental impact);

• Reconstruction of sewerage system of Termez city – Category 3 (low risk of

environmental impact).

37. According to received permissions, almost for all sub-projects a final stage of

environmental impact assessment - Statements of Environmental Consequences (SEC)

need to be developed and approved by State Environmental Expertise under the State

Nature Protection Committee of the Republic of Uzbekistan.

38. Such, Vodokanals should prepare SEC before the operational stage for the

Damkhodja Trunk Main and Navoi province subprojects: Karmana, Kiziltepa, Kanimekh,

Beshrabad, Yangirabad.

39. Requirements indicated in Environmental Appraisal for Termez project need to be re-

confirmed with Surkhandarya Nature Protection Committee. The Environmental Appraisal

states that next (second) stage of Environmental Impact Assessment needs to be prepared

for this project before object commissioning. The clarification could be done by

Surkhandarya PIU’s staff or Environmental Specialist of the Consultant.

40. In accordance with ADB’s Safeguard Policy Statement, sub-projects under Tranche 1

were classified as category B, because potential adverse environmental impacts are less

adverse than those of category A projects and it requires conductions initial environmental

examination.

41. Initial Environmental Examinations (IEEs) for each sub-project were prepared by the

Borrower in 2009 and they were approved by ADB. However, IEEs were not published on

ADB web-site.

PART II - ENVIRONMENTAL MONITORING

42. As mentioned above, during reported period (July-December 2015) construction

works were implemented only by one Contractor in Galasiya sub-project, construction works

in Termez sub-project were recently completed.

43. Environmental monitoring within Tranche 1 consisted of environmental audits

conducted by Contractor’s designated Environmental Specialist and preparation of EMRs

with further submission them to PIU.

44. PIU’s designated specialist conducted environmental monitoring as part of technical

supervision.

45. However, track recording system were not in the place and it needs to be organized

for next Tranches. PIU collected EMRs submitted by Contractors and copies of Acceptance

Committee Acts with confirmation from State Nature Protection Committee and prepared

quarterly reports for PPMU and PPMU prepared semi-annual reports for ADB.

46. Environmental monitoring from Consultant’s site was not implemented due to

absence of relevant staff in the team. External monitoring of environmental performance was

done by ADB mission Environmental Officer (June and November 2015). Mission aide

memoires with observations and non-compliance were provided to PPMU for further actions

(Attachment 3).

47. According to Environmental Monitoring Plan included into IEEs on sub-projects, the

following parameters needed to be monitored during the construction stage (Attachment 4):

• Dust;

• Noise;

• Transport;

• Waste disposal;

• Land clearing;

• Utilities and traffic impacts.

48. The EMPs indicated that Contractor was responsible for conduction visual monitoring

of above indicated parameters. No more requirements on environmental monitoring were

included in EMP and as following in SEMP. Therefore, instrumental monitoring of quality of

environment was not conducted.

49. According to information provided by PIU staff, several cases of evident of improper

storage of wastes were observing. PIU used practice of verbal caution firstly, after this

written notification could be sent Contractor. However, due to absence of track recording

system it is not possible to monitor actions undertaken after such notifications and to assess

the results.

50. Taking in consideration that construction works within this project are done,

Completion Checklists recommended by ADB (June 2015) need to be filled for each

subproject site in order to monitor and proof compliance with environmental requirements

indicated in EMP. These checklists need to be filled by the Consultant Environmental

Specialist or PIU’s designated staff and they have to be submitted to ADB as part of

Completion Report.

51. In addition, notifications on non-compliance were provided to PPMU as well. Final

EMR should demonstrate how non-compliances were addressed.

PART III - ENVIRONMENTAL MANAGEMENT

3.1 Site Environmental Management Plans

52. Four SEMPs were developed by Contractors for the 4 subprojects within Tranche I.

SEMPs were identical without consideration project site specifications and sub-projects

details which are needed to be taken into consideration for further projects. They were based

on EMPs included into IEE for each sub-project. SEMPs were prepared after

commencement of construction activities were not officially approved by PIUs and by the

Consultant, however, the Contractors provided the progress on EMP implementation in their

Quarterly Reports on Environmental Monitoring to PIUs.

53. IEEs for this Tranche do not include requirements on development other

environmental management plans.

