1.0 INTRODUCTION

1.1 Project Outline

Canberra Metro is Australian Capital Territory’s largest public transport project and the first stage of the capital’s new fully-integrated light rail system due to commence revenue service in the second half of 2018.

The Canberra Metro contract is a Public Private Partnership project – the largest in the history of Australian Canberra Territory, as well as the first of its kind for a Metro project within the ACT region. The Project involves the design, construction, operation and maintenance of:

14 Light Rail Vehicles (LRV) manufactured by CAF in Spain (URBOS 100 Platform);

12 new stops and associated urban design;

12 kilometres of new (embedded) track and rail systems, traffic signalling, mechanical, electrical and 750V OHW supply systems;

Building and operating the Flemington DMF (Depot Maintenance Facility) at Sanford/Flemington, which will provide rolling stock stabling and maintenance facilities

The operation and maintenance of the Canberra Metro Rail system for 20 years.

Canberra Metro is employing an Intelligent Transport System (ITS) based Signalling System, which interfaces and integrates into the existing road traffic control network. There will be no “train control” or protection component to this Signalling system, because the LRVs are operating in mixed traffic conditions and are driven by sight. LRV service will be managed from the Operations Control Centre (OCC) located in the Depot facility at Sandford.

All stops and LRVs will be fitted with Passenger Information Display Screens (PIDs) and/or Public Announcement (PA) systems.

2.0 SCOPE OF WORKS AND/OR SERVICES

2.1 General

The Subcontractor is, except as otherwise stated or excluded elsewhere in this document (“Scope Works and/or Services”) responsible for the provision of all management, supervision, labour, materials, plant, equipment, consumables, tools, overheads, taxes, wages, accommodation, transport, site allowances, preparation of documentation, and any other incidental costs whatsoever necessarily required and incurred in undertaking the installation of conduits/pits for communication and high voltage as described herein.

This includes all related items as contained within the Contract documentation and to the satisfaction of: -

All Legislative Requirements,

Building Code of Australia,

Australian Standards,

Codes of Practice,

HSE Requirements, and

Delivery Contract requirements. The details in this document must be read in conjunction with the Contract Conditions, Specifications, project documentation as well as the drawings and specifications noted in the schedule of Drawings. The Subcontractor warrants that it has, and it is deemed to have, fully informed itself in relation to site conditions including traffic areas and all documents furnished by JHCPBJV, prior to it tendering for the Contract Works and has fully satisfied itself regarding all the conditions, risks, contingencies and other circumstances which might affect its performance of the Contract Works. in particular, the Subcontractor warrants that it has, and it is deemed to have, thoroughly investigated all matters regarding the relevant site, surface and sub-surface conditions. The Subcontractor is deemed to have inspected the site and made allowance for any works not detailed on the drawings or tender documentation that are necessary for the successful completion of the Contract Works.

1. The Subcontractor shall carry out the works in accordance with the specifications, standards and drawings, including but not limited to the scope sections outlined with in this document;

2. The Subcontractor shall make allowances for the cleaning and re-instatement of any surfaces or materials disturbed, marked or soiled by any plant, equipment, vehicles and/ or personnel employed or under the direction of the Subcontractor to JHCPBJV’s satisfaction;

3. The Subcontractor is responsible for housekeeping at the work front;

4. The Subcontractor shall work collaboratively with JHCPBJV and other subcontractors to ensure the Contract Works are completed with a best-for-project focus, utilising where possible a multi-skilled workforce;

5. The Subcontractor is responsible for all costs incurred to mobilise to site and also to demobilise from site;

6. The Subcontractor is responsible for transport of materials and personnel to and from the Contract Works areas in a form of transport approved by JHCPBJV;

7. All deliveries of plant and material by the Subcontractor are to be coordinated with JHCPBJV to align with other concurrent activities in the surrounding areas and to comply with the Community and Environmental guidelines of the project;

8. The Subcontractor is responsible for protection of all survey set-out points and markers at the work front;

9. The Subcontractor is responsible for the Supply, erection, and removal of all temporary guards, barriers, handrails and work platforms required for the execution of the works.

10. The Subcontractor is responsible for providing, monitoring and maintaining adequate protection of all Works and/or Service until completion of works, having regard to the likely effect of all following trades and the sequencing of works. The Subcontractor will be responsible for the rectification of any items damaged by following trades as a result of deficient protection.

