The meeting was called to order at 5:38pm.

3. APPROVAL OF MINUTES –
a. Minutes of April 29, 2020, meeting – Approved unanimously.
4. UPDATE
a. Update on November 2019 – April 2020 Decisions
Mrs. Pokrant discussed the status of the November 2019, December 2019, January 2020,
February 2020 and April 2020 decisions.
Commission member Canales asked who the new Dangerous Building Official for the
City of Del Rio. Mrs. Pokrant stated that she is designated as the acting dangerous
building official, but that all the reports and assessments provided in this agenda were
completed by Mr. Cook prior to his departure.
5. OPEN PUBLIC HEARING
Notices were posted on the five structures below on May 8, 2020. Notice in the Del Rio
newspaper was published May 10, 2020 (Sunday). Five Notices and DBO Reports were

mailed by Certified Mail on May 8, 2020. DBO Update Reports were provided by email
when available.
a. Public Hearing to determine if the structure at 407 Dr. Fermin Calderon Blvd. (San Felipe Heights Block 4, Lot 4 and 5) fails to comply with the minimum standards because of one (1) or more of the five stated conditions listed in City
Code Chapter 7; Article II, Dangerous Buildings; Section 7-19, Minimum Standards..
Mrs. Pokrant presented the DBO Update Report on this structure. Since the first presentation at the April 29, 2020, meeting, the property owner/owner
representative has been secured the structure, made structural repairs, replaced the doors and windows and cleaned the lot.
The new owner, Mr. Luis Arteaga spoke to the commission about the improvements he made to the property and the plans he had for the property. Commission member Salgado asked if the sewer has been extended to the
property. Mr. Arteaga stated that building was connected to water and wastewater, but the meter has been disconnected. He stated he has contracted with
a plumber to get a permit and bring all plumbing up to current code standards. He also stated that he has contacted an electrician to bring all electrical into current code standards.
Commission member Salgado commended Mr. Arteaga for all the work he has done in such a short amount of time to fix the property.
A motion was made by Commission member Valdez Fernandez and seconded by Commission member Salgado for “No further Commission action required”. Four votes in favor and no votes against were given.
b. Public Hearing to determine if the structure at 306 Jones (S-2-P Block 1, Lot 4) fails to comply with the minimum standards because of one (1) or more of the five stated conditions listed in City Code Chapter 7; Article II, Dangerous
Buildings; Section 7-19, Minimum Standards..
Ms. Pokrant presented the DBO Update Report. She mentioned that staff has not heard back from the property owner regarding the notice mailed or posted to the property. Commission member Canales asked if staff has spoken with any of the
neighbors in the area. Mrs. Pokrant stated that staff has not, as it is not a requirement in the code or state law. She stated that staff could try to talk to the
neighbors. The board members further discussed the DBO report with Mrs. Pokrant. A motion was made by Commission member Robles and seconded by
Commission member Salgado to hold off on demolition proceedings for one month while staff attempts to contact the property owner.
Four votes in favor and no votes against were given.

c. Public Hearing to determine if the structure at 403 Ware Street (Fairview Block 18, Lot 7) fails to comply with the minimum standards because of one (1) or more
of the five stated conditions listed in City Code Chapter 7; Article II, Dangerous Buildings; Section 7-19, Minimum Standards.
Mr. Pokrant presented the DBO Report. The owner’s representative, Alma Galindo, addressed the Commission, agreeing with the report presented and the
recommendation; but requested additional time to comply. A motion was made by Commission member Canales and seconded by
Commission member Salgado to secure the structure within 30 days (June 24, 2020) and demolish the structure within 60 days (August 26, 2020). Four votes in favor and no votes against were given.
d. Public Hearing to determine if the structure at 900 Dignowity Street (Fairview
Block 18, Lot 8) fails to comply with the minimum standards because of one (1) or more of the five stated conditions listed in City Code Chapter 7; Article II, Dangerous Buildings; Section 7-19, Minimum Standards.
Mrs. Pokrant presented the DBO Report. Mrs. Pokrant informed the board
members that the property owner, Mrs. Elizondo, has demolished the main structure on the property and has removed all the debris from the demolition. A motion was made by Commission member Valdez Fernandez for No Further
Commission Action Required. Commission member Salgado seconded the motion but asked if the garage shown in the documents is also located on this
property as he felt it was unsafe and should be demolished. Mrs. Pokrant stated that she was unsure but could review and report back to the commission at the next meeting. It was confirmed by Mr. Cook who was listening to the meeting
that the garage was located on this property. Commission member Valdez Fernandez amended his motion for No Further
Commission action required for the main structure but to bring back an item on the next meeting to demolish the remaining garage structure. Commission member Canales seconded the motion.
Four in favor and no votes against were given.
e. Public Hearing to determine if the structure at 908 W. Garza (Brodbent, Block 8,
Lot S PT 6 & S PT) fails to comply with the minimum standards because of one
(1) or more of the five stated conditions listed in City Code Chapter 7; Article II, Dangerous Buildings; Section 7-19, Minimum Standards.
Mrs. Pokrant presented the DBO Report. She stated the property owner has demolished the front porch and garage on the property and the owner has also
removed the debris from the demolish. Commission member Valdez Fernandez confirmed this was the information that was emailed over in a supplement. Mrs.
Pokrant stated that there was a duplicate printed with the agenda, so the supplement was given at a later date. The property owner, Mr. Rangel spoke to

