    Charleston, West VirginiaFebruary 19, 2013

    The meeting was called to order at 1:10 p.m. by President Chad Hutson. Memberspresent: Chad Hutson, John Stump, Keith Kimble, Ira Handley, John Fahey and Chad Harding. Sarah Lobban attended but was late arriving due to adverse weather conditions. Non memberspresent, Constance Sloan, Administrative Assistant and Regina Foster, Administrative Assistant.

    Chad Harding moved to go into Executive Session pursuant to WV Code 6-9-4(4),seconded by Keith Kimble. The motion carried unanimously.

    On motion of Keith Kimble, seconded by John Fahey, the Board voted to return to publicsession

    The Board then moved to the recommendations of the Complaint Committee as follows:

    COMPLAINT 2012-05

    Smith Funeral Home alleged that Markwood Funeral Home had illegally charged forembalming. The complaining funeral home held a preneed funeral contract which waspurchased by the deceaseds guardian and the family of the deceased was unaware of thepreneed. Markwood furnished the Board a copy of a letter from the deceaseds sone stating thathe had inadvertently failed to advise Smith that he had authorized his fathers embalming. TheDirector communicated with Smith that this letter should resolve the matter and that Markwoodshould be paid.

    Smith then revised their funeral contract, subtracting the amount of the embalming feewhich was a covered expense under the preneed but did not refund the amount of the embalmingto the family. Instead, the family was advised that the funeral home was making no charge forembalming and that the family should pay the other funeral home for that charge.

    The matter was then referred to the Preneed Division of the Attorney Generals Officeand it was determined that the family was entitled to a refund of the embalming fees as those hadbeen purchased in the preneed contract.

    The Complaint Committee recommends that the complaint against Markwood bedismissed as there was no violation of the Funeral Service Examiners Act. The Committeefurther recommends that Smith Funeral Home be advised not only of the dismissal but that hisactions in attempting to prevent the respondent funeral home from being paid and to have theconsumers pay for services already purchased in the preneed are unethical and that future suchacts will result in disciplinary action against him and his funeral home.

  • COMPLAINT 2013-01

    This complaint was originally received March 21, 2012 from Mr. Burkhammer but didnot have enough substance that would enable the Board to adequately know what was beingcomplained of. A letter was sent to the complainant requesting specific information but noresponse was ever In received. In December the complaint called asking about his complaintand denied getting a letter from this Board, however, the address he gave at this time was theaddress to which the letter had been sent.

    The respondent funeral home, Hardman-Paletti Funeral Home, was contacted and askedto respond in writing as required by law. Originally, the funeral director contacted, AnthonyPaletti, stated that he did not make the arrangements, his father (who is unlicensed) had met withthe family and made the arrangements. He stated he would talk with his father and call back. When he called back he put his father on speaker phone and all the questions were answered byhis father.

    On January 28,2013 Hardman-Paletti Funeral Home filed an answer through theirattorney at which time Anthony Paletti stated he had made the funeral arrangements. It isapparent both from conversations with the complainant and the response of the funeral home,that Mr. Burkhammer wanted nothing to do with his fathers funeral arrangements, especially ifit included paying for the funeral. Complainants sister, who although a minor was representedby her legal guardian, wished a viewing and the guardian signed the embalming authorization.Mr. Burkhammer met with John Paletti and signed the authorization for the cremation. Thefuneral home states that the Complainant was never billed for any services.

    Mr. Burkhammers allegation that he never dealt with a licensed funeral directorappears, contrary to the written response of the funeral home, to be true based on theconversations with Anthony Paletti and this office on two different occasions.

    The Complaint Committee recommends the Complaint be dismissed insofar as theauthorization for the embalming is concerned and the fact that a third party was involved in thefuneral arrangements. The sister of the complainant was represented by her guardian andtherefore there is no violation of the Funeral Service Act. The Committee recommends theLicensee in Charge and Anthony Paletti are to be advised that with the exception of makingPre-need Contracts, the owner of the funeral home may not, under any circumstance, meet withfamilies for the purpose of making funeral arrangements or performing any other activitieswhich are the sole responsibility of a licensed funeral director and that their licenses are subjectto disciplinary action if Mr. Paletti continues to operate outside the scope of what is permittedunder the Funeral Service Act.

    COMPLAINT 2012-13

    The complaint alleges that her fathers funeral arrangements were handled by MeltonMortuary and his body was cremated by Sever Funeral Service. She believes the ashes she

  • received are not those of her father. The cremation authorization was signed by all familymembers and the funeral home was to receive the ashes and hold for a burial at the grave of thedeceaseds wife. There was no specific person authorized to pick up the ashes.

    The cremation of the deceased took place in February, 2012. The ashes remained atMelton Mortuary until September 25, 2012 when the complainant made a rip to the funeral hometo retrieve them. Upon arriving at the funeral home and asking for the cremains, purportedly anemployee of the funeral home told her that there was a balance due on the account which had tobe paid before the cremains could be released. That balance was paid by the complainant bycredit card. At first the employee refused to release the cremains because the complaint had notmade the arrangements but instructed another employee to bring the cremains to her. Whencomplainant received the box she noted that the taped seal had been cut and inquired as to why. She was told so they could compare the numbers on the outside with the tag on the inside.

    When complaint returned to her home in Ohio she had a Deputy Sheriff come to heroffice on October 11, 2012 to confirm that the numbers on the outside of the box matched the tagon the inside. There was no metal tag in the cremains. On October 19, 2012, the officer had thecremains scanned through a metal x-ray machine. The x-ray did not reveal a metal tag but didreveal a large mass of small metal particles.

    On October 24, 2012 Melton Mortuary responded and stated that there was never anyindication that the release of the cremains was dependent upon payment of the account balanceand that it was poor timing on the part of the employee who advised the complainant that therewas a balance due. That aspect of the complaint has been addressed with staff so that in thefuture there will be no misunderstandings on this issue. Melton stated that because the othersister was the only local contact and the person who made the contract, they felt obligated tocheck with her prior to releasing the remains. Melton states that their instructions up to thatpoint were to retain the ashes until burial arrangements had been made. Melton states theyshould have made the telephone call to the other sister in front of the complainant with everyoneon speaker phone so all parties would be involved in the conversation. The funeral home hasalso met with staff to ensure that in the future this will not happen.

    The complainant received a portion of the remains in the original temporary urn with theCertificate of Cremation attached. The identification tag was retained with the portion of theremains going to the sister.

    The funeral home states that the metal fragments found in the ashes likely are the resultof the deceaseds open heart surgery at which time titanium wires were used to repair theprocedure. Sever Funeral Service also responded stating that there was no wrong doing and thatthe cremation was done properly. The letter contained some derogatory remarks about thecomplainant and her family.

