की िेबसाइट www.sac.gov.in पर भी उपिब्ध हैं। इचु्छक वनविदाकार इसे िेबसाइट से डाउनिोड कर सकते हैं

तथा अपने प्रस्ताि Rs.545.00 प्रते्यक (रेिांवकत वडमांड डर ाफ्ट के रूप में) के वनविदा शुल्क के साथ प्रसु्तत करें। अपना

प्रस्ताि प्रसु्तत करते समय विफाफे के ऊपरी भाग पर वनविदा सं. तथा वनयत वतवथ वििें।

यवद दस्तािेज डाक द्वारा मंगाए जा रहे हैं तो वनम्न बातो ंको नोट करें :

1. वनविदा दस्तािेज मंगाने के विए भेजे जा रहे वनिेदन पि पर वनविदा सूचना संख्या तथा वनविदा संख्या दोनो ंवििी

जाएं तथा वनविदा शुल्क Rs.545.00 प्रते्यक (वकसी भी राष्ट्र ीयकृत बैंक द्वारा जारी रेिांवकत वडमांड डर ाफ्ट के रूप में)

के साथ माि क्रय एिं भंडार अवधकारी, अंतररक्ष उपयोग कें द्र, अहमदाबाद- 380 015 को भेजा जाए।

2. वजस विफाफे में इस प्रकार का वनिेदन भेजा जा रहा हो उसके ऊपरी भाग पर "वनविदा दस्तािेजो ंके विए अनुरोध"

वििा जाए। प्रते्यक वनविदा दस्तािेज के विए अिग वनिेदन पि एिं अिग वडमाण्ड डर ाफ्ट भेजा जाए।

3. वनविदा शुल्क (अप्रवतदेय) का भुगतान रेिांवकत वडमाण्ड डर ाफ्ट (माि एमआईसीआर डीडी) के रूप में वकया जाए

जो अहमदाबाद में देय हो तथा िह माि िेिा अवधकारी, सैक अहमदाबाद-380 015 के नाम पर विया जाए।

4. वडमाण्ड डर ाफ्ट के पीछे विके्रता का नाम एिं वनविदा संख्या दजज होनी चावहए।

5. वनयत वतवथ बढाए जाने के वनिेदन पर कोई विचार नही ंवकया जाएगा।

6. डाक द्वारा वनविदा दस्तािेज की वबक्री वनयत वतवथ से 10 वदन पूिज बंद कर दी जाएगी।

7. यवद विके्रता व्यखिगत रूप से आकर वनविदा दस्तािेज प्राप्त करना चाहते हैं, तो िे वनयत वतवथ से एक वदन पूिज तक

क्रय प्रभाग (वबखडंग नं. 30-ए, कमरा नं. 57) में वकसी भी कायज वदिस पर 1400 से 1600 बजे के बीच संपकज करें ।

8. मोहरबंद प्रस्ताि प्राखप्त की समय सीमा प्रते्यक वनविदा के सामने वनवदजष्ट् वनयत वतवथ को 1500 बजे तक रहेगी।

9. अंवतम समय सीमा से पूिज प्राप्त बोवियााँ उपखथथवत वनविदाकारो/ंउनके द्वारा प्रावधकृत प्रवतवनवधयो ंकी उपखथथवत में

उसी वदन 1530 बजे िोिी जाएंगी।

10. ऊपर वनवदजष्ट् वतवथ को यवद छुट्टी घोवषत की जाती है तो सैक का अगिा कायज वदिस वनविदाओ ंकी प्राखप्त एिं िोिने

के विए वनयत वतवथ माना जाएगा।

11. वििंब/देरी से प्राप्त प्रस्ताि स्वीकृत नही ंवकए जाएंगे।

12. वजन पावटजयो ंने समय से बोिी जमा कराई है तथा वनविदा िोिने में भाग िेना चाहते हैं, िे अपने प्रावधकृत प्रवतवनवध

का नाम उस विवशष्ट् वनविदा में उखिखित वनधाजररत वतवथ से एक वदन पूिज सूवचत कर दें। वििंब से/अंवतम क्षणो ंमें

प्राप्त प्रिेश हेतु अनुरोध पर विचार नही ंवकया जाएगा।

13. वनम्नविखित िगज के वनविदादाता को वनविदा के साथ ईएमडी में छूट के विए उवचत दस्तािेजी साक्ष्य

प्रसु्तत करने पर ईएमडी के भुगतान से छूट दी जाती है )हो िागू यवद( :

सैक में अवधकृत विके्रता के रूप में पहिे से पंजीकृत/पेनािीकृत विके्रता|

भारतीय प्रवतवनवध को शावमि न करते हुए सीधे प्रस्ताि प्रसु्तत करने िािे विदेशी विके्रता

भारत सरकार के आदेशानुसार ईएमडी के भुगतान से विशेष रूप से छूट प्राप्त कोई अन्य

14. वनविदा मूल्ांकन प्रवक्रया के दौरान अपनी वनविदा को िापस िेने िािे विके्रताओ ंकी ईएमडी जब्त

कर िी जाएगी। विफि विके्रताओ ंकी ईएमडी वनविदा अिाडज करने के बाद, वनविदा अिाडज करने के

30 वदनो ंके अंदर ब्याज के वबना ईएमडी िौटा दी जाएगी।

Tender documents can be bought from the Purchase Division, SAC and are also available on ISRO

website www.isro.gov.in and SAC website www.sac.gov.in. Interested tenderers may download the

same from the website and submit their offer along with tender fee of Rs.545.00 each (In the form of

Crossed Demand Draft). While submitting your offer superscribe Tender No., and due date on the

envelope. Govt. dept., PSUs (both Central & State) and Units registered with NSIC/MSME/KVIC are

exempted from Tender fees, subject to submission of supporting documents.

