1. คนตางดาวทประสงคจะทางานตองมวซา Non- Immigration

Visa (การตรวจลงตราประเภทคนอยชวคราว) ประเภท

1.1 การตดตอ หรอประกอบธรกจ หรอ การทางาน (รหส B )

1. A foreigner who wishes to apply for a work permit must

receive.

1.1 Non – Immigrant Visa (Category B)

to conduct business / to work

1.2 การอน (รหส O ) ไดแก

- สมรสกบบคคลผมสญชาต ไทย

- อปการะบคคลซงมสญชาตไทย โดยเปน บดา หรอมารดา

1.2 Non – Immigrant Visa (Category O )

- Married with Thai Spouse. *The applicant must

show the Marriage Registration.

- To aliment Thai child.**Birth Certificate is required.

2. คนตางดาวตองเปนผมความรความสามารถในงานทขอ

อนญาต / ไมเคยตองโทษจาคกในระยะความผดตาม

กฎหมายวาดวยคนเขาเมองหรอกฎหมายวาดวยการทางาน

ของคนตางดาวในระยะเวลาหนงปกอนวนขอรบใบอนญาต

2. Having knowledge, skills as stated in the application for a

Work permit / Never having been imprisoned for violations

of the Immigration Law or the Working Foreigners Act. At

least 1 year prior to the application.

ไมเปนผเจบปวยดวยโรคเรอน วณโรคในระยะอนตราย

โรคเทาชางในระยะปรากฏอาการอนเปนทรงเกยจแก

สงคม โรคตดยาเสพตดใหโทษอยางรายแรง โรคพษสรา

เรอรง และโรคซฟลสในระยะท 3

Not being insane or mentally sick, suffering from Leprosy,

Tuberculosis, Drug Addiction, Alcoholism, Elephantitus

and third stage of Syphilis.

3.หลกเกณฑการพจารณา

- นาเงนตราตางประเทศเขามาลงทนหรอใชจาย

3. Criteria for consideration

- National security

- Occupational opportunities for Thais / Tax payment

- Large amount of foreign currencies brought by foreign investors for

investment.

การกาหนดจานวนการพจารณาออกใบอนญาตทางาน

(1)ทนจดทะเบยนทชาระแลว 2 ลานบาท / 1 คน (ไมเกน 10 คน)

***คนตางดาวมคสมรสเปนคนไทยซงจดทะเบยนสมรสโดย

ถกตองตามกฎหมาย ขนาดของการลงทนลดลงกงหนง

Criteria prescribing number of Work Permits issued.

（1）The employers whose business has a registered

paid-up capital of not less than 2 million baht / 1 foreigner

**not more than ten people.

(2) เงอนไขอน ๆ

เชน นานกทองเทยวเขามาหาพนคนในรอบป

- สถานประกอบการมการจางงานคนไทยไมนอยกวาหนงรอยคน/หรอ

- สถานประกอบการชาระภาษเงนไดใหแกรฐในรอบปทผานมาไมนอย

กวา 3 ลานบาท

-Other conditions

- Paying tax avenue at least 3 million baht in previous year.

- Performing tourism business which brought at least 5,000 foreign

tourists into Thailand in the previous year.

- Employing at least 100 Thai workers.

4. อายของใบอนญาตทางาน พจารณาอนญาตให

ตามความจาเปนของงานหรอตามทขอ ทงน

ไมเกน 2 ป/ครง

4. Validity of Work Permit

A Work Permit is issued for a 2 year period and may be renewed every

two years thereafter

An Authorized official may grant a work period according to the necessity

of work but for later than 2 years.

5. การตออายใบอนญาตทางาน คนตางดาวผรบใบอนญาตทางาน หาก

ประสงคจะทางานนนตอไป ตองไปขอตออายวซาจากสานกงานตรวจคน

เขาเมองกอน แลวจงใหยนคาขอตออายใบอนญาตทางานตามแบบคาขอ

“ตท.5” โดยตองยนแบบคาขอกอนสนอายการอนญาต ทงน “ใบอนญาต

ทางานทสนอายแลวไมสามารถตออายได”

5. Work Permit Renewal

The Work Permit holder whose work permit is going to expire but wishes

to continue work as stated in the work permit. The work permit application

should be submitted before the expiry date of the work permit by means of

WP.5: AN EXPIRED WORK PERMIT CANNOT BE RENEWED

6. การเปลยนหรอเพม การทางาน สถานท และทองทในการทางาน

คนตางดาวผถอใบอนญาตทางานทยงคงทางานกบนายจาง/สถาน

ประกอบการทอนญาตไวเดม จะตองยนคาขอและไดรบอนญาต

จากนายทะเบยนกอนเทานน

6. Changing or adding work or work place or locality of work

The Work permit holder who continues to work with the same employer

and wishes to change/add work or workplace locality of work

The Work permit holder has to notify and submit documents before and has

to wait for the registrar’s approval.

