An Executive Session to determine positions relative to matters that may be subject to negotiations, develop a strategy for negotiations, and/or instruct negotiators, pursuant to C.R.S. §24-6-402(4)(e) regarding the recreation center and related to the City’s Rhodes project/property acquisition.

PROCLAMATION

Mental Health Month 2021 “ Tools 2 Thrive”

May 2021

WHEREAS, mental health is essential to everyone’ s overall health and well-being; and

WHEREAS, all Americans face challenges in life that can impact their mental health, especiallyduring a pandemic; and

WHEREAS, prevention is an effective way to reduce the burden of mental health conditions; and

WHEREAS, there are practical tools that all people can use to improve their mental healthand increase resiliency; and

WHEREAS, mental health conditions are real and prevalent in our nation; and

WHEREAS, with effective treatment, those individuals with mental health conditions can recoverand lead full, productive lives; and

WHEREAS, each business, school, government agency, health care provider, organization andcitizen share the burden of mental health problems and has a responsibility to promotemental wellness and support prevention and treatment efforts.

NOW, THEREFORE, BE IT RESOLVED THAT, I, Mayor Ashley Smith, along with Valley- WideHealth Systems, proclaim May 2021 as Mental Health Month. I also call upon the citizens, government agencies, public and private institutions, businesses, and schools to commit ourcommunity to increasing awareness and understanding of mental health, the steps our citizenscan take to protect their mental health, and the need for appropriate and accessible services forall people with mental health conditions.

National Historic Preservation Month ~ May 2021

WHEREAS, local historic preservation is an effective tool for revitalizing neighborhoods, fostering local pride and maintaining community character while enhancing livability; and

WHEREAS, historic preservation is relevant for communities across the nation, and for Americans of all ages, all walks of life and all ethnic backgrounds; and

WHEREAS, Cañon City has a very distinct and unequaled Historic District and various historic landmarks; and

WHEREAS, Cañon City has a vast network of dedicated residents, groups, and other organizations that pride themselves on the hard work and determination put forth in order to preserve our unique past for future generations; and

WHEREAS, it is important to celebrate the role of history in our lives and the contributions made by dedicated individuals in helping to preserve the tangible aspects of the heritage that has helped shape us as a community;

NOW, THEREFORE, I, Ashley Smith, Mayor of Cañon City, Colorado have the distinct honor of proclaiming May 2021, as

National Historic Preservation Month and call upon the people of Cañon City to join their fellow citizens, across

Colorado and the United States in recognizing and participating in this special observance.

ORDINANCE NO. 12, SERIES OF 2021

AN ORDINANCE OF THE CITY OF CAÑON CITY DESIGNATING THE PROPERTY AND BUILDING LOCATED AT 403 ROYAL GORGE BOULEVARD, CAÑON CITY, COLORADO AS A HISTORIC SITE (PEABODY MANSION)

WHEREAS, the owner of the property located at 403 Royal Gorge Boulevard (the "Property") has submitted an application for a historic site designation for the Property ("Application");

WHEREAS, pursuant to Sec. 12.30.080(C) of the Cañon City Municipal Code, the Historic Preservation Commission of the City of Cañon City (“Commission”) held a duly notice public hearing on April 14, 2021 on the Application;

WHEREAS, after conducting the public hearing, the Commission recommended designation of the Property as a historic site;

WHEREAS, pursuant to Sec. 12.30.080(F), on May 3, 2021, City Council held a duly noticed public hearing on the Application; and

WHEREAS, after considering all relevant testimony and evidence, the City Council approved designation of the Property as a historic site.

NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF CAÑON CITY:

Section 1. The City Council makes the following findings of fact:

a. The original building and construction of the Property took place in 1880-81, making it significantly more than 50 years old. The building was last renovated and restored in 1993.

b. The Property was originally owned by James and Anne Clelland and is also associated with former Colorado Governor James H. Peabody, the Clelland's son-in-law. James Clelland is a former mayor of Cañon City with additional significant state and local political ties.

c. The Property is one of only three noted structures in Cañon City that are Second Empire. Of the three Second Empire structures in Canon City, the Property is the oldest of the three and is currently not listed on either the State or National Register of Historic Landmarks.

Section 2. Based upon these findings, the City Council determines that the Application meets the following criteria:

a. The building is at least 50 years old.

Section 3. The City Council designates the following property as a historic site pursuant to the City's Historic Preservation Ordinance:

403 Royal Gorge Boulevard, Cañon City, Colorado.

Section 4. Severability. If any section, subsection, paragraph, clause or other provision of this Ordinance for any reason is held to be invalid or unenforceable, the invalidity or unenforceability of such section, subsection, paragraph, clause or other provision shall not affect any of the remaining provisions of this Ordinance, the intent being that the same are severable.

Section 5. Effective Date. Pursuant to Article XII, Section 3 and Section 5 of the Charter, this Ordinance shall be effective five (5) days after final publication if it is published after adoption or if not so published, five (5) days after its adoption.

Architectural Description:

The Peabody Mansion is a two-story brick Second Empire house as defined by the concave mansard roof, bracketed cornices, and the central projecting pavilion. The house has 2 one-story bay windows, one on the west side and the other on the east side. The 1.5 story brick addition on the northeast side of the house was added in 1893. The foundation of the house is primarily sandstone blocks.

Narrative Description

The Peabody Mansion has seen a couple renovations during its history. The original front porch of the house was replaced around 1946 with a large wrap-around porch. According to a feasibility study of the mansion done in 1991 by Semple, Brown, and Roberts architects, the original brick façade was covered in stucco sometime prior to November 1969.