If the documents are requisitioned by post, the following points shall be noted:

1. Request letter shall be sent for requisitioning tender documents indicating tender notice number

and tender number together with tender fee Rs..545.00 each (In the form of Crossed Demand Draft

issued by any Nationalized Bank) to the Purchase and Stores Officer, Space Applications Centre, Ahmedabad - 380 015 only.

2. The Envelope containing such request shall be super-scribed with “Request for Tender Documents”. Separate request letter and separate Demand Draft shall be sent for each tender document.

3. The tender fees (non-refundable) shall be paid in the form of CROSSED DEMAND DRAFT (MICR

DD ONLY) payable at AHMEDABAD in favour of The ACCOUNTS OFFICER, SAC, Ahmedabad - 380 015 only.

4. Vendor name and tender number shall be indicated on the reverse side of the Demand Draft.

5. No request for extension of the due date will be considered.

6. The sale of the tender documents through POST shall be closed 10 days prior to due date.

7. In case vendors desire to collect the tender document in person, they may contact Purchase Division (Bldg. No. 30-A, Room No. 57) on any working day between 1400 to 1600 hrs up to one day before the due date.

8. Deadline for the receipt of the sealed offers shall be up to 1500 hrs on the due date mentioned

against individual tender.

9. Bids received before the deadline shall be opened in the presence of attending tenderers/their authorized representatives on the same day at 1530 hrs.

10. In the event any date indicated above is declared as holiday, the next working day at SAC shall be

considered as the due date for receiving & opening of tenders.

11. Late/Delayed offers will not be accepted.

12. Parties, who have submitted bids in time and want to participate in tender opening, may inform

their authorized representative’s name one day in advance of the due date indicated against the particular tender. Delayed requests / requests for entry at eleventh hour will not be entertained.

13. The following categories of bidders shall be exempt from paying EMD subject to submission of appropriate documentary evidence with the bid in support thereof (if applicable): Vendors already registered/empanelled with SAC as authorized vendors. Overseas bidders submitting offers directly without involving an Indian Representative. Central PSUs/PSEs and autonomous bodies Micro and Small Enterprises Khadi and Village Industries Commission National Small Industries Corporation Any other establishments specifically exempted from paying EMD by an order of the

Government of India.

14. The EMD of bidders who withdraw their bid during the tender evaluation process shall be forfeited. EMD of unsuccessful bidders shall be refunded without interest after the tender has been awarded, within 30 days of the award of the tender.

शिबंधि एिं िरे्त / TERMS & CONDITIONS

1. कार्य का दार्िा Scope of contract:

निम्िनिनित निबंधि एवं शतों के अिसुार अंतररक्ष उपयोग कें द्र (सैक), अहमदाबाद से डोर किेक्शि-डोर नडिीवरी आधार पर भारत के नवनभन्ि

स्थािों तक वाय ुमागग द्वारा कन्साइिमेंट का प्रेषण और नविोमतः -

Despatch of consignments By Air from Space Applications Centre (SAC), Ahmedabad to various locations in India

and vice versa on door collection-door delivery basis as per terms and conditions given below.

2. िैधर्ता अिशध Validity period:

अिबंुध जारी होिे की नतनथ से एक िर्य की अवनध के निए वैध होगा और आपसी सहमनत होिे पर और एक वषग के निए बढाया जा सकता ह।ै

The Contract shall be valid for a period of ONE year from the date of its issue and extendable by one more year on

mutual consent.

3. दि Rates:

3.1 दरें डोर किेक्शि-डोर नडिीवरी आधार पर पैिेट-वार/ अधग पैिेट-वार और प्रनत नकिोग्राम आधार पर उद्धतृ की जाएँगी (संिग्िक-II में नदए गए

फॉमेट के अिुसार)।

3.2 उद्धतृ दरें सैक से सामाि संग्रनहत करिे और इस संनवदा के अंतगगत शानमि गंतव्यों तक पह चँािे तथा नविोमतः की व्यवस्था करिे जैसे प्रचािि

प्रभार सनहत होंगी। पे्रषण संनवदाकार के बंद (कंटेिर वािे) वाहि में नकया जाएगा।

3.1 Rates shall be quoted pallet vise/half pallet wise and per kg basis on Door Collection and Door Delivery basis (as

per format enclosed at Annexure – II).