the commission about the structure and asked for additional time to complete the demolition. Commission member Canales asked Mrs. Pokrant if the structure was
secure. Mrs. Pokrant reported that the owner has secured the structure. She confirmed with the owner that the side windows and back windows are new and
confirmed the owner fixed the chain link fence on the property. Mrs. Pokrant stated that if the front windows are secured then the structure would be secured enough to wait for the demolition. Commission member Canales asked how
much time the property owner would like to finish the demolition. Mr. Rangel stated the 60 days would be enough time.
A Motion was made by Commission member Canales and seconded by Commission member Valdez Fernandez to secure the structure within 30 days (June 24, 2020) and demolish the structure within 60 days (August 26, 2020).
Four in favor and no votes against were given.
6. ADJOURNMENT –
a. Next meeting is scheduled for June 24, 2020, at 5:30pm
Commission member Canales wanted to verify staff would bring forward the
agenda items that were given time extensions at this meeting.
Commission member Canales asked if the meeting will once again be held over
the virtually.
Mrs. Pokrant asked if the Mayor Lozano would like to address this matter.
Mayor Lozano thanked the commission for their service and stated the city is
following the Governor’s and CDC guidelines on the meetings. He stated this
would be another dial in opportunity and the ability to log in under the computer.
There was further instruction from Javier Herrera, the City’s Media Technician,
on guidance for logging into the meeting over the computer.

Program Suggestions Moving Forward:
Acting Dangerous Building Official will create a team of individuals who will review and makerecommendations for new structures being brought forward into the program. This team would be comprisedof the Chief Building Official, a Fire Department Official, a Police Department official, a CommunityServices official, and the acting Dangerous Building Official.

Acting Dangerous Building Official recommends a program to assist property owners with the costsassociated with deposit of the building debris at the landfill. Funds would be taken from the city budget forthe demolition of structures.

March 7, 2020, with clearing of interior of structure. Structure removal began March 12, 2020.

February 2020 Cases:
1007 Taini
Determination letter deadline for Owner demolition was April 6, 2020. Owner hired contractor to
demolish the storage shed in backyard and accomplish other Commission-directed activities. Spoke to
Owner on March 10, 2020. Contractor completed demolition work of shed March 12, 2020. The
building is secure.
710 Rio Grande
Determination letter deadline for Owner demolition was April 26, 2020. Owner will perform demolition,
saving floor and pier foundations, if possible. Death in family delayed start of demolition. Structure was
razed April 14, 2020. Debris removal began week of April 20, 2020. The owner continues to remove
debris on the property.

Owner accomplished Commission-directed securing of structure and cleaning up of lot. DBO sent
package of information to the owner regarding how to proceed with any reconstruction considering the
location of structure is in Floodway, but USPS returned envelope as Undeliverable.
403 Plaza Ave.
Owner’s contractor obtained Building Permit and has begun replacing entire roof system. Work nearing
completion. Owner planned to repair interior walls next.
April 2020 Cases
407 Dr Fermin Calderon
The property owner secured the completed the work to the structure prior to the May 27, 2020
commission date. The commission voted “No further action required”.
108 Yucca Street
Owner has hired a contractor to start the demolition of the structure. Acting BDO met the contractor at
the site to discuss the demolition on 5/21/2020. Staff visited the site on 6/23/2020 and found the structure
completely demolished and debris removed.

