Clubhouse Gets Facelift

If you haven’t been to the clubhouse lately, you are in for a pleasant surprise! Clubhouse Chair Harley O’Neil has been busy with some serious upgrades: Bathrooms: The first concern regarding the bathrooms was supporting the roof decking. Workers installed post and beams in both bathrooms to provide the additional support. Circulating fans were removed from both bathrooms and new fans, ducted to the outside were installed. Suspended ceilings and trouffer lighting were installed from materials Harley had left over from an-other job at no materials cost to the club. New toilets, urinal, stall enclo-sures, thermopane windows, doors, hardware, counter tops, sinks, and faucets were installed. New vinyl flooring was installed in the men's room. Wainscot was installed on the walls inside and outside of the bathrooms.

Entry/office area and main room: Wainscot was installed in the entry and throughout the main floor area. Cinder block is now concealed by sheetrock. New doors were installed for the office and the storage in the main area. New double pane sliding glass doors were installed and the fireplace was re-

faced with faux river rock. A gas insert was installed in the fireplace. It has a switch on the side to turn it on and a fan control. It provides a lot of heat.

II. Limitation on Access to the Reserves

A. Access to the reserves is limited to active members of Innis Arden Club, Inc., and their guests when ac-companied by a shareholder for social purposes only. Business invitees are not allowed in the reserves without written approval from the Reserves Chairperson or the Board president. B. Reserves with beach access may be fenced at entrance points. Gate keys may be purchased by active mem-bers from the Reserves Chairperson. Beach access reserves I and O and the west end of reserves H and U are closed from 9:30 p.m. until 5:00 am.

Ill. Permitted and Prohibited Activities in the Reserves

A. The Reserves are to be used for recreational activities only, such as hiking, walking, running, horseback riding and play. B. The following activities are prohibited:

1. The use of any motor-driven vehicle unless specifically authorized by the Board. 2. Dumping or depositing any materials in the Reserves, including, but not limited to, trash or garden clippings. 3. Carrying or use of firearms, bows/arrows, or other weapons. 4. The use of fireworks. 5. The building of fires unless specifically authorized by the Board. 6. Large gatherings or parties which may create a nuisance or excessive noise.

Board about the cost of vinyl flooring versus wood flooring. After the floor is installed, he wants to enclose the 4" steel supports to make these supports more attractive. A nickel plated front for the fireplace will be ready in about one more week, which will give the fireplace a rich look. Harley invites community input!

Clarence Bodine Celebrates his

100 Year Birthday!

Clarence was born on May 22, 1907 in Santa Cruz, Califor-nia. He was to mar-ried Hildur for 72 before her passing in 1999. He retired from the Army in 1947, was a home builder and contin-ues with his local apartment rental business.

Court Orders Robert and Janet Carlson to Pay Club $57,500.00 in Attorney's Fees and Costs

King County Superior Court Judge Charles Mertel has ordered the Carlsons to pay the Club $57,500.00 in attorney's fees and costs in partial reimbursement for the Club's expenses in the lawsuit brought by the Carlsons against the Club. While the Club sought a total award of $95,000.00, Mr. Carlson argued to the Court that the award should be limited to $13,000.00 on the basis that some issues in the case were not covered by the attorney fee provision of the Homeowners Association Act. The $57,500.00 awarded by the Court will assist in reducing the impact on the Club of insurance deductibles and increased premiums associated with lawsuits such as the Carlsons'. Until paid, the award will accrue inter-est at a substantial rate. On May 18th, Judge Charles Mertel signed an order setting an appeal bond for the Carlsons in the sum of $84,000. The bond can be reduced by $14,000 for each of the six trees the Carlsons elect to height-reduce. The Court will consider imposing sanctions against the Carlsons at a hearing set for June 18th. On May 23rd, at 8:30 A.M., the Club's attorney, Peter Eglick, will be presenting an order for a judgment against the Carlsons in the amount of $57,590.92 which represents the attorney's fees and costs awarded by Judge Mertel to the Club.