    The Complaint Committee recommends this complaint be dismissed as the is noevidence of any wrong doing on the part of the crematory. Because there could be metalfragments in the cremains from shipping containers or various types of surgeries, the Board is

  • confident that the cremains the complainant received are those of her deceased father. TheCommittee further recommends that the Director send a letter to the crematory advising themthat the remarks contained in their response to the complaint regarding the family of thedeceased are inappropriate. Further, the funeral home should implement procedures to ensurethat in the future the situation as existed here with releasing the cremains does not happen; thatunless there is a designated person to receive the cremains, the appropriate next of kin shall allbe present or consent to the release of cremains to a person or persons.

    John Stump moved that the Board accept the recommendations of the Committee withregard to all complaints; the motion was seconded by John Fahey and carried unanimously.

    The Minutes of the Meetings held October 24, 2012 and December 3, 2012 wereunanimously approved on motion of Chad Harding, seconded by Keith Kimble.

    The Financial Reports for September, October, November and December 2012 wereunanimously approved on motion of Chad Harding, seconded by Keith Kimble.

    On motion of Chad Harding, seconded by Keith Kimble, the Purchase Card reports forSeptember, October, November and December 2012 were unanimously approved.

    The Board then considered the Consent Agreement signed by Junora Walton of WaltonsChapel of Faith Funeral Home (Complaint 2012-08) wherein she agreed to be Reprimanded forher failure to keep current her State, City and Board licenses, and to also be placed on probationfor a period of one year and also considered the Consent Agreement signed by Billy Ray Surrattof Elk Funeral Home (Complaint 2012-06) wherein he agreed to complete correctly and timelyall death certificated and to be placed on probation for a period of six months. The Board votedunanimously to accept the Consent Agreements.

    The Board then reviewed the letter from the Boone County Prosecuting Attorneyupdating this office regarding criminal prosecution of Thomas Stevens for embezzlement ofpreneed funeral funds. The Director will continue to monitor the matter.

    The Board next discussed the monthly inspections and although the inspector is doing agood job the Board would like the Director to ask that he make telephone calls the day prior tohis inspections so that the funeral homes can make sure someone is present when he arrives. The only time telephone calls will not be made in advance is there is some problem with thefuneral establish that leads the Director to believe the inspection should be unannounced.

    The Board then discussed the position of Executive Director and based upon theperformance of Ms. Foster the past two and a half months, in addition to her training for the pasteighteen months, John Stump moved, seconded by Sarah Lobban, that Regina Foster bepromoted to the position of Executive Director. The motion carried unanimously.

    On Motion of Chad Harding, seconded by John Fahey, the Board voted unanimously toraise Ms. Fosters salary to $45,000 a year effective March 1, 2013.

  • The Board next discussed the renewal of the lease for its office space and on motion ofChad Harding, seconded by Keith Kimble, the Board unanimously approved the renewal of thelease for the current office space. The lease will be for a minimum of one year, however, if thelandlord is agreeable to extending the lease beyond that period with no raise in rent, the Directoris authorized to sign the lease.

    The Board then moved to election of the position of the unexpired term of Secretary dueto the death of Mr. Tomassene. On motion of Ira Handley, seconded by Sarah Lobban, JohnStump was unanimously elected as Secretary of the Board for the remainder of the term endingJune 30, 2013.

    Charleston, West VirginiaMarch 5, 2013

    This meeting was properly noticed and approved through the secretary of State on2/17/13 as an Emergency Meeting, to act upon rent increase and act upon lease for office spaceonly.

    The meeting was held via teleconference and was called to order at 9:05 a.m. Memberspresent: Chad Hutson, Keith Kimble, Ira Handley, John Fahey, Chad Harding and SarahLobban. John Stump was unable to participate. Non members present, Constance Sloan,Administrative Assistant and Regina Foster, Executive Director.

    Purpose of the meeting was to act on new lease for office space with an increase of$40.54 per month. The lease period would be for three years with no further increases during thatperiod.

    Chad Harding seconded by Sarah Lobban voted that the Board go forward with the newlease terms. The motion carried unanimously.

    There being no other business to discuss Ira Handley made the motion to adjorn secondedby Chad Harding, The motion carrier unanimously.

    June 3, 2013

    The meeting was called to order at 1:00 p.m. by President Chad Hutson. Memberspresent: Chad Hutson, Keith Kimble, Ira Handley, John Fahey and Sarah Lobban. Chad Hardingwas present via teleconference. John Stump was absent. Non members present, Regina Foster,Executive Director and Constance Sloan, Administrative Assistant and Regina Foster, ExecutiveDirector.

    Ira Handley moved to go into Executive Session pursuant to WV Code 6-9-4(4),seconded by Keith Kimble. The motion carried unanimously.

    The Board then moved to the recommendations of the Complaint Committee as follows:

    COMPLAINT 2013-02

    This complaint was filed by a gentleman against Kimes Funeral Home. Although thegentleman has some mental problems and was placed in Weston State Hospital after being foundguilty by reason of insanity of the crime of arson, he has never been declared incompetent and,in fact, if extremely brilliant.

    The complainant has had some very valid complaints against this funeral home and someaspects of those complaints resulted in action by the Attorney Generals Office and a referral tolaw enforcement for investigation of criminal activity.

    However, in the instant case, the deceased died in 2006 and the pictures provided do notsubstantiate the complainants belief that his brother looked like a clown. The embalming roomreports do not indicate any unusual problems with the embalming.

    The evidence presented does not indicate any violation of the Funeral Service ExaminersAct and the Complaint Committee recommends that the complaint be dismissed.

    COMPLAINT 2013-04

    The Complainant alleges that Lobban Funeral Home did not give him a price list until thedate he retrieved the ashes from the funeral home.

    The deceased died December 17, 2012 and her body was picked up by CharlestonMortuary and taken to the crematory in Princeton as this was a direct cremation which had beenarranged for by the complainant by telephone. There was some delay in getting the death

  • certificate from CMS and with the holiday schedule there was a delay in getting the cremationdone.

    The funeral home states that in the initial conversation with the complaint which wasover the phone, that she gave him an estimate of the costs and told him that the final bill could bedifferent depending on obituary charges, the cost of an urn if one was purchased, sales tax, etc.

    The actual cremation took place January 12, 2013 and the ashes were picked up at thecrematory on January 25, 2013. The death certificates were received on February 9, 2013 and onFebruary 10, 2013 the complainant was contacted by phone and asked if the funeral home coulddeliver the death certificates and finalize the bill. Complainant stated that was not convenient tohim and that he had decided not to purchase an urn and for her to mail the death certificates,which she did. The complainant did not come to the funeral home until February 17, 2013 atwhich time the bill was finalized and he was provided with the GPL. The complainant returnedthe following day and paid the bill in full.