3.2 The Rates quoted shall be inclusive of operation charges such as arrangement for pickup of consignment from SAC

and delivery at destinations covered under this Contract and vice versa. Delivery will be made in closed body

(containerized) vehicle of contractor.

4. सशंिदा का परिचालि Operation of contract

4.1 कंसाइमेंट का नववरण, पैनकंग नववरण, पे्रषण की अंतररम नतनथ, स्थि इत्यानद तथा िागू अिसुार अन्य शते एवं निबंधि के साथ कंसाइमेंट के पे्रषण

के निए जैसा और जब अपेनक्षत होगा हमारे द्वारा प्रत्येक प्रेषण के निए आवश्यक सचूिा/ कायग आदेश जारी नकया जाएगा।

Necessary intimation/work Order will be issued by us for each dispatch and as and when required for dispatch of

consignments with the details of the consignments, packing details, tentative date of dispatch, destination etc. and

other terms and conditions as applicable.

4.2 कंसाइिर/कंसाइिी के स्थाि पर िोनडंग और अििोनडंग गनतनवनधयों का संचािि संबंनधत कंसाइिर/कंसाइिी द्वारा नकया जाएगा।

Loading/Unloading activities at consignor’s/consignee’s place will be carried out by the respective

Consignor/Consignee.

4.3 भंडार के क्र.भं.अ./वरर.क्र.भं.अ./प्रधाि, क्र.भं. से मेि/फोि द्वारा सचूिा प्राप्त होिे पर िोनडंग, प्रेषण पवूग कायग इत्यानद के निए, पहिे से ही

कंसाइमंेंट की िोनडंग के निए एक बंद वाहि तैयार रिा जाएगा।

A closed body vehicle for loading the consignment shall be positioned well in advance for loading, pre-Despatch

works etc. on getting intimation from PSO/SPSO/HPS of stores by mail/phone.

4.4 सड़क मागग से एयरपोटग पररवहि के निए प्रदाि नकया गया वाहि अनधमान्यत: 5 वषग से कम परुािा हो और सड़क पर चिािे योग्य तथा अच्छी

नस्थनत में वैध राष्ट्रीय परनमट सनहत होिा चानहए। प्रदत्त वाहि के साथ सड़क पर चिािे के निए आरटीओ मंजरूी/ नफटिेस प्रमाण-पत्र होिा चानहए

और पंजीकरण प्रमाणपत्र, अद्यनतत भगुताि रसीद, उत्सजगि परीक्षण प्रमाणपत्र, बीमा पॉनिसी, अंतर राज्य परनमट, ड्राइवर का अद्यति वैध ड्राइनवंग

िाइसेंस इत्यानद जैसे आवश्यक दस्तावेज होिे चानहए।

The vehicle provided for transportation by road to Airport shall preferably be less than 5-year-old and roadworthy

and in good running condition having valid National Permits. The vehicle provided should have RTO

clearance/Fitness Certificate for road worthiness and shall have the required documents such as Registration

Certificate, up to Date Tax Paid Receipt, Emission Test Certificate, Insurance Policy, Inter State Permit, up to date

valid Driving License for the Driver etc.

4.5 ठेकेदार कंसाइमेंट िोनडंग हतेु वाहि ररपोनटिंग करते समय कंसाइिर को अपिे प्रनतनिनधयों और वाहि ड्राइवर का नववरण यथा िाम, ड्राइनवंग

िाइसेंस की प्रनत, संपकग फोि सं. इत्यानद प्रदाि करेगा।

Contractor shall give the details of their representatives and vehicle driver such as name, copy of driving license,

contact phone numbers etc. to the consignor at the time of reporting the vehicle for loading consignments.

4.6 ठेकेदार या उसके प्रानधकृत प्रनतनिनध को कंसाइमंेंट िोनडंग के समय अनिवायग रूप से उपनस्थनत रहिा होगा और कंसाइमेंट सपुदुग करते समय एयर वे

नबि (एडब्ल्यबूी)/ बुनकंग रसीद इत्यानद देिा होगा और नदिांक, सामग्री का नववरण, आयति भार तथा पैकेज की संख्या का स्पष्ट रूप से उ्िेि

करिा होगा।

The Contractor or his authorized representative shall invariably be present during the process of loading the

consignments and shall submit Air Way Bill (AWB)/Booking receipts etc. on handing over of the consignments and

clearly indicate date, Goods description, weight volume and number of packages.

4.7 ठेकेदार एयरपोटग में नवमािि नवभाग, सुरक्षा नवभाग और अन्य ऐजेनन्सयों से मंजरूी प्राप्त करिे के निए नजम्मेदार होगा और सनुिनित करेगा नक

कंसाइमंेंट नबिा नकसी अवरोध सरिता से पह चँ जाए।

The Contractor is responsible for taking clearance from Aviation department, Security department, and other

agencies in Airport and ensure easy dispatch of the consignments without any hindrances.

