REPORT NARRATIVE SYNOPSIS: On 09/07/14, at about 1630 hours, Deputy Gracza (2412) responded to a report of a domestic violence incident that occurred at Summit Avenue, in the City of Encinitas. Bishop Slingerland (DOB

) and his girlfriend (DOB ) became engaged in a verbal argument. became angry due to Slingerland's drinking and possible drug use which resulted in

taking Slingerland's key to her residence. She put all his personal property on the front porch. stated Slingerland placed both of his hands around her neck and attempted to choke her. Additionally, Slingerland threw a plastic and glass picture frame at resulting in two red marks on her left arm. See case #14145799. On 09/07/14, at about 2050 hours, Bishop Slingerland returned to residence and broke the window to gain entry into the residence. Deputies arrived at the residence and located a bloody broken front window. Slingerland was heard inside the residence and was told to exit, but he did not comply. Deputy Chapman (#2683) released his K-9 which made contact with Slingerland. Slingerland was taken into custody and admitted to breaking the front window to gain access to the residence. Slingerland stated he no longer lived at the residence. Slingerland was arrested for 273.5 PC - Spousal Abuse with Visible Injury from case number 14145799 and 459 PC - Residential Burglary. One CD containing photos and four DNA swabs were placed into Encinitas Evidence. ORIGIN: On 09/07/14, at about 2050 hours, I was dispatched to Summit Avenue, in the City of Encinitas to investigate a report of a residential burglary in progress. BACKGROUND:

On 09/07/14, at about 1634 hours, Bishop Slingerland (DOB ) and his girlfriend (DOB became engaged in a verbal argument. owns the residence located at Summit Avenue in the City of Encinitas. She allowed Slingerland to live at the location when their relationship was going well. became angry due to Slingerland's drinking and possible drug use.

took Slingerland's key and placed all his personal property on the front porch. When Slingerland returned, he became enraged and used a screw driver to try and gain entry into the residence. Slingerland was unsuccessful, but broke a wooden piece of the front door, cracked a window, and removed a window screen.

stated Slingerland used both of his hands, placed them around neck, and attempted to choke her. Additionally, Slingerland threw a plastic and glass picture frame at resulting in two red marks on her left arm. During the incident, Slingerland threatened to kill and then kill himself. See case #14145799 for details. INVESTIGATION: On our way to the residence, Deputy Murray (#0690) set up a perimeter position on the residence. Deputy Murray and I arrived on the scene. Deputy Chapman and his K-9 partner (Rex) were on scene speaking with the reporting party, (DOB ). pointed in the direction of where he heard the broken glass come from. There was a long "L" shaped driveway that approached the residence, which is shared by other residences. Deputy Chapman, Rex, Deputy Murray, and I approached the residence of Summit Avenue, in Encinitas. There was a white 2005 Toyota Tacoma (CA in front of the residence. The front driver's side door was open. The registered owner of the vehicle was Bishop Slingerland. We approached the vehicle. The vehicle was unoccupied, clothing scattered in the backseat, and dried blood on the center console. Deputy Santalo (#6960) and Deputy Johnson (#5417) arrived on scene and took a perimeter position behind the residence. Deputy Chapman, Rex, Deputy Murray, and I walked up the steps of the residence. At the top of the stair case, broken glass and blood splatter was on the floor. The front window of the residence was broken with blood located inside and outside of the window. I was able to hear someone, later identified as Bishop Slingerland, inside the residence. inside the residence. Deputy Murray had his department issued Glock 22 hand gun pointed at Slingerland. Deputy Chapman removed Rex from Slingerland. I placed Slingerland into handcuffs.

Slingerland was helped to his feet and escorted down stairs to be treated by paramedics. Paramedics determined that Slingerland needed to be transported to Scripps Hospital in La Jolla. Deputy Murray rode with Slingerland in the ambulance (See Deputy Murray's deputy report for details).

Deputy Johnson contacted and obtained his statement.