To date the Acting DBO has not been contacted by this owner and a site visit conducted on 6/23/2020
showed no progress has been made on the demolition.

The owner has complete the demolition of the required structures on the property and most of the debris
has been removed.

InformationSUBJECT:Public Hearing to determine if the structure at 306 Jones (S-2-P Block 1, Lot 4) fails to comply with the minimumstandards because of one (1) or more of the five stated conditions listed in City Code Chapter 7; Article II,Dangerous Buildings; Section 7-19, Minimum Standards.
BACKGROUND:This is the second hearing for this property. At the May 27, 2020 meeting the commission motioned to hold off ondemolition proceedings for one month while staff attempts to contact the property owner.
DISCUSSION:Dangerous Building Official's Report is attached.
Staff was contacted by a niece of the owner of record. Mrs. Bocanegra has passed away and the house has not beendeeded over to anyone within the family. The family is in the process of evaluating all of their options and all legalrequirements moving forward.
PROS:Structure is unsecured and dilapidated.
CONS:Public safety is at risk, if this property remains unsecured.
RECOMMENDATION:Staff recommends review and determination of demolition.

Report of Substandard Structure and
Recommendation to Building Standards Commission

Structure Address: 306 Jones St.
Under the City of Del Rio, Texas, (City) Code of Ordinances Chapter 7, Boards and
Commissions, Article II. Building Standards Commission; Dangerous Buildings; the City
invokes its authority to abate nuisances as a home rule city and Section 214.001 et
seq., Local Government Code.
Minimum Standards Per Article II, Section 7-19, Minimum Standards, of the City Code of Ordinances, (Ord.
No. 2013-055), “the term “building” shall include a structure of any kind or part thereof.
All buildings and structures in the city shall conform to the minimum standards set out in
the city’s building code, fire code, plumbing code, electrical code and mechanical code
(the “codes”). Failure to comply therewith shall constitute a violation of this article. In
addition, a building or structure which fails to meet the minimum standards set out in the
codes or in the following cases shall be subject to abatement as herein set out.”
A building is considered to be (1) dilapidated, substandard or unfit for human habitation;
and (2) a hazard to public health, safety and welfare and not to meet the minimum
standards, sometimes referred to as the safety standards, for the continued use and
occupancy” under any one (or more) of the circumstances and conditions below. This
Report addresses each circumstance and condition, as part of the analysis to determine
whether the structure is to be determined as not meeting the minimum standards and if
so; is, therefore, determined to be Substandard.
1) Any building that is uninhabitable, untenantable and unsightly due to
obsolescence and deterioration caused by neglect or vandalism or fire damage
or old age or the elements as evidenced by such conditions as roof, ceiling,
floors, sills or foundations or any combination thereof being decayed or failing
apart; or
2) Any building in danger of falling and injuring persons or property; or
3) Any building, which is a fire menace because of its dilapidated condition; as
described in subsections (1) or (2) or for other reasons; or
4) Any building, which is damp and in an unsanitary condition and is likely to create
disease and sickness because of being in a dilapidated condition as described in
subsections (1) and (2) or for other reasons; or

5) Any building, which is open and insufficiently secured to prevent entry by
children, vagrants or criminals or constitutes an attractive nuisance to children.
Report Finding:
As a result of the Inspection detailed below, the two structures (main structure and
cottage) meet subsections (1), (2), (3) and (5) above and consequently, do NOT meet
the minimum standards of Article II, Section 7-19. They are, therefore, determined to be
SUBSTANDARD.
Inspection
Per Article II, Section 7-21, Inspection, of the City Code of Ordinances, the Dangerous
Building Official (DBO), “shall inspect any unoccupied building that is suspected of not
meeting safety standards” and shall perform eleven specific duties. This Report and
Recommendation addresses each of these eleven specific duties below:
(1) Obtain and consider the following information:
a. The age and general condition of the premises;
b. Previous violations of hazards found present in the premises;
c. The type of premises;
d. The purpose for which the premises are used; and
e. The presence of hazards or violations in and the general condition of the
premises near the premises to be inspected.
And determine if the building is unsafe and does not meet the described
safety standards and should be reported to the building standards
commission and notice issued;
Report Finding:
a) The Val Verde County Appraisal District database shows the year the main
structure was built as 1940, but not the build year of the cottage. Hardcopy of
the database record, dated February 21, 2020, is provided as Attachment (1).
b) No previous violations of hazards were identified.
c) The construction type of main premises is concrete pier foundation, wood
frame, wood siding, and metal roof; with concrete front porch and several
stoops. The cottage has stucco over CMU block walls and a metal roof.
d) The purpose of the premises is as a residence.
e) The premises in the surrounding area are of similar age, properly maintained,
and occupied; and do not have obvious safety violations as does this property.

