GENERAL BUSINESS ITEM NUMBER 11.2 TITLE Council Services Report REFERENCE 691322
AUTHOR Nathan Mclvor, Area Manager, Central Arnhem RECOMMENDATION (a) That the Manyallaluk Local Authority receive and note the Council Service
Report for the LA meeting at Manyallaluk on 6 February 2017. BACKGROUND Council services are still working towards our weekly schedule. Council is working closely with the CDP participants in Manyallaluk, this is a strong and positive relationship. Our new Municipal Supervisor commenced in his role in December 2016 and has been learning many new things including computer work. A lot of rain has caused some washouts particularly around the office area. Work has commenced but not completed to try and stop the flow of water causing this damage. ISSUES/OPTIONS/SWOT Decision still to be made of where solar lights will go in the community. Council is waiting on the next 2 to arrive for install. Solar lights have been repaired except for the middle one, the wires have been too badly damaged and we will need an electrician to re-wire the lights. Speed bump install was completed in community. Draft MOU with Jawoyn around management of their areas in community has been completed by Jawoyn. They are keen to work with Council in areas around land management and maintenance of their park lands in the Eva area. Ben is following up on the Buffalo issue for Manyallaluk and this has also been listed in the draft MOU. Jawoyn is asking Manyallaluk residents to report buffalo sightings in community so they can action a plan to make the numbers smaller. Manyallaluk road has been graded just before the first big rains, the road has held up quite well under the circumstances. Another grade will occur just after the wet season and recap the crown of the road. Trees along the side of the road and some drain clearings occurred which helped in the overall state of the road. GENERAL BUSINESS ITEM NUMBER 11.4 TITLE Governance Report - Policy Update REFERENCE 691323

Leave Policy.
BACKGROUND The HR011 Leave Policy was approved at the last Ordinary Council Meeting on 14th December 2016. The HR011 Leave Policy was due for review in May 2015. SLT has endorsed the reviewed the policy with the following changes: 1. Policy Statement - Removal of reference to Attachment A under the Policy Statement
as this refers to the Leave Form that we do not attach to policies but reference in section 9 Related Forms.
2. Definitions – a. Child – removal of as it is confusing and the Other definitions explains to find more
definitions from National Employment Standard - “If under section 5 of The National Employment Standards, one person is a child of another person, other relationships are also to be determined on the basis that the child is child of the other person. For further information refer to Section 5 of The National Employment Standards.”
b. Adding the definition for Cultural Business and Cashed out.
3. 6.1 removed the following: “Employees may be required to take annual leave during Christmas as part of the Regional Offices close-down. In this event employees will be given four (4) weeks notice.” Includes the: Leave Paid at Commencement of Leave Period An employee may choose to be paid annual leave at the commencement of their approved period of annual leave rather than be paid annual leave fortnightly during the period of the approved annual leave. If an employee wants to be paid annual leave at the start of their leave this needs to be specified on their leave form for approval. The employee must have the full annual leave entitlement to have the annual leave component paid in advance otherwise this will not be paid.
4. 6.2 Heading has been changed from Sick leave to Personal / Carer’s leave and all other reference to Sick leave changed to the same. Also addition of
a. accumulates from year to year. b. Better explanation of why a person may take Personal / Carer’s leave c. Removal of – “Employees who have taken five or more days from their sick
leave entitlements within a six month period, will be required to provide a medical certificate for all occurrences of sick leave thereafter.”
d. Addition of – “At the time of notification the employee must advise their supervisor or manager of the period or expected period of leave. An employer

can request evidence about the reason for personal/carer’s leave. The request for evidence has to be reasonable. If the employee doesn’t provide the requested notice or evidence they may not get compassionate leave.”
e. Documentation requirements – addition of “statutory declaration” and clearer explanation of when the medical certificate or statutory declaration. Also “Medical appointments and elective surgeries that are pre-arranged can only be covered by sick leave if an employee is not able to work because of a personal illness and/or injury. It will depend on each individual circumstance. An employer can ask for evidence from an employee to confirm that they were unfit for work. This can help decide if an employee should be paid sick leave or be paid a different type of leave or entitlement.”
f. amended to now read that notification of absence can be via verbal, text or email
5. 6.3 removal of “Employees must provide notice and evidence of leave as set out
under the sick leave entitlement in this policy.”
6. 6.4 removal of “Notice must be given prior to the commencement of the leave if reasonable to do so. If an employee is unable to provide prior notice, then notice as soon as practicable.” And under heading Taking Compassionate Leave – removed “2 separate periods of 1 day each; or” And inclusion of “An employer can request evidence about the reason for compassionate leave (as per dot points above). The request for evidence has to be reasonable. If the employee doesn’t provide the requested notice or evidence they may not get compassionate leave. An employee will be paid at their base rate of pay for their ordinary hours of work for the period.” Removed “or a member of the employees household”
7. 6.5 reworded first paragraph and removed “Summoned to a court case”. Includes Voluntary emergency management activity details.
8. Inclusion of 6.6 Defence Reserve Leave
9. 6.7 reworded and changed 3rd paragraph to correctly reflect long service leave maturity and how it is calculated. And inclusion of “Periods of unpaid leave will not be counted towards the accrual of Long Service Leave.” Added Long service leave can not be “cashed out” as per the Long Service Leave Act Section 10 (4).
10. 6.8 inclusion of entitlement simplifying adoption and “When the leave starts (if the leave is taken after another person cares for the child or takes parental leave).” Plus administrative changes to make it more understandable. Last point now reads - TOIL hours must be taken at a mutually convenient time and within four weeks of being accrued; otherwise the accrued TOIL will be lost.
11. 6.9 includes now an explanation of Cultural Business leave how it is granted and clarifies what options of leave are available.