11. The Subcontractor is to provide measures by the relevant authorities, ordinances, regulations and common law for the protection of surrounding public and private property, footpaths, streets, kerb and gutters, the public, occupants and workmen during the course of the works and pay all fees required for restoration of the same.

12. All debris, rubble and rubbish must be disposed of in accordance with documentation, codes, standards, legislation, regulatory authorities etc. All waste materials that can be recycled must be sorted by the Subcontractor and placed in the recycling bins.

2.2 Detailed Description of the Work Elements

The subcontractor is to allow for all works required in order to complete the tree felling and stump grinding scope as shown on the attached marked up layout and described herein including but not limited to all materials, plant, labour, fuels & consumables.

The subcontractor is to attend site prior to submitting their price to ensure that site conditions and access is understood and allowed for. The subcontractor is to clearly identify within their tender response any exclusions or assumptions they have relied upon. Any works not expressly identified will be deemed to be included in their price.

The subcontractor is to allow for wood-chipping / disposal / removal of all felled timber and stumps from site as part of the subcontract works.

Access Points

Access for all work locations will be from Flemington Road and will as per the supplied Temporary Traffic Management Plan.

Site hours will be between 7:00 am and 6:00 pm Monday – Friday, and 8:00 am to 1:00 pm Saturday

Work Sequence Requirements

The following sequence of work activities and dates are indicative only and subject to change in accordance with the master programme.

Work areas highlighted with a red cloud are priority works and need to be removed by early November 2016. There are approximately 31 trees that are in the highlighted area.

The subcontractor shall provide a felling program for the remaining 140 trees which will be reviewed, amended, and approved by CMC. It is excepted for all trees to be removed by early December 2016.

Subcontractor is required to provide and comply with the below requirments.

PPE requirements for this project include but are not limited to Hard Hats, High Visibility shirts or vests, Steel Capped Safety Boots, Long Sleeve Shirt, Long Trousers, Medium Impact Safety Glasses and Gloves and Clip at all times plus additional task specific PPE such as chainsaw chaps. Other requirements are available upon request.

2 All delivery drivers must report to the site office prior to entering site.

Subcontractor is aware that other contractors will be working in the area and that the subcontractor will not have sole access to the site. The subcontractor is to assist with the interfacing / coordination of other subcontractors work to ensure the timely completion is achieved.

4 The subcontractor is required to submit site specific safe work method statements to Canberra Metro a minimum of 1 week prior to commencing the activities on site. Note, that due to the time constraints for this scope of work the review will be expedited as far as reasonably practicable

5 Works shall be carried out in accordance with the Contract, Specifications, Drawings, Scope of Works, WorkCover codes of practice, Building Codes of Australia, Australian Standards and all relevant Authority, Statutory and Safety requirements.

6 Clean up works on a daily basis. Deposit all non-hazardous waste in bins provided by Canberra Metro.

7 The subcontractor is responsible for keeping the works zone safe at all times. General housekeeping throughout the site to be maintained at all times. The subcontractor is responsible for disposal of all waste materials.

8 subcontractor to provide all barricades, warning signs etc required to carry out the works in accordance with the statutory safety requirements,

9 The subcontractor is to coordinate with Canberra Metro to ensure location and protection of underground services. The subcontractor is responsible to obtain a signed “Permit to Disturb” form from Canberra Metro prior to commencing any excavation works.

10 The subcontractor must comply with all Contract and legislated environmental requirements. This includes the requirement for all plant and equipment to be washed down prior to leaving site at the completion of works

11 The subcontractor is to attend a daily pre-start meeting each morning prior to commencing work. Allowance to attend this should be included in your rates.

12 The subcontractor is to ensure flashing yellow lights, non-tonal reversing beepers, fire extinguisher and UHF radios are installed on all plant

13 The subcontractor is responsible for all environmental controls applicable to their works through the work site during construction.

14 The subcontractor must provide all safety documentation required by legislation in regards to plant, this includes Plant Hazard Assessments, Maintenance Records, Registration, any engineering modification certificates and plant will be inspected as it comes to the project.

15 The subcontractor must access the site via the nominated access routes.

16 All personnel working on site must have a OH&S General Induction Training Certificate for Construction Work in NSW issued by WorkCover

17 All personnel are to have asbestos awareness training as required by ACT legislation

18 The subcontractor shall provide experienced, trained, competent and qualified personnel to carry out the works.

19 The subcontractor shall provide evidence, at the induction prior to commencement, that all its employed personnel are competent and appropriately certified.