It is determined by the DBO that the buildings at 306 Jones St are unsafe, do not
meet the described safety standards, and should be reported to the building
standards commission and notice issued.
(2) Verify ownership and property description by such sources as the tax rolls, utility
rolls, title run and any other reasonable and available sources of information;
Report Finding:
According to the Val Verde County Appraisal District database, the owner is the
Manuela Bocanegra Estate, c/o Fidel and Olivia Bocanegra in Big Lake, TX, Owner
ID 31158. The City Utility Billing Division reported that the billing account was closed
on May 16, 2011.
(3) Inspect the property and report any items that violate the safety standards;
Report Finding:
The premises have multiple hazards or safety standards violations, including, but not
limited to, unsecured windows, rotted wood, open electrical boxes (albeit
unenergized), exposed roofing sheathing and framing, broken glass, debris, and an
overgrown, unkept backyard with large cactus.
(4) Photograph the property;
Report Finding:
Photographs of the property with annotations are provided as Attachment (2). The
structures are unsecured.
(5) Determine if there is any personal property in the building and if it has any value
or not (value means that it would sell for a price that is over and above the cost of
collecting, transporting, storing and selling at a city auction) and administer such
property pursuant to this article;
Report Finding:
No personal property of any value was noted during the inspection. Trash and debris
cover the backyard of the unsecured structures.
(6) Obtain inspections by police, fire and health officials;
Report Finding:
Multiple Police incident reports were identified from April 2009 – December 2010, and
are provided as Attachment (3).

(7) Determine the condition of utilities serving the property and if such utilities should
be disconnected;
Report Finding:
All utilities have been secured since May 16, 2011. The electrical service has been
disconnected at the utility pole. The weatherhead mast and main panel are located
on the corner of the structure; but are unusable.
(8) Prepare a notice and report to the building standards commission and to the
District Court in case of any appeal;
Report Finding:
Draft notice is provided as Attachment (4).
(9) Obtain necessary search warrants when there is probable cause pursuant to
Article 18.05, Code of Criminal Procedure;
Report Finding:
No possible evidence of potential criminal activity was noted during the inspection, so
no probable cause exists to obtain Article 18.05 search warrants.
(10) Determine necessary repairs to bring into compliance with safety standards
unless determined repairs would require substantial reconstruction; and
Report Finding:
Repairs to resolve the numerous safety concerns would require substantial
reconstruction of the structures. The structures are beyond repair. It is also noted
that the property is located within the FEMA established Floodplain, per Attachment
(5). Such location makes renovation or reconstruction difficult administratively, but
not impossible.
(11) Determine if unsafe conditions should be abated by being secured or by removal.
Report Finding:
The main structure is unsecured at the windows, doors, several wall openings, and
under the floor. Boarding up these openings with plywood would secure the structure
ONLY if the screws used to secure the plywood would remain tight against the aged
and bare wood siding and framing, which is doubtful. The wood framing is likely
rotted, as is the front porch framing. The main structure is almost entirely of wood
construction. Combining the construction and the unkept yard, this structure presents
a serious fire hazard. Removal is the best option for both structures.

