Recommendation:Whereas the County of Brant, in anticipation of considerable population growth,employment growth, and development activities, has undertaken a DevelopmentApplications Process Review and a Development Applications Fee Review;

And Whereas these reviews have identified process improvements for developmentapprovals, additional development approvals staff, and changes in the developmentapprovals fees structure to ensure that the County has the appropriate process,resources,and financial ability to meet its legislative obligations related development approvalsin the County of Brant;

Background Former County of Brant Councillor Willem Bouma was successfully elected as a member of the Provincial Legislative Assembly on June 7, 2018. Under the Legislative Assemblies Act, any person elected while holding office as a member of municipal Council is deemed to have resigned from the municipal office at the end of the day that the return of the election is published in “The Ontario Gazette”. The returns were published on Saturday, June 23, 2018 and as such the resignation became effective as of Sunday, June 24.

Report Council Vacancy to be Filled Under The Municipal Act, if the office of a member becomes vacant, the Council shall at its next meeting declare the office to be vacant. As such, a declaration must be made at the June 26, 2018 Council meeting, as per staff’s recommendation. Normally, under The Municipal Act, within 60 days after the day a declaration of vacancy is made, the municipality shall either appoint a person to fill the vacancy or pass a by-law requiring a by-election (August 24, 2018 in this case). Under The Municipal Elections Act, no by-election shall be held for a vacancy occurring after March 31 in a regular election year, so Council is limited to the option to appoint a person to fill the vacancy. The person appointed shall hold office for the remainder of the term. The vacancy must be filled by someone who is qualified to run for the office and who has consented to accept the office, if appointed. There are no legislative guidelines / regulations which dictate how Council must undertake the appointment process and the County of Brant does not have a Policy to Fill Council Vacancies. A review of municipalities who either have a Council Vacancy Policy or have recently undergone a Council vacancy / appointment process, identifies the following common approaches:

• Open call for nominations from qualified electors. Applicants submit an applicationform, a declaration of qualifications and relevant background information. Generally aspecial Council meeting is held to hear from each applicant and/or ask questions orthe applicants before Council makes a decision in open session on the appointment.The special meeting may or may not also provide an opportunity for members of thepublic to speak in favour / opposition to the applicants.

• Appoint next runner-up from previous election. Sometimes this option is based oncriteria of the percentage of votes obtained by the next runner up (i.e. 70% ofremaining votes).

• Call for nominations from any interested candidates in the previous election. Similar toan open call, but limited to those who ran in the previous election.

The vote on a process for appointing a member of Council to fill the vacancy and the vote to appoint a member must be held in Open Session. There is no option to allow the seat to remain vacant or to appoint an existing member of Council to serve in its stead. Council make take into consideration whether or not an applicant intends to file nomination papers, but there is no precedence that they could require a candidate not to run.

Other Appointments to be Filled Former Councillor Bouma served on the following committees that should be given consideration for an alternate County Council appointment:

• Social Services Committee• Brant County Health Unit• Community Services Committee• Shared Services Committee

Quorum for these committees may be affected if the vacancy is left until after the appointment process for the Council position is concluded.

Delegation –Grand River Cab- June 26, 2018

The purpose of this briefing note is to provide an update regarding the delegation from Grand River Cab scheduled to be heard at the June 26, 2018 meeting. The delegation is in response to a requirement in the Subsidized Transportation Program (STP) contract that magnetic signs be displayed on their cabs when providing service pursuant to the STP contract.

The Municipal Act states that a licensing bylaw of a municipality is void to the extent it prevents the owners and drivers of taxicabs from engaging in conveyances transporting individuals with disabilities from any point in the municipality to any point outside the municipality pursuant to a written contract provided the cab is licensed in the municipality where the conveyance begins or ends.

The requirement to display a magnetic sign when performing STP service was developed in consultation with IBI consulting to help identify when County cabs were performing STP service and were therefore subject to the Municipal Act exemption. This requirement was put in place to prevent disruption of STP service. The requirement to display magnetic signs was not as a result of a request from the City as indicated in the delegation material.

The changes to the contract were communicated to Grand River Cab via email on May 15, 2018, requesting feedback by May 18, 2018. Each of the changes were discussed in detail with a representative from Grand River Cab on May 16, 2018 and the representative was in agreement with the changes. Corporate Development Committee approved the recommended changes to the contract at the June meeting.

With respect to concerns regarding Brantford cabs providing service in the County, Municipal Law Enforcement Officers actively monitor while on patrol and investigate any complaints received. A comprehensive review of the County Taxi Bylaw will be undertaken in consultation with the City of Brantford once Phase 2 of the IBI study has been completed. The City of Brantford is also planning a comprehensive review of their bylaw which will provide an opportunity to address any City-County service issues.