20 The subcontractor is to provide any plant, fuel or equipment to access their Works

21 The subcontractor is to provide temporary power required for hand-tools during installation works

2.2.1 Technical requirements

- As required under the Contract.

2.2.2 Safety

Subcontractors are required to comply with the Canberra Metro Construction (CMC) Project policies and procedures.

1. The Subcontractor shall make allowances for all inductions, competency testing and all necessary personnel protective equipment (PPE) inclusive of personal locks and isolation devices as required to undertake the Contract Works and/or Services and any additional PPE requirements as required by JHCPBJV for works being undertaken on the project;

2. The Subcontractor shall undertake testing and tagging of all electrical equipment as per JHCPBJV requirements and AS3012:2003 Electrical Installations – Construction and demolition sites;

3. The Subcontractor shall provide a Safety Management Plan for review and approval by JHCPBJV 21 days prior to commencement of the Works and/or Service. Alternatively, the Subcontractor may submit to JHCPBJV in writing an acknowledgement of its compliance with JHCPBJV Safety Management Plan; JSEA’s are to be developed and submitted to JHCPBJV for approval prior to commencement of work

4. The Subcontractor is deemed to be aware that the onsite component of the Contract Works and/or Services may be carried out in a trafficable area and should familiarise its entire workforce as such. There are implied hazards with work that include heat, dust, noise in ground and overhead services and the Subcontractor is deemed to be fully aware and has familiarised themselves with these conditions prior to commencing the Contract Works and/or Services.

5. Provision for Material Safety Data Sheets (MSDS) for all solvents, cleaning fluids, and chemicals introduced on the project site.

6. Provision for a recognised Safety Representative and certified First Aid Officer on the project construction team for the entire duration of the Scope of Works and/or Services.

7. Copy of morning prestart sheets need to be presented to Safety department by 9am every morning.

2.2.3 Design

No permanent design works are required by the Subcontractor for this package, however where applicable it is to be completed under the Scope of Works and/or Services.

1. Where applicable under the Contract the Subcontractor is responsible for the design, construction and certification of any temporary works required to aid completion of the Contract Works and/or Services;

2. The Subcontractor is responsible for the provision of all certifications required to carry out the Works and/or Services; and

3. The Subcontractor shall supply copies of any third party or statutory authority approvals or

certifications that have been created or obtained during the course of the Contract Works.

2.2.5 Plant and equipment

1. The Subcontractor, where supplying its own plant, equipment and vehicles must allow for inspections as required by JHCPBJV and must provide for any maintenance, modifications, additions and/or repairs as directed by JHCPBJV to ensure their safe operational use on the Project. All motor driven equipment used within the work area must be diesel powered.

2. The testing, tagging and provide/maintain a register of all portable equipment and extension leads used on the project site.

3. Dependent on the area of work, up to 48 hours notice may be required for deliveries of plant and/or equipment.

4. Conduct all plant servicing off site and ensure that any spills or waste products are immediately notified, cleaned up and/or disposed of in the appropriate manner. All refuelling of plant or small equipment on site.

2.2.6 Site Meetings, Reporting and Coordination

1. The Subcontractor is to coordinate with JHCPBJV’s representative on a daily basis to ensure the Contract Works and/ or Service are co-ordinated with the overall project requirements and will not hinder any other works being carried out on the project;

2. The Subcontractor shall program, coordinate and allow for the ordering, receipt, storage, and handling of all plant and materials, including free issue items, from the agreed point of delivery to the final installed position in the Subcontract Works;

3. The Subcontractor is to make provision for attendance at weekly Site coordination meetings and any other meeting as directed by JHCPBJV;

4. The Subcontractor shall be responsible for proactively engaging with JHCPBJV engineers and site representatives to ensure that access requirements and provisions are clearly communicated to JHCPBJV for the express purpose of avoiding and/ or mitigating potential delays to the Subcontractor;

5. Supply daily / weekly records based on construction programme; and

6. All reporting required for Daily, Weekly & Monthly tracking.

2.2.7 Materials

1. Where applicable the Subcontractor shall comply with project packing and marking requirements and packing declaration;

2. The Subcontractor shall arrange delivery and unloading of all required permanent and temporary materials required for the Contract Works and/or Service; and

3. Storage of materials and equipment within the licensed project area shall be in areas designated by JHCPBJV. Onsite storage shall be for staging only.

