Bankruptcies get an even “better” treatment: Conventional loans will be allowed aſter a 4 year wait- ing period (2 with extenuating cir- cumstances) for Chapter 7 and 2 year wait- ing period for Chapter 13 af- ter discharge. FHA loans are permissible af- ter only 2 years of Bankruptcy dis- charge for Chapter 7, VA has similar require- ments. The reality is that neither Bankruptcy, nor Short Sale or even Foreclosure would pre-clude one from buying a home in as little as 2 to 4 years. Meet Joe and Sandra, a retired couple in their 60’s who are preparing to downsize and sim-plify. The thought of de-cluttering in prepara-

tion for selling their home is daunting; after so many years in their home, they’ve accumulated truckloads of stuff… much of which they won’t want or need in the new, smaller house.

Joe and Sandra’s adult kids and their families have vol-unteered to help out but, between busy work schedules and kid’s activities, their time is limited. They thought

about renting a receptacle and gathering some volunteer friends and family to do the job (DIY)… until they learned about the Rubbish Works DFY (do it for you) approach.

Spring isn’t just a time for clean-ing. It’s also a

great time to freshen up your bedroom. People often put their bedroom décor on the back burner and focus on everything else in their lives. It’s easy to do with all of the daily responsi-bilities and tasks we have. Not anymore! Having a space that is calming, relaxing and a place to rejuvenate is good for your mind, body and soul. And who doesn’t need a little calming now and then? I know I do.

I have a few inexpensive tips for you to create a bedroom that you’ll actu-

ally want to spend time in. Weekend proj-ect, here you come!

PAINT! By far the cheapest solu-tion with the biggest impact. Grab a

couple of gallons of paint and get to work. Choose a color that is calming and sooth-ing and will help you sleep.

Add in a few new throw pillows and a blanket to add color and texture. This

will make your current bedding look new and save on the cost of all new bedding.

Use what you’ve got. Refinish your current bedside lamps, candlesticks

or picture frames. Primer and spray paint do wonders for those small décor accesso-ries.

COMMUNITY WAREHOUSE HOSTS ANNUAL SPRING FUNDRAISER

The table & CHAIR AFFAIR is a fun, funky event that brings together friends of social services, the arts, and reuse to raise funds for Community Warehouse.

Over 100 artists have transformed tables, chairs and other ordinary household items into unique works of art, both functional and decorative, to be sold to the highest bidders in a fabulous silent auction. The evening also features a dinner, exciting live auction of experience packages, entertainment, and more!

WHEN: Thursday, March 21 from 5-8:30pm

WHY: Community Warehouse is a local, nonprofit agency offering essential furniture and household items to low- income individuals and families. Together, we put used goods to good use every day as we help our neighbors in need. All proceeds from the event directly support Community Warehouse.

Home burglaries cost consumers bil-lions of dollars each year. These in-vasions of private homes traumatize

thousands of families. Thieves target homes temporarily unoccupied while the owners are enjoying their vacation. Before you leave for vacation, take every possible step to see that your home appears occupied.

Lock all doors and windows. This sounds basic, but is too often over-

looked. Be sure to lock the garage door and disconnect your garage door opener.

Keep up driveway activity. Ask a neigh-bor to park in your driveway.

Be sure mail and newspaper deliveries are handled. You can stop deliveries or

have a neighbor collect them for you.

Do not announce your absence on your answering machine. Thieves sometimes

call to see if a house is empty.

Keep up the outside appearance of your home. If you take an extended trip, ar-

range to have grass cut or snow shoveled.

Use automatic timers. Set them to turn lights off and on.

Notify the police of your absence. The police will usually do occasional drive-

bys to check your home.

While none of these suggestions can guarantee the safety of your home, they

are proven deterrents against home burglar-ies.

Is Refinancing Right for You?

