Tom noted that up until this time NSU has been using the ENGL or IDL prefix for the English as Second Language or Intensive English programs and recently NSU has had a group redesigning a curriculum for English programs for Academic Purposes (EAP). The curriculum is broken into pre-beginner, beginner, intermediate, and advanced with some associate courses included in there as well. Chuck mentioned USD likes the steps NSU has taken and is considering changes in their program for the future. Sam encouraged everyone to review what they are doing on campus in regard to their ESL program because the better the outcomes are defined, the more easily the programs can be defended if the federal government asks questions.

104/L Foundations of (Biology) (Chemistry) (Earth Sciences) (Physics) for Educators. Chuck noted these are courses proposed to meet the requirements of students pursuing elementary education. At USD students were taking one semester of General Biology with lab and then only one semester of another course but they really need a broader survey of the sciences to prepare them to teach at the elementary level. Chuck stated the series was a cooperative venture between the science chairs and the Education School to meet those needs in a more compact format. Sam noted that if this series is approved by the Board, other campuses with Elementary Education programs may want to look into this. Sam stated while we typically limit when Gen Ed courses go to the Board to the December meeting, this is a unique set of courses that will warrant Board discussion and so it is his intent to take these forward this spring for consideration by the Board. Sam will discuss this further with Dr. Warner.

NSU is requesting that EAP: English for Academic Purposes be added to the list of approved prefixes. This proposal was discussed earlier when Tom provided a broad overview of the changes NSU was implementing to its ESL program. Tom noted that the attached memo does a good job of laying out the program. Laurie asked whether other institutions will be expected to change to a common prefix. Sam stated that Council Members should make others on campus aware of this proposal from NSU and have discussions about implementing this option. However, he quickly added that there are no expectations that others change.

Black Hills State University has submitted requests to establish agreements with the following institutions to be considered by the Board at the April 2013 meeting.

Konkuk University (KU), Seoul, Korea Western Dakota Technical Institute (WDT)

Sam noted that the proposed articulation with Western Dakota Technical Institute (WDT) agreement serves as an umbrella option for a range of program associated to the Applied Sciences programs offered by WDT. Sam mentioned as an operational note, for the last calendar year Western Dakota Technical Institute was not transcripting transfer courses with a “T” and that has led to some confusion. Sam has received assurances that WDT will once again follow the agreed upon process.

b. SDSM&T South Dakota School of Mines and Technology has submitted requests to establish agreements with the following institutions to be considered by the Board at the April 2013 meeting.

As the discussion of these proposed agreements wrapped up, Sam noted there are tens of agreements that the Board has approved between the system’s institutions and international institutions and some of these are clearly not being used. Sam suggested that institutions go through the set of approved agreements and make of list of the ones that are inactive and consider proposing that they formally be terminated.

B. Smarter Balanced Implementation Update Katie noted that in late September the draft of the Achievement Level Descriptors was sent out for review. The ALDs were created to define what it means for students to be “college ready” in their ability to complete a particular skill or set of skills that aligns with the Common Core State Standards. With the help of each campus’ there were several meetings held across the state between higher

education faculty and K-12 teachers to review the draft ALDs and gather feedback. Katie stated that comments from these meetings was forwarded to the Board office and that these were summarized into a report that was submitted by Dr. Warner and Dr. Schopp to Smarter Balanced for their consideration. The ALDs will be re-released in early February and those will be circulated to the implementation team for further review and feedback. Sam noted that the discussions that were coordinated between K-12 and the institutions were very well received and it is something that K-12 would like to continue to see happen. Sam mentioned that participants thought that the most valuable part was the chance to come together to have a detailed discussion on student expectations. In addition, Sam noted that the staff of Smarter Balanced stated they were grateful for the summary and additional discussion details from SD. Sam noted the more difficult part of this process is coming up; when the cut scores will be set. Items are being developed and the piloting process will begin this spring with ‘score data’ that will become available. In the near term, there will be opportunity for the implementation team to get involved in setting score ranges for the various levels of performance. Sam stated that moving forward there are two things that will be interesting. First, the funding for both SB and PARCC will end in September 30th, 2014 and there are no plans for continuation beyond that so the states are figuring out what this will be mean. States with bi-annual budgets will have to start building funding into their budget immediately. Secondly, Sam noted when this process started initially there was language from SB and PARCC that the results of these assessments would be used to determine college-readiness. There will be some re-shaping of this message with clearer understanding that this will be one of a few data points that will be used to determine whether a student is ready to enroll in credit-bearing courses in ELA or in math. Laurie asked how the SD Virtual High School is doing. Sam noted it is effectively fulfilling its primary purpose which is to offer credit recovery programming. It’s an option for students who failed a core course to demonstrate mastery at some sub-set of the material in that course. Tom mentioned that students have to register through the virtual school if they want to take the system’s e-learning courses or be involved in the AP program as well now. Tom noted that there are more providers from out of state that are looking for a profit from credit recovery in South Dakota and he is not sure there is any profit to be made by that.