The Owner and any mortgagee or lienholder are hereby notified that this property, identified as:
306 Jones St S-2-P Block 1, Lot 4; Property ID 30590
has been found to be dilapidated, unsanitary, and open; and to create a fire menace; all in violation of City of Del Rio
Ordinance Nos. 95-21 and 2013-055. The City of Del Rio will secure or remove the building, if the ordered action is not
taken within thirty (30) days by the Owner or by any known mortgagee or lienholder, after the hearing of the Building
Standards Commission or the District Court, if appealed.
A public hearing will be held before the Building Standards Commission on
Wednesday, July 1, 2020; at 5:30pm at the Council Chambers – City Hall, 109 West Broadway, Del Rio, Texas.
In the event of demolition by the City of Del Rio, the Owner within thirty (30) days after the hearing and the known
mortgagee or lienholder shall be responsible for removing from the building any personal property, fixtures or other
property of value.
If the Owner fails to remove any personal property, fixtures or other property in the building, the Dangerous Building
Official shall dispose of such personal property pursuant to Chapter 7 “Boards and Commissions”, Article II, Building
Standards Commission: Dangerous Buildings; Section 7 – 22, of the City of Del Rio Code of Ordinances.

InformationSUBJECT:Public Hearing to determine if the structure at 403 Ware Street (Fairview Block 18, Lot 7) fails to comply with theminimum standards because of one (1) or more of the five stated conditions listed in City Code Chapter 7; ArticleII, Dangerous Buildings; Section 7-19, Minimum Standards.
BACKGROUND:This is the second hearing for this property. At the May 27, 2020 meeting the commission voted to secure structureno later than June 24, 2020 and demolish by owner no later than August 26, 2020.
DISCUSSION:Dangerous Building Official's Report is attached.
In a site visit to the property on June 23, 2020 staff found there was no progress made to secure the structure andthe structure was in the same condition as reported at the May 27, 2020 meeting. In a phone call to the point ofcontact for the property on 6/26/2020 staff was informed that the structure was now secured. Staff was unable toconfirm this prior to the publication of the agenda.
PROS:Structure is unsecured and dilapidated.
CONS:Public safety is at risk, if this property remains unsecured.
RECOMMENDATION:Staff recommends review and determination of demolition.

Structure Address: 403 Ware St.
Under the City of Del Rio, Texas, (City) Code of Ordinances Chapter 7, Boards and
Commissions, Article II. Building Standards Commission; Dangerous Buildings; the City
invokes its authority to abate nuisances as a home rule city and Section 214.001 et
seq., Local Government Code.
Minimum Standards Per Article II, Section 7-19, Minimum Standards, of the City Code of Ordinances, (Ord.
No. 2013-055), “the term “building” shall include a structure of any kind or part thereof.
All buildings and structures in the city shall conform to the minimum standards set out in
the city’s building code, fire code, plumbing code, electrical code and mechanical code
(the “codes”). Failure to comply therewith shall constitute a violation of this article. In
addition, a building or structure which fails to meet the minimum standards set out in the
codes or in the following cases shall be subject to abatement as herein set out.”
A building is considered to be (1) dilapidated, substandard or unfit for human habitation;
and (2) a hazard to public health, safety and welfare and not to meet the minimum
standards, sometimes referred to as the safety standards, for the continued use and
occupancy” under any one (or more) of the circumstances and conditions below. This
Report addresses each circumstance and condition, as part of the analysis to determine
whether the structure is to be determined as not meeting the minimum standards and if
so; is, therefore, determined to be Substandard.
1) Any building that is uninhabitable, untenantable and unsightly due to
obsolescence and deterioration caused by neglect or vandalism or fire damage
or old age or the elements as evidenced by such conditions as roof, ceiling,
floors, sills or foundations or any combination thereof being decayed or failing
apart; or
2) Any building in danger of falling and injuring persons or property; or
3) Any building, which is a fire menace because of its dilapidated condition; as
described in subsections (1) or (2) or for other reasons; or
4) Any building, which is damp and in an unsanitary condition and is likely to create
disease and sickness because of being in a dilapidated condition as described in
subsections (1) and (2) or for other reasons; or