4.8 महत्वपणूग कंसाइिंमेंट के निए जहां भी कंसाइिी/कंसाइिर प्रनतनियकु्त और एस्कॉटग रििा चाहता ह,ै उसे तदिसुार अिमुनत प्रदाि की जाएगी।

Wherever Consignee/Consignor intents to depute and escort for important consignments, he shall be allowed

accordingly.

4.9 पररवहि की गई सामनग्रया ँपारगमि काि के 24 से 48 घटंों के भीतर उनचत समय में गंतव्य स्थिों पर पह चँ जािी चानहए। तथानप, प्रत्येक कायग

आदेश में कंसाइमंेंट पे्रषण के निए निधागररत समय/अवनध की सचूिा अिग से दी जाएगी। सामान्य पररनस्थनतयों में कंसाइमंेंट साप्तानहक कायगनदवसों

के दौराि सोमवार से शकु्रवार 0900 बजे से 1800 बजे के बीच गंतव्य स्थिों पर प्राप्त नकया जाएगा। ठेकेदार को कंसाइिी/कंसाइिर को पवूग सचूिा

देिे की व्यवस्था करिी होगी।

The materials transported should be delivered to the destinations within a reasonable time of 24 to 48 hours of transit

period. However, the specified time/duration for delivery of the consignments shall be intimated separately in each

Work Order. Under normal circumstances the Consignments will be received at destinations only during the Week

Days from Monday through Friday between 0900 hrs to 1800 hrs. The Contractor shall make arrangements to

intimate the consignee/consignor well in advance.

4.10 यनद ठेकेदार निधागररत समय के अंदर कंसाइमंेंट प्रेनषत िहीं कर पाता ह,ै तो सैक ठेकेदार से प्रत्येक 12 घंटे की देरी पर पररवानहत सामाि के मू् य के

0.5% के समतु्य पर या सामाि के मू् य के अनधकतम 10% के भाग के रूप में जमुागिा वसिू करिे का अनधकार सरुनक्षत रिता ह।ै

If the Contractor fails to deliver the consignments within the stipulated time, SAC reserves the right to recover from

the Contractor as penalty a sum equivalent to HALF PERCENT (0.5%) of the value of goods transported for every

twelve hours of delay or part thereof, subject to a maximum of 10% of the value of goods.

4.11 कंसाइमंेंट की सिुक्षा Safety of consignments:

4.11.1 ठेकेदार को पररवहि के निए सौंपी गई सामग्री/उपकरण सामान्यत: उच्च मू् य, पररष्ट्कृत तथा राष्ट्रीय महत्व की समयबद्ध पररयोजिाओ ंके निए

अनभप्रेत होते हैं। ठेकेदार अत्यनधक सावधािी के साथ कंसाइमंेंट के सरुनक्षत पररवहि के निए नजम्मेदार होगा।

The material/equipment entrusted for transportation to the contractor are normally high value, sophisticated and

intended for time bound projects of National importance. The Contractor shall be responsible for safe transportation

of the consignment with utmost care.

4.11.2 चूँनक हमारा कंसाइमंेंट अनत संवेदिशीि और उच्च मू् य वािी वस्तुएं है, अतः हमारी मंजरूी/अिमुनत के नबिा स्टैनकंग/एक्स रे स्कैनिंग/जाँच करिे

की अिमुनत िहीं ह।ै हािांनक, ठेकेदार पैनकंग से पवूग कंसाइमेंट का निरीक्षण करेगा और पैनकंग अिबंुध अनधकाररयों एवं नवमािि कनमगयों की

उपनस्थनत में की जाएगी, नजिकी व्यवस्था ठेकेदार द्वारा नबिा नकसी अनतररक्त शु् क की जाएगी। ऐसी व्यवस्था करिे के निए सैक द्वारा इस संबंध में

अनग्रम सचूिा दी जाएगी।

Since our consignments are very sensitive and high value items, stacking/x-ray scanning/testing is not allowed

without our clearance/permission. However, contractor shall inspect the consignments before packing and packing

shall be done in the presence of contract officials and Avionics personnel which will be arranged by the contractor,

without any extra charges. Advance intimation in this regard shall be given by SAC for making such arrangements.

4.11.3 पररवहि/नडस्पैच के निए सौंपे गए सामाि िोनडंग पॉइटं छोड़िे से पवूग वेनजंग इत्यानद के साथ समनुचत रूप से बंधा और नतरपाि से अच्छी तरह

ढका होिा चानहए तथा वाहक द्वारा रास्ते में कंसाइमंेंट की सरुक्षा के निए सभी सावधानियाँ बरतिी होगी।

Goods entrusted for transportation/despatch shall be transported properly covered with tarpaulin, with proper lashing,

wedging etc., before leaving the loading point and to take all precautions to protect the consignment en-route by the

Carrier.

4.12 कंसाइमंेंट का मू् य बह त अनधक है और इसके मू् य का आकिि घोषणा िहीं की जा सकती ह।ै

The value of the consignments are very high and cannot be assessed/declared.