KIM’S PROPERTY TALK: DERAILMENT OF A SHORT SALE

There’s been a lot of talk these days about home refinancing. Interest rates certainly are at

a historic low, so there are some definite benefits in choosing to refinance right now. You can low-er the overall cost of your loan, get rid of your mortgage insur-ance, or even lower your monthly payment. However, there are a few things to make sure you keep in mind when considering a refi. It’s not right for everybody, and it might not be right for you.

Do you have enough money

in savings to pay for it? Refinancing your home comes with all the closing costs buy-ing or selling a home

comes with—you’re essentially reselling the

home to yourself. These costs can add up, so if you don’t

have enough set aside to manage them, refinancing could end up putting you into more debt than it’s getting you out of.

What’s your current interest rate?

If your new rates aren’t going to be at least one percent lower than your current rate, it prob-ably won’t be worth the time and money to refinance your home.

What’s your current equity?

As good as interest rates are right

now, if you haven’t built up any equity in your home yet, it might not be the right time for you. Most of the time you’re going to need at least a 20% equity on your home to move forward with a re-finance. If you have at least 20% equity, you’ll usually be able to get rid of your mortgage insurance fee, which can save you around $100 a month! If you don’t have any equity, though, there’s still hope—you may qualify for a special government-sponsored home affordable refinance pro-gram (HARP). Your current loan must have closed prior to June of

2009 and have been sold to either Fannie Mae or Freddie Mac.

Why are you refinancing?

Is it to pay off your mortgage faster, lower your monthly pay-ment, or will you be cashing out a refinance to pay for something else? A car, a home renovation, a child’s education? While this can often be a good option, consider seriously whether you want to make the commitment of going into more debt. Usually I would advise against using a refinance to fund a depreciating invest-

ment, such as a car, but a home renovation might add value to your house and gain you a return. Just make sure you discuss and research all your options before choosing this route; if you’re not prepared for more debt you could end up losing your home.

And, as always, feel free to call or email me to discuss your refi-nance options. Many people are taking advantage of the current refinancing opportunities, but it’s not for everyone. Make sure you know it’s right for you.

Congratulations, your short sale has been approved! You see those words in a document from your sell-er’s lender or the listing agent and everyone gets

excited. The buyer’s agent scrambles to deposit the earnest money, schedule the buyer’s home inspection and send the third party approval to the buyer’s lender. The hard part is over, right?

Not so fast. The mortgage lender (or lenders) has approved a short payoff in exchange for a release of their lien(s) on the property, but the escrow company has now issued the title report, and you discover additional liens on the property.

I recently experienced this scenario while representing the buyer in a short sale transaction. I received an e-mail from the listing agent with a copy of the short sale approval pro-viding that we close in 30 days. We immediately deposited earnest money and scheduled a home inspection. To my horror, the listing agent asked that we postpone the home inspection because there were other liens on the property of which he was unaware when he initiated the short sale. The listing agent had received the short sale approval a few days prior to notifying me and only then ordered the preliminary title report at which time he learned of the ad-ditional liens. Now every broker should know that releases from ALL lienholders are required in order to transfer title to the property.

I did not want to offend the listing agent, but I had to ask, “Didn’t you obtain a preliminary title report when you took

the listing?” No, he did not. He merely asked the sellers what liens were on the property when they signed the listing con-tract.

Brokers, if you are going to list and negotiate short sales, you order a preliminary title report from your escrow company once you have a signed listing contract. In addition, you should request supplemental reports on a regular basis. The short sale process can take a few months, or it can take a year or longer and a lien can attach to the property at any time. In fact, it is not uncommon to have judgment liens or tax liens against a property, in addition to the mortgage liens.

Everyone knows there is nothing short about short sales. So brokers, do you want to lose a buyer after working months to obtain short sale approval? Buyers, do you want to contribute extra funds for lien releases because the listing agent or short sale negotiator failed to account for all liens against the proper-ty when obtaining short sale approval? Will the mortgage lien-holders even allow such payments by the buyer? Brokers, will the senior mortgage lienholder contribute additional funds to junior lienholders and give you an extension of the closing date after it has already provided an initial short sale approval? Brokers, do your sellers have funds to contribute to the junior lienholders? Brokers, are the junior lienholders even willing to release their liens for partial payments or do they require full satisfactions of the debts in exchange for releases? These are all questions that can be avoided if you order a preliminary title report upon execution of the listing contract and account for

all liens when requesting short sale approval.