5) Any building, which is open and insufficiently secured to prevent entry by
children, vagrants or criminals or constitutes an attractive nuisance to children.
Report Finding:
As a result of the Inspection detailed below, this structure meets subsections (1), (2), (3)
and (5) above and consequently, does NOT meet the minimum standards of Article II,
Section 7-19. It is, therefore, determined to be SUBSTANDARD.
Inspection
Per Article II, Section 7-21, Inspection, of the City Code of Ordinances, the Dangerous
Building Official (DBO), “shall inspect any unoccupied building that is suspected of not
meeting safety standards” and shall perform eleven specific duties. This Report and
Recommendation addresses each of these eleven specific duties below:
(1) Obtain and consider the following information:
a. The age and general condition of the premises;
b. Previous violations of hazards found present in the premises;
c. The type of premises;
d. The purpose for which the premises are used; and
e. The presence of hazards or violations in and the general condition of the
premises near the premises to be inspected.
And determine if the building is unsafe and does not meet the described
safety standards and should be reported to the building standards
commission and notice issued;
Report Finding:
a) The Val Verde County Appraisal District database shows the year the structure
was built as 1950. Hardcopy of the database record, dated December 20,
2019, is provided as Attachment (1).
b) No previous violations of hazards were identified.
c) The construction type of premises is wood pier with some concrete block as a
footing foundation, wood frame, wood siding, and a wood frame with shingle
roof.
d) The purpose of the premises is as a residence.
e) The premises in the surrounding area are of similar age, properly maintained,
and occupied; and do not have obvious safety violations as does this property.
It is determined by the DBO that the building at 403 Ware St. is unsafe, does not
meet the described safety standards, and should be reported to the building
standards commission and notice issued.

(2) Verify ownership and property description by such sources as the tax rolls, utility
rolls, title run and any other reasonable and available sources of information;
Report Finding:
According to the Val Verde County Appraisal District database, the owner is
Guadalupe Esquivel de Perez of 508 E. Rodriguez, Del Rio, Owner ID 94008. The
City Utility Billing Division reported that the billing account was closed August 6,
2003.
(3) Inspect the property and report any items that violate the safety standards;
Report Finding:
The premises have multiple hazards or safety standards violations, including, but not
limited to, open electrical boxes (albeit unenergized), exposed roofing sheathing,
broken glass and missing windows, and dilapidated wood siding.
(4) Photograph the property;
Report Finding:
Photographs of the property with annotations are provided as Attachment (2). The
entire structure is dilapidated. Siding and floor structural members are rotten. The
structure is fully unsecured at multiple doors and windows.
(5) Determine if there is any personal property in the building and if it has any value
or not (value means that it would sell for a price that is over and above the cost of
collecting, transporting, storing and selling at a city auction) and administer such
property pursuant to this article;
Report Finding:
No personal property of any value was noted during the inspection. Trash and debris
cover the floor of the unsecured structure.
(6) Obtain inspections by police, fire and health officials;
Report Finding:
No such inspection or incident reports were identified.
(7) Determine the condition of utilities serving the property and if such utilities should
be disconnected;

All utilities have been secured since 2003. The electrical service has been
disconnected at the weatherhead mast and main panel, which are located on the
corner of the structure; but are unusable.
(8) Prepare a notice and report to the building standards commission and to the
District Court in case of any appeal;
Report Finding:
Draft notice is provided as Attachment (3).
(9) Obtain necessary search warrants when there is probable cause pursuant to
Article 18.05, Code of Criminal Procedure;
Report Finding:
No possible evidence of potential criminal activity was noted during the inspection, so
no probable cause exists to obtain Article 18.05 search warrants.
(10) Determine necessary repairs to bring into compliance with safety standards
unless determined repairs would require substantial reconstruction; and
Report Finding:
Repairs to resolve the numerous safety concerns would require substantial
reconstruction of the structure. The structure is beyond repair.
(11) Determine if unsafe conditions should be abated by being secured or by removal.
Report Finding:
The structure is open and unsecured at the windows, doors, and several holes in the
walls and under the floor. Boarding up these openings with plywood would secure
the structure ONLY if the screws used to secure the plywood would remain tight
against the aged and bare wood siding and framing, which is doubtful. The wood
siding and framing are rotted. The structure is entirely of wood construction. This
structure presents a serious fire hazard. Removal is the best option.
Proximity to Another Structure Demolished by the City
This structure is within the same fenced area as 900 Dignowity, a structure to be
considered for demolition by the Owner under order of the Building Standards
Commission, per Attachment (4) from the Val Verde County Appraisal District maps.
If the City is required to perform the demolition of 900 Dignowity, the 660 feet
minimum distance rule would apply to the instant structure, 403 Ware Street.