C. System Conference on Academic Quality Sam noted this is an update on planning for the conference but this group has been copied in communications with the planning group. Dates have been set and the group is working on confirming Cedar Shore as the meeting site. There will be an opportunity for each of the institutions to frame an issue or item that is addressed on campus for discussion with Peter Ewell, a Vice President with the National Center for Higher Education Management Systems. Sam stated that as discussions have unfolded the people involved have noted that this needs to be a conference for faculty and faculty need to be the primary participants from the campuses. The operating assumption will be to have about 10-15 representatives per campus. Sam mentioned that as

Council Members discuss this on campus they need to notethis expectation. In addition, he asked the group to freely share comments and concerns with your campus representatives or to contact either Sam or Katie an email.

D. Photo Sharing Sam noted that TAC received a request to incorporate student photos into other regental information systems. As we know student photos are already in the card ID system but the thought is to include these in other administrative systems that are maintained. Dr. Shekleton has offered some observation that this idea should be closely considered. Sam stated he was asked to bring the item to AAC to see if there are any comments or concerns. Sam noted there are those individuals who deal with students who believe that having a student’s image as part of the Student Information System would be helpful and make processes easier. Laurie noted that SDSU receives this request from advisors all the time and she believes it is really helpful for them. Sam mentioned that the downside of this is security because students do need the ability to exclude their photo since it gets down to FERPA with the expectation that those viewing have abonafide right to know. Sam noted he will let Janice and Monte know the members who spoke to this issue expressed support for the idea and encouraged everyone to have discussion with their SAC representatives on campus.

E. Complete College America Remediation Proposals Sam noted as AAC is aware there have been proposals funded to implement remediation programs and those individuals who proposed the projects have been notified that these have been approved. At this point in time, campuses should be in the implementation stages. In future months, the Board office will be asking for update on the progress of these proposals. Sam stated this project was set up as a reimbursement coming process. Laurie asked if institutions should set up individual indexes for these and let Sam know the balanced when the implementation is complete. Sam responded that institutions can request a quarterly reimbursement and he will go back to the informational email he sent out and re-send to the campuses. Sam noted the discussion from the CCA annual convening in December included conversations about structured pathways to college credentials. It is the idea that institutions should be providing more structure for incoming students. In some ways this aligns with the discussions AAC has been having regarding the Admissions form about establishing a career interest area. Sam noted that rather than letting students wonder freely through the first two years before they enter courses in their major, there is a lot of discussion about giving students sets of options or even only one more limited option to help them move along. There is a reference to a recent publication from Jobs for the Future in the item that Sam encouraged AAC to look at. Mary Kay noted that with Exploratory Studies Programs, SDSU is still waiting for approval on the ES codes. Sam noted that discussions continue and he believes this is close to being finalzied.

Sam noted there was a kickoff event last fall for the CCA remediation proposals and there has been discussion about having an interim statewide gathering. Sam asked members whether it would it be helpful to do something like that yet this spring (early April or mid-May) or the fall (early September) with the thought to bring together staff from all campuses to have discussions about what each is working on. Chuck Staben noted that after the semester would be better than during. Other member agreed that would be the best. Sam noted that he will start looking at possible options and send out dates for campus input.

F. Implementing Board Policy 4:34 Sam noted this item lays out a topic under discussion by RAC. As BOR Policy 4:34 is implemented, it is important to implement steps to make sure that faculty know before they go to make presentations at professional meetings or other similar at venues off campus that this could be considered a disclosure of an invention and they would need to inform people internally. Sam added that the recommendation for the travel form is that this notice be included on travel forms everywhere and if there are complaints from faculty is most likely they will be directed at council members so this is more of an awareness item for AAC. Laurie noted that the other issue dealing with the traveling form at SDSU is the international insurance that is required to be purchased when faculty take an international trip, which is a new requirement also. There are two pieces of information that are mandatory for the insurance that SDSU was not capturing so that has been integrated into state travel as well. Laurie mentioned that if you’re working on your traveling form that may be something else to be included.

G. Compliance with USDOE Requirements –Publishing Textbooks Information Sam noted this item is here because at the end of December, the system office received a complaint from a parent that textbook information was not available online far enough in advance of the start of the semester to allow students to purchase books from another source, leaving the campus bookstore as the only option.. Sam stated that most all campuses would agree the reason institutions were required by the USDOE in 2010 to provide this information was to give students options which could save them money. Chuck noted that generally students will not need the textbook information until about 10-14 days before class. That gives them sufficient time for book comparison and shipping time before the start date of class. Sam stated with the changes that have occurred in state authorization and the evaluation of consumer complaints, this item could have easily been referred to an AG’s office for resolution since it has nothing to do with academic programs. Sam encouraged all members to have the discussion on their campuses as it may be worth it to have some kind of agreement published that the information will be posted by a certain date before the start of the semester.

