    As of Septembers end, there are80 activists incarcerated inBurma, with 130 activists

    currently awaiting trial forpolitical actions. Section 18 ofthe Peaceful Assembly andPeaceful Procession Actcontinues to account for a largenumber of these arrests andincarcerations.

    The following is an analysis ofmedia coverage and AAPPinformation received fromBurma, focusing on issuesregarding political prisoners, aswell as developments pertainingto civil rights and freedoms inBurma.

    In September, AAPP documented thesentencing of 11 political activists, theindictment of 13 individuals (including 2detained), and the release of 2 politicalprisoners.

    The Committee for Scrutinizing the RemainingPolitical Prisoners was again an issue inSeptember. Aung Thein, Deputy Minister in thePresidents office and Secretary of theVerification Committee for the Release ofRemaining Political Prisoners, was quoted inRFA at one point stating that the committee

    may be disbanded as there are almost noremaining political prisoners. He argued thatthose that do remain are incarcerated undercriminal offences. He also hinted at plans tocreate new linkages between the Minister ofHome Affairs and political prisoners group toset up a new committee.

    Issues surrounding media freedom alsopersisted through September. A two dayconference on media development was hostedby the Myanmar Media Development Thematic

    Working Group, UNESCO, the Ministry ofInformation, and International Media Support(an NGO) in Rangoon on September 18 and 19.At the same time, the Government has decidedto bring defamation charges against twopublications in Burma, after negotiationsthrough the Interim Press Council failed toresolve ongoing issues.

    Meanwhile, the Myanmar National HumanRights Commission (MNHRC) submitted aproposal to the government urging them to

    sign the International Economic, Social, andCultural Rights Covenant and the Civil andPolitical Rights Covenant. The currentgovernment had also promised in January ofthis year that they would sign on to the UNConvention Against Torture in September, yetno mention has been made of such a step thismonth.

    Student Activist Arbitrarily Arrested andDetained

    Phyu Hnin Htwe, a member of the All BurmaFederation of Student Unions (ABSFU), hasbeen arrested and arbitrarily detained byBurmese authorities. On September 13, she wasarrested from her home in PatheingyiTownship, Mandalay, by Lieutenant KhinMaung Oo of Pathein-Gyi Myoma PoliceStation, and immediately indicted by YinmabinTownship Court under Section 364 and 368 ofthe Penal Code (kidnapping charges).

    The charges relate to an incident occurring on

    May 18, 2014, when villagers in Letpaduangtemporarily kidnapped two Chinese staff ofthe Wanbao Company over ongoing disputesregarding the controversial mine project in thearea. Phyu Hnin Htwe was there teachinggrade eleven students, and was charged withsix other residence for the kidnapping. Thecase against five of the accused was dropped ata court hearing due to a mutual understandingbetween the Company and the governments ofChina and Burma. Phyu Hnin Htwe, along with

    her co accused Win Kyaw, were absent fromthe hearing. The authorities had not pursuedthe case until her arrest on September 13. Sinceher arrest, Phyu Hnin Htwe has had courtappearances on September 15, 23, and 30 atYinmabin Township Court. She continues to bedenied bail.

    Two Charged, One Arrested in Relationto Protests Against Student Bill

    Three individuals have been charged and onearrested in relation to protests against theNational Education Bill held on September 4 inTaungoo Township, Pegu Division. LaurentsKyaw Kyaw, (Chairman for the All BurmaFederation of Student Unions (ABSFU)), TunAung Kyaw, (ABSFU member), and Aung ThanHtay (aka Japei) have been charged underSection 18 of the Peaceful Assembly andPeaceful Procession Act, and Aung Than Htaywas also arrested around midnight onSeptember 9. As of September 10, Aung ThanHtay was still detained in No. 2 Police Stationin Taungoo Township, Pegu Division. AungHtet (Coordinator of the InformationCommittee, ABSFU), who contacted the policestation on September 10, said that the policeinformed him that Aung Than Htay wouldmost likely be released on parole if there weretwo grantors for him. Aung Than Htay waspreviously incarcerated in 2013 for six monthsunder Section 505(b) of the Penal Code.