Not only will we be made towitness the destruction and plunder of the wildlife in the "settlement" area we will also we subject toendless construction noise and uproar. What a disgrace on you our trusted councillors! Paris has beenravaged with ridiculous amounts of useless housing which removes the nature of our town and offerslongtime residents nothing but aggravation and loss of rural living. Paris has become a bloated, overfed glutton of construction. What a disaster.

We are definitely in support of preserving this building built by the famous architect John Turner.Some of his magnificent buildings have been lost. The original Central School is a tragic example. There are still some structures that stand in tribute to this outstanding builder and that also canserve as tourist attractions to be added to what Brantford and Brant County already have to offer. WHEREAS pursuant to Section 15(1) of the Police Services Act, being Chapter P15, R.S.O. 1990, as amended, authority is vested in Council to appoint persons to enforce the by-laws of the municipality;

AND WHEREAS the Building Code Act, 1992, S.O. 1992, c. 23, grants enforcement powers to Property Standards Officers who have been assigned the responsibility of administering and enforcing by-laws passed under section 15(1);

AND WHEREAS pursuant to Section 12 of the Dog Owners Liability Act, R.S.O. 1990, Chapter D16, Municipal Law Enforcement Officers are deemed peace officers for the purposes of the Act;

AND WHEREAS the Council of the Corporation of the County of Brant deems it necessary to appoint Lisa Madden as a Municipal Law Enforcement Officer and a Property Standards Officer;

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE COUNTY OF BRANT HEREBY ENACTS as follows:

1. THAT section 6 of By-law Number 43-17 be amended to read as follows:

“THAT Lisa Madden is hereby appointed as a Property Standards Officer and as a MunicipalLaw Enforcement Officer for the purpose of enforcing all County By-laws and for the purposeof exercising the powers of a peace officer pursuant to the Dog Owners’ Liability Act, R. S.O.1990, c. D16 effective from April 30, 2018 to September 1, 2018.

2. THAT this by-law comes into force and takes effect upon passage.

To appoint Inspectors pursuant to the County Site Alteration By-law

WHEREAS pursuant to Section 15(1) of the Police Services Act, being Chapter P15, R.S.O. 1990, as amended, authority is vested in Council to appoint persons to enforce the by-laws of the municipality;

WHEREAS pursuant to Section 435 of the Municipal Act, 2001 S.O. 2001, C 25, a municipality has the power to pass by-laws providing that the municipality may enter on land at any reasonable time for the purpose of carrying out an inspection to determine whether or not a bylaw, direction or order of the municipality is being complied with and further that the power of entry shall be exercised by an employee, officer or agent of the municipality or a member of the police force;

AND WHEREAS the County of Brant Site Alteration By-law grants the powers of entry and inspection and the power to issue orders to Inspectors that are designated, appointed and authorized by Council to administer or enforce the provisions of the Site Alteration Bylaw;

AND WHEREAS the Council of the Corporation of the County of Brant deems it necessary to appoint the Manager of Development Engineering Review, the Lot Grading Technologist and Municipal Law Enforcement Officers as Inspectors for the purpose of administering and enforcing the provisions of the Site Alteration Bylaw;

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE COUNTY OF BRANT HEREBY ENACTS as follows:

1. THAT Don Cunningham, Lori Fox, Greg Bergeron, Dave Kelly, Erna Booth, Amanda Paine,Richard McGinnis and Lisa Madden are hereby appointed as Inspectors for the purpose ofadministering and enforcing the County of Brant Site Alteration Bylaw.

2. THAT this By-law comes into force and take effect upon passage.

To confirm the proceedings of Council

WHEREAS by Section 5 of The Municipal Act, 2001, S.O. 2001, c. 25, the powers of a municipal corporation are to be exercised by its Council;

AND WHEREAS by Section 11 of The Municipal Act 2001, S.O. 2001, c. 25, the powers of every Council are to be exercised by by-law;

AND WHEREAS it is deemed expedient that the proceedings of the Council of the Corporation of the County of Brant at this meeting be confirmed and adopted by by-law;

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE COUNTY OF BRANT HEREBY ENACTS as follows:

1. THAT the action of the Council of the Corporation of the County of Brant in respect of eachrecommendation contained in the reports of the Committees and each motion and resolution passedand other action taken by Council of the Corporation of the County of Brant, at its meetings held onMay 23, June 5 and June 26, 2018 are hereby adopted and confirmed as if all such proceedingswere expressly embodied in this by-law;

2. THAT the Mayor and proper officials of the Corporation of the County of Brant are herebyauthorized and directed to do all things necessary to give effect to the action of the Council referredto in the preceding section hereof;

3. THAT the Mayor and the Clerk be authorized and directed to execute all documents in that behalfand to affix thereto the seal of the Corporation of the County of Brant.