I’ll bet I’m not the only one who is happy

to see the rains slowing down and the sun shining a bit more. But, what that means is it’s time for some spring cleaning on the outside of the house.

With all the rain we’ve had this winter and spring, I’ve seen a lot of gutters overflow-ing. Generally that means there is debris in the gutter or in the downspout. Remov-ing it is relatively easy; getting to it is often the greater challenge. This is where all that ladder safety we talk about on the radio show is so important:

• If using a conventional stepladder, make sure it is fully open and all four feet are on solid, level ground. Never stand on the top or the top step; it’s just too easy to fall, because there is nothing to lean against.

• If using an extension ladder, make sure both feet are on solid, level ground and are one foot away from the wall for every four feet up the wall on which the ladder is resting. For example, if the ladder is 12 feet high on the wall, the feet should be 3 feet out from the wall.

Something worth checking while working

with the gutters is to make sure they are hanging tight against the house. If water is allowed to flow behind them, the result is often rotten fascia board and that means carpentry work, which can be quite expen-sive. As long as we’re working outside and enjoying the sunshine, there are a few oth-er things worth paying attention to:

Window wells and foundation vents are notorious for collecting leaves

during the winter. This would be a good time to clean them out.

Shrubs and trees tend to hold mois-ture against the siding, so they should

be cut back to where they won’t touch the house.

If the air conditioner has been cov-ered for the winter, this is a good

time to remove the cover and to clean all the weeds and debris from around unit.

This is the time of year birds and stinging insects start to build nests.

Keep a close eye out and try to remove them before they get a chance to begin raising their family in your house.

If not already taken care of, it’s probably a good time to remove

the insulation from the outside hose

connections and to turn the water back on. Hopefully, we’ve seen the last of our freez-ing weather for this year.

Clean and inspect all window and door screens. Make repairs or re-

placements as necessary.

Check bricks or blocks for cracked mortar or loose joints.

Check painted surfaces for paint fail-ure, water damage, or mildew.

Check caulking where two different materials meet, where wood siding

joins the foundation wall, at inside cor-ners, and where the window and door trim meets the siding.

For most of us, this would be a pretty full weekend worth of work. But, it’s worth giv-ing up a couple days of fishing or golf. Ev-ery time you find and correct or prevent a

problem, just remind yourself that you are preserving what is likely your most valu-able investment – your home.

Clean out the gutters ev-ery year. The good news is that many ladders now

have spans designed to keep you at the perfect distance from the gutters without resting or leaning again them which can cause dam-age. Be sure to remove the gutter covers before you begin this task so you don’t miss any build up of leaves and debris.

Rinse out the gutters. It will not only help push clogs out, it will highlight any leaks that need re-pair.

Check the connections and look for any rusting spots. You might

have to replace a section if it’s got-ten away from you.

Patch smaller holes with roofing cement, larger ones may require a metal patch.

Installing iron mesh at the mouth of the drain pipes is good, but don’t forget to check for clogs there too.

Protect your gutters with gutter screens. They will prevent build-up and allow leaves to accumu-late on top of them. Just be sure to take care of those piles because as they rot, they can damage your roof.

Quick Home Improvement Tips for Spring The winter is coming to an end and fresh air, warm winds and bright sunshine are on the way. The American Society of Home Inspectors (ASHI) has provided the following checklist to help homeowners figure out the areas to target for repair. You can run through these chores and be ready to bask in the sunshine in no time.

GuttersCheck for leaky or loose gutters. A gutter that isn’t draining correctly can cause water to enter a crawl space or basement. Ensure that all downspouts empty at least eight inches from the foundation and that they are free of any debris.