4.13 माि केवि ठेकेदार के जोनिम पर भेजा जाएगा। रान्सपोटेशि/ हैंडनिंग के दौराि कंसाइमंेंट को ह ए िकुसाि और क्षनत की क्षनतपनूतग ठेकेदार द्वारा

सैक/इसरो को की जाएगी। उठाईगीरी, चोरी, क्षनत और माि की गैर-नडिीवरी के िकुसाि के निए ठेकेदार उत्तरदायी होगा।

The goods shall be dispatched at contractor’s risk only. Any loss or damage caused to the consignment during

transportation/handling shall be compensated by the contractor to SAC/ISRO. The contractor shall be liable for

damages towards pilferage, theft, damage and non-delivery of consignments.

4.14 जोनिम िरीद: यनद ठेकेदार ऊपर बताए अिसुार कायग करिे में नवफि होता है तो सैक, अहमदाबाद के पास नकसी भी अन्य कूररयर सेवा/रांसपोटगर

के माध्यम से पररवहि कायग करािे का अनधकार सरुनक्षत ह ैयनद ठेकेदार इस अिबंुध के अंतगगत कायगरत होता तो इस संबंध में ठेकेदार को नदए जािे

वािे शु् क से ऊपर और अनधक होिे वािा व्यय नकसी अवसर के प्रनत पक्षपात ि करते ह ए, ठेकेदार से वसिू नकया जाएगा।

Risk Purchase: If the Contractor fails to carry out the job as mentioned above, SAC, Ahmedabad reserves the right to

get transportation work carried out through any other courier services/transporters at the risk and cost of the

Contractor and any other expenditure that may be incurred in this connection over and above what would have been

payable to the Contractor, had the Contractor been engaged under the terms of this contract, shall be recovered from

the Contractor without prejudice to any opportunity, the cost in addition to the freight.

4.15 संपकग नबंद ुके रूप में अहमदाबाद नस्थत संपकग कायागिय/संपकग व्यनक्त/फोि.िं. उपिब्लध कराए जाएँ।

Contact Office/Contact person/Ph. No. should be available as Focal point at Ahmedabad for communication.

5. मूलर्ांकि प्रशिर्ा Evaluation Criteria:

इस निनवदा के निए अहगता हतेु, मू् यांकि के निए प्रस्ताव के साथ निम्िनिनित दस्तावेज प्रस्तुत नकए जाएँ।

In order to qualify for this tender, the following documents should be submitted along with offer for evaluation.

5.1 पत्र-व्यवहार के निए अहमदाबाद में ठेकेदार का पंजीकृत/शािा कायागिय होिा चानहए। प्रानधकृत व्यनक्त/ संपकग िं. के साथ कायागिय पता के

नववरण के साथ उपिब्लध होिा चानहए।

The contractor should have a registered/branch office in Ahmedabad for communication. Details of office

address along with contact of authorized person/contact no. shall be provided.

5.2 फमग/ ऐजेंसी का वैध स्थापिा पंजीकरण प्रमाणपत्र ।

Valid establishment Registration certificate of the firm/agency.

5.3 फमग/ ऐजेंसी का जीएसटी पंजीकरण प्रमाणपत्र।

GST Registration certificate of the firm/agency.

5.4 ठेकेदार द्वारा कम से कम एक वषग के निए समाि संनवदा(ओ)ं के संपादि का अिुभव होिा चानहए। संनवदाओ/ं कायग आदेशों/ कायग पणूगता प्रमाणपत्र

की प्रनतयाँ संिग्ि की जाएगी।

The contractor should have experience of executing similar contract(s) for at least one year. Copies of contracts

/work orders /work completion certificates shall be enclosed.

6. सशंिदा प्रदाि कििा Award of Contract:

सैक को एक से अनधक ठेकेदारों को ठेका प्रदाि करिे का अनधकार ह।ै यनद एक से अनधक प्रस्ताव प्राप्त होते हैं, तो आवश्यक सेवाएँ सैक के

निणगयािुसार अहग सेवा प्रदाताओ ंमें नवतररत की जाएँगी। प्रत्येक िाइि आइटम कोड के निए अहग बोिीकताग(ओ)ं द्वारा दी गई न्यिूतम बोिी

न्यिूतम प्रस्ताव मािा जाएगा और अन्य सभी अहग बोिीकतागओ ंको प्रनत-प्रस्ताव देकर न्यिूतम दरें देिे के निए कहा जाएगा। ठेकेदार द्वारा प्रनत-

प्रस्ताव की स्वीकृनत प्रत्येक वगग के सभी िाइि आइटम के निए होगी। प्रनत-प्रस्ताव की आंनशक/सशतग स्वीकृनत को निरस्त कर नदया जाएगा।

SAC reserves the right to award the contract to multiple contractors. If more than one offer is received, the required

services shall be divided among the qualified service providers as decided by SAC. The lowest rates offered for each

line item by the qualified bidder(s) shall be treated as Lowest offer and the same shall be counter offered to all other

qualified bidders asking to match the Lowest rates. The acceptance of the counter offer by the contractor should be

for all the line items for each category. Partial/conditional acceptance of counter offer shall be liable for rejection.