    The FTC Rule, which is incorporated in the Funeral Service Examiners Act, provides thatthe triggering event for giving out a GPL is a face-to-face meeting. With regard to the Statementfor Funeral Services, the FTC Rule provides that if arrangements are made over the telephone,you should give the consumer the Statement at the earliest possible date. If the consumer makesall funeral arrangements by telephone, you make a reasonable attempt to give a completedStatement to the consumer before a final disposition of the remains occurs. If the Consumerdoes not visit the funeral home in person before the final disposition, you should still give orsend a completed statement to the consumer as soon as possible.

    A review of the circumstances of this complaint does not indicate that Lobban FuneralHome violated this FTC Rule which would, in turn, be a violation of the Funeral Service Act. The Committee, therefore, recommended this complaint be dismissed.

    COMPLAINT 2013-05

    The complainant states that she and her niece were refused permission by Keller FuneralHome to view her deceased husband prior to him being taken to the cemetery; that she wasforced to ride in a very cold car provided by the funeral home; that the obituary notice wasincorrect and that there was no Register Book or memory cards at the funeral.

    The funeral home responded that on two separate occasions the complainant refusedpermission to embalm the body and she arranged for a direct burial with grave side service. Itwas only when the complainant arrived at the funeral home as they were preparing to leave forthe grave side service that the complainant asked to view the body. Because the body had notbeen embalmed, and there was rapid deterioration, it was not possible to view the body.

    The funeral home further states that they were unaware that the complainant was going touse a funeral home vehicle until she showed up at the funeral home and thus did not have a carready for her use. The funeral home admits there was an error in the obituary and that the

  • Register Book and memory cards were not provided. Those items were deducted from theStatement of Goods and Services provided.

    As a signed disclosure would have been required prior to viewing of an unembalmedbody, it is apparent that the funeral home did not anticipate that the complaint or other personwould be viewing the body. It is also apparent that they did not anticipate the complainantwould be requesting to ride in a funeral home provided vehicle. It is unfortunate that theobituary had to be corrected and that the Register Book and memory cards were not provided. These mistakes, although unfortunate, do not give rise to a violation of the Funeral ServiceExaminers Act and the Complaint Committee recommends that the complaint be dismissed andthat the funeral home be instructed to institute some type of check list so that in the future theseproblems do not occur.

    COMPLAINT 2013-06:

    The complainant says that Barlow Bonsall Funeral Home failed to timely order a VAmarker for their deceased relative. The funeral home cremated the deceased and her ashes werethen claimed by her fianc and taken to Virginia for burial at a cemetery there. Approximately ayear later the complainant called the funeral home to inquire about the marker and was told theywould check with the VA and call back. When complainant did not hear from the funeral homeshe called again and was told that the wrong form had been submitted and that they hadresubmitted the application.

    In January 2013, complainant called the VA Office in Quantico, VA and was advised thatno order was in their system for the deceaseds marker. In February 2013, complainant calledthe funeral home and this time provided the name, address and telephone number for the funeralhome in VA where the marker was to be shipped direct rather than to Charleston. In March2013 complainant was again advised by the VA that there was no order in their system.

    Barlow Bonsall admits there was a delay in the original order due to the fact they had notreceived the proper work to complete the order. The paper work was then completed and mailedto the cemetery in Virginia. For whatever reason, the cemetery did not receive the documentsand the paper work was resubmitted to the cemetery on February 14, 2013 and that it is theresponsibility of that funeral home/cemetery to complete the paper work and submit it to the VA.

    It appears that Barlow Bonsall have done their portion of the paper work and that theVirginia facilities are now responsible for completing the remainder of the paper work andordering the marker.

    As there is no violation of the Funeral Service Examiners Act, the Complaint Committeerecommends that the complaint be dismissed but that the funeral home institute some type oftracking system to check on these orders at 60 day intervals.

    Prior to voting on the Complaint Committee recommendations, Ms. Sloan noted for therecord that Sarah Lobban did not participate in any discussion of Complaint 2013-04 and that

  • she had recused herself from voting on that complaint.

    John Fahey moved that the Board accept the recommendations of the Committee withregard to all complaints; the motion was seconded by Keith Kimble and carried unanimously,with Sarah Lobban abstaining from voting.

    The Minutes of the Meeting held February 19, 2013 were unanimously approved onmotion of Chad Harding, seconded by Sarah Lobban.

    The Financial Reports for January, February, March and April, 2013 were unanimouslyapproved on motion of Chad Harding, seconded by John Fahey.

    On motion of Chad Harding, seconded by Sarah Lobban, the Purchase Card reports forJanuary, February and March 2013 were unanimously approved.

    The Board then considered the issue of whether or not a Bachelors in Technology fromSUNY Canton would meet the requirements of the Funeral Service Examiners Act, whichrequires a Bachelors in Mortuary Science. On motion of Ira Handley, seconded by SarahLobban, the Board unanimously voted to accept that degree as being sufficient to meet theeducational requirements for West Virginia licensure.

    The Board then discussed a request from Mike Howard for a pay increase. On Motion ofChad Harding, seconded by John Fahey, the Board voted unanimously to raise Mr. Howardspay by five percent (5%) or a total of $445.73 per year effective July 1, 2013.

    Chad Hutson then appointed Keith Kimble and Sarah Lobban to the ComplaintCommittee for two years terms effective July 1, 2013.

    Chad Hutson then announced his intention to resign as President of the Board and askedfor nominations for the positions of President and Secretary of the Board. Ira Handleynominated Chad Harding for the position of President and John Stump for the position ofSecretary of the Board. There being no other nominations, Keith Kimble seconded the motion,which carried unanimously. The terms of office for the respective positions are effective July 1,2013.

    October 8, 2013

    The meeting was called to order at 1:00 p.m. by President Chad Harding. Memberspresent: Chad Hutson, Keith Kimble, Ira Handley, John Fahey, John Stump, Chad Harding andSarah Lobban. Non members present, Regina Foster, Executive Director and Constance Sloan,Administrative Assistant. At the conclusion of the Executive Session Rob Kimes and AnthonyPaletti joined the meeting.

    Chad Hutson moved to go into Executive Session pursuant to WV Code 6-9-4(4),seconded by Sarah Lobban. The motion carried unanimously.

    On motion of Ira Handley, seconded by Sarah Lobban., the Board voted to return topublic session

    The Board then moved to the recommendations of the Complaint Committee as follows:

    COMPLAINT 2013-04

    The Complainant requested a reconsideration of the dismissal of his complaint againstLobban Funeral Home alleging she did not give him a price list until the date he retrieved theashes from the funeral home.

    The deceased died December 17, 2012 and her body was picked up by CharlestonMortuary and taken to the crematory in Princeton as this was a direct cremation which had beenarranged for by the complainant by telephone. There was some delay in getting the deathcertificate from CMS and with the holiday schedule there was a delay in getting the cremationdone.

