STAKEHOLDER ENGAGEMENT PLAN SEP FOR THE 750 KV ZAPORIZKA-KAKHOVSKA TRANSMISSION LINE PROJECT
1 INTRODUCTION – WHAT IS THIS DOCUMENT ABOUT?
This document is prepared and provided to the public by the Southern Electric Power System, NPC “Ukrenergo” (Ukrenergo), based in Odessa. We are planning a new transmission line Project from Zaporizka Nuclear Power Plant (ZNPP) to Kakhovska, which is essential for improving the quality and stability of electricity to the many towns and villages in the southern regions. We have engaged Ukrainian firms to prepare the necessary designs, permits and approvals, and an international firm with preparation of an Environmental and Social Impact Assessment (ESIA) as per the requirements of international lenders. It is an important part of the ESIA process and our Project planning that the interested public, people living or working in the project area and representatives from local towns and other authorities as well as non-governmental organizations – NGOs (together referred to in this document as “stakeholders”) are informed about our plans and have the opportunity to provide comments and give input to the ESIA preparation. This document provides a brief background of the project and the key regulatory situation, describes the stakeholders we have identified and the meetings held so far, and the plans for future meetings and how we plan to keep the stakeholders informed in a timely manner. As further explained in this Document, we are trying to make it as convenient as possible for you to have access to Project information (e.g. via newspaper and radio announcements, meetings, copies of ESIA documents posted at local town halls, direct mailings and the Ukrenergo web-site) and also to reach us with your inputs (e.g. via letters, telephone, fax, emails).

2 PROJECT BACKGROUND
Construction was first started by Ukrenergo in 1991 of the 750 kV ZNPP – Kakhovska overhead transmission line (TL) with 750 kV “Kakhovska” substation and 330 kV overhead line diversions (the Project). The purpose of the Project – as one of four TL projects related to the original design of the ZNPP - is to ensure normal conditions for ZNPP output capacity and to improve reliability of the power supply in the southern Kherson and Mykolaiv regions of Ukraine and the Autonomous Republic of Crimea. The other three TLs were built as planned, but the construction works of this Project were stopped in 1998 due to lack of funds. Ukrenergo now intends to restart and complete the construction of the Project, and has engaged LLC “Southern Energy Company” to update the design specifications. It is expected that financing for the Project will be provided by international lenders such as the European Bank for Reconstruction and Development (EBRD). The Environmental and Social Impact Assessment (ESIA) for the Project will be carried out by the firm ERM according to the Ukrainian and EBRD requirements and will consider the following Project components:
Construction of the 750kV ZNPP – Kakhovska TL (190 km);
330 kV double circuit TL diversion Novokakhovska–Ostrovska to 750kV

Kakhovska substation (28km);
330 kV double circuit TL diversion Novokakhovska–Kherson to 750kV Kakhovska substation (17 km);
Construction of 750/330 kV Kakhovska substation including two autotransformers 2x1,000MVA;
Reconstruction of the partly built 330/220 kV Novokakhovska substation.
The TLs and other objects related to the Project are located in the following jurisdictions: Zaporizka Oblast: 5 village councils and towns within the following Rayon:
- Kamyanka-Dniprovska
Kherson Oblast: 20 village councils, municipal settlements and towns within the following Rayons:
- Verkhniy Rogachyk,
- Velyka Lepetykha,
- Gornostayivka,
- Kakhovka,
- Tsyuryupynsk,
- Beryslav.

Scoping document and other documents that are being made publicly available
(further below we explain how/where to obtain such documents).
3 PUBLIC CONSULTATION AND DISCLOSURE REGULATIONS AND REQUIREMENTS
- Ukrainian Requirements
The Law of Ukraine On Environmental Protection (1991) sets general rules and requirements for public access to environmental information. The Law of Ukraine on Ecological Examination (1995) is the main umbrella law regarding Environmental Impact Assessment (EIA-OVNS in Ukrainian), and, in addition to spelling out main requirements for EIA, also mentions environmental rights and interests of general public, and a right to perform a public environmental review by individuals and/or Non Governmental Organizations (NGOs).
According to national legislation requirements, the EIA and the Public Consultation and Information Disclosure process form part of the Ukrainian project licensing procedures.
The EIA section is undertaken as a part of the project documentation, which is regulated by the State Construction Standard (DBN A.2.2-3-2004) “Design. Content, Development Order, Approvals of the Construction Project Documentation”.