May 8, 2007 Minutes Innis Arden Board Meeting

The meeting was called to order by Board President Mi-

chael Jacobs at 7:10 pm.

Board Members Present: Michael Jacobs- President,

Bob Allen – Buildings & Remodels, Harley O’Neil - Club-

house, Tracy Landboe – Activities; Kathi Peterson –

Grounds.

A motion was made and seconded to approve the 2007

April Board meeting minutes. Motion passed 8-0.

Committee reports were given:

A. Treasurer - Pat French: Pat provided the April financial

statement; costs are under budget for 2007 with the ex-

ception of costs related to the clubhouse remodeling that

is in the process of taking place. Past dues – we have

24 current delinquent, 14 continuing that have a history of

non-payment, we will send 38 past due monthly state-

ments which include late and interest assessments. We

will be aggressively pursuing past due accounts this year.

Pat is researching relationship with Russ Cole to deter-

mine when monthly statements can be provided in ad-

vance of the board meetings for early review prior to pub-

lic discussion at meeting. The Club’s cash balance was

reduced by approx $41,000 in April as a result of pay-

ments to the EKG law firm (which will be reimbursed by

our insurance company). Our cash balance is now

$315,000.

B. President- Mike Jacobs:

Litigation update and summary. The court-ordered media-

tion in the Cottingham et. al. vs. Club litigation occurred

on April 26th. Former Superior Court Judge George

Finkle with Judicial Dispute Resolution acted as the medi-

ator. Five Board members attended including Jacobs,

Fosmire, Peterson, Martsolf, and O'Neil. The media-

tion went on for nine hours and resulted in no agree-

ment. An executive session was scheduled for 8:30 P.M.

to consider a recent proposal received from the Plain-

tiffs. Mr. Eglick's firm will be seeking an award for attor-

ney's fees and costs against all of the Plaintiffs based

upon the Club's successful summary judgment motions

dismissing essentially all of the Plaintiffs' claims. In the

Carlson matter, Judge Mertel ruled that the Club was the

prevailing party and awarded attorney' s fees with the

amount to be determined at a hearing on May 11th at

10:00 A.M. The Carlsons have filed a Notice of Appeal.

Vice President – David Fosmire:

Compliance Committee report and updates. No new peti-

tions in the last month. The Board will have its monthly

compliance hearing tomorrow in the Hollinrake v Meln;

Martsolf v Burns and Hollinrake v Rust matters.

The Buchmayr,Hollinrake,Jones v. Lewis and the How-

ard, Steele, Mackey v. Knauer & Montgomery, Oughton,

Dragoy matters will be discussed at the June 13th Board

Hearing.

C. Shannon Grady: continuing researching opportunities

to redesign IA Web Site and purchase an e-

communication suite to expand the Club’s ability to easily

communicate and share information with homeowners.

D. Building and Remodels – Bob Allen:

• Mike Rasch has submitted application to replace the

deck on the back of his house. All neighbors have

been contacted and signed off on the application.

Motion made and seconded to approve Rasch re-

model, the motion passed 8 – 0.

• Johnson application, neighbor sign offs are complete,

moved and seconded to approve remodel, motion

passed 8 – 0.

Several remodels and rebuilds are in the pipeline but

haven’t completed applications. Bob provided a reminder

of the B&R process and underscored the fact that if

shareholders notify him first, he can greatly improve and

assist with the process so that they are aware of the

steps involved.

E. Activities – Tracy Landboe: Salmon barbecue is

scheduled for September 9th and the Activities Commit-

tee is looking for a volunteer to chair the event. We have

hired a new tennis pro that is a Shoreline grad and is

looking for an assistant pro. Sign ups are ongoing and

published in the bulletin. The installation of new tennis

nets are being handled by Heidi Nelson.