7. อตราคาธรรมเนยม

(1)การยนคาขอ ฉบบละ 100 บาท

(2)ใบอนญาต

(ก)ใบอนญาตทมอายไมเกนสามเดอน ฉบบละ 750 บาท

(ข)ใบอนญาตทมอายเกนสามเดอนแตไมเกนหกเดอน

ฉบบละ 1,500 บาท

(ค)ใบอนญาตทมอายเกนหกเดอนแตไมเกนหนงป ฉบบ

ละ 3,000 บาท

7. Rate of Fee

(1) Application Form 100 Bht.

(2) A Work Permit

(a) A Work Permit not exceeding 3 months 750 Bht.

(b) Valid for 3-6 months 1500 Bht.

(c) Valid for 6 months – 1 year 3000 Bht.

8.คนตางดาวตองไมขอทางานตามพระราชกฤษฎกากาหนด

งานในอาชพและวชาชพทหามคนตางดาวทา พ.ศ. 2522

จานวน 39 อาชพ (โปรดดรายละเอยดจากเอกสาร)

8. Foreigners must not work in an occupation and

profession which prohibits a foreigner to engage as the

following (Please see the details in the paper.)

๑. ผรบใบอนญาตตองมใบอนญาตอยกบตว หรออย ณ

สถานททางานในระหวางเวลาทางานเพอแสดงตอพนกงาน

เจาหนาทหรอนายทะเบยนถาฝาฝนตองระวางโทษปรบไม

เกนหนงหมนบาท

A Work Permit holder shall carry the permit with himself/herself or

keep it at the place of work while working, ready at all times, for

presenting to the competent official or the registrar

Any permit holder who violates or fails to comply with the foregoing shall

be liable to a fine of not exceeding ten thousand Baht.

๒. ผรบใบอนญาตตองทางานตามประเภทหรอลกษณะงาน

และกบนายจาง ณ ทองทหรอสถานท และเงอนไขตามท

ไดรบอนญาต ถาฝาฝนตองระวางโทษปรบไมเกนสองหมน

บาท

A Work Permit holder shall engage and perform work only in the particular

type of work or job description, and with an employer in certain locality or

place of work under stipulated conditions as permitted. Any permit holder

who violates or fails to comply with the foregoing shall be liable to a fine of

not exceeding twenty thousand Baht.

๓. ผรบใบอนญาตตองตออายใบอนญาตกอนใบอนญาตสนอาย

หากไมยนขอตออายใบอนญาตและยงคงทางานนนตอไป ม

ความผดฐานทางานไมไดรบใบอนญาต ตองระวางโทษจาคกไม

เกนหาป หรอปรบสองพนบาทถงหนงแสนบาทหรอทงจาทงปรบ

Prior to the expiration of the permit, the permit holder shall submit an

application for the permit renewal to the registrar. Any work permit holder who

violates or fails to comply with the foregoing and still continues engaging in

the work performance as specified in the permit without permission shall be

liable to imprisonment for a term of not exceeding five years or to a fine from

two thousand to one hundred thousand Baht, or to both.

๔. ผรบใบอนญาตซงฝาฝนหรอไมปฏบตตามเงอนไข

ในการอนญาตนายทะเบยนมอานาจสงเพกถอน

ใบอนญาตได

In case it appears that a permit holder violates or fails to

comply with the conditions stated in the granted permission,

the registrar shall have the power to revoke the work permit.

ผถกดาเนนคด : คนตางดาว

1.ทางานโดยไมไดรบใบอนญาต (มาตรา 51 ) : ตองระวาง

โทษจาคกไมเกนหาป หรอปรบตงแตสองพนบาทถงหนง

แสนบาท หรอทงจาทงปรบ

Alleged offender : Foreigner

1.Working without a work permit ( Section 51 ) :

Imprisonment not exceeding five years or a fine of two

thousand Baht up to one hundred thousand Baht or both.

2.ผรบใบอนญาตทางานอนเปนการฝาฝนเงอนไขท

กาหนดไว (มาตรา 52 ) : ตองระวางโทษปรบไมเกน

สองหมนบาท

2.The holder Works in violation of conditions.

( Section 52 ) : A fine not exceeding twenty thousand

Baht.

3.ผรบใบอนญาตไมมใบอนญาตอยกบตว หรออย ณ

สถานททางานในระหวางเวลาทางาน ( มาตรา 53 ) :

ตองระวางโทษปรบไมเกนหนงหมนบาท

3.The holder fails to have a Work Permit during

working hours. ( Section : 53 ) : A fine not exceeding

ten thousand Baht.

ผถกดาเนนคด : นายจาง

1.รบผรบใบอนญาตทางานทตางจากทระบไวใน

ใบอนญาต ( มาตรา 54 ) : ตองระวางโทษปรบไมเกน

หนงหมนบาท

Alleged offender : Employer 1.Hiring A holder who

possesses qualifications different from that prescribed

in the Work Permit. ( Section 54 ) : A fine not

exceeding ten thousand Baht.

2.รบคนตางดาวทไมมใบอนญาตทางานเขาทางาน

( มาตรา 54 ) : ตองระวางโทษปรบตงแตหนงหมน

บาทถงหนงแสนบาทตอคนตางดาวทจางหนงคน

2.Employing a foreign employee who does not have a

Work Permit. ( Section 54 ) : A fine of ten thousand

Baht up to one hundred thousand Baht per one

employed foreigner.