    The funeral home states that in the initial conversation with the complaint which wasover the phone, that she gave him an estimate of the costs and told him that the final bill could bedifferent depending on obituary charges, the cost of an urn if one was purchased, sales tax, etc.

    The actual cremation took place January 12, 2013 and the ashes were picked up at thecrematory on January 25, 2013. The death certificates were received on February 9, 2013 and onFebruary 10, 2013 the complainant was contacted by phone and asked if the funeral home coulddeliver the death certificates and finalize the bill. Complainant stated that was not convenient tohim and that he had decided not to purchase an urn and for her to mail the death certificates,which she did. The complainant did not come to the funeral home until February 17, 2013 atwhich time the bill was finalized and he was provided with the GPL. The complainant returnedthe following day and paid the bill in full.

    The FTC Rule, which is incorporated in the Funeral Service Examiners Act, provides thatthe triggering event for giving out a GPL is a face-to-face meeting. With regard to the Statement

  • for Funeral Services, the FTC Rule provides that if arrangements are made over the telephone,you should give the consumer the Statement at the earliest possible date. If the consumer makesall funeral arrangements by telephone, you make a reasonable attempt to give a completedStatement to the consumer before a final disposition of the remains occurs. If the Consumerdoes not visit the funeral home in person before the final disposition, you should still give orsend a completed statement to the consumer as soon as possible.

    The Board has confirmed with Seaver Mortuary that they did give an invoice to either thetransport service or the person picking up the cremains for Lobban and that due to the backlog ofwork and the holiday schedule they are unable to state when the invoice was sent to Lobban.

    A review of the circumstances of this complaint again does not indicate that LobbanFuneral Home violated this FTC Rule which would, in turn, be a violation of the Funeral ServiceAct. The Committee, therefore, recommended this complaint be dismissed but that the Directorwrite Lobban and ask that she try to get her billings done a little faster in the future.

    COMPLAINT 2013-08

    The complainants deceased brother was first taken to Tyree Funeral Home, however, thefamily wanted him transferred to High Lawn Funeral Home. The brothers of the deceased were told that the decedents daughter (Janette Hall) would have toarrange for the transfer to their funeral home.

    On March 23, 2013, the complainant and his family went to the funeral home to make thefuneral arrangements. At that time they met with the Kaye Ballard, owner of the funeral homewho is not a licensed funeral director and who very frequently meets with family to make at-need funeral arrangements. The complaint was told that the funeral bill would need to be paid infull before the body would be removed to their funeral home. At that time they were given aprice quote of $5590.61 for the funeral services. On March 24, 2013 the family returned to thefuneral home and paid in full the bill. The body was removed from Tyrees on March 25, 2013.

    At no time prior to the funeral, and specifically not at the time the second Statement ofGoods and Services was prepared, were the complainants given receipts for their payments orpresented with the finalized bill. When the complainant asked for a copy of the contract hefound that the deceaseds daughter was the named purchaser, that the Statement was datedMarch 26, 20913, the day of the funeral, and that they had been charged a second embalming feein the amount of $895.

    Complainant asked the funeral home to give him a contract with his name so that hecould file the claim against the estate but the funeral home refused. After several unsuccessfulattempts to obtain the contract and a refund of the second embalming charge, the complainantfiled his complaint with this office. (It should be noted that this office talked with the owner andwas assured that the contract would be rewritten and a refund made, however, that did nothappen.)

  • The funeral home responded to the complainant and in their response states that KayeBallard, owner of Highlawn, met with Bobby Gene Ward and his family on March 25, 2013, atwhich time the contract was executed. The response further states that he (Mr. Ward) metwith the funeral director, Mr. James Patton, who came in the office while they were meetingwith Ms. Ballard, when he spoke to them, gave them his sympathy . . .

    The response also questions the refund of $220 stating that their cost for embalming wasless than Tyree charged. The Board obtained a copy of the statement from Tyree for the servicesrendered. Their charges were $300 for removal and $625 for embalming, totaling $925. Respondent told the complainant that the embalming fee was $925 and that they were cheaperand thus saved him money.

    On June 10, 2013, the Board advised the attorney for respondent the discrepancy in hisclients figures and that the refund would be proper. The Board also advised the attorney thatthe contract should be in the name of the complainant.

    Complainant has notified this office that he has received a refund and, finally, a newcontract in his name.

    The Complaint Committee notes that the license in charge at the time of this complainthas now been criminally charged with a felony and is no longer at the funeral home. A new LIChas been hired and he has been advised that he must insist that the owner refrain from funeraldirector activities.

    The Complaint Committee recommends that the current Licensee in Charge of HighLawn Funeral Home be advised that the Kaye Ballard may not make funeral arrangements orperform other duties of a licensed funeral director and that any such conduct in the future willresult in penalties not only against the Licensee in Charge but also the license of the funeralhome. The funeral home is to be instructed to comply with the FTC Rule relating to giving theStatement of Goods and Services in a timely manner.

    COMPLAINT 2013-09

    The complainant alleges that he was treated unprofessionally by David Deal of DealFuneral Home with regard to his wifes funeral services and specifically, that the funeral directoris attempting to hold him responsible for a funeral bill of an in-law.

    The funeral director responded and his response does indicate that he has a problem withthis family as well as complainants in-laws. His recitation of services rendered in the past to amember of his in-laws family is unprofessional, at best.

    Complainant called the funeral director at 1:30 am to say he wanted to change thearrangements. He is miffed that the funeral director was upset at being awakened at that hourand hung up on him. However, it is unacceptable to make changes to a funeral at that hour of themorning.

  • The Complaint Committee believes that both the complainant and the funeral director areat fault. However, the funeral director should be better prepared to act in a professional manner. His personal attacks on th complainant and his extended family are uncalled for, unethical andunprofessional. The complainant states in his response, he has made payments to the funeralhome contrary to what the funeral home represents in its answer.

    The Complaint Committee finds that David Deal did act in an unprofessional manner andrecommends that the Board by letter admonish the funeral director that his personal attack on thecomplainant and extended family is unprofessional and that he should probably refrain fromhandling future services for these families.

    COMPLAINT 2013-10

    The complaint is the sister of the deceased. She complains Richard M. Roach FuneralHome did not embalm her sister and that no one at the viewing was aware they were viewing anunembalmed body.

    The funeral director says that although the body was unembalmed, at the request of thefamily, that adequate measures were taken to ensure sanitation and safety. Some cosmetic workwas done and the body was prepared for viewing. An unembalmed body disclosure was placedin the register.

    The husband of the deceased sent a letter to the Board stating that his wifes body hadbeen preserved and she was dressed and prepared for viewing.