    Environmental Activists Detained,Sentenced

    Environmental activist Tun Tun Oo wasarrested on August 29 and charged underSection 61 of the Forestry Law by a DedayeTownship forestry officer. Tun Tun Oo, alongwith others, was planting mangroves in an areadevastated by cyclone Nargis.

    On September 15, three Dedaye Townshipresidents in Irrawaddy Division were arrestedand charged under Section 18 of the PeacefulAssembly and Peaceful Procession Act inrelation to the mangrove protests. Myint Lwin,Cho Lwin, and Khin Shwe were accused ofgiving speeches in Southern Dedaye Township,beside the Kappali Sea, and were indicted byStation Commander Police Lieutenant NaingMon Tun from Kyone-Dar Police Station. Thethree had been assisting Tun Tun Oo. Theywere brought before the court on September 16for examination.

    On September 23, Tun Tun Oo was sentencedto six months imprisonment under three

    separate counts of Section 18 by Judge Ye HtutKhaung. Cho Lwin and Khin Shwe were givenfour month sentences, while Myint Lwinreceived a two month sentence. They will servetheir sentences in Pyapon Prison. Tun Tun Oostill faces charges at Dedaye TownshipsForestry Department, and was meant to appearin Dedaye Township Court on September 26.

    Four Protesters Sentenced UnderSection 18

    On April 2, 2014, four protesters, Myo Han,

    Aung Soe Thein, Htin Aung Kyaw and ToeMaung Lay, demonstrated against the Housing

    Departments confiscation of land owned byBasic Education Primary School No-16,Myingyan Township. The application toconduct a demonstration had been declinedand, as a result, the four individuals were eachcharged and convicted to two monthsimprisonment under Section 18 of the PeacefulAssembly and Peaceful Procession Act byMyingyan Township Court on September 19,2014.

    Sein Than Receives Multiple Sentences

    Sein Than, organizer of the MichaungkanProtest Camp, received two additionalsentences in September. On September 9,Latha Township Court sentenced him to fourmonths imprisonment with hard labor underMunicipal Act 68 for constructing the protestcamp in the City Development Committee area

    without permission. He was then sentenced tofour months imprisonment with hard labor onSeptember 10 by Kyauktada Township Courtunder Section 18 of the Peaceful Assembly andPeaceful Procession Act for an unauthorizedprotest. This is his sixth sentencing, and henow faces two years imprisonment. Theongoing protests oppose land seizure inMichaungkan, Thingangyun Township,Rangoon, where over 300 households wereevicted.

    Nay Nwe Than, Sein Thans daughter, and fourothers, have also been indicted under Section18 by Pabedan Township Court for protestingoutside of the courtroom without permission.His daughter claims that she was simplyattending his hearing out of support, as she haddone previously without issue.

    Htin Kyaw Sentenced Again

    On September 3, Htin Kyaw (leader ofMovement for Democracy Current Force

    (MDCF)) was sentenced to one year and fourmonths imprisonment by North OkkalapaTownship Court. He received a one yearsentence under Section 505(b) of the PenalCode and a four month sentence under Section18 of the Peaceful Assembly and PeacefulProcession Act. On September 11, he wassentenced to a further two years under Section505(b) by Shwe Pyi Thar Township Court.

    He has been sentenced under ten counts ofSection 505(b) and three counts of Section 18,amounting to an eleven year, four monthsentence. His charges stem from protestswhere he denounced the government duringspeeches, distributed leaflets calling on thegovernment to resign, and held a candlelightvigil through different Rangoon townships.

    Army Tortures Six Chin Farmers

    A Burmese army unit has been accused by Chin

    human rights activists of arbitrarily detainingand torturing six Chin farmers. Major Tin HtutOo of Light Infantry Battalion 344 is accused ofbeating the farmers whilst in custody, believingthem to support the Chin rebels. It is allegedthat the arrest was ordered in Kone PyinVillage on August 24. Their release came afterthey were forced to sign a statement statingthat they would not have contact with the ChinNational Front (CNF). Aung Kyaw Hla, one ofthe villagers tortured, went to Bangkok with

    Chin human rights workers in order to receivetreatment for neck injuries sustained duringhis detention.

    On September 19, the six individuals werecalled into Light Infantry Battalion 344s base,where they were detained. They were againforced to sign a document, this one stating thatthey would retract what they had previouslysaid about their detention and torture. ChinNGOs are now helping them to file an officialcomplaint with the Burma Army.