SAC reserves the right to split the order/modify the apportionment from time to time on the eligible participating

parties based on the approved L1 rates.

7. भुगर्ताि िर्तें /Payment Terms:

7.1 कंसाइमेंट के नवनमतीय/वास्तनवक भार, जो भी अनधक हो के आधार पर, स्वीकृत दरों के अिसुार भगुताि नकया जाएगा। नवनमतीय भार की गणिा

निम्िािसुार की जाएगी।

Payment will be made as per the agreed rates, on the dimensional/actual weight of the consignments, whichever is

higher. The dimensional weight will be calculated as below.

नवनमतीय भार की गणिा हतेु सूत्र: (िंबाई X चौड़ाई X ऊँचाई) से.मी. में / 5000

7.2 सामग्री के नववरण और आवश्यक वाहिों के नववरण दशागते ह ए कंसाइिर द्वारा पररवहि हतेु जारी निदेश, कंसाइमंेंट अच्छी नस्थनत में प्राप्त करिे के

बाद कंसाइिी के प्रानधकृत अनधकारी द्वारा नवनधवत प्रनतहस्ताक्षररत पावती जैसे नवनधवत प्रनत हस्ताक्षररत दस्तावेज आपके नबि के साथ िगाकर

प्राप्त करिे के 30 नदि के भीतर भगुताि जारी नकया जाएगा। कंसाइिी से प्राप्त पावती में प्राप्त कंसाइमंेंट का वजि और रनजस्रेशि िंबर के साथ उस

वाहि का प्रकार भी नििा हो नजससे कंसाइमंेंट भेजा गया। िागू आयकर आपके नबि से काट निया जाएगा।

Payment shall be arranged within 30 days from the date of receipt of your bills duly supported by all relevant

documents such as instructions for transportation issued by the consignor indicating details of materials and type of

vehicles required, acknowledgement obtained from the consignee duly counter signed by the authorized officer for

having received the consignment in good condition. The acknowledgement obtained from the consignee shall also

indicate the weight of the consignment received and type of vehicle with registration number through which the

consignment delivered. Income tax applicable shall be deducted from your bill.

7.3 समय-समय पर िागू कर एवं ड्यटूी का अिग से भगुताि नकया जाएगा।

Taxes & Duties shall be paid extra as applicable from time to time.

8. बीमा : हमारे कोई भी कंसाइमंेंट का बीमा ि नकया जाए जब तक ऐसा करिे के निए ि कहा जाए और बीमा शु् क के निए कोई अनतररक्त

भगुताि का दावा या प्रनतपनूतग िहीं की जाएगी।

Insurance: None of our consignments shall be insured unless otherwise asked to do so and no additional payment

shall be claimed or reimbursed towards insurance charges.

9. समापि र्ा सशंिदा का अलपकाशलक समापि: नवभाग के पास संनवदा की अवनध के दौराि एक महीिे का िोनटस देकर नबिा कोई कारण

बताए नकसी भी समय संनवदा का समापि या अ्पकानिक समापि का अनधकार सरुनक्षत ह।ै

Termination or Short closing of Contract: The Dept. reserves the right to terminate or Short close the contract at

any time during the period of the contract without assigning any reason whatsoever by giving ONE M0ONTH’S

notice.

10. समािांर्ति/ र्तदर्य सशंिदा: सैक/इसरो के पास उक्त और समाि सेवाओ ं को प्राप्त करिे के निए संनवदा की अवनध दौराि एक से अनधक

आपनूतगकतागओ ंको समािांतर/ तदथग संनवदा करिे का अनधकार सरुनक्षत ह।ै

Parallel / Adhoc Contract: SAC/ISRO reserves the right to enter into parallel / Adhoc contract(s) with one or more

suppliers during the currency of the contract for availing the same or similar service.

11. संनवदा के नियमों के अिसुार नकसी भी नस्थनत में कायग के दौराि दघुगटिा के कारण कनमगयों को चोटग्रस्तता और उपकरणों/वाहिों को ह ए िकुसाि

की क्षनतपनूतग के भगुताि के निए सैक उत्तरदायी िहीं होगा।

SAC shall not be responsible for payment of compensation to the persons for injuries or for damages of the vehicle

involved in accidents while carrying out the works as per the terms of the contract under any circumstances.

12. केवि संनवदा प्रदाि करिे से आपको नवभाग से समग्र कायग प्राप्त करिे का अनधकार िहीं नमि जाता ह।ै

Mere awarding of the contract does not entitle you to demand the full scope of work from the Department.

13. सशंिदा का उप ठेकेदाि: ठेकेदार को सैक, अहमदाबाद पवूग में निनित अिुमोदि निए नबिा नकसी अन्य फमग को नकसी भाग के रूप में या संनवदा

को उप-ठेका, स्थािांतरण या सौंपा िहीं सकेगा।

Subletting of Contract: The Contractor shall not sublet, transfer or assign the contract or any part thereof to any

other firm without the prior written approval of SAC, Ahmedabad.