    The Complaint Committee finds that there was no violation of the Funeral ServiceExaminers Act and recommends that the complaint be dismissed as the funeral director acted toensure the safety and welfare of all concerned.

    COMPLAINT 2013-11

    The complainant alleges that Junora Walton of Waltons Chapel of Faith actedunprofessionally towards her and her family and did not properly embalm her deceased father. The father of complainant died July 30, 2013 at 4:00 am at his place of residence. JunoraWalton was contacted and a transport service picked up the body.

    Junora Walton was supposed to call the family on Wednesday, July 31st to arrange tomeet the family. When she did not call that morning, the complainants mother called to askabut the death certificate at which time she was advised she was putting the cart before thehorse and that the death certificate had been sent to the doctor for signature. When thecomplainants mother asked about coming in to make the arrangements, she was told that mostof that could be done by telephone.

    When the complainants mother told the funeral director that she was thinking of afuneral August 17, due to family coming from out of town and other reasons, the funeral director

  • said that was entirely too long and that if they were looking at that date they would have tocremate him. Because the funeral director had a funeral the following day (Thursday) thearrangements conference was set for Friday, August 2, 2013 at 10am.

    The complainant offers a very detailed statement regarding the events which took place. What is apparent is that at no time did Junora Walton offer a GPL or give a GPL to the family(as they had to ask prices) nor did she show them a casket price list before showing themcaskets.

    Complainant became uncomfortable with the meeting and decided to transfer her fatherto another funeral home. At that time she asked what the charges were for the transportation andembalming and was told by Ms. Walton that the total was $960. As the complainant was drivingto the bank to get the money she received a telephone call from Ms. Walton wanting payment incash, which was done.

    Charleston Mortuary Service removed the body from the Waltons Chapel of Faith andcalled Preston Funeral Home, the receiving funeral home, and stated that they would need towork on the body to have him viewable, including embalming because of the condition of thebody. Ms. Walton states that after the initial embalming process, it was clear that [thedeceased] had not embalmed well due to the many complications of his condition when hearrived and that extensive work would have to be done to try to keep him. An embalming roomreport from CMS is submitted as part of the record indicating the work necessary. NOTE:Respondent funeral home did not have am embalming report and only started using them afterthis complaint was filed and the inspector asked for a copy of the deceaseds report.

    CMS was able to adequately embalm the body and do restoration work so that a privateviewing could be had on Wednesday, August 7,2013. In the respondents response she statesthat she was going to be charged extra anyway because of the amount of work that wasinvolved.

    The respondent funeral director has had two previous complaints resulting in reprimandsand probation in each instance. She is currently on probation under Complaint 2012-08.

    An inspection was made of the funeral home shortly after this complaint was received. See attached inspection report.

    The Complaint Committee recommended that Junora Walton be required to hire alicensed funeral director to act as Licensee in Charge at her facility for a period of one year andthat the Licensee be required to be present for all arrangements, at need or preneed, as well asduring the embalming of bodies and to attend all funeral or memorial services. That theembalming fee of $750 be returned to the complainant and that Junora Walton pay to the Boardthe sum of $500 as administrative fees. The Committee also recommended that the Board allowthe Committee to negotiate a consent decree with the Respondent pursuant to W. Va. Code 6-4-2.8

  • COMPLAINT 2013-12

    Complainant called this office and said she wanted to make a complaint about a funeraldirector at Ross Funeral Home in Fairmont. She alleged that he has allowed her and others towitness embalmings. She provided the names of Brad Summer and Bob and a person namedSteven Coark.

    A letter was sent to the director notifying him of the complaint and asking for hisresponse. After receiving the letter, the director called the office and stated that this was untrue,was the result of a domestic situation between he and his now ex-girlfriend and that he had noidea who Mr. Coark was, and that Brad Summer and Bob were employees in the funeral homewho assist him after the embalming in dressing, etc. the body. The director was instructed towrite a response and he did.

    The response by the director states that the complainant has been harassing him and thatneither she or anyone else has watched embalmings. He also alleges that the Marion CountySheriffs Department is working on this matter (I assume he means possible harassmentcharges).

    The Complaint Committee recommends that the complaint be dismissed as there isnothing to substantiate the complaint and as this is the result of some domestic situation.

    The Complaint Committee also recommended to the Board that a letter be sent to PatBoyle advising him that he is to contact the Board Office with any complaints and concerns thathe may have and that his actions in contacting Mr. Howard, the Boards inspector, questioninghis inspection of a competitor facility were unethical and unprofessional especially when he hadbeen expressly told that would be improper by the Executive Director. He is to be advised thatany future such conduct will result in disciplinary action.

    On motion of Chad Hutson, seconded by John Fahey, the recommendations of theComplaint Committee were unanimously accepted by the Board.

    On motion of John Stump, seconded by John Fahey, the Minutes of the June 3, 2013 meetingwere approved unanimously.

    On motion of Chad Hutson, seconded by Sarah Lobban, the Financial Reports for May, June, Julyand August 2013 were unanimously approved.

    On motion of John Fahey, seconded by Ira Handley, the P-Card reports for April, May, June, Julyand August 2013 were unanimously approved.

    The Board considered the reinstatement of Carl Durgan conditioned on him obtaining hiscontinuing education hours from the time his license lapsed to June30, 2013; that he perform a one-yearperiod of apprenticeship and pass the West Virginia Funeral Service Exam. On motion of Ira Handley,seconded by John Stump, the Board unanimously agreed to allow Carl Durgan to reinstate his license on

    On motion of Chad Hutson, seconded by Sarah Lobban, the Board approved payment of themembership dues for the coming year to the International Conference.

    COMPLAINT 2013-03:

    The original complaint form was filed in this office on February 28, 2018. Complainant allegedthat Bartlett Funeral Home obtained her fathers body without her permission and embalmed himwithout her permission. There were no other facts to go on. Complainant was contacted byphone and asked for a detailed statement so the Complaint Committee would have theinformation it needed to make a decision. By letters dated June 19 and September 6, 2013, theBoard again requested the complainant to provide us with a detailed statement about hercomplaint. On September 25, 2013 we received the statement by email and notified BartlettFuneral Home of the complaint. In addition to the removal and embalming without herpermission, the complainant says that employees at the funeral home were rude and disrespectfulto her and that one employee released confidential information relating to her plans forcremation of her father which caused her problems in the community.

    The Board also contacted Grafton City Hospital relating to the release of the deceased andreceived a very detailed account from them . According to the hospital, they talked with thecomplainant a the time her father was taken to the hospital and based on the information of theperson who came to the hospital with her father, he had expressed his desire to go to Bartlett. According to the hospital the complainant agreed to the removal; however, the followingmorning complainant called the hospital stating that she had not given permission for herfathers release; that she didnt have money for a funeral and that Mr. Green (a neighbor) hadgone to the courthouse to try and get appointed as executor of her fathers estate and thatcremations werent legal in West Virginia. An employee of the hospital assured her thatcreations could be done in this state.