F. Reserves – Brian Dodd:

1. Shareholder Ron Christianson presented the board a

proposal to install and maintain a hedge, consisting

of pyramidal arborvitae less than 6’ in height, along

his easterly property line at his own expense. The

proposed location is adjacent to the drainage/ditch

modifications performed by the City of Shoreline over

the past several years. He has been maintaining his

property and the adjacent drainage area in the recent

past. He presented a large photograph to illustrate to

the Board that weeds and scrubby vegetation in and

adjacent to the ditch is an eyesore when viewed from

the easterly windows of his home a few feet away. He

is also concerned about privacy and safety issue for

pedestrians walking into this area, many of whom

trespass across his property to gain access to the

area. The board moved and seconded the ability of

Ron Christianson to install a hedge to restore privacy

and have the city install grass to restore the damage (Continued on page 5)

to the reserves during the installation of the ditch on

188th. Motion passed.

2. Recognition and thanks go out to Maggie Taber for

installation of numerous plants in the reserves.

3. REMINDER TO ALL SHAREHOLDERS: Our Re-

serves are for the constructive use of the community,

but destructive activity such as excavation for bicycle

jumps is not allowed, since this disturbs the slopes

and plants, etc. It can also be dangerous, even

though any shareholder (including the shareholder’s

guests) visiting the Reserves do so at his/her own

risk. We have had recent problems with youths of

various ages digging up the Reserves, making exces-

sive noise during the day and after dark, as well as

leaving bottles and other garbage when they leave.

Any shareholder who knows those who might be perpe-

trating the activity is encouraged to call the police if such

activity requires immediate response, or to E-mail me

(briand@dodd.com) to report any other problematic activ-

ity.

G. Grounds – Kathi Peterson: Landscapers have begun

work on the new contract, our agreement includes two

men, working an eight hour day (16 hours) one day a

week to mow the lawn, maintain grounds and beds at

entrances – additional time spent cleaning invasive out of

reserves and trail clearing.

H. Clubhouse – Harley O’Neill: In April the Clubhouse

received $1,000 income, $250 expenses. Harley is re-

searching prices and options for flooring and encourages

your comments. Clubhouse improvements are continuing,

walls and fireplace have been installed.

Board Agenda

Judy Allen provided a report on work she has been doing

to support our shareholders. To assist with shareholders

who have been experiencing high volumes of solicitation

traffic, she has developed no solicitation/no trespassing

signs that would be available for purchase for $10 each.

We would need a team of volunteers to offer these to the

community and in addition, she would provide installation

for $10 each. Driveways over 50 feet would require more

than one sign. Board moved and seconded the purchase

of the first 200 signs, the motion was passed 9 – 0. Judy

will handle bookkeeping.

The second enhancement includes the design of IA win-

dow decals, illustrated with our new IA logo, used to des-

ignate IA vehicles; the board will purchase 2000 for com-

munity distribution. Judy has asked the board to consider

the proposed date for our community to adopt a road,

Saturday 6/2 – 10am – 12 noon, the board agreed, volun-

teers will be needed to assist in the project which will en-

hance the Shoreline environment by cleaning up the

road.

May Activities Report Next Activities Meeting will be held Monday June 4th at 7 p.m. Location - TBD Save the Date for the Innis Arden Salmon Barbeque to be held Sunday September 9th. Anyone interested in planning and helping out with the Salmon BBQ in September, please con-tact Julie Forster 542-9705 or Shelley Watson 542-4369. We would like to put together 4 com-mittees with volunteers and potentially have one or two designated co-chairs of the event. We would like to start the planning of this event prior to summer, as we will need to reserve the BBQ and potentially procure salmon (if we can!). Please let me know if you are interested in co-chairing this event or heading up a committee. Ideally we should have a Food committee, regis-

tration committee, supply and equipment commit-tee and Children's Activities Committee. If we have 4-5 people willing to lead the charge, the event will be much more manageable for all in-volved. Please let Julie or Shelley know how you would be willing to help with this event.