The requirements to inform and to take public interests into account are set out in the State Construction Standard (DBN А.2.2-1-2003) “The Structure and Content of EIA Study in the Design and Construction of Proposed Development Projects. Basic Design Principles”.
The Public Consultation and Information Disclosure process is defined by the Order of the Ministry of Environmental Protection of Ukraine “On the Approval of Regulation on Involvement of the Public in Decision Making on Environmental Issues (No.168 of 18/12/2003)”.
The EIA should explain the rationale of the proposed project and assess the environmental effects on the natural, social and built environment. It should also describe possible alternatives, establish the baseline, developed measures for prevention or limitation of the negative environmental effects, and ensure the project is compliant with environmental, sanitary and other relevant legislation.
For EIAs for activities or objects of “high environmental hazard”, the EIA Proponent or developer must inform the public via the local authorities about the planned project, define place and procedure of public hearings, and collect and take account of public comments and suggestions.
In accordance with Annex “E” to the DBN А.2.2-1-2003, the construction and operation of electricity transmission lines – such as the proposed TL Project - is not classified as an activity or object of high environmental hazard. In this case the process of Public Consultation and Information Disclosure is not obligatory.
- International Lender Policies
However, the process of Public Consultation and Information Disclosure is required under European Union Directives and by the EBRD policies1 as a lending prerequisite:
To identify people of communities that are or could be affected by the project, as well as other interested parties.
To ensure that such stakeholders are appropriately engaged on environmental and social issues that could potentially affect them through a process of information disclosure and meaningful consultation.
To maintain a constructive relationship with stakeholders on an ongoing basis through meaningful engagement during project implementation.
Ukrenergo is experienced in such public consultation and discussions about environmental and social impacts of its TL projects, e.g. having implemented projects according to EBRD standards in 2005 (330kV TL Ajalyk – Usatove) and 2008 (Rivne NPP - Kyiv). 4 STAKEHOLDERS
In this section we describe the Stakeholders that we have identified so far in our ESIA process. A list of specific statutory stakeholders relevant for this Project including national, regional and local administrations, and NGOs is provided in Annex 2 (total over 160 Stakeholders at this time), along with the status of invitations to previous scoping meetings (described in other Section below) and project documentation delivered to date. These Stakeholders identified so far include the following main groups:
Statutory organisations and bodies which represent public functions or other formal agencies with responsibilities related to the Project (See Annex 2 for specific addresses) National Ministries
State Administrations of Oblast Rayon and Municipalities (where applicable)
Village councils in the settlements adjacent to the route and other planned facilities
Regional and District level environmental authorities (including protected areas)
Regional and District level public health authorities
District level urban development, architecture and infrastructure departments
Regional and District level departments of land resources
Regional level cultural heritage / archaeology departments
Regional and District level agriculture departments
State forestry management department(s) if/where applicable
State Water management department where applicable (e.g. river crossing)
Other Organisations/NGOs Several NGOs at regional and national level have taken part in the Scoping Meetings and have submitted written comments. Refer to Annex 2 for specific names of the NGOs identified to date. Landowners/Landusers The identification of affected landowners and landusers is still under preparation. Ukrenergo already holds state acts for permanent use of land plots where towers are located for the main TL and the 330 kV Novokakhovska-Ostrovska diversion. Ukrenergo is currently in the process of finalizing the routing of the 330 kV Novokakhovska-Kherson diversion and acquiring the related land plots where the towers will be located.

The land owners/land users affected by right of way and protection zones of the planned routing of the TL and diversions have so far been informed about the Project through the public media (see Section 5.1). The land users will include private individuals, agricultural cooperatives/commercial farms and other users. Ukrenergo is presently compiling the names and addresses of the affected landowners and landusers along the planned routes. These will then be included on the list of Stakeholders in Annex 2, so that more direct communication can be held in the future. Local population in the settlements adjacent to the route and other planned facilities These persons have so far been represented by the leaders of the village, town or rayon-level leaders on the Stakeholder list. If any of these persons expresses a particular interest in becoming more involved, they can of course be specifically added to the Stakeholder list by contacting Mr. Shvedkyi (contact details see above).
General Public The general public has so far been represented by the various statutory bodies and NGOs. If any person expresses a particular interest in becoming more involved, they can of course be specifically added to the Stakeholder list by contacting Mr. Shvedkyi (contact details see above). Workers/Employees of the Ukrenergo involved in the Project Workers involved in the Project construction and operation have specific internal communication processes, including a grievance mechanism for workers, and are therefore not included in the Stakeholders list. Ukrenergo will prepare a separate consultation plan for the workers at the various project stages.
We wish to involve all relevant Stakeholders in this Project. Please inform
Ukrenergo if you feel that additional persons or organisations should be added to
the Stakeholders list.
5 PREVIOUS CONSULTATIONS
There have been two stages of previous consultations regarding this Project. The initial consultations for this Project are related to the original TL route planning and approval procedure in 1989. Ukrenergo obtained the official acts for permanent land use required for construction and operation of the 750 kV ZNPP – Kakhovska TL, and at that time all necessary approvals from the official stakeholders at the TL routing stage were obtained.
As part of the current Project, Ukrenergo held three initial Scoping Meetings aimed at a preliminary introduction and discussion of the Project to identify important environmental and social issues and concerns for the ESIA and to present this Public Consultation and Disclosure Plan (in its previous version):