14. अनिवायग बाध्यता : यनद अिबंुध की निरंतरता के दौराि नकसी भी समय अिबंुध के तहत नकसी भी दानयत्व के नकसी भी पक्ष द्वारा परेू या कुछ

नहस्सों का निष्ट्पादि करिे में नकसी भी यदु्ध, शत्रतुा, सावगजनिक शत्र ुके कृत्यों, गहृयदु्ध, तोड़-फोड़, आगजिी, बाढ, नवस्फोट, महामारी, संगरोध,

प्रनतबंध, हड़ताि, िॉकआउट या दैवीय कृत्य (इसमें इसके पिात घटिा कहा जाएगा) की वजह से रुकावट अथवा देरी होती ह,ै तो दोिों में से

नकसी भी पक्ष को इस घटिा के आधार पर अिबंुध को समाप्त करिे का अनधकार िहीं होगा और नकसी भी पक्ष को दसूरे पक्ष के समक्ष इस गैर-

निष्ट्पादि या निष्ट्पादि में देरी की वजह से िकुसाि के निए कोई दावा करिे का अनधकार भी िहीं होगा, बशते इस तरह की घटिा के होिे की सचूिा

दस्तावेज के साथ नवनधवत प्रमानणत कर एक पक्ष द्वारा दसूरे पक्ष को घटिा की तारीि से 48 घंटों के भीतर दी गई हो।

Force Majeure: If any time, during the currency of this contract the performance in whole or in part by either party

or any obligation under this contract shall be prevented or delayed by reason of any war, hostility, acts of the public

enemy, civil commotions, sabotage, fire, flood, explosions, epidemics, quarantine, restrictions, strikes, lockouts or

act of God (hereinafter referred to as events) then provided notice of the happening of any such event is given by

either party to the other within 48 hours from the date of occurrence thereof neither party shall by reasons of such

event, be entitled to terminate this contract nor shall either party have a claim for damages against the other in respect

of such non-performance or delay in performance.

15. मूलर् परििर्तयि खंड : ठेकेदार द्वारा इस अिबंुध के अंतगगत उद्धतृ दर/शु् क इस अिबंुध की अवनध के दौराि नकसी भी नस्थनत में उसके द्वारा अन्य

नकसी फमग/पक्ष के साथ नकए गए समाि अिबंुध की न्यूितम दरों से अनधक िहीं होिा चानहए। उक्त अिबंुध की अवनध के दौराि, यनद ठेकेदार अन्य

नकसी व्यनक्त/ संस्थाि/ फमग के निए दर/शु् क घटाता ह ैजो नवभाग द्वारा नदए जा रह ेशु् क से कम ह,ै तो ठेकेदार इस तरह की कटौती की सचूिा

सैक, अहमदाबाद को देगा। अिबंुध के तहत देय मू् य/शु् क ऐसी कटौती िागू होिे की नतनथ से घट जाएँगे।

Fall Clause: The rates/charges quoted by the Contractor under this contract shall not in any event, exceed the lowest

charges for the similar contract entered into by the Contractor with any other firm/party during the currency of the

said contract. During the said period of the Contract, if the Contractor reduces the charges/prices to any other

persons/organizations/firm at a charge lower than the amount payable by the Department, the Contractor shall

forthwith notify such reduction to SAC, Ahmedabad. The prices/charges payable under the contract shall stand

correspondingly reduced from the date of coming into force of such reduction.

16. मध्र्स्र्र्ता : इस समझौते/ अिबंुध के अंतगगत सभी नववाद, मतभेद, दावों और मांगों को निदेशक, अंतररक्ष उपयोग कें द्र, अहमदाबाद द्वारा नियकु्त

एकि मध्यस्थ को संदनभगत नकए जाएँगे। ऐसी मध्यस्थता अहमदाबाद में आयोनजत की जाएगी तथा मध्यस्थता और सुिह अनधनियम, 1996 के

अधीि एवं उसके द्वारा शानसत होगी।

Arbitration: All disputes, differences, claims and demands arising under or pursuant to or touching this

agreement/Contract shall be referred to a SOLE ARBITRATOR to be appointed by the Director, Space Applications

Centre, Ahmedabad. Such arbitration shall be held in Ahmedabad and shall be subject to and governed by the

PROVISIONS of the Arbitration and Conciliation Act 1996.

17. बर्ािा िाशि जमा (ईएमडी) : निनवदा के साथ ईएमडी के रूप में रु.2,50,000/- (रुपए दो लाख पचास हजाि मात्र) की रानश जमा की

जाएगी, जो िेिा अनधकारी, सैक के िाम नकसी भी अिुसनूचत बैंक द्वारा उनचत रानश के गैर-न्यानयक स्टैंप पेपर पर जारी नडमांड ड्राफ्ट/ बैंकर चैक/

नियत जमा रसीद या बैंक गारंटी के रूप में हो सकती ह।ै बैंक गारंटी के मामिे में, यह अंनतम निनवदा नतनथ से 45 नदि की अवनध तक वैध होिा

चानहए। सफि बोिीकताग की ईएमडी अिबंुध के नियत प्रदशगि के निए सरुक्षा जमा (ब्लयाज मकु्त) रानश प्राप्त होिे के पिात िौटा दी जाएगी।