3.2 Site Inspections, Audits and Corrective Actions

54. As noted above, site inspection of environmental safeguards implementation was

conducted by Contractor’s designated person, PIU’s specialist and ADB’s Environmental

Officer within Missions.

55. As per PPMU information, under the subprojects, weekly control was conducted by

the PIU’s and Contractor’s Environmental Specialists to check up realization of

environmental mitigation measures. The construction supervision from the Consultant

presented on construction sites almost all time.

56. During construction the main requirements on mitigation measures were

implemented. As preventive measures from the formation of dust, the excessive excavated

soil was watered prior to disposal (transportation).

57. All wastes and debris are stored in designated area of site in special containers and

in due time are disposed to designated area approved by Hokimiyat. Dangerous materials

(fuel, chemicals) are not utilized during construction activities.

58. Contractor timely removes and recycles construction waste paper and scrap metal.

On Construction sites there are containers for collecting garbage and construction wastes.

59. Workers live in nearby areas. The Contractors provide the delivery of workers to

construction site and after the working day, they come back to the place of residence.

60. Workers’ Safety - Depth of tranches does not exceed up to 1.6 m and there were no

collapse danger. At least once in a quarter the Contractor with the presence of the Engineer

of technical supervision carried out training of all workers to safety precautions requirements.

Daily, before the starting work, all workers were warned about obligatory observance of

requirements of safety precautions. Workers were provided by overalls and individual

defense means (a welding mask, glasses, etc.).

61. Some non-compliance with in-time waste disposal were noted by PIU staff. After

verbal notification Contractor resolved issue. However, due to absence of track recording

system in PIUs, monitoring of implementation mitigation measures, evident on non-

compliance and undertaken correction actions can not be monitored.

62. During the ADB Mission conducted in June 2015, a format of Completion Checklist

was provided to PMMU as example and necessary requirements of environmental

compliance for completed subprojects to be filled up and submitted to ADB. Along with the

Checklist, the following observations requiring correction actions were done:

63. Damkhodia: Scrap metals are stockpiled, including empty old transformers. No

information available on how oil was released from the transformers, thus posing a possible

risk of leaking PCB oils. Staff working in the chlorination house do not use the provided

personal protective equipment (PPE) in this hazard condition.

64. Kiziltepa Water Supply (under liability period): Defect liability period has expired but

some defects can be observed and a concrete area for vehicle maintenance was not

constructed. Oil spills are noted in some places. The Mission requested measures to prevent

from oil leaking to the soil ground and better housekeeping practice.

65. Djiduvan (completed). Special attention from Vodocanal is required for

demolishment work which involves asbestos roofing materials as to avoid breaking and

exposing workers to asbestos dust.

66. Gallasiya (on-going), hand-over is expected in end of Jun 2015. The Mission

requested attention paid to post-construction cleanup and the disposal of the old transformer

(manufactured in 1986). No release of the potential PCB-containing oil from the transformer

will be allowed.

67. Termez: activities are on-going. The project site is located very near residential

houses thus requiring additional public consultation, signage with project information and

contact numbers, traffic safety measures, and enhanced mitigation measures for noise and

air pollution. The Mission also requested better waste management and good housekeeping

practice.

68. As to date of reported period, there were not provided any Completion Checklist to

ADB. For full project completion, the Checklists for each subproject site need to be filled and

submitted to ADB as part of Final Completion Report. Observed non-compliance needed to

be addressed and results have to be reported as well.

3.3 Consultation and complaints

69. Construction works have been implemented in permanent interaction with local

administrative units – makhallas. Prior starting works heads of makhallas were informed

about planning activities. During project implementation, communication between

Contractors and PIU staff have been kept as well.

70. Information about activities under sub-projects of Tranche 1 was available in each

sub-project site, where an Informative Banner with brief description and objectives of project,

implementers, schedule of construction works, deadlines and contact information was

placed.

71. According to representatives of PIUs and Contractors on Tranche 1, there was no

any complaint from local people living in project or surrounded area. However, there were no

logbooks on construction sites.

72. In project districts Social Commission Unit under the local khokimiyats and

Information Centers under Vodokanals were created. However, data on activities performed

by Unit was not available in PPMU.