, and gave her a call to see if she was ok. stated she was not home. stated Slingerland had been acting weird. requested call the Sheriff's Department and he did. noticed Slingerland's vehicle in the driveway with the front door open.

INVESTIGATION (Continued):

Deputy Santalo took 60 photographs of the residence and the vehicle. I located blood outside the window. I took a DNA swab from outside of the window sill where the blood was located. I secured the swab into an evidence envelope. I located blood on the inside of the window. I took a DNA swab from inside of the window sill where the blood was located. I secured the swab into an evidence envelope. I located blood in the bedroom on the bed. I took a DNA swab from the bed where the blood was located. I secured the swab into an evidence envelope. Deputy Colburn (0095) located blood inside Slingerland's vehicle's center console. Deputy Colburn took a DNA swab from the center console where the blood was located. Deputy Colburn secured the swab into an evidence envelope.

Slingerland's vehicle was towed per 22651(h)(1) CVC- Driver arrested. entered Slingerland's vehicle into Sheriff's Teletype as a stored vehicle.

I returned to the Sheriff's Encinitas Station. Deputy Santalo copied the digital photos onto a CD. I placed the CD and each DNA swab into evidence.

Vista Detention Facility Deputies arrived at Scripps Hospital in La Jolla and took custody of Slingerland.

I concluded my preliminary investigation.

On 09-07-2014, at about 2051 hours, I (Unit #10K12) was working as a Deputy Sheriff assigned as a Canine Handler to the Northern San Diego County Canine Centralization Unit when I received a radio call (CAD #E1934421) to assist Encinitas Patrol Units with a residential burglary in progress at Summit Avenue in the city of Encinitas. I was wearing a full Sheriff's Canine uniform and was driving a fully marked Canine patrol vehicle (#20283) equipped with overhead lights and a siren.

The reporting party, (DOB told Sheriff's dispatch he heard glass breaking at his neighbor's residence and observed a white male adult crawling through the window. said he does not believe the male lives at the location and assumed the neighbor's residence was being burglarized. also relayed he had called

(DOB ), the resident who lives at the location, who stated no one had permission to be inside her residence. In addition, relayed to that she believed the suspect could possibly be her ex-boyfriend who was later identified as Bishop John Slingerland (DOB .

also called Sheriff's dispatch, as this call was unfolding and advised she had been involved in a domestic violence incident (CAD #E1933985) earlier in the day with her ex-boyfriend, Bishop Slingerland who stated he was going to kill her rabbit which was loose in the house and not caged. also confirmed he (Slingerland) never actually lived there, just stayed there off and on when allowed.

Several other units confirmed the suspect was possibly Bishop Slingerland, who was currently wanted for a domestic violence incident which occurred at the location earlier in the day.

It was later learned that on 09-07-2014, at about 1634 hours, Bishop Slingerland and his ex-girlfriend, became engaged in a verbal argument at Summit Avenue in the city of Encinitas. became angry due to Slingerland's drinking and possible drug use. During the verbal argument, Slingerland attempted to choke by placing both of his hands around her neck. Slingerland also threw a plastic and glass picture frame at resulting in two red marks on her left arm. During the incident Slingerland threatened to kill and then himself. Slingerland then fled the location in his vehicle. Probable cause exists to arrest Bishop Slingerland for violation of 273.5 PC (Felony Domestic Violence).

Shortly thereafter, Slingerland confronted current boyfriend only know as " at an unknown location in Encinitas. During a subsequent altercation, Slingerland sustained an injury to his leg. Slingerland then drove back to

apartment where he parked his 2005 Toyota Tacoma pickup (CA Lic ) in the front driveway and scaled a flight of stairs to the second story apartment.

It is unknown what Slingerland's intention was by returning back to residence and the scene of the earlier domestic violence incident. We can only assume Slingerland had returned to the location to cause bodily harm to who was currently not at home and / or her rabbit.