    The complainant then contacted Donald G. Ford Funeral Home to make the removal fromBartlett and to proceed with the paperwork for cremation. When Mr. Ford contacted Bartlett hewas told he had to pay a removal fee and embalming fee, however, they later stated that there

  • would be no charge for either service.

    Bartlett responds that they acted appropriately and provide documents which purport to showthat the deceased had previously been to their funeral home and picked out funeral services. There was no contract and there is no written instructions from the deceased that the services beprovided by the funeral home. He did list his daughter as his next of kin and also his neighbor,Mr. Green, as a care giver and instructed that Mr. Green be contacted as his daughter was inCalifornia. No where does it give Mr. Green authority to make final disposition arrangements.

    In her time of grief, it is conceivable that the complainant did not understand what she was beingtold the night her father died. It is also believable that the employees of the funeral home tried toargue with her over the funeral arrangements and they may have had good intentions but lackedspecific written instructions from the deceased. The final call is by the next of kin.

    After discussion of the facts of the complaint, it appears that the complainant has no evidence tosubstantiate her complaint and thus there does not appear to be a violation of the Funeral ServiceExaminers Act and the complaint should be dismissed. However, the Committee feels that therespondent funeral home be advised that they should endeavor to personally obtain permissionfrom the next of kin prior to making removals or embalmings and that staff should refrain fromdiscussing or making funeral arrangements. This is a job solely for a licensed funeral director.

    COMPLAINT 2013-07:

    This complaint was originally received May 2, 2012. Because the complaint dealt with criminalactivity both on the preneed side and otherwise, the complaint was referred first to Ralph Laytonof the Attorney Generals Office and then to the Parkersburg Police Department.

    The complainant is a ward of the State and at the time of the filing of this complaint was apatient at Sharp Hospital, Weston, having been committed there by Order of the Wood CountyCourt for arson of his home. Although the complainant is a patient of a mental facility, he hasnever been declared incompetent, and according to his case worker, is quite capable to handlinghis affairs. He is only required to have a Medical Power of Attorney for his medical treatmentwhile at Weston or such other facility as he may be transferred to.

    The Complainant alleges that during his commitment at Weston he entered into two preneedcontracts with Kimes Funeral Home in Parkersburg, WV. One for himself for the purchase of acopper casket and the other for funeral arrangements for his brother. He also made Mr. Kimeshis Power of Attorney and entrusted him to hold several thousand dollars of Travelers Checks. Sometime in 2012 complainant attempted to transfer his preneeds to another funeral home inParkersburg and Mr. Kimes advised that funeral home that the complainant was incompetent andcould not make that decision. Kimes also advised the other funeral director that he did havesome Travelers Checks but that they had been cashed. The complainant had a list of the checknumbers and denominations and had American Express trace the checks. Copies of the cashedchecks were provided to this office and were subsequently provided to the Attorney General and

  • the Parkersburg PD.

    Mr. Laytons investigation of the matter resulted in Kimes being required to repay the complaintthe $5,000 in travelers checks that Kimes had cashed and used for his own interest, and to refundhim the cost of the bronze casket which was purchased supposedly under a preneed contract,however, the casket was at the funeral home and the funds were never put in trust.

    Although the AG did find that Kimes had violated the law in not only this complaint but in othercontacts as well, and then instructed Kimes to return money to the complainant, they did notrefer the matter to law enforcement.The Parkersburg Police Department made an investigation and determined that the checks werecashed, but since Kimes had repaid the money they decided not to prosecute and closed the case.

    Kimes initially defended his action saying the complainant was mentally incompetent, however,he obviously did not believe him to be so mentally incompetent that he had the complainantmake him his POA and proceeded to enter into a preneed contract with him for himself as wellas one for his brother. In addition, he accepted five thousand dollars in Travelers Checks tohold for the complaint. Mr. Kimes responded that . . . I have not been charged with anycrime with any law enforcement agency and all matters dealing the Pre-Need Division of theState Attorney Generals Office have been cleared up.

    After reviewing the police reports, the conversations with Board staff and the Attorney GeneralsOffice and with Mark Hickman of Vaughan Funeral Home, the Committee is of the opinion thatMr. Kimes did not act in a professional manner and that he acted in a willful departure fromaccepted standards of professional conduct (30-6-23(a)(3). The Committee recommends thatKimes be REPRIMANDED for his handling of Norman Reynolds money and be warned thatfuture such conduct will result in disciplinary action.

    COMPLAINT 2013-14

    The file contains numerous letters from the complainant alleging a conspiracy between ReasnerFuneral Home, an attorney, and members of her extended family. Most are confusing andincoherent. She also claims an investigation of the deceaseds doctor by the FBI which seems tobe substantiated by a copy of some correspondence but which does not pertain to her complaintthat her husbands body was sent to Reasner without her permission.

    It is unclear why the Ohio ME released the body to Reasner without authorization from his wife,if, in fact, they knew he was married. There were police officers at his home and it would seemthat they would have made notation of her being his wife. However, the Ohio ME evidentlybelieved that Reasner Funeral Home was supposed to receive the body and releasedcomplainants husband to them.

    The funeral home states that they were unaware until after the deceaseds sister came in to makethe arrangements that he was married and called complainant to ask her to come in and bring themarriage license. (The sister supposedly told the police, at the time of death, that the deceased

  • and complainant had divorced but were living together).

    The complainant went to the funeral home and provided the death certificate. She made nodemands that the deceased be moved to another funeral home nor did she protest that he hadbeen improperly removed from Ohio without her consent. Complainant advised the funeralhome that she had no money to pay for a funeral. As this was an Ohio death, there were nofunds available from Ohio to pay for the funeral. The deceaseds mother and sister offered topay for the funeral expenses and the complainant, who was accompanied by a friend, signed awaiver of her right to make final disposition.

    There is some reference to Bill Watson, an attorney in Wellsburg, being involved in this coverup. However, Mr. Watson is the attorney for the family of the deceased in an oil/gas leasedispute and has advised us that he knows nothing about this matter. The funeral home states thatthey called their attorney. Not Mr. Watson, for advice on the waiver.

    The EMS report lists several narcotic medicines that were prescribed to the deceased, and itseems that the doctor who prescribed those meds also was injecting him with experimentalmedicines. This appears to be the basis of the FBI investigation.

    Most of her complaints relate to activities which are not under the jurisdiction of this Board. There is also the issue of a headstone being purchased by the mother for his grave but again, thecomplainant had no money for the headstone and as a general rule that would be a part of thefinal disposition. In addition, the deceased in buried in a plot owned by his mother.