2.2.8 Planning and quality assurance

1. The Subcontractor shall produce all work Inspection and Test Plans (ITP) and checklists, construction method statement, (CMS), work method statements (WMS), risk assessments, Job Safety and Environmental Analyses (JSEA) and quality documentation in a format as agreed with JHCPBJV. All documentation shall be issued to JHCPBJV at least 21 days prior to commencement of the Contract Works for submission to the independent verifier and/or the client for approval;

2. The Subcontractor shall ensure all test equipment is calibrated and calibration certificates are provided to JHCPBJV along with all test results as and when calibration of test instruments is undertaken; and

3. Provision of all completed commissioning documentation including ITPs, WMS and as-built drawings. Copies are to be signed by the Subcontractor’s Representative. All drawings returned by the Subcontractor shall be marked “as-built” regardless of the extent of any changes.

2.3 JHCPBJV obligations

JHCPBJV will provide the following items:

1. Project inductions;

2. Survey reference points as required to undertake the Contract Works and/or Services. JHCPBJV shall provide designated survey points for the Subcontractor to set out the works utilising their own equipment to achieve the tolerances as per the standards, specifications and drawings. It remains the Subcontractor’s responsibility to offset and protect all survey marks provided by JHCPBJV. Costs of re-survey will be passed onto the Subcontractor;

3. Provision of site security of construction sites and laydown yards. The Subcontractor will be responsible for the security of their materials, plant, equipment and facilities with in these areas;

4. Provision of rubbish bins and clearing and or removal of same;

5. Provision of surface cribbing facilities on a shared basis;

6. Ventilation of work areas;

7. Chamber access passage lighting sufficient for access only;

8. JHCPBJV will provide a supply of potable water, power, and compressed air. These services will be available at designated locations for use by the Subcontractor, and are shared with all other subcontractors and JHCPBJV;

9. Provision of 240V power at temporary distribution boards as designated locations;

10. Traffic management accordance with project and area traffic management plans. The Subcontractor shall be required to plan its works in conjunction with JHCPBJV such that appropriate planning and approved times are programmed so as not to impact delivery. All requirements for road or path closure are to be requested in writing by the Subcontractor; and

11. Excavation permits with approvals based upon applications made by the Subcontractor in accordance with JHCPBJV trenching and excavation requirements.

2.5 Exclusions

The Subcontractor is not required to supply / construct/ service the following elements (Refer to the highlighted drawings for scope representation and clarification):

2.6 Access and egress details

The following section outlines the expected Contract Works and/ or Service area access and egress that will be present during the period of the Contract Works. The Subcontractor must make sufficient allowances for the following:

1. JHCPBJV will provide sufficient access to the Contract Works area to enable the Subcontractor to execute the Contract Works. JHCPBJV cannot guarantee continuous access and access to each work area must be coordinated between JHCPBJV and the Subcontractor as advance of activities commencing;

2. The Subcontractor does not have exclusive access to the Contract Works area and JHCPBJV from time-to-time will, with notice, designate and control the limits of operation of the Subcontractor’s activities. It is the responsibility of the Subcontractor at no cost to comply with reasonable or controls as may be necessary;

3. The Subcontractor must plan for access limitation/ delays in its progress and resultant costs are deemed to be included in the Contract Sum and or applicable Rates. At times JHCPBJV and other subcontractors may be working in the Contract Works area or access routes concurrently with the execution of the Subcontract Works by the Subcontractor. All necessary precautions must be taken by the Subcontractor to avoid interfering with such activities of JHCPBJV or other subcontractors and it is the Subcontractor’s responsibility to co-ordinate its activities with other subcontractors and JHCPBJV. The Subcontractor is not entitled to make any Claim in respect of any losses, costs, expenses, damages or delays resulting from the shared use of the Subcontract Works area or access routes;

4. No onsite parking is provided by JHCPBJV for Subcontractor employees. Only approved Subcontractor vehicles will be allowed access to the Site and then only by arrangement with JHCPBJV;

5. The Subcontractor must transport its personnel from the agreed muster point(s) to the Contract Work areas. There is no general parking of vehicles in the Site;

6. Access conditions within the tunnel may not be on a level surface. There is high potential to be driving vehicles through rocky, undulating and muddy surfaces;

7. Any cranage required at the Contract Works area is to be coordinated with JHCPBJV’s Representative(s);

8. Delivery and unloading of equipment and materials must be coordinated and planned with JHCPBJV’s Representative(s);

9. Access arrangements may change throughout the duration of the Contract Works. Access into the tunnel will be provided at all times and will be coordinated with JHCPBJV;