I know based on my 23 years of law enforcement experience as a Deputy Sheriff that suspects who use illegal drugs often act and display irrational behavior as Slingerland was demonstrating. These types of subjects will often become extremely violent when confronted and use any means possible to escape capture. They also have a high tolerance for pain due to alcohol and illegal drugs in their systems. This was a high risk incident which was going to place law enforcement in a position of disadvantage based on the fact Slingerland was in a second story apartment and had a view of the surrounding area. It was also unknown if Slingerland was armed with a weapon. Suspects displaying irrational / suicidal behavior, similar to Slingerland's, have been known to ambush and use weapons against law enforcement to avoid arrest and a lengthy prison term.

My intention was to have the canine available at the scene as a psychological deterrent to any aggressive acts Slingerland might make against us. Additionally, I wanted to prevent the using of a higher level of force.

DEPUTY'S OBSERVATIONS AND ACTIONS:

I arrived on scene at approximately 2056 hours, removed my canine partner "Rex" from my patrol vehicle and began walking down the street, toward the location of the call. I was then flagged down by the reporting party, who was standing at the top of the driveway leading down to the apartment / condo complex where the incident was occurring.

began briefing me on what he had seen and heard as other units began arriving on scene. Deputies Murray #0690 (Unit #23P1C) and Ivicevic #9271 (Unit #25P3C) were the first units to arrive on scene and met with me. We quickly formulated an action plan and approached the location to get a better view of the area. As we walked toward the location we observed a white Toyota Tacoma (CA Lic ) parked in front of a two story apartment building. The driver's side door to the vehicle was partially open.

About this time, Deputies Colburn #0095 (Unit #25P7C), Plantz #4370 (Unit #21P1C), Johnson #5417 (Unit #25P5C) and Santalo #6960 (Unit #20P1C) arrived on scene and began setting up a perimeter around the location. With containment on the perimeter and the location being on the second story we decided to approach the location to try and contact Slingerland who we believed was inside the location.

Several lights were on inside the apartment, but we could not see anyone inside. I could hear the sound of movement inside the apartment, which verified someone was inside.

Deputy Murray, Ivicevic and I slowly walked toward the bottom of the staircase to position ourselves in a safe position of cover at the corner of the ground level garage, just below the apartment. I then unscrewed the light bulbs from a motion light positioned at the bottom of the staircase to place us in a position that was not illuminated by light. As I was doing this other Deputies cleared any threats inside the pickup and surrounding area. During a glance inside the open door of the pickup, Deputies observed fresh blood inside the cab. This information was relayed to Deputies standing nearby. The origin of the blood was unknown if it was from Slingerland or another victim.

It is my experience that domestic violence suspects will often return back to the victim's residence to retaliate and / or verbally abuse the victim so they will be uncooperative with any follow-up investigation by law enforcement. Suspects will also threaten to kill their victim or commit suicide to gain their compliance. I felt Slingerland returning back to the location was a continuation of the earlier domestic violence incident.

With perimeter units in place, Deputy Murray, Ivicevic and I began our approach to the location. We traversed up a staircase leading up to the second story unit at Summit Avenue with "Rex" and I taking the lead.

As we walked up the staircase we determined it led up to a second story balcony which only accessed the victim's apartment. The upper walkway / balcony turned to the left toward the front door. A window was positioned near the front door, which looked directly into the kitchen, just above the sink. The approach exposed us to extreme danger since we had no safe exit or place to retreat if Slingerland was armed with a weapon. The front door to the apartment was approximately 10 feet from the top of the staircase. I was concerned that if Slingerland exited the apartment armed with a weapon or in an assaultive manner we would not be able to react to the threat in a timely manner. Based on this I took the lead position with the canine as we walked up the staircase and toward the front door of the apartment.

While at the top of the staircase, I peeked around the corner and observed a weight lifting dumbbell positioned on a table just under the kitchen window which was shattered and damaged. I believed the dumbbell might have been used as a tool to shatter the window. Blood droplets were visible on the balcony floor and smeared blood was visible on the window frame and surrounding areas. It appeared whomever was inside had possibly cut themselves, as they forced entry and were bleeding.