PART IV - CONCLUSION AND RECOMMENDATIONS

73. Based on results of conducted audit the following conclusions were given:

74. PPMU improved activities on compliance with environmental safeguards during

projects implementation. For all subproject IEEs were prepared and national Environmental

Appraisal were received. However, IEEs were not published on ADB website and were not

disclosed to public.

75. SEMPs were prepared by Contractors and Environmental aspects were part of

Contractors’ Quarterly reports. In addition, Contractors submit monthly reports to PIU. PIU

prepares quarterly EMRs and submits to PPMU.

76. Environmental monitoring was implemented only by Contractors themselves and

within ADB mission. No track record system of environmental monitoring and performance in

the PIUs. For the reported Environmental Monitoring from Supervision Consultant side were

not implemented due to absence of Environmental Specialist.

77. Only visual environmental monitoring was done, SEMPs did not include requirement

on conduction instrumental monitoring.

78. For completion report the following actions are needed to be implemented:

Attachment 3. ADB mission’s site specific note

MFF Water Supply and Sanitation

Site-specific Mission note (19-24 June 2015)

The following project sites were visited: Damkhodja , Kiziltepa , Djiduvan, Gallasiya , Termez ,

Kokand 1 and 2, Rishtan, Fergana, Andijan, Margilan. The Mission met with representatives of

Vodokanals, PIUs, contractors, supervision consultant (Eptisa). In all subprojects of Tranche 1,

PIU staff working with no more payment and Eptisa was not available. The knowledge of

EMG functioning is limited.

Mission findings::

1. Damkhodia:: the investment completed with minor refurbishment and post-

construction work remained at the distribution center. The project sites are kept in

acceptable conditions. Scrap metals are stockpiled, including empty old transformers.

No information available on how oil was released from the transformers, thus posing a

possible risk of leaking PCB oils. Staff working in the chlorination house do not use the

Environmental Safeguard Findings:

The PPMU hired environmental safeguards specialist to monitor the implementation of

IEE and EMP and prepare bi-annual environmental monitoring reports (EMR) in November 2015 after several reminders and follow up by ADB. Submission of due EMR was delayed for 4 months. The Mission noted that the agreements reached during the review mission in June 2015, particularly engagement of international and national environmental specialists (Supervision Consultant EPTISA) from the savings other positions has not materialized. The Mission raised it concern that environmental issues possibly remain unattended on most of the project sites which may result in non-compliance with environmental requirements. The Mission requested the PPMU and EPTISA consultants to finalize the draft contract amendment on engagement of specialists as it has repeatedly been agreed during the last review missions and meetings. PPMU advised that as per the contract with EPTISA, international environmental specialist was not envisaged and the remaining person-months from international specialists will be reallocated to Team Leader who has utilized more than 70% of the time allocated and civil works under Tranche 4 will start soon. EPTISA informed the mission that both parties (EA and EPTISA) agreed to the candidate of national environmental specialist to be fielded immediately.

The Mission proposed the following:

1. Finalize agreement with EPTISA on recruitment of national consultant who will help

to bring project back on track for environmental safeguard compliance. 2. Improve reporting including contractor’s monthly progress reports and Supervision

consultant’s quarterly reports address environmental safeguard issues. The

reporting requirements and track record system as part of PPMS need to be

established at PPMU as soon as possible.

3. The environmental safeguard specialist of PPMU to monitor site inspection and site

management improvement to be done by EPTISA and contractors. The Mission

strongly recommended that PPMU to use site inspection checklist provided during

last review mission. EPTISA to provide guidance to the contractors and improve

site supervision of mitigation measures, using the weekly site inspection checklists

for submission to PIUs/PPMU and issuing non-compliance notices as needed.

4. Additional public consultation during the site inspection should be conducted with

the people, for the project sites located in the residential areas or pipe laying works

close to the community areas.

5. Improve safety and traffic management at the required project sites if the sites are

neighboring to households and the streets used for material transportation.

6. EPTISA environmental consultant to provide trainings on site supervision and etc.

7. Improve quality and timely submission of bi-annual EMRs as required twice a year

every 15 January and 15 July. Mission advised the next EMR (Jul-Dec 2015) will

be submitted by 15 January 2016 with no more delays.