    Prison Sentence of Win Cho and Wai LuReduced

    On September 18, Rangoons Peoples SupportNetwork member Wai Lu and land activist WinCho had one month deducted from their threemonth sentences. They were originally

    sentenced on August 25 as a result of ademonstration against the plan to raise the costof electricity. Their lawyer, Robert San Aung,claims the reduction is meant to allow Win Choto attend a religious ceremony planned for hisdaughter on October 25, 2014. This is the firsttime that any individuals who have appealed

    Section 18 of the Peaceful Assembly

    and Peaceful Procession Act have hadtheir sentences reduced.

    Government Brings Defamation ChargesAgainst Two PublicationsThe Ministry of Information plans to take legalaction against two media publicationsfollowing the breakdown of negotiations whichhad been mediated by the Myanmar InterimPress Council. Letters of complaint were sentto the council by the ministry regarding twoarticles they considered defamatory. The first(published in the Myanmar Herald) talkedabout President Thein Sein; and the second(published in the Daily Eleven) accused the

    Ministry of Information of misusing funds inthe purchasing of a printing press. Ye Htut (theMinister of Information and the presidentialspokesman) stated that taking legal action wasdue to the media publications refusing to writeretractions. It is unclear whether they will becriminal or civil cases.

    Monks Lodge High Court AppealAshin Uttara, a Burmese monk who wasarrested and disrobed in June and also hascitizenship in the UK, along with four clerics,lodged an appeal at Rangoon High Court onSeptember 22. They are charged withdefaming religion and insubordination of the

    state monastic council. The monks deem thelatter charge, which was brought againstthem by Rangoons Religious AffairsDepartment, to be baseless, and havetherefore challenged it in the high court.(23 September 2014 - DVB)

    Peace Day MarchesSeptember 21 was International Peace Day,which saw members of youth networks from6 districts in Irrawaddy gather to recite

    poems, march and chant in recognition ofthe event. Three among more than 200members of the Irrawaddy Division YouthNetwork were indicted under Section 18 ofthe Peaceful Assembly and PeacefulProcession Act at Ahthe-Gyi Police Station,with the Township Police Chief acting asprosecutor. Those involved in the peace daymarches were denied permission to carry outthe demonstration.

    Magwe Protestors Charged withTrespassing

    On September 18, eleven members of theNLD and 88 Generation for Peace and OpenSociety were officially charged withtrespassing. On June 9 2014, NLDs Nay MyoKyaw, Than Aung, Than Naing, Chit Htwe,Ye Tint and Soe Moe; and 88GPOSs HlaSan, Muang Muang Soe, Than Tun Aung,Nyo Aye and Tun Khine Oo held a rallycalling for Article 436 of the Constitution tobe revised. They were summoned to MagwePolice Station and charged under Section 447

    of the Penal Code for trespassing, due to theprotest being held on the grounds of AyeZedi Pagoda. They were informed of thepending charges in July, but they were notformally processed until this month.

    LAND ISSUES

    Last SEZ Resident Faces TrespassingCharges

    Kyaw Win, the last resident of phase one areaof the Thilawa Special Economic Zone, hasbeen charged under Section 447 of theBurmese Penal Code for trespassing in thearea. He, along with his wife and two children,were held at Thanlyin Prison brieflyon September 26 before being released onbail. People who were living on the land havebeen moved to another area. He acceptedinitial compensation from the government,which was almost 5.5 million kyat, but refused

    to accept the rest of the compensation afterfinding out that it was not enough to build anew house for his family and buy land to grazehis cows.

    More Kanbalu Farmers Sentenced

    Twenty one more farmers from KanbaluTownship have been convicted with sentences

    ranging from three months to four years. Thefarmers from Mya Mon Village wereprosecuted on August 20, 2014. One of theindividuals sentenced is said to have passedaway six years ago.

    Farmers from Kanbalu involved in land-confiscation cases also say that costs associatedwith trial and incarceration are furtherindebting them. 173 farmers have beeninvolved in litigation, with 57 incarcerated inJuly in addition to the 21 sentenced in August.

    Villagers have expressed frustration about thedifficulty of visiting family members, as thefarmers have moved prisons and travel isexpensive.