I immediately began giving verbal announcements into the apartment through the shattered window. I yelled, "Sheriff's Department" several times and began giving canine announcements. As I was giving my third canine announcement, I heard a male voice respond back to me. The subject who was later identified as Bishop Slingerland stated he had been sleeping and was not coming out because he had a broken leg and could not walk. I know that suspects will often lie to law enforcement hoping they will just leave. I did not believe Slingerland had been sleeping because we could hear movement inside the apartment as we set up the perimeter.

I continued giving announcements and ordered Slingerland several more times, to come out or I would send in my canine. I ordered Slingerland to crawl out and show me his hands several times. After no response or cooperation from Slingerland, I believed he was trying to stall his exit so he could gain the upper hand on us. It had been two to three minutes from the time I first began giving announcements for Slingerland to surrender and come out with his hands in the air. The apartment Slingerland had entered was a small one bedroom apartment with a bathroom, kitchen and family room. From my position near the window, I could visually clear the kitchen and family room. I believed Slingerland was answering back to me from the bedroom or bathroom, which was positioned down a hallway.

From where Slingerland's vehicle was parked outside he would have had to walk or even crawl, if his leg was broken, to gain access up the staircase and into the apartment through the window. If Slingerland actually did have a broken leg it is my belief he would still be able crawl out to the front door and unlock it for us. At this point, I had given Slingerland sufficient time to exit the residence and believed he was not going to surrender peacefully.

I felt it was unsafe for me and my partners to enter the apartment to apprehend Slingerland without the use of my canine partner. I was increasingly concerned due to the blood found in Slingerlands pickup, his refusal to exit the apartment and his untruthfulness about being asleep. Based on the totality of the circumstances, I believed he posed a serious threat to me and my partners.

In order to protect myself and my partners from injury and reduce the likelihood of a deadly force incident, I believed the best method to apprehend Slingerland would be to deploy "Rex" through the window and into the apartment. Using "Rex" as a force option would prevent me and / or my partners from possibly getting injured. This would also give us time to force open the locked front door and divert Slingerlands attention away from us. I quickly lifted "Rex" into the open window and gave him the command to search. Within seconds, "Rex" ran into a narrow hallway leading from the living room into what I believed was a bedroom area. I then heard the sound of someone yell and began giving "Rex" the apprehension command.

I quickly turned toward the front door and began giving the front door rear mule kicks to force it open. On my second try, the buckle on my gun belt released and opened. I then had Deputy Murray kick open the front door as I reattached the buckle on my belt.

At this point, "Rex" had made contact with Slingerland's right bi-cep and was pulling him from the end of the hallway across the living room floor on his back. As I entered the living room, I noticed that Slingerland had an injury / laceration to the left side of his jaw / neck. It was later determined that "Rex" had first made contact with Slingerland on the jaw / neck and then repositioned to the right bi-cep. As I neared Slingerland, I began giving him verbal orders to get onto his stomach. Slingerland complied. I then ordered "Rex" to release his hold on Slingerland which he did. Slingerland was then placed into handcuffs without further incident. A request for paramedics was then made for the canine contact along with a notification to the Canine Supervisor, Sergeant Hout #2284.

Slingerland was then escorted by Deputy's from the apartment, down the staircase to the front driveway for medical evaluation by paramedics.

Sergeant Berlinsky #1328 arrived on scene and acknowledged that force was used.