YardLook for any low areas throughout your yard, and particularly near the foundation. If any are found, fill them with soil. Spring rain can cause a yard to flood, which may lead to foundation damage. Furthermore, when water gathers in a low area during the summer, it makes a perfect insect breeding ground.

TrimTake a screwdriver and check the trim around your decks, railings, doors and windows. Spring rain can do significant damage, so now is the time to repair wood trim.

HOME WARRANTY TIP: Keep range-top burners and reflectors clean; they will reflect the heat better, and you will save energy.

Simple Non-Toxic Cleaner Recipes to Clean the Whole HouseFloors: A simple floor cleaner is made by adding 2 to 4 tablespoons of Castile soap and 10 drops of lemon essential oil to a large container. Fill with 1 gallon of hot water and stir to mix. If the floor is greasy, add up to 1/8 cup of vinegar.

Walls and Counter Tops: The above floor cleaner will work well on walls and counter tops too. If you wish to disinfect, mix equal parts vinegar and water. Add 5 to 10 drops of essential oil, per 16 oz of mixture, if desired.

Mirrors: Mirrors can be cleaned well with water and a microfiber cloth. If you are looking for more shine (and germ killing power), combine 1 ½ cups of water with ½ cup of vinegar in a spray bottle and shake to mix. Add 5 to 10 drops of orange or lemon essential oil for extra cleaning power and added fragrance.

Facebook has made it a regu-lar activity to add new up-dates, most of which cause

headaches for users and refrain from solving any of the big bugs that cause the most complaints. One of the biggest issues that Facebook users have been experi-encing in their News Feed is the amount of noise that seems to ac-cumulate on it.

There is a little known extension that works to help fix all of this, Social Fixer.

You may already be familiar with the old name that Social Fixer used, which was formerly named Better Facebook. If you’re not, then you may be excited to know that it’s a simple extension avail-able for most browsers that allows you to customize Facebook to a great extent.

Social Fixer is available for Mozilla Firefox, Google Chrome, Safari, Opera and Grease-Monkey. The only big browser that it’s not available on is Internet Explorer.

The Big Features Social Fixer Brings to the Table

Social Fixer adds a lot that Face-book should have added years ago. From customizing your feed to changing how you see older posts based on criteria you input, you can decide how you want your Facebook to look like.

The biggest highlights are includ-ed below:

Your feed gets sorted by the most recent posts instead of being a jumbled mess of posts.

The sidebar chat can be turned off and the old pop-out style of chat that used to be anchored to the bottom right of the page can be enabled in place of it.

You can disable things like the Lightbox that affects how you view an enlarged picture.

Groups where you are a member

Personalize your Facebook Account via Social Fixer

and pages that you like can ap-pear in an optional scrolling col-umn on the left side of the page.

News feeds can be customized and put in dynamic and static tabs. Furthermore, you can cus-tomize which people, pages and applications appear in these tabs.

You can mark posts as read to hide them until a new comment becomes posted, or you can hide read comments permanently.

When a friend removes you from their friends, you can receive a notification.

You can move your notifications to the right sidebar to make them similar to the old style of notifica-tions that Facebook had.

Instead of being forced to manu-ally tag a person, you can simply click on the person’s name to tag them when replying to a com-ment. This is especially helpful if the person you’re replying to isn’t a friend already.

Social Fixer adds a plethora of useful features that Facebook is missing. Unlike the majority of programs that promise to do something for Facebook and then fail to deliver, Social Fixer is a le-gitimate application that does ex-actly what it says it will.

This is the first of four articles on Self-Directed (SD) IRA, Roth IRA, IRA LLC, Roth IRA, LLC, 401K, HSA,

Coverdell, as well as SoloK for self-em-ployed people.

• In 1935 – Social Security was created.

• 1974 – Employee Retirement Income Security ACT (ERISA). This act included Self-Directed accounts including IRA’s and 401Ks.