    AAPP and FPPS have written Obama, as well asother world leaders, to ask them to raise theissue of the Burmese governments failure torelease all political prisoners in the nextASEAN meeting. Thet Oo (FFPS spokesperson)stated that international leaders cannotoverlook those who are being incarcerated aspolitical prisoners, especially as thegovernment refuses to cooperate with localorganizations working towards the release ofprisoners.

    Force

    The Asian Legal Resource Centre, an NGO withconsultative status with the UN, issued severalnotices to the UN about rights abuses in Asia,one of which was about the continued use oftorture in the Burmese Police Force. It read,The practice of police torture in Burmaremains unchanged despite the efforts andwork of countless individuals across the globe.

    Human Rights Groups Petition EU toPressure Thein Sein

    A letter sent ahead of President Thein Seinsvisit to Europe urged the EU to show itssupport for human rights in Burma by creatinga new resolution regarding Burma. The letterwas signed by Amnesty International, TheInternational Federation for Human Rights,and The Alternative ASEAN Network on

    Burma. At one point the letter draws attentionto the ongoing situation of political prisonersin Burma: President Thein Sein failed to keephis promise to release all prisoners ofconscience by the end of 2013. So far in 2014,scores of human rights defenders, politicalactivists and farmers have been arrested orimprisoned simply for the peaceful exercise oftheir human rights; at least 70 politicalprisoners including prisoners of conscience remain behind bars.

    Media Personnel Receive Awards

    The five Unity Journal employees incarceratedin July have been awarded honorary

    citizenship by an Italian town. The official

    letter of nomination for the award wasdelivered to the groups lawyer on August 26.The awardees include journalists Paing ThetKyaw Si Thu, Thae Yar Zar, Lu Maw Naing andCEO Tint San. The award ceremony is set to beheld in December, 2014, Rangoon.

    Aung Zaw, founding editor-in-chief of theIrrawaddy, also received the Committee toProtect Journalists 2014 International PressFreedom Award, recognizing courageousreporting.

    Most disconcerting is the governmentscontinued reliance upon Section 18 of thePeaceful Assembly and PeacefulProcession Act as a means to indict andimprison political opponents. Thismonth, an additional ten people weresentenced under Section 18, while twelvewere charged under the broadly appliedlaw. It should be strongly noted that one

    of those twelve was a solo protester,despite the fact that the law explicitlyapplies only to groups of more than oneperson. This clearly exemplifies thecurrent governments disregard for therule of law when in pursuit of their ownpolitical objectives.

    Similarly, the ongoing arbitrary detentionof Phyu Hnin Htwe over baseless chargesstemming from an incident in May isanother example of this blatant disregard

    for international norms regarding anindividuals basic rights to a fair trial. Shewas held incommunicado for the first twodays of her detention, and has remainedin detention without any legitimateexplanation as to why she has not beengranted bail.

    On January 16, 2014, Deputy Minister ofForeign Affairs Thant Kyaw stated thatBurma would sign on to the UNConvention against Torture (UNCAT) at

    the UN General Assembly (UNGA) inSeptember. As of writing, the conventionis yet to be signed on to, and no indicationhas been given that the Burmesedelegation plans to sign on; Minister of

    Foreign Affairs Wunna Maung Lwin, headof the delegation, made no mention of itin his statement to the UNGA.

    The ongoing difficulties of the Committeefor Scrutinizing the Remaining PoliticalPrisoners are reflected in the everincreasing numbers of arrests andimprisonments. Yet there is little pressureon the government to improve the

    process. There has been little to nocooperation from the government sideand 2014 has seen the Committee processgrind almost to a halt. This directlycontradicts the fact that nine people weresentenced this month under Section 18,as mentioned above. This illustrates thefissure between the rhetoric employed bythe government and the actual state ofaffairs within Burma regarding politicalprisoners. If the Committee ends in its

    being disbanded, the questions will stillremain regarding, what, if anything, willreplace it. Without such a processpolitical prisoner issues are always indanger of falling from government andinternational agendas altogether.

    AAPP urges the government to fulfill theircommitment to signing on to UNCAT, aswell as President Thein Seins promise toensure the release of all political prisonersin Burma.