Encinitas Paramedic Unit #2392 and Engine #2311 arrived on scene. Paramedic medically triaged Slingerlands injuries. Slingerland was transported to Scripps La Jolla Hospital for further treatment. M.D. medically evaluated Slingerland who had sustained a canine contact bite on the left side of his lower jaw / neck and a second canine contact bite on his right bi-cep. Slingerland had also sustained a laceration across the top of his fingers on his left hand. It is believed these injuries were sustained when Slingerland shattered the window to the apartment. It was also determined that Slingerland sustained a broken left (tibia) leg, which is believed to have occurred prior to our call based on Slingerland's statement. M.D. told me Slingerland would need further surgery to the injuries to his left fingers / left leg and would need to be admitted into the hospital for treatment.

Sgt. Berlinsky later arranged through Central Detention Facility for a Detention Deputy to respond to the hospital to take over supervision of Slingerland who was expected to be in the hospital for a few days.

Sergeant Hout from the Sheriff Canine Unit arrived at Scripps La Jolla Hospital to complete a K-9 deployment investigation. I later completed a Department of Animal Control Bite Report, which was faxed on 09-08-2014 @ 0115 hours, to the Escondido Humane Society. A County of San Diego (Use of Force) SO-120 form was completed, which detailed the canine contact points along with force used by Deputy Murray during the apprehension of the suspect.

Slingerland was charged with violation of 459 PC (Residential Burglary) and 273.5 PC (Spousal Abuse). Slingerland is currently receiving medical treatment at Scripps La Jolla Hospital and will be later booked into the Central Detention Facility.

REPORT NARRATIVE

ORIGIN: On 09/07/14, at about 2050 hours, I responded to a residential burglary call at Summit Avenue in the city of Encinitas DEPUTY'S OBSERVATIONS AND ACTIONS: While driving to the call, dispatch advised me the reporting party (RP) stated he heard a male crying on his neighbor's balcony. He then heard breaking glass and saw a male crawling into the neighbor's home. The RP stated he did not believe the male lived at the location. A second RP, the homeowner, called in stating her neighbor had called her, and told her someone was breaking into her apartment. The homeowner said she thought the subject breaking into her home was her ex-boyfriend, Bishop Slingerland. Deputy Colburn advised dayshift had been to the location earlier in the day and taken a domestic violence report. The suspect from that call, Bishop Slingerland ( , had not been located. Deputy Gracza wrote the report (CN 14145799) and had told me at shift change there was probable cause to arrest Slingerland. Slingerland was said to be driving a white Toyota Tundra. I arrived on scene at about 2056 hours. Deputies Ivicevic, Santalo, Johnson, Planz, and Colburn arrived to establish a perimeter around the residence. Deputy Chapman and his patrol trained K9 partner Rex also arrived on scene. Deputy Chapman, Rex, Ivicevic and I walked to the residence, which was down a long driveway. As we walked down the driveway I saw a white Toyota Tundra bearing California plate parked in the driveway in front of the residence. The driver's door was open, and it was unoccupied. The Tundra came back registered to the suspect, Slingerland. We approached the front door of the residence, which is located on the second story. A window next to the front door had been shattered, and there was broken glass on the ground. I saw blood on the window frame. I removed my department issued Glock 22 handgun and held it in the low ready position. I believed the suspect in the house had been involved in a