10. The Contract Work areas may have limited portal access from time-to-time and alternative access arrangements to the Contract Works areas must be maintained. The dimensions of the access passages and Contract Work areas are detailed in the drawings. The Subcontractor

must undertake the Contract Works from within the available access locations and must coordinate the Contract Works with JHCPBJV and other subcontractors so as not to delay them or the Subcontract Works; and

11. Hours of operation available for performance of the Contract Works will be day shift hours currently performed by JHCPBJV are between (generally) 6:00am to 6:00pm Monday to Saturday. Holiday work hours vary depending on JHCPBJV requirements. Works outside these times are subject to approval by JHCPBJV.

2.7 Scope Methodology

The chosen scope methodology to undertake the Contract Works is to be determined by the Subcontractor and submitted to JHCPBJV for approval, but must achieve the requirements of this Scope of Work and/or Service in a timely, safe, and efficient manner. As part of the scope, the Subcontractor is required to resent details of their proposed system and methodologies.

4.0 ITEMS FREE ISSUED BY JHCBPJV

The following items will be supplied free of charge to the Subcontractor by JHCBPJV for incorporation into the Contract Works and or Services. The Subcontractor is deemed to be fully responsible for the items from the time of receipt by the Subcontractor. The Subcontractor is responsible for agreeing a materials schedule for each separate portion with the relevant area project Engineer within two (2) weeks of award of Contract. The Subcontractor is responsible for coordinating with JHCPBJV’s Representative to ensure at least two (2) week’s notice is given in respect of daily requirements for material deliveries from the previously agreed materials schedule.

5.0 DELIVERY PROGRAM

The Subcontractor as part of this Scope of Works and/or Service is required to develop a detailed program, within the bounds of the table below, and in conjunction with JHCPBJV, that ensures that the Contract Works are completed on time. Preparation of the Subcontractor’s Program must meet the provisions of the program requirements.

5.1 Program and Rate of Progress

7.1.1 Within 14 days of the date of Contract execution the Subcontractor shall provide JHCPBJV Representative with a detailed program (including a critical path) for the performance of the Contract Works and or Service (“Subcontractor’s Program”) for JHCPBJV Representative's approval. Any such approval shall not relieve the Subcontractor of any of its obligations under this Contract.

7.1.2 The Subcontractor’s Program must be based on the JHCPBJV dates and or milestones of program;

(a) identify all activities, critical activities (critical path), key dates, target milestones and completion dates for the provision of the Contract Works;

(b) identify the allocation of resources necessary to complete the Contract Works

(including the number of man hours that the Subcontractor has allowed to complete the onsite Contract Works); and

(c) be prepared in sufficient detail to enable TJH to verify that the scheduling of the

Subcontractor’s Activities is in accordance with the program requirements of JHCPBJV.

7.1.3 The Subcontractor shall closely adhere to the approved Subcontractor’s Program and shall take all necessary measures to bring the Subcontract Works and or Service back on schedule should any delay occur.

7.1.4 Should the Subcontractor fail to take what JHCPBJV’s Representative considers are effective measures to remedy any delay(s) within seven (7) days of written notification by JHCPBJV’s Representative to do so, then JHCPBJV’s Representative may direct the Subcontractor to take such measures as JHCPBJV’s Representative considers necessary to bring the Subcontract Works back on schedule. The Subcontractor shall be liable for all additional costs which the Subcontractor may incur as a result of such a direction from JHCPBJV’s Representative. If the Subcontractor fails to comply with JHCPBJV’s Representative's direction JHCPB may at the expense of the Subcontractor and, without prejudice to any other right it may have under this Subcontract, step in and take any action necessary to bring the Subcontract Works back on schedule or withhold the whole or any portion of any payment due to the Subcontractor until such time as the Subcontractor has complied with the direction.

7.1.5 The Subcontractor shall perform its obligations under the Subcontract with due expedition and without delay.

7.1.6 JHCPBJV’s Representative may direct in what order and at what time the various stages or parts of the Subcontract activities shall be performed. If the Subcontractor can reasonably comply with the direction, the Subcontractor shall do so. If the Subcontractor cannot reasonably comply, the Subcontractor shall notify JHCPBJV’s Representative in writing giving detailed reasons.

7.1.7 Within seven (7) days of any approved change to the date for completion or any intermediate milestone date the Subcontractor shall submit a revised Subcontractor’s Program to JHCPBJV’s Representative.