GENERAL BUSINESS ITEM NUMBER 11.5 TITLE New and Reviewed Policies REFERENCE 691273
AUTHOR Cristian Coman, Compliance Coordiantor RECOMMENDATION (a) That the Manyallaluk Local Authority receive and note the new and reviewed
policies approved by Council. BACKGROUND The following policies were reviewed/created, Council approved these policies at the Ordinary Meeting of Council on 2nd March 2017: -HR027 Staff Criminal Offences Policy -CL010 Register of Interests Policy -HR006 Working with Children Policy -ADM003 Complaints Policy -HR031 Performance Management Policy -HR024 Special Measures Recruitment Policy -HR004 Recruitment and Selection Policy RGRC is required to have policies which cover certain HR principles (s105(2) Local Government Act). SLT endorsed the policies on the 6 February 2017. ISSUES/OPTIONS/SWOT NEW HR027 Staff Criminal Offences Policy This policy will fulfill the requirements of relevant sections of the Local Government Act and provide a framework for which paid and voluntary staff member are dealt with if imprisoned whilst employed by Roper Gulf Regional Council. The policy provides clarity in support of the relevant legislation and guidelines. CL010 Register of Interests Policy The purpose of this Policy is to provide direction to Roper Gulf Regional Council (RGRC) Members with regard to compliance with the Register of Interest requirements of the Local Government Act 2008 (NT).
Council must maintain a publically available Register of Interest and this policy provides guidance on this requirement. REVIEWED HR006 Working with Children Policy Changes include:
• Policy name from Working with Children Certificate Policy to Working with Children Policy.
• Corrected reference to the appropriate regulations to abide by. • Inclusion of definitions for Exemption and a negative notice or interim negative
notice. • Clearer and more explanatory principles of the policy. • Inclusion of list Council positions requiring a Working with Children Clearance. • Clearer recruitment requirements.

• Removal of the need for CDP participants participating in activities requiring a clearance.
• Removal of 1.5 Transitional arrangements for new employees and 1.6 Notification of refusal or cancellation of a Working with Children Clearance as these subjects are covered in the Principles.
ADM003 Complaints Policy Changes include:
• Revised definition of Natural Justice • Correct the legislation referencing • Inclusion of 6.1.9 Third Party Complaints • Clearer explanation of 6.2.2 Lodging/Receiving a Complaint • Addition of 2 reasons why a complaint should not be investigated
i. The complaint does not allege misconduct, or offences, or involvement by RGRC staff or members.
ii. The allegations raised in the complaint are not the responsibility of RGRC.
• 6.2.4 clarification regarding who is assigned complaints and where complaints are to be submitted
• 6.2.6 extensive addition of information under formal complaint investigation and assessment process for staff complaints
HR031 Performance Management Policy The HR031 Performance Management Policy covers the ss 105(a)(ii)-(iv) Local Government Act requirements. The objectives of Roper Gulf Regional Council (‘RGRC’)’s Performance Management Policy (‘Policy’) are to:
a) improve the standard of an employee’s performance and/or correct an employee’s conduct where RGRC deems this appropriate or necessary; and
b) provide employees with an opportunity to improve their performance or correct their conduct (other than in situations where summary dismissal is appropriate).
HR024 Special Measures Recruitment Policy The HR024 Special Measures Recruitment Policy outlines the recruitment of specific groups whilst complying with the Anti-Discrimination Act and Racial Discrimination Act 1975 (Cth). A special measure is a plan designed to promote equality of opportunity. Special measures are a form of lawful discrimination in favor of groups, such as Aboriginal and Torres Strait Islander persons, who have not yet achieved equality in employment (s57 Anti-Discrimination Act). These guidelines are developed and implemented according to the Australian Human Rights Commission’s ‘Targeted Recruitment of Aboriginal and Torres Strait Islander People’ guidelines. All appointments under Special Measures Recruitment will be based on requirements under the followed business needs:

A program specifically designates a vacancy for a person from an Equal Employment Opportunity (EEO) group and it cannot be filled by any person from outside that group.
• Priority Consideration and Preference Applicants from the EEO target group will be considered first before all other applicants, and given preference in selection if they meet all the criteria and are at the suitable level.
HR004 Recruitment and Selection Policy The policy has been reviewed with the following changes:

included in the 2017/2018 Regional Plan. BACKGROUND This report provides an update on the status of the Bulman 2016-2017 Town Priorities and 2015-2016, 2016-2017 Local Authority Funding. ISSUES/OPTIONS/SWOT The Draft 2017-2018 Town Priorities needs to be developed and submitted to the Regional Plan. GENERAL BUSINESS ITEM NUMBER 11.7 TITLE Council Financial Report - Community
Benefit Fund Application - Request for support REFERENCE 691325
AUTHOR Hilary Sinfield, Grants Coordinator RECOMMENDATION (a) That the Manyallaluk Local Authority support Council’s application to the
Department of Trade, Business and Innovation’s Community Benefit Fund for assistance with the Manyallaluk Bollard Project.
BACKGROUND Council is currently developing a funding application for the next round of the Community Benefit Fund. This application is requesting funds to assist with the purchase and installation of bollards along the road near the Old Homestead and along the road near the Main Park. The Manyallaluk Local Authority are requested to provide their in principle support for this project to assist in strengthening the application and to help with showing the Department of Trade, Business and Innovation that the community of Manyallaluk need bollards. ISSUES/OPTIONS/SWOT Nil. FINANCIAL CONSIDERATIONS This application will request for $10,000 to purchase bollards. ATTACHMENTS:

GENERAL BUSINESS ITEM NUMBER 11.8 TITLE Community Services Report REFERENCE 691505

RECOMMENDATION (a) That the Manyallaluk Local Authority receive and note the Community Services
report. BACKGROUND SNP: The program is getting full support from School Principal. Katherine staff is visiting the community on regular basis to resolve any arisen issues. The school was closed from 19.12.2016 till the 30.01.2017 for Christmas break. Katherine staff has visited the school and women centre on 31.01.2017 for a meet and greet. The SNP program has started running back to normal and kids are getting healthy breakfast and lunches on time. The school principal has appreciated the efforts put in by Katherine staff and community staff to run the program smoothly. The Katherine staff is arranging for a morning tea on the 10.02.17 during school assembly for children parents to make them aware of the importance of healthy breakfast and meals for their children. Sports & Rec: During the school holidays, Katherine staff has visited the community to run Youth Vibe program. The football game was arranged on 06.01.2017 and joined by 13 Children, Sunrise Health Community staff and Roper Gulf staff. BBQ lunch was provided to all attendants. The winners of the game were handed gifts/prizes by council staff. The Sports & Rec officer position is vacant from last few month due to resignation by Darryl Watson. The community staff is waiting on applicant to provide documents to arrange for the interviews. Cherche: The position is vacant currently due to Sherese Dooley went on maternity leave. The position was advertised and interviews were arranged. But the process couldn’t be completed due to applicant went for Christmas holidays and didn’t return back as of yet. In January 2017, Roper Gulf welcomed it’s new member in Baby of Sherese Dooley. Katherine staff is working towards filling this position with the assistance of council services team and school principal. Aged Care: The services are running smoothly. Aged Care staff was on annual leave from 26.12.2016 to 15.01.2017. During her leave, council services staff delivered the meals to aged care clients. The Department of Infrastructure, Planning and Logistics (DILP) has been engaged by the Department of Housing and Community Development (DHCD) to deliver a number of upgrade and capital works programs for remote public housing throughout Big Rivers Region.
The National Partnership on Remote Housing (NPRH) and the Remote Australia Strategy (RAS), formerly known as the National Partnership Agreement on Remote Indigenous Housing (NPARIH) and Stronger Future in the Northern Territory (SFNT), are Australian Government (AG) funded programs aiming to deliver upgraded and new houses by June 2018.
Department of Infrastructure, Planning and Logistics will be managing the upgrade and capital works program in the Roper Gulf Region. All tenancy and general maintenance matters are the responsibility of the Department of Housing and Community Development.
Through this program the Northern Territory and Australian Government aim to:
• Increase the supply of new houses and improving the condition of existing properties in remote communities through replacement builds;
• Address severe overcrowding in remote communities through the building of new properties and the introduction of the new ‘Room to Breathe’ program introduced by the NT Government.
• Increase Indigenous Employment and training initiatives in remote communities; and
• Build capacity and business opportunities to Indigenous Business Enterprises
DIPL aims to improve the way in which it communicates and understands that engagement needs to occur with Local Government Councils and there representative bodies around;
• Traffic management;
• Waste management and associated activities;
• Indigenous employment initiatives and training options available in communities;
• Discuss concerns of community and any factors impacting progression of works;
• Understand community protocols and any cultural sensitivity that must be observed and adhered if/when required, by contractors and staff;
• Managing expectations surrounding the programs; and
• Also to understanding impacts, and risks and social benefits of programs.
DILP wish to inform community residents of the program and rationale by:
• Providing information on the commitment and opportunities of the program;