domestic violence incident earlier in the day, and had now forced entry into the residence. I did not know if the subject was armed with any type of weaponry, which could have been used to harm myself, or my partners. Deputy Chapman made several K9 announcements into the residence. After several announcements I heard a muffled male voice reply from inside the residence, "I'm sleeping." Deputy Chapman gave several more K9 announcements, ordering Slingerland, by name, to exit the residence. Slingerland yelled back, "I can't, my leg is broken." Chapman ordered Slingerland to crawl out and show his hands. I could not see into the residence from my position of cover. Suddenly I heard Deputy Chapman yell, "Show me your hands, show me your hands now!" Deputy Chapman deployed Rex through the shattered window into the residence. Within a second or two of Rex entering the residence I heard Slingerland start to scream. Deputy Chapman told me to kick the front door of the residence. I was able to force entry into the apartment by kicking the front door. As I entered the residence, followed by Deputy Chapman and Deputy Ivicevic, I saw Rex making contact with Slingerland's left jawline. Rex then moved, and made contact with Slingerland's right bicep area. Deputy Chapman ordered Slingerland to stop fighting with his dog, and lay on his stomach. As Deputy Chapman moved to secure Rex, I pointed my Glock at Slingerland. I did not know if Slingerland had armed himself, or if he would use any weapons against me or the other deputies once Rex was released from the contact. I kept my Glock pointed at Slingerland for about ten seconds while Deputy Chapman removed Rex and Deputy Ivicevic handcuffed Slingerland. Once Slingerland was secured in handcuffs, I requested paramedics respond for treatment of wounds on his neck, and arm. I also noticed a gash on Slingerland's right hand. While Deputy Chapman watched the handcuffed Slingerland, Deputy Ivicevic and I cleared the remainder of the residence. When I entered a bedroom I saw blood on the bed sheets and on the floor. There was no one else in the residence. Deputy Ivicevic and I walked Slingerland out of the residence. Slingerland complained his left ankle was broken, and was unable to place weight on it. Slingerland slid down the stairs on his rear end as he was unable to walk on his own. We had Slingerland lay on the driveway while we waited for paramedics to arrive. I asked Slingerland, "What were you doing in that house?" Slingerland responded, "I live there." I asked him, "If you live there, why did you break in through the window? Don't you have a key?" Slingerland responded, "My girlfriend kicked me out, she took my key." I then asked, "Why didn't you come out, didn't you hear us tell you that we were going to send in a dog, and you would be bit?" Slingerland responded, "I heard you." I asked him what had happened to his leg. Slingerland told me he had confronted a man who had been messing around with his girlfriend, and he had gotten into a fight, and his leg had been broken. He did not describe how it had occurred. Slingerland was told he was under arrest for a domestic violence charge. Paramedics arrived and transported Slingerland to Scripps La Jolla Hospital for treatment of his injuries. At the hospital Slingerland would repeat, "I fucked up, I fucked up." I asked Slingerland if he ever received mail at the residence he had broken into, and he told me he never had. I asked if he knew his girlfriend had kicked him out, and if he had left willingly. Slingerland responded, "Yes." Hospital staff told me Slingerland would be admitted and possibly need surgery on his broken leg and hand. At about 0134 hours, I read Slingerland the Miranda Admonishment from my Department issued Deputy's Notebook. I asked him question 1, if he understood his rights. He responded, "Yes." I asked him question 2, if he was willing to speak with me. He responded, "No." I did not question him further. At about 0245 hours Deputy Salenko arrived and took custody of Slingerland.

CONFIDENTIAL:

On 09/07/2014, at approximately 2051 hours, Deputy Chapman received a radio call of a residential burglary in progress at Summit Avenue in the city of Encinitas. The reporting party advised he had heard glass breaking and observed a male crawling through the window of the victim's apartment.

Deputy Chapman was a short distance from the location and was the first on scene.

STATEMENT FROM DEPUTY CHAPMAN:

Deputy Chapman arrived on scene at about 2056 hours and spoke with the reporting party. The reporting party, , advised Deputy Chapman he heard glass breaking and looked in the direction from which the noise came. He observed an unknown male crawling through a broken window in his neighbor's apartment. did not recognize the male and believed the apartment was being burglarized so he called 911. told Deputy Chapman he also called the owner of the apartment,

, and advised her of what was happening. advised no one should be at the residence. also advised that the suspect might be her ex-boyfriend Bishop Slingerland.

Several deputies from the Encinitas Station began arriving on scene. Deputy Chapman briefed the responding Deputies on the details of the call. A perimeter was set around the apartment in an attempt to contain the suspect.

As containment was being set, Deputy Chapman was advised had called 911 and relayed to Sheriff's Dispatch that no one should be at the residence. also advised Sheriff's Dispatch that she was the victim of a domestic violence incident earlier in the day and .that Bishop Slingerland was the suspect. Deputy Chapman was advised by assisting Deputies that there was probable cause to arrest Slingerland for domestic violence charges.