The stucco and the wrap-around porch have since been removed as part of an extensive renovation/restoration project in 1993. This project was coordinated by the Chamber of Commerce, with direct involvement from the Main Street, USA of Cañon City, the Upper Arkansas Area Council of Governments (UAACOG), and the City of Cañon City as part of the River Station Project. The renovation of the

mansion was funded through grants and donations. Other renovations done at this time included repair of the existing metal roof, replacement of deteriorated sandstone sills and any wood surfaces, removal of the non-historic enclosed porch on the east, the west bay window, and the addition on the rear of the structure. The installation of an access door to the front porch deck was also done. The rehabilitation of the interior of the house entailed the removal of all non-historic additions to the interior of the house (i.e. plaster, drop ceilings, and floor coverings), and the reconstruction of the fireplaces and mantels to resemble original pieces.

Upon completion of the renovation in 1993-94, a new building inventory of the Peabody Mansion was filed with the Colorado Historic Preservation Office. According to Colorado’s online Cultural Resources Database (COMPASS), the mansion was assessed as being eligible for the State Register in April 1994 but the property was never designated. The current appearance of the house has not been altered much from the 1993-1994 renovation. The application states that the “masonry is in need of restoration cleaning and removal of the [spalling] due to” the sealant that was applied to the brick of the house during the 1993-1994 renovation. This deterioration of the brick on the exterior of the house was evident in 2005 and has continued to be an ongoing concern. The current owners of the house intend to rehabilitate the house and “carry on the vision that Cara Fisher, Darryl Biggerstaff and the City of Cañon City had in the 1990s in saving the grand building.”

Significance of the Property:

The Peabody Mansion is one of only three noted structures in Cañon City that are Second Empire (the other two are the St. Cloud Hotel – 1886 and the Robison Mansion - 1884). Of the three Second Empire structures in Cañon City, the Peabody Mansion is the oldest of the three and is currently not listed on either the State or National Register of Historic Landmarks. According to the application form the “Peabody Mansion is the last of the grand homes that originally lined the north side of River Street”, now Royal Gorge Boulevard.

This house is primarily associated with two individuals, who were deeply involved in local and state politics, the Honorable James Clelland and his son-in-law and former Colorado Governor, James H. Peabody. James Clelland was an early settler to Cañon City, arriving in 1871. James Clelland became the second person to hold the office of mayor of Cañon City, serving from 1873 -1874. Clelland also served as a member of the last Territorial Council in 1876 representing Fremont County. He then served in the State’s first State Senate in 1877 representing the 14th District of Colorado. James Clelland owned and operated a dry goods and general merchandise store onlocated at 404 Main Street from 1874 to the 1880s. Clelland lived in this house with his wife Anne and their son James until he died in 1892. His wife, Anne continued to stay in the house with her daughter Frances Peabody and her family until her death in 1916.

Ms. Frances Clelland married James H. Peabody in 1878. The couple had three children James C., Cora, and Jessie, who grow up in the house at 403 River. James Peabody originally came to Cañon City in 1875 and began working for James Clelland in the dry good store. James Peabody served the community in many different capacities. He acted as City Treasurer (1876 – 1877), City Clerk (1878), City Alderman (1879, 1880, 1881), Mayor of Cañon City (1901 and 1902), School Director from 1882 to 1889, and County Clerk and Recorder from 1882 to 1889. In 1902, he accepted the Republican nomination for Governor of Colorado. He won the election

and served as governor from 1903 to 1905. During his term in office, the family lived in Denver returning to Cañon City and the house on River Street after allegations of election fraud and Gov. Peabody’s resignation from office in March 1905.

According to a biography printed for Peabody’s memorial service in 1917, James Peabody was also organized and served as president of involved with the Cañon City Electric Power & Light Company, the First National Bank in Cañon City (1888 -1907), and the Cañon and Royal Gorge Railroad Company (1906). In addition, Peabody and James Clelland were original stockholders in the company that developed the city’s first water works in 1879. Following the death of Gov. Peabody in 1917, Mrs. Peabody sold the house to William Kettle, who operated a second-hand store and rooming house. In 1939, the City of Cañon City took ownership of the property with the design to partner with the American Legion and the Works Progress Administration (WPA) to demolish the house to make room for a large auditorium. The funding for this project fell through and L. M. Litz purchased the house from the City for $1,000 with plans to make it into an apartment house in 1942. By the mid-1940s the house was utilized as a motel (known as the El Rio Motel and later the Cadaleen Motel). In 1946, Forrest Nicholas and local businesswoman Dusky Nicholas (a.k.a. Dusky Kier) bought the house and opened the El Rio Motel. Mrs. Nicholas sold the property to business partners Kenneth Owens (former Cañon City Police Chief) and James Bollin in 1951.

The house continued as an office for the motel until roughly 1988. The City of Cañon City acquired the house again in 1992 from the Fremont National Bank. After the extensive rehabilitation, the house became the Chamber of Commerce and continued to function as their offices until 2019.

Findings of Fact:

Under these findings of fact this structure meets the criteria for designation as listed in the City’s Ordinance (Sec. 12.30.090).

1. The building is at least 50 years old. 2. The building exemplifies specific elements of an architectural style or period. 3. The building exemplifies cultural, political, economic, or social heritage in the community. 4. The building represents an association with a notable person(s).

Staff Recommendation:

As this is a public hearing, staff recommends City Council cites these findings of fact as stated in the staff report, the application form, and the Historic Preservation Commission’s Resolution 4, Series 2021 to approve Ordinance 12 of Series 2021 designating the Peabody Mansion located at 403 Royal Gorge Boulevard as a local historic structure.