अिबंुध की समानप्त के 30 नदि के भीतर असफि बोिीकतागओ ंकी ईएमडी िौटा दी जाएगी। यनद निनवदा की वैधता की अवनध के दौराि

निनवदाकताग/ठेकेदार अपिी निनवदा में पररवतगि करता ह,ै या उसे वापस िेता ह ैया निनवदा के संबंध में नकसी प्रकार का पररवतगि करता ह ैतो के्रता

द्वारा ईएमडी जब्लत कर िी जाएगी। पंजीकृत नवके्रता या पंजीकरण के िवीिीकरण हतेु आवेदि कर चकेु नवके्रता, कें द्रीय पीएसय/ूपीएसई/स्वायत्त

संस्थाि, सूक्ष्म एवं िघु उद्योग, केवीआईसी, राष्ट्रीय िघु उद्योग निगम आनद को ईएमडी के भगुताि से छूट दी जाती ह।ै

Earnest Money Deposit(EMD): An amount of Rs.2,50,000/- (Rupees Two Lakhs and Fifty Thousand only) to

be submitted along with the tender as EMD, in the form of demand draft/Banker’s Cheque/Fixed Deposit Receipts or

Bank Guarantee from any of the Scheduled Banks executed on non-judicial stamp paper of appropriate value, drawn

in favour of Accounts Officer, SAC. In case of bank guarantee, it shall be valid for a period of 45 days beyond the

final tender validity date. The EMD of the successful bidder shall be returned after receiving Security Deposit

(interest free) for the due performance of the contract. The EMD of the unsuccessful bidders shall be refunded within

30 days of conclusion of contract. The EMD shall be forfeited by the purchaser, if the tenderer /contractor withdraws

or amends his tender or derogates from the tender in any respect; within the period of validity of the tender.

Registered vendors or vendors who have already applied for renewal of registration, Central

PSUs/PSEs/Autonomous Bodies, Micro and Small Enterprises, KVIC, National Small Industries Corporation, etc.,

shall be exempt from the payment of EMD.

18. सिुक्षा जमा (एसडी) : सफि बोिीकताग अिबंुध रानश का 10% सरुक्षा जमा (ब्लयाज-रनहत) बैंक गारंटी के रूप में प्रस्तुत करेगा, जो सैक के िाम

नकसी भी अिसुनूचत बैंक द्वारा उनचत रानश के गैर-न्यानयक स्टैंप पेपर पर जारी होगी और क्रय आदेश/ अिबंुध की समानप्त की नतनथ के 60 नदि

बाद तक वैध होगी। एसडी के निए बैंक गारंटी का नियत प्रारूप संिग्ि ह।ै अिबंुध के संतोषजिक निष्ट्पादि के बाद निबंधि एवं शतों के अिुसार

बैंक गारंटी िौटा दी जाएगी। स्थािांतरण और हैंडनिंग प्रचािि के दौराि सैक के कंसाइमंेंट को क्षनत होिे पर सैक, अहमदाबाद क्षनतपनूतग के निए

संपणूग रानश वसिू करिे के निए स्वतंत्र ह।ै यनद हमारे कंसाइमंेंट को कोई क्षनत/िुकसाि होता ह ैतो ठेकेदार सैक को संपणूग हानि की प्रनतपनूतग करेगा।

सभी दावे अनधमान्यता के 30 नदिों के भीतर सिुझा निए जाएँगे। अिबंुध तोड़िे की नस्थनत में सरुक्षा जमा जब्लत कर िी जाएगी।

Security Deposit: The successful bidder shall submit a Security Deposit of 10% of contract value (Interest Free) in

the form of Bank Guarantee in favour of SAC for the due performance of the contract from any of the

Scheduled/Nationalized Bank executed on non-judicial stamp paper of appropriate value and shall be valid for a

period of 60 days beyond the date of the completion of the PO/Contract. The prescribed BG format for SD is

enclosed. The SD will be refunded after satisfactory execution of the contract as per terms and conditions. SAC,

Ahmedabad is at liberty to recover the entire amount of security deposit for the damage occurred to the SAC

consignments during the transportation and handling operations. In case, the loss/damages caused to our

consignments, the Contractor shall reimburse the full loss to SAC. All claims shall be settled immediately within 30

days of preferring the claim. In case of breach of contract, the Security Deposit will be forfeited.

19. लागू कािूि : इस अिबंुध की भारत सरकार के काििूों के अंतगगत व्याख्या की जाएगी और यह उसी अथग में उसी के द्वारा शानसत होगा।

Applicable Law: The contract shall be interpreted and construed and governed by the Laws of India.

20. न्र्ार् के्षत्र : इस अिबंुध के तहत नकसी भी मामिे की सिुवाई और निणगय हतेु अहमदाबाद में नस्थत न्यायािय न्यायके्षत्र होंगे।

Jurisdiction: The courts within Ahmedabad will have the jurisdiction to deal with and deciding any matter arising

out of the contract.