Deputy Chapman conducted a pre-deployment briefing with Deputies Murray and Ivicevic and retrieved his canine from his patrol car. Deputies Chapman, Murray and Ivicevic made a plan to approach the apartment and attempt to contact the unknown suspect.

During their approach, they noted the lights in the apartment were on and they could hear noises coming from inside the apartment.

As they approached the apartment, they observed a white Toyota truck parked in front of the apartment building. The driver's door was partially open. Deputies cleared the truck of any threats and noticed there was fresh blood inside the interior. A records check of the truck revealed the registered owner was Bishop Slingerland.

Based on the circumstances, Deputy Chapman believed the suspect inside the apartment might be Slingerland. Deputy Chapman believed Slingerland's return to the apartment and forced entry was possibly a continuation of the earlier domestic violence incident. Based on Deputy Chapman's experience, he knows domestic violence crimes can be highly volatile and can pose a serious threat to responding law enforcement. Deputy Chapman became concerned about the "fresh" blood in the truck and suspected there might be other victims or acts of violence not yet known to the Deputies on scene.

Deputies Chapman, Murray and Ivicevic began to negotiate the stairs leading to the upstairs apartment. Deputy Chapman was concerned about the lack of cover and concealment when walking up the stairs and the short distance between the top of the stairwell and the apartment Slingerland was believed to be inside. Deputy Chapman was concerned if Slingerland exited the apartment in an assaultive manner, or with a weapon, they would have little or no place to fall back, no cover and their reaction time was severely diminished. Deputy Chapman took the lead in the stack going up the stairs with his canine in front of him. Deputy Chapman put the canine up front to be used as psychological deterrent to any violent actions and to assist in a safe approach to the apartment. In an effort to further conceal their approach, Deputy Chapman disabled the lighting illuminating the stairs.

As Deputy Chapman reached the top of the stairwell, he observed the broken window and observed additional blood. There were blood droplets around-the window and blood smears on the window itself. Deputy Chapman announced "Sheriffs Department" several times and received no response. Deputy Chapman began giving canine announcements and still received no response. The announcements were given from the broken window. Based on the size of the apartment, Deputy Chapman felt it would be highly unlikely that anyone inside the apartment would not hear the announcements. Given the fact the lights were on, there was fresh blood in the truck and on the broken window, coupled with the fact the Deputies heard movement inside the apartment as they approached, Deputy Chapman became increasingly concerned about the lack of response and what Slingerland's intentions might be.

Deputy Chapman gave a third canine announcement and heard a male voice, later confirmed to be Slingerland, respond from inside the apartment. Deputy Chapman told Slingerland to walk to the sound of his (Deputy Chapman's) voice with his hands in the air and unlock the front door. Slingerland responded telling Deputy Chapman that he had been sleeping and couldn't come to the front door because he had a broken leg.

Deputy Chapman told Slingerland to crawl out and advised him ifhe didn't comply the canine would be sent in the apartment and he would be bitten. Deputy Chapman received no response. Deputy Chapman attempted to initiate a verbal dialogue with Slingerland but was again met with no response. Deputy Chapman gave additional canine announcements in hopes the threat of the canine would convince Slingerland to cooperate or at least initiate verbal contact. Deputy Chapman received no response.

At this point, based on Slingerland's resistance to follow Deputy Chapman's commands or even engage in conversation and his untruthfulness about sleeping, Deputy Chapman began to believe Slingerland was not going to cooperate or surrender peacefully.

Deputy Chapman could see the family room and kitchen through the broken window, however he could not see into the hallway that led to the bedroom where Deputy Chapman believed Slingerland was located. Based on the size of the apartment, Deputy Chapman decided the safest way for the Deputies to make entry into the apartment was to deploy the canine into the residence while they forced entry through the front door. By deploying the canine into the window, the immediate area could be secured by the canine allowing Deputies to safely enter the doorway. Based on the totality of the -circumstances, Deputy Chapman felt the safest method of apprehending Slingerland was with the use of his canine.

