In its report tabled in Parliament recently, the Comp- troller and Auditor General (CAG) of India took of a strong note of the failure of the Build- ing and Other Construction Workers’ Welfare Board, (BOCWWB) Port Blair, to apply for exemption in compliance with the Income Tax Act re- sulted in avoidable payment of Rs 34.68 lakh towards income tax which would otherwise have been available for utilization on social welfare measures of the workers and their families. In its report, the audit agency stated Welfare Board (BOCWWB) was constituted in January 2009 by the Andaman and Nicobar Administration in accordance with Section 18 of the Building and other Con- struction Workers’ (Regulation of Employment and Conditions of Service) Act, 1996. The BOCWWB was established for the welfare of building and other construction workers and hence satisfied the neces- sary conditions for income tax exemption under Section 10 (46) of the Income Tax Act, 1961. Audit noticed that BOCWWB failed to apply for exemption to the income tax authorities and hence no notification for exemption had been issued by the Central Government. In the absence of a notification for exemption, tax deducted at source of Rs 46.79 lakh was deducted by banks on interest earned on deposits kept with them by BOCWWB between November 2013 and December 2016. The Central Audit in its report said that BOCWWB filed an Income Tax Return (ITR) for the Assessment Year 2015-16 showing nil income and was given a refund by the Income Tax Department of the TDS collected by banks of Rs 12.11 lakh for that year. BOCWWB thus made an avoidable pay- ment of Rs 34.68 lakh towards Income Tax. The Board in February last year stated that an application for exemption has been submitted to the Government of India in view of the audit observation. “Thus, failure of BOCWWB to apply for exemption in compliance with the provisions of the Income Tax Act resulted in avoidable payment of Rs 34.68 lakh towards income tax. Had the exemption been obtained, this amount would have become available for utilization on social welfare measures of the workers and their families,” the CAG said. 2nd edition of Andaman Safari Autocross on April 22 ROOPA LALL PORT BLAIR, APR 17/-- / Andaman Safari will hold its season II event with the message “Skills on track not on the road” on April 22 this year.