    The complainant has lost her husband and daughter to tragic deaths and I am advised that herfriend, who accompanied her to the funeral home, died approximately 2-3 weeks later. Thesetragic events no doubt contribute to her confusion.

    There is nothing to indicate that the funeral home violated the provisions of the Funeral ServiceExaminers Act and the Committee recommends that this complaint be dismissed.

    JOSHUA GREEN - APPRENTICE APPLICATION

    The applicant has been convicted of DUI, third offense, and is currently on parole in MonongaliaCounty through October, 2014. The Administrative Assistant has talked with the parole officerwho states that Mr. Green spent one year on home confinement and has completed his classes forreinstatement of his drivers license, has had no dirty urine or drug screens and has been a modelparolee. The applicant has been an employee of the funeral home for some time and has decidedto make that his career choice. He meets the educational requirements to begin the apprenticeprogram. The Committee recommends that his application be accepted on a probationary statusand that his period of probation run concurrent with his current parole in Monongalia County.

    On motion of John Stump, seconded by Chad Hutson, the recommendations of theComplaint Committee were unanimously accepted by the Board.

    April 2, 2014

    The Special Meeting of the Board was called for the purpose of resolving thematters contained in two complaints and was held via telephone conference. Themeeting was called to order at 9:20 a.m. by President Chad Harding. Members present:Chad Hutson, Keith Kimble, Ira Handley, John Stump, Chad Harding, Sarah Lobbanand John Fahey. Non members present, Regina Foster, Executive Director andConstance Sloan, Administrative Assistant. The public portion of the meeting wasattended by Junora Walton and her attorney, Timothy A. Bradford.

    Chad Hutson moved to go into Executive Session pursuant to WV Code 6-9-4(4),seconded by Sarah Lobban. The motion carried unanimously.

    On motion of John Stump, seconded by John Fahey, the Board voted to return topublic session

    The Board then moved to the recommendations of the Complaint Committee asfollows:

    COMPLAINT 2013-11 and 2013-15:

    Both complaints herein are consolidated into a Consent Order and Decree withthe following conditions:

    1. Junora Walton will practice under probation and supervision for a period ofnot less than six (6) months during which time she will be supervised by Jeremy Brown. The supervision will be required at such time as Ms. Walton meets with families for thepurpose of making funeral arrangements and during the period of time the respondentembalms a deceased body. Ms. Walton is to notify Mr. Brown immediately uponreceiving a death call and arrange with him for the date and time of the embalming andto set a mutually agreeable time for all parties to meet for the arrangements conference.

    2. Jeremy Brown is not to be considered the Licensee in Charge of WaltonsChapel of Faith and shall incur no liability for the actions of Junora Walton. JeremyBrown is not an employee of the Board of Funeral Service Examiners and anycompensation for his supervision of Ms. Walton will be arranged between the two ofthem.

    3. Jeremy Brown shall prepare a report of his observations of the funeralarrangement meetings and the embalmings and submit them to the Board after eachsuch occurrence. These reports will be reviewed by the Board at its June and October,2014 meetings and should there be any problem areas noted, Ms. Walton will benotified of the problem and the actions necessary for corrections.

  • 4. Junora Walton is to pay $750 to Meshea Poore; $500 to the Board ofFuneral Service Examines as administrative fees incurred in Complaint 2013-11;and$250 for a reinspection fee. The period of probation/supervision shall not ceaseuntil all such fees have been paid. The Executive Director may enter into a paymentplan for the fees due the Board.

    5. In the event of any violations during the term of the Consent Decreebetween the Board and Junora Walton, the Consent Decree shall become null and voidand the Board will immediately notify its legal counsel to begin proceedings to suspendor revoke the license of Junora Walton and Waltons Chapel of Faith Funeral Home.

    6. The issues in Complaints w2013-11 and 2013-15 are incorporated forresolution in the Consent Decree.

    7. This Consent Decree is a public record as defined in W. Va. Code 29B-1-2(4).

    The Board then moved to the recommendations of the Complaint Committee as follows:

    COMPLAINT 2013-16

    The Complainants daughter died in Seattle, WA and was cremated. Her ashes wereshipped to complainant for burial in WV. To make a long story short, on January23, 2013 she met with Tim Sizemore, the owner of the Stockert-Sizemore FuneralHome and arranged for the burial, purchase of a monument and for the funeraldirector to have a priest bless the grave. At the initial meeting she paid a deposit tothe Mr. Sizemore in the amount of $150 and later paid the balance of $332 on hercredit card. After going home she noticed the name was misspelled and called thefuneral director who said he would have it corrected. He was supposed to contactthe family when the grave was ready but did not do so.

    On Memorial Day 2013 she visited the grave site and the monument had thedaughter=s last name misspelled even though the funeral director had assured herthat it would be corrected before it was even cut. She claims she made numerousother calls to the funeral home with no success.

    Later, she talked with Anthony Palette who advised he was buying the funeralhome and met with him and he said he would take care of the situation. She toldhim about the cremation jewelry she had left at the mortuary which were to haveashes put in them and that her daughter=s fiance was to take a small amount ofashes with him to Europe to scatter. Mr. Paletti told her she needed to buy aspecial thing t carry ashes out of the country and that the cost was $50 which shepaid to him at that time.

  • In October 2013 she talked to Mr. Paletti again and states that he told her it wasnot his problem and she should look to the former funeral director (Tim Sizemore)to have the matters taken care of. In December 2013 having received no resolutionof these matters she filed a complaint with the Board.

    Tim Sizemore refused to answer the complaint and in a telephone call with the Board officestated he was practically bankrupt and living with a relative and had no source of income which Ibelieve to be untrue. Anthony Paletti filed an answer and stated that he did not become theowner until December 19, 2013 and was not responsible for anything the former owner said ordid.

    The representations made by Anthony Paletti are not completely true. He was actively involvedwith that funeral home for the majority of 2013, even placing ads in the newspaper with hispicture and adding his name to the funeral home. Board personnel personally told the him that hecould not do what he did without the ownership of the funeral home being transferred to him. As a result, what happened is that the other person who was a partner of the former owner andwho held a lien on the property, foreclosed and Anthony Paletti then bid it in. Even then, it wasseveral weeks before the paperwork was filed in the Board office and only after he was calledand told either get the paperwork here or close up did the Board finally get the paperwork for thenew ownership of the funeral home.

    The complainant instructed the Board not to bring the complaint before the Committee inFebruary as she was trying to get the matter resolved with Mr. Paletti. She has now advised usthat the ashes are buried in the grave that has been blessed by the priest and that she does notwish to proceed with the complaint.