Deputy Chapman deployed his canine into the open window and began immediately trying to force the door open. Deputy Chapman's belt buckle failed and he was delayed briefly opening the door. Deputy Murray immediately moved into position and forced the door open. Once inside the residence, Deputy Chapman observed his canine had made contact with Slingerland's right bicep.

As Deputy Chapman approached, he ordered Slingerland to roll onto his stomach. Slingerland complied. Deputy Chapman immediately ordered his canine to release his bite. Deputy Chapman's canine complied immediately. Deputy Murray handcuffed Slingerland.

Deputy Chapman advised the Sheriffs Communication Center of the canine contact and requested medical assistance. Deputy Chapman also requested the notification the Canine Unit Sergeant.

Encinitas Paramedic Unit #2392 and Engine #2311 arrived and treated Slingerland. Encinitas Paramedic Unit #2392 transported Slingerland to Scripps Hospital located at 9888 Genesee Avenue in La Jolla.

I concluded my interview of Deputy Chapman.

I contacted Slingerland in the emergency room at Scripps Hospital.

STATEMENT FROM BISHOP SLINGERLAND:

Slingerland understood I was interviewing him regarding the use of the Sheriffs Canine and that the interview was being recorded.

Slingerland does not suffer from mental illness.

Slingerland has no problems with his eyes or ears.

Slingerland said he is not using any street drugs.

I asked Slingerland if he heard the Sheriffs K9 announcement. Slingerland said he did. Slingerland said he had a broken ankle and was trying to come out. Slingerland told me he was pushing himself out sliding on his buttocks. Slingerland said he couldn't walk out because his ankle was broken.

Slingerland said he heard 3 canine warnings and then a final one. Slingerland said he came out of the door with his hands up but he was on the ground. Slingerland couldn't stand up because his leg was broken. Slinglerland told me the door he came out of was the "Hallway entrance."

Slingerland said the dog was biting him for 3 or 4 minutes.

Slingerland said he didn't know how the Deputies took the dog off of him. Slingerland said the Deputies wouldn't call him of£ Slingerland said he could not move.

When asked if there was anything he would like to add, Slingerland said he felt like the Deputies knew the dog was biting him on the throat and they didn't stop him. Slingerland felt they saw him and he wasn't fighting back.

I concluded my interview of Slingerland. I photographed Slingerland.

CONCLUSION:

Deputy Chapman's decision to use his canine was based on the following factors:

Slingerland was the suspect of a domestic violence crime.

Slingerland was actively resisting Deputy Chapman's efforts to arrest him by refusing to exit the apartment or verbally respond to Deputy Chapman's orders.

There was fresh blood inside Slingerland's truck and on the outside of the apartment window. Deputy Chapman did not know if Slingerland was armed with a weapon or had committed other crimes of violence related to the earlier domestic violence.

Deputy Chapman used his canine to apprehend Slingerland in an area where it was unsafe for Deputies to proceed.

The use of the canine was within policy and deployed in an appropriate manner.

REVIEW:

On 09/07/2014, at about 2110 hours, I was notified by Sheriffs Dispatch that Deputy Chapman's canine had made contact with Slingerland. I was advised Slingerland had been transported by Encinitas Paramedic Unit #2392 to Scripps Hospital located at 9888 Genesee A venue in La Jolla.

I met with Deputy Chapman at Scripps Hospital and completed the above investigation.

I made all appropriate notifications to both the Communications Lieutenant as well as the on call Divisional of Inspectional Services Sergeant Passalacqua.

Photos were taken of Slingerland's injuries and an interview was conducted regarding the incident. The interview and photographs of Slingerland were copied to a CD-R disc and attached to this investigation.

INJURIES:

Slingerland sustained a laceration to the left side of his jaw and his right bicep.