1. Zaporizhzha, Str. Grebelna 2 (Ukrenergo Offices), on April 27, 2009, at 2 pm. 2. Nova Kakhovka, Prospect Dniprovskiy 23 (Town Hall), on April 29, 2009, at 2 pm. 3. Kiyv, Sofiyvska Str. 23-27, (EBRD office), on May 13, 2009, at 2:30 pm. Each meeting lasted between 1.5 to 2.5 hours with the following main agenda points: Welcome by Ukrenergo, explanation of purpose of the meeting and the public
participation process
Technical Description of the Project (by Southern Energy Design Institute)
Description of anticipated key Environmental and Social Aspects of the Project (by ERM in English, with translation into Russian/Ukrainian)
Open-end session with questions and comments by the Attendees; some questions could be directly answered by Ukrenergo, the Design Institute or ERM.
The comments and questions raised in these Scoping Meetings are being considered by ERM in the preparation of the ESIA. In addition, several concerns from stakeholders have been directly submitted to Ukrenergo subsequent to the meetings in form of letters and emails, and these are also passed on to ERM.
For the above-described Scoping Meetings, the Public and Stakeholders were provided with advance notice of the dates and venues of the planned meetings in the following manner:
Statutory stakeholders, state administrations of the Zaporizka and the Kherson Oblast, Rayons, local communities and NGOs each received a written invitation by mail to the scoping meetings and a copy of the draft Scoping Document and the draft SEP document by mail and/or email.
The general public was informed about the Project and the related Scoping Meetings via newspapers and radio announcements. The names and dates of the various newspapers and radio advertisements are provided in Annex 3.
The experience with the above Scoping Meetings and subsequent comments received has shown that some Stakeholders were not aware of the meetings – even though their organisations are listed in Annex 2 and mailings were sent to them. Also, we discovered that some residents of the local villages along the route were not yet aware of the Project at all. Based on these lessons-learned, we are in the process of improving the
information-communication procedures for future disclosures, e.g. via:
Updating/correcting the mailing addresses;
Conducting follow-up mailings or phone calls to confirm receipt;
Issuing written bulletins/brochures

6 FUTURE DISCLOSURE OF INFORMATION AND PARTICIPATION
A time-line of the public disclosure process for this Project is provided in Annex 4. This shows the past events and gives tentative dates for future actions. The next steps will include disclosure of the Draft ESIA Report and related Public Hearings, as described below.
PUBLIC DISCLOSURE OF DRAFT ESIA REPORT
The Draft ESIA Report is scheduled for completion by early July 2009 and will then be publicly disclosed for a 120 day period. At present, it is anticipated that this 120 period will extend from July to November 2009; specific dates will be made public once confirmed by advertisements in local newspapers and radio stations and by posters on the bulletin boards of the relevant Oblast and Rayon offices listed below. During this period the public and Stakeholders can review the Report and provide comments and questions to Ukrenergo. Following the comment period, the ESIA document will remain in the public domain. The full text of the Draft ESIA Report will be available for review at the following locations: Ukrenergo offices in:

Oblast State Administrations of the Zaporizhzha and Kherson Oblast, and at the
District State Administrations of the District or Municipal Councils of the seven Rayons through which the TL passes (see Annex 5).
The executive summary of the Draft ESIA Report will be available at the larger towns and villages located near the planned TL routes, while shorter brochures will be distributed at the smaller villages. The table in Annex 5 shows for each of the 35 relevant communities (at level of Oblast capital, Rayon capital, or town/village) the location (and contact person) of the local Bulletin Board where Project information will be available (at least in brief summary form), along with the nearest location to review the full Draft ESIA. In addition, the full Draft ESIA will be available for review on the Ukrenergo web-site: http://www.ukrenergo.energy.gov.ua. The Executive Summary will be available throughout the 120-period and afterwards on the EBRD web-site:

Ukrenergo will hold a number of Public Hearings in the course of the 120-day disclosure period. The draft ESIA will be in the public domain at least 30 days prior to any meetings for people to review. The intent of the Public Hearings is to discuss the findings of the Draft ESIA with the public and provide an additional chance for open discussions and clarifications between the public and the Project team, as well as further input to the ESIA by the Stakeholders. At present it is tentatively planned to hold one hearing in each of the seven districts/rayons through which the transmission line passes (see list in Annex 5). This will allow for easier access and participation by local residents. If additional or alternative Hearing venues are requested by the Stakeholders, we will try to accommodate for this as far as possible. The hearings are currently scheduled for September 2009, after the national summer vacation and harvesting period in July/August. The public and the stakeholders will be informed at least 3 weeks in advance of the Public Hearings (dates and locations will be identified and disclosed). Based on the experiences in April and May 2009 from the public notification of the Scoping Meetings (see Section 5 above), we believe that the newspaper and radio announcements worked well (described in Annex 3), but it will be important to reach out more directly to the local village residents by posting bulletins at central locations (as detailed in Annex 5). Therefore, we plan to inform the general public via:
newspaper advertisements
radio announcements
bulletins posted at the offices of the local authorities and town halls of the affected rayons and Oblasts
In addition, the identified stakeholders (as per Annex 2), including participants of previous Scoping Meetings and persons who submitted comments directly to Ukrenergo in the past, as well as landowners/users will receive notification by mail and/or email – depending on which method had best worked previously. Comments, questions and suggestions concerning the Draft ESIA Report will be invited from Stakeholders and the public throughout the 120 day public disclosure process, and of course during the Public Hearings. The Stakeholder input will be considered by Ukrenergo and the Project consultants. In general, comments will be responded to by Ukrenergo in writing within 2 weeks after receipt (whereby some responses may require more time if translation needed or otherwise complex). Where appropriate, the draft ESIA report will be revised accordingly during finalisation. The central contact person at Ukrenergo for inquiries and submittal of comments during the 120-day disclosure period is Mr. A.M. Shvedkyi (contact information provided in Section 1 - Introduction).

For convenience, a “Public Comments and Suggestions Form” has been prepared (see Annex 6) but is not obligatory to use. Comments may be provided to Mr. Shvedkyi via letter, email, fax, or telephone call.
Additional Disclosure of Information Information on the Project will be made available throughout the Project period on the websites of Ukrenergo (http://www.ukrenergo.energy.gov.ua), and the Ministry of Fuel and Energy of Ukraine (http://mpe.kmu.gov.ua), Information provided on the websites will comprise topics such as the current status of planning, application procedure and project implementation, and information material such as described below in standard data formats (e.g. PDF). The information will be placed on the website as it becomes available and/or is updated. Besides information in electronic format, Ukrenergo will provide a summary information brochure (2-4 pages) on the project at billboards etc. in settlements near the route (see Annex 5), and update these periodically as the Project progresses. This will be especially important during the construction phase as the local residents may be affected by the construction activities. We welcome your suggestions on how we can further improve our process of
informing the public and stakeholders and encouraging comments and feedback
regarding the Project.

8 GRIEVANCE MECHANISM
The above-described procedures have focused on comments and inputs by Stakeholders during the preparation phase of the ESIA; such input is typically related to environmental or social issues and the content of the ESIA. The Grievance Mechanism, on the other hand, provides Stakeholders a way to formally register any complaints/ grievances to Ukrenergo about any part of the process of the Project implementation. Examples of Grievance issues may include items such as: Lack of timely response to input given during the ESIA/Planning process; Damage to crops during tower construction; Unexpected corona noises during operations.
Ukrenergo has designated Mr. A.N. Shvedkyi, First Deputy Director of Southern Electric Power System – Ukrenergo, as the “Public Liaison Officer” and thus also responsible for grievance response during project preparation, construction and operation stages. Contact details of Mr Shvedkyi are given in Section 1. For convenience, a “Public Grievance Form” has been prepared (see Annex 7) but is not obligatory to use. Grievance statements may be provided to Mr. Shvedkyi via letter, email, fax, or telephone call. Grievances will in general be responded to within 2 weeks after receipt.
Should the need arise, Ukrenergo will consider the establishment of a conflict resolution "committee" (comprising Ukrenergo representatives, village council representatives, and other persons as appropriate) for the management of complex grievance issues. The Environmental and Social Management Plan (ESMP), which will be part of the ESIA document, will contain additional information on the grievance mechanism.