    The Complaint Committee recommends dismissal of the complaint with a letter being written toMr. Paletti that his involvement with the funeral home prior to his purchase of the funeral homedid obligate him to take responsibility for the actions of the former owners in this matter just ashe is responsible to any problems which may occur with preneeds.

    COMPLAINT 2014-02

    Complainants mother died on December 4, 2013 and her body was transported to Frey FuneralHome sometime later, approximately 9 hours later. The complainant states that the Mr. Freytold them that something had gone wrong in the embalming process having to do with tissuegases and that she could not be shown. Complainant says he suggested cremation and that theythought her body had already been sent to the crematory and she demanded to see the body,which she did. She then complains he did not get the death certificates and that they had to do it,however, it seems that the problem was that Hospice had not processed the death certificates.

    Mr. Frey responds with a detailed description of the measurers he took in the embalmingprocess, and that his reference to cremation had to do with authorization for embalming. He

  • further states that the complainant has not paid the bill and only complained after receiving asecond notice.

    The complainant received a copy of the funeral directors response. She was advised that theinvoice submitted was within the prices on his price list and that she had, in fact, received a $950discount. We have received no response from her.

    Mr. Frey can be brusque at time, however, he has always been fair with his consumers. It is truehe should have given her a Statement of Goods and Services at the time of the arrangementsconference or no later than the day of the funeral, however, I he stated he wanted to have thecorrect amounts for obituary costs, etc. As Hospice had not processed the death certificate hecould not file it with Vital Registration.

    Complaint Committee recommended dismissal of the complaint with a letter to the funeraldirector that in the future if he does not have the costs of certain cash advance items that he makea good faith estimate and give the family the Statement of Goods and Services at the time of thearrangements conference but no later than the day of the funeral. If the costs are less, he canrefund money, if they are more he can bill for the difference. He would, of course, indicate onthe Statement that these are estimated costs.

    On motion of Chad Hutson, seconded by Ira Handley, the recommendations of theComplaint Committee were unanimously accepted by the Board.

    On motion of John Fahey, seconded by Sarah Lobban, the Minutes of the February 4,2014 meeting were approved unanimously.

    On motion of Chad Hutson, seconded by John Fahey, the Financial Reports for January,February, March and April, 2014 were unanimously approved.

    On motion of Ira Handley, seconded by Keith Kimble, the P-Card reports for January,February, March, April and May, 2014 were unanimously approved.

    The Board was then updated on the criminal process for James Patton and Elk FuneralHome and the latest filing against Broyles-McGuire Funeral Home by the Attorney General.

    The Board then discussed holding continuing education seminars in several locationsaround the State in September, October and early November. The Board was advised that themoney had been set aside in the budget for payment of instructors, meeting rooms, etc. Onmotion of Chad Hutson, seconded by Sarah Lobban, the Board voted unanimously to hold theseminars and instructed the Board staff to proceed with plans for the same.

    The need to fill the vacant position of Administrative Assistant was discussed, and onmotion of John Fahey, seconded by Ira Handley, the Board unanimously voted to fill theposition. Starting salary is to be $35,000. The President and Secretary of the Board are tointerview prospects and decide on the person to ultimately be hired.

  • The matter of election of officers of the Board was next on the Agenda. Chad Hutsonmade the motion that Chad Harding continue as President of the Board. The motion of secondedby Keith Kimble. There being no other nominees, the Board voted unanimously to elect ChadHarding as the President.

    Chad Hutson then moved that John Stump continue as the Secretary of the Board,seconded by Sarah Lobban. There were no other nominees and the Board voted unanimously toelect John Stump as Secretary of the Board.

It was noted that because of the change to OASIS thatmonthly reports from June to date were unavailable from the Auditors Office or the Departmentof Administration and would be presented to the Board at a later date.

    On motion of John Fahey, seconded by Keith Kimble, the P-Card reports for June, Julyand August, 2014 were unanimously approved.

    On motion of Keith Kimble, seconded by Chad Hutson, the payment of membership duesto the International Conference was unanimously approved.

    The Board then discussed the payments from DHHR as it relates to green burials andthe fact that funeral homes are not being paid for those burials but will pay for cremations. Onmotion of Ira Handley, seconded by Keith Kimble, the Board voted to direct a letter to DHHRasking for their regulations to be amended to allow payment of the $1250 for green burials whentraditional caskets and vaults were not utilized. The Board acknowledges that this is a growingtrend and that funeral homes should not fear charges being brought against them foraccommodating the wishes of the family based on outdated regulations.

    The Board then discussed the lack of payments from the Medical Examiner for providingtransport services and from DHHR for indigent burials. On motion of John Fahey, seconded bySarah Lobban, the Board voted unanimously to contact the Governors Office and DHHR toinquire as to when these payments can be expected to resume in a timely matter.

    The Board next took up the matter of transport services being provided to the MedicalExaminers Office by funeral homes and that these funeral homes are showing up at crimescenes, accident scenes or at homes where an unattended death had occurred in vehiclesdisplaying the name of their funeral home and wearing name tags from their funeral homes. Insome cases, these persons are openly soliciting services in violation of the law. On motion of

  • John Fahey, seconded by Sarah Lobban, the Board voted to have the Director contact theMedical Examiners Office and advise them that these transports are their agents and in must notuse marked vehicles. Keith Kimble did not vote.

    The Board, on motion of Ira Handley, seconded by Sarah Lobban, voted unanimously toseek legislative change, either by modification of the statutes relating to funeral service, or bylegislative regulations, to require ownership of funeral establishment to be noted in theiradvertisements. This would include sole proprietorships and corporate owned funeral homes.

    On motion of Chad Harding, seconded by Keith Kimble, the Board voted unanimouslythat the duties of staff should be designated, but at the same time staff would at all times assistothers in the performance of their duties.

    Regina Foster is primarily to work on the OASIS program in order to be able to pay bills,make deposits, process travel and any other functions which are integral to the operation of theoffice. She is to gradually phase in Amanda to this system so that eventually the office will havetwo persons who can conduct the finances of the office.

    Amanda Legg will do data entry of all continuing education hours, apprentice reports andinspection reports. She will process new applications for establishments or individual licenses. She will help with filing and eventually the reorganization of the files with Connie and phaseinto the Oasis system.

    Connie Sloan is to be the Office Manager and will oversee the workflow of the office,which means designation of tasks, she will coordinate vacation schedules and will keep timerecords, handle complaints, and assist with Budget preparation.

    The Board then discussed inspection reports and the need to hire an additional inspectorand to split the inspections as to regions as had been done in the past. The Board inquired if IraHandley was still interested in doing inspections and he replied in the affirmative. On motion ofSarah Lobban, seconded by John Fahey, the Board voted unanimously to hire Ira Handley to fillthe second inspector position and to split the state into two inspection areas, effective November1, 2014.

    The Board set the next meeting for February 10, 2015.
