Rulemaking 06-03-004 (Filed March 2, 2006) ADMINISTRATIVE LAW JUDGE’S RULING SHORTENING COMMENT PERIOD ON PETITION FOR MODIFICATION BY OPEN ENERGY CORPORATION On March 1, 2007, Open Energy Corporation (Open Energy) filed a petition for modification of Decision 06-08-028 regarding solar incentives for building-integrated photovoltaic (BIPV) systems. Open Energy requests expedited treatment of its petition, claiming that BIPV suppliers are at a material disadvantage in marketing their solar products based on the current treatment of incentives for BIPV systems. Open Energy claims the sooner the Commission can act on its petition, the less likely material and perhaps permanent reductions in BIPV product usage will occur. Good cause being shown, this ruling shortens the response time for the Open Energy petition for modification from the normal 30 days to 15 days. Accordingly, IT IS RULED that responses to Open Energy Corporation’s petition for modification should be filed no later than March 16, 2007.
