RE: Senate Rules Violation against State Senator Maria Sachs

Dear Chairman Thrasher:

Please accept this letter as my formal complaint against State Senator Maria Sachsfor possibleviolation of the Rules of the Florida Senate.

I allege Senator Sachs violated Senate Rule 1.361, relating to Solicitation or acceptance of

contributions; registration and disclosure requirements, by not registering her affiliated

political committee, Moving Florida Forward PC, with the Senate Committee on Rules. I

am requesting you promptly investigate this matter, and where appropriate, apply the

applicable sanctions outlined in Senate Rule 1.361.

In support of this allegation, I offer the following for your consideration:

1. Senate Rule 1.361(3), requires Any Senator who directly or indirectly solicits, causes tobe solicited, or accepts any contribution on behalf of any organization described under

section 527 or section 501(c)(4) of the Internal Revenue Code, any political committee,

or any committee of continuous existence must immediately disclose such activity to,

and register with, the Rules Committee.

2. IRS form 8871 (attached)provides notice that Moving Florida Forward PC wasestablished under Section 527 of the Internal Revenue Code

3. Section 106.0701, F.S. requires "candidates for such offices who directly or indirectlysolicit, cause to be solicited, or accept any contribution on behalf of an organization that

is exempt from taxation under s. 527 or s. 501(c)(4) of the Internal Revenue Code, which

such individuals, in whole or in part, establish, maintain, or control" shall promptly create

a public website that contains a mission statement and the names of persons associated

with the organization.

4. To comply with s. 106.0701, F.S., Senator Maria Sachs filed a statement of solicitation onform DS-DE 102 (attached). This statement declares that Senator Sachs established and

controls Moving Florida Forward.

15.Because Moving Florida Forward PC or Senator Maria Sachs was not listed on thedocument Registration of Contribution Activity, Listing of Registrations

Received,it is my personal knowledge that Senator Maria Sachs has not

registered Moving Florida Forward PC pursuant to Senate Rule 1.361(3) (see

attached document)

16.Because of the above facts of which I have personal knowledge, I am alleging thatSenator Maria Sachs has violated Senate Rule 1.361(3), by not registering her

affiliated political committee with the Senate Committee on Rules.

Therefore, I ask the Florida Senate Committee on Rules to fully investigate this matter, and

where appropriate, apply the applicable sanctionsoutlined in Senate Rule 1.361.