Training for READY Neighborhood June 21 @ 7:00 By Officer L.D. Obstler

As you know we are attempting to get as many of our neighborhoods trained to become a READY Neighbor-hood. We use a tool to do this called Mapping Your Neighborhood. The State of Washington Department of Emergency Management created it so we can have a con-sistent way of doing this state wide. We have challenged each of our CERT GRADUATES, along with Block/Neighborhood Watch Captains and Council of Neighborhood Representatives to learn how to use this tool and help get their neighborhoods organized to help each other during a disaster! I understand there will be some overlap between all of you (some of you are the Block/Neighborhood Watch Captains and have CERT grads living in your neighborhood for example) – but that just makes your neighborhood stronger! So, on June 21st at 7:00pm at the Shoreline Fire Head-quarters, 175th and Aurora, the State Trainer, LuAn Johnson, will come and train all of you to use the tool. The training will last for approx 90 minutes. After the training is over ALL of the CERT graduates who have requested to be utilized as registered emergen-cy worker volunteers will need to stay and we will ensure we do have an application on file and a signed waiver for a criminal records check. I did find out you do NOT have to give me your Social Security number if we aren’t tracking your training. I will discuss this in more detail at the meeting. Please RSVP to me (206-546-3636) that you are coming so I know how many to expect.

Innis Arden Shareholders Receive Award Beth and Doug O'Neill received a "Key Award" from the Washington Coalition for Open Govern-ment (WCOG-- http://www.washingtoncog.org/) on May 11th during the NFOIC Conference. They regularly attend city council meetings and try to hold their elected officials accountable. In 2006, they were concerned when their deputy mayor lost emails she had received and sent related to government business after the O’Neills had requested the emails in a public records request. The judge to whom their case was assigned was not familiar with the law and dismissed their PDA suit determining that there was no point to a suit because records they requested no longer existed. The lower court decision will be appealed. The O’Neills invested $20,000 of their own money in the lawsuit selling off antiques and raiding their savings to pay for the legal battle. They should be commended for stepping up to the plate and fighting an open government violation in court.

Watch for a picture of the sign available for or-der in the next bulletin. Innis Arden Board has voted to "Adopt A Road" in cooperation with the City of Shoreline. Our first litter pick up date is Saturday June 2nd 10AM-12noon. Meet at the clubhouse. A new web site available to anyone who is in-terested in accountability and integrity in your city government. www.wakeupshoreline.com is ready to answer many of your questions. "Benefit Shoreline" is having a Tag, Bake, Plant, Gift, and Rummage Sale Saturday June 23rd at the Clubhouse. We will be supporting accountability and integrity for candidates for Shoreline City Council. If you have anything to donate please help us and call Judy Allen 542 3219 or just come Saturday and have fun. A little heads up to Innis Arden residents on the Point Wells Development project. Demoli-tion is proposed and 1000 new residences are planned to be built. The only road access is through Richmond Beach and Innis Arden.

2007 INNIS ARDEN TENNIS PROGRAM Girls and Boys Ages 6-18

June 28 - August 9-- No classes July 4 (Wed makeup Aug. 9) This is the registration form for the 6 week summer session of tennis lessons and TENNIS TEAM (youth over 12) and JUNIOR TENNIS TEAM (ages 6 to 12). Players will be divided by skill level into classes which will meet twice weekly at the Innis Arden tennis courts. Reserves Update

Planted in April: Bear: 3 Indian Plum, 14 Nootka Rose, 3 Crabap-ple, 9 Snowberry, 2 Nootka Rose, 2 Ocean Spray, 3 Cascara, 3 Red Flowering Currant, 5 High Bush Cranberry, 10 Red Huck, 20 Ever Huck, 18 Salal Blue Herron: 1 Beaked Filbert, 2 Red Flowering Currant, 5 High Bush Cranberry, 2 Mock Orange, 2 Ocean Spray Blackberry, thistle, Japanese Knotweed, and more were removed. “Cut” the grass and weeds in Lower Bear and cut up the fallen cherry. The downed fence material at top of Bear was re-moved and brush and weeds were cleared away from earlier plantings. Special thanks to Shelley Watson, Dave Fosmire, Kathi Peterson, Bob & Judy Allen, Roger Lowell and Maggie Taber who coordinated this effort.