H. Recent USDOE Announcements –Gainful Employment Sam noted these rules have now been reestablished and, as the Council has talked about this in the past, the position being taken by the system’s Financial Aid Directors is that none of our programs in South Dakota are gainful employment programs because financial aid is not authorized for students enrolled in certificate programs. Sam mentioned that there are few programs that have been identified to the Federal Government as gainful employment programs but he encourages council members to be aware of this item. When campuses bring certificate programs online, staff should recognize that if the program calls for creating new courses that they are increasing exposure. Cecelia noted that DSU has one certificate program in Health Information Management this is eligible for gainful employment reporting because it is meets the hours requirement. Chuck mentioned USD made changes to their certificate programs so they no longer fall underthe gainful employment requirements. Sam recommended that institutions should look at the set of certificate programs being offered on their campus and decide which ones are viable because with eliminating some programs, it may limit exposure.

I. Adjuncts and Lecturers under the Affordable Care Act Barbara noted that the IRS issued proposed administrative rules on the Affordable Care Act on January 2nd and is currently accepting comments on the proposed rules through March 18, 2013. Barbara noted that is unclear what the definition of a part-time employee would be and so it is important for the BOR to work with the South Dakota Bureau of Human Resources and other agencies to help minimize the risk that we might be exposed to with employees who work part-time or less than part-time under our definition. Depending on how you read the new rules of the Affordable Care Act, those employees may become eligible for health care. Barbara mentioned she is scheduled to discuss this item with a couple agencies via webinar over the next two weeks and she has sent all information to the campus HR representatives. The rules would take effect in January 2014. Chuck noted that the proposed guidelines suggest if an employee works 75% for longer than 3 months they would be considered eligible for healthcare and so for example, an adjunct who teaches 75% time for one semester would qualify for health benefits and if the institution didn’t pay the benefits they would be fined around $2000. Therefore, Chuck stated it is important to find clarity in these guidelines because if the length is less than a semester, it can really change what population of adjunct becomes eligible for health benefits, which in turn has an associated cost factor. Chuck noted that for USD part-time or temporary instructors are the big population on campus and currently USD considers someone that is not part-time as a person who works over 50% time in a sustained manner (over 6 months) with the prospect of probable future employment.

Barbara stated that ideally BOR staff would like to submit a comment to the IRS before the mid-March cut off and engage our legislators in Washington about our concerns. Barbara noted if there are any comments or concerns moving forward with this please contact her with them.

J. Revisions to AAC Guidelines – Programmatic Changes Sam noted this item recommends some programmatic changes to the AAC Guidelines to align them with the actual practice of today. The changes will be made and posted to the SDBOR website. Sam mentioned that last fall AAC talked about making changes on the course forms so they are more user-friendly and we will be moving forward with that discussion in the upcoming AAC meetings.

Other Informational Items: Sam noted he sent a request to Daniel to update the information on numbers of gradates be major during the last 5 years to trigger this year’s review of program productivity. Sam will send the information out to AAC soon. Sam stated recently there was a DDN session with campuses on the Study Abroad guidelines and Financial Aid Directors are currently working on revised language that will make guidelines clearer. Sam will follow-up with the Financial Aid Directors to make sure this one comes to closure. Sam mentioned that last year there were significant changes with the international student fee to including an increase in price and making it an ongoing fee where the fee is charged every semester a student is registered, which include summer. In some cases, students are required to register for one course in the summer even if they are not on campus. Sam noted at the December Board meeting there was a group of international students from the SDSM&T who asked that the charging of the fee in the summer be revisited. Laurie noted that SDSU has had a lot of discussion on this topic and they would be open to removing the fee from the summer semester. Sam noted that he will send this item back to the International group for review and changes for recommendation should be sent in within the next couple months for approval. Updates from Janice: Janice noted that Starfish implementation went live in January and for the most part the functionality part of it seems to be working seamlessly. There has been some good feedback from faculty and staff who are utilizing the system. With the expectation of a couple technology questions a week from campuses the project is going as planned. The first 3rd week progress survey will be completed this week and after the surveys haven been completed the campus project teams will be doing some one-on-one and focus group discussions to ask questions such as, how easy was this, are there things that need to be changed, is there addition guidance that can be provided, does there need to be better training documentation, etc. The next progress survey will go out in the 8th week as planned. Janice stated that there are already 23 pages of flags that have been utilized in the system and that means faculty are using manual option to flag early alerts which is a positive to this product. encouraged institutions to have discussions on campus to see if the correct work flow is setup for the flagging process, meaning that does the university have the right people looking into the system and responding to those flags. Janice mentioned that the goal is to have a face-to-face meeting as a project team at the end of May to discuss all comments and concerns as well as possible updates. Janice noted she will send out an updated on the implementation of the Ellucian project. Currently, the DegreeWorks work flows and practices are moving forward and this development is scheduled to go live in January 2014.
