JOHN BARTON I, Great XII Grandfather

Husband of Elizabeth Father of John Barton II, Great XI Grandfather

John Barton was referred to in the 1522 Military Survey. He was married to Elizabeth and made his will in 1544. In his will he mentioned his son, John Barton, and his wife, Elizabeth, and her children. Looking at the wording of the will I would suspect that John was not the son of Elizabeth Barton. Willia Barton had a child, born not baptised, buried 22 Dec 1635 Burial: He may have been buried on 15th September 1654 or more likely in 1669: William Barton gent was buried (of?) Morton, November 15, 1669 JOAN SMITH Richard Smyth was marryed to Johan Barton the xxviii th day – May 1621 The first probable child of Richard and Joan Smith in 1623/4 January, namely Johan Smyth, was baptized Witnesses: William Barton, John Smyth and Katheren Smyth RICHARD SMITH (Richard, William), son of Richard SMITH, was born in 1596 in Gloucester, and died between 1 Jan. 1666 and 22 Aug. 1666 in Wickford. He married (1st) JOAN BARTON, who was born about 1599 in Gloucestershire. He married (2nd) of Narragansett, Washington Co., ELIZABETH, who was born in 1599 in Gloucestershire, and died in 1664 in Kingston 1675 lawsuit involving Richard Smith, Junr., of Narragansett Report of Cases Decreed in the High Court of Chancery (167- surely 16695): Eleanor Ireland, Thomas Walthew and Mary his wife, and William Ireland, Plaintiffs. Robert Thurston and Richard Smith, Defendants. William Barton by his last Will dated in 1679 [sic – surely 1669], devised to his Sister's Children, (Whereof Eleanor, Mary, and William, the Plaintiffs, are three) 50 l. a-piece to be paid within 3 Months after his Decease; and made the Defendant Smith (then in New England) Executor, and left a great personal Estate there, of which Smith the executor possessed himself, and proved the Will, and returned into England, having left the Care and Management to the other Defendant Thurston, in Trust to pay the Testator's Debts and Legacies, and particularly the Legacies given to the said Plaintiffs. Thurston had sufficient to pay all the Debts and Legacies with a great Overplus, and therefore confessed Assets; but that he had expended for Smith more than he had received, and refused to pay the Legacies due to the Plaintiffs; because they and their Father and Mother had abused him by uncivil Language ...

Wherefore it appearing that Smith had promised to pay the said Legacies, and had given Orders to Thurston for that Purpose, who was entrusted with the Estate, in order to pay the said Debts and Legacies, and had paid all but to the Plaintiffs, and had con fessed Assets, but would not pay, because of the ill Language; The Court decreed him to pay the several Legacies to the Plaintiffs, with Interest from the Time the fame should have been paid, with Costs out of his own Estate, and so doing to be indemnified, &c. An important letter not among the Winthrop papers, which casts light of Richard Smith's English connection, was written by him on October 22, 1669, from Narragansett to an uncle William Barton, Morton near Thornbury. It reads as follows: "UNKELL BARTON: my kind respets present to you and to my Aunt Irland. Yor Leter by John Sundrland I receved & nothing in the world could be more aceptabell then to heare of yor helth and welfare in this life; and my prayres shall be that god will inrich you with his everlasting blesing of his Loue and favor ... In December, 1674, Smith addressed a letter "For the Worshipfull: John Smith Esqure--att his house in Nibley in the county of gloseter"; which is also endorsed, "Mr Smith yt, he will come for England in ye Springe." This letter has a red wax seal with Smith's arms--the same found on many other Smith letters and the arms afterwards used by Richard Updike--and reads as follows: "MUCH HONNORED SIR. my deare respets & servis to you selvfe and your honnored good Ladey with all your relacions, not forgetting your great respet extended twowords me: since, my: departuer, in doeing what you could to maynetayne my intrest in my Abstanc, which I have had an acount of, I have since my departuer mett also with varyaues [various] sucksese in my Negociacions, having lost much by reson of the late ware, I intend by the first ship that comes from hence in the springe next, if god permit, to: waight upon you: if my Luife contuniey: and that withoutt fayle: where I hope to find your favoraball aspectt, and doe request your favoraball asistanc: still to contuney: relating to the Managment of that smalle mater I have in Eingland in kepeing it outt of the hands of roges & knaves, as hetherto: you have done, Robertt Thurston nott being so capaball: without your asistanc, all thatt I can doe att present is my thainkfull acknowlidgement for all your and my wellwishies twowards you and your ... So, the mentions of "Aunt Irland" and "Robertt Thurston" would seem to prove the suit was connected with this family. (?) ELIZABETH BARTON

Bishop’s Transcript: 1604 May 1st

Elizabeth the (da ) of Willm Barton baptized the same daye (first May)

We find in the Bishop’s Transcripts the following entry: Elizabeth the daughter of Willm Barton baptized the same day (1 May 1604). She has Robert Smith above and Edward Baker below. Which matches the Thornbury Parish Register. With two baptisms in 1604, one in May and the other in August, it would appear that there may be two William Barton Families?