• 1994 – Roth IRA was created, allowing after-tax contributions to accumulate tax free, and heirs inherited tax free.

• 2004 – SoloK was created, for self-em-ployed people

Pensco, the largest custodian for self-di-rected accounts, grew from $3 billion/2008 to $10 billion today. Self-Directed retire-ment accounts have become very popular. A SD IRA or Roth, by law, require a cus-todian.

You, too, can self-direct (SD) what you have invested in your IRA, Roth IRA, 401K, SoloK, Health Savings Account (HSA), or Coverdell Education Savings Account.

Most other funds such as 403b, 457 etc., can be converted if you are no longer employed with the sponsoring entity. Each year, you can make the maximum contribution to each of your self directed accounts.

• Loose mounting bolts. This condition is more often caused by age rather than installation, although improper installation will hasten the loosening process.

• Attic pull-down ladders are cut too short. Stairs should reach the floor.

• Attic pull-down ladders are cut too long.

This causes pressure at the fold-ing hinge, which can cause break-

age.

• Improper or missing fasteners.

• Compromisedfirebarrierwhen installed in the garage.

• Attic ladder frame is not properly secured to the ceiling opening.

• Closed ladder is covered with debris, such as blown insulationorroofingmaterialshed during roof work. Inspectors can place a sheet on the floor beneath the lad-der to catch whatever debris may fall onto the floor.

• Cracked steps. This defect is a problem with wooden ladders.

• In sliding pull-down ladders, there is a potential for the lad-der to slide down quickly without no-tice. Always pull the lad-der down slowly and cautiously.

Attic pull-down ladders, also called attic pull-down stair-ways, are collapsible ladders

that are permanently attached to the attic floor. Occupants can use these ladders to access their attics without being required to carry a portable lad-der.

COMMON DEFECTSHomeowners, not professional car-penters, usually install attic pull-down ladders. Evidence of this distinction can be observed in consistently shoddy and dangerous work that rarely meets safety standards. Some of the more common defective conditions ob-served by inspectors include:

As a new year starts so does the anticipation of people throughout

the Northwest thinking about those home projects both in-side and out.

The Portland Home and Gar-den show is the perfect venue or manufacturers, retailers and contractors to all gather and show off their talents and wares.

This year was perfect timing for Westlake Development Group to provide a showcase house and educational platform for awareness of made in America products in the construction industry. Several months ago

plans were drawn and ideas pull together to build an all Made in America home in the Portland Expo center. This 2500 sq. ft. re-vealing home concept was de-signed by Mike Barclay principle of Barclay Home Designs and Garrison Hullinger , principle of Garrison Hullinger Interior De-sign.

With such esteemed partners on this project the pressure was re-ally on Westlake to perform and build out a model that would cap-ture the attention and do justice to the design. So, at 12 o’clock on a Sunday night the crews filtered in to start work on what would be an amazing display of an all made in America home. With over 60

subcontractors, the materials showed up and the teams worked fluidly as the project came to-gether and I can proudly say it was representative of true Made in America.

Westlake was given 48 hours to build a 2500 sq. ft. home inside the Portland Home and Garden show. I can proudly say we did it in 36! As one of our team mem-bers said… Who says a contrac-tor cannot need a time schedule?

Throughout the week presenta-tions were given to help educate the true meaning of the social, economic and environmental im-pacts that we can make if you take the time to select wisely.

The TV crews were thrilled to see a project that would allow them to view from the outside look-ing in and capture the wonder-ful work that Garrison Hullinger Interior Designs had worked so hard on creating.

That exhibit has become the springboard for the home that Westlake Development Group is

currently building for the 2013 Street Dreams in West Linn. In July the public will get an op-portunity to view the same team members work as we unveil ‘The American Dream’.

Westlake Development Group would like to thank all of those who participated in this year’s Portland Home and Garden Show to create such an awesome display knowing that it is ‘Because Made in America Still Matters.’
