COURT OF APPEALS DUTIES:1. The primary duties of a law clerk are to analyze andresearch cases on appeal.2. A law clerk’s typical responsibilities include cite checking,close review of the record and transcripts from the districtcourt, evaluating conflicting briefs, supplementing the legalresearch submitted in the briefs, and assisting the judge inaccurately synthesizing the facts and the law throughpreparation of bench memoranda and providing furtherassistance in opinion preparation.

QUALIFICATIONS:1. The minimum academic requirement for application forboth courts is enrollment as a second-year law student2. Graduation from an accredited law school is required tobegin employment3. Professional skills and scholastic proficiency are bothconsidered4. Strong writing and research skills are essential5. Law clerks for assignment judges learn all aspectsof court administration and assist with processing emergentmotions. Trial court law clerks gain practical experiencewhile gaining valuable insight into the judicial process.Under the direction of one or more judges over the course ofthe year, trial court law clerks observe judicial proceedings,attend conferences with attorneys and judges, receivetraining in mediation and mediate small claims cases andsummarize information for judges. REQUIREMENTS

EDUCATION: Law clerks must have graduated from a lawschool approved by the American Bar Association by thetime of their law clerk appointment. The Judiciary’s lawclerkship program is intended for recent law schoolgraduates who have not yet engaged in the practice of law.Selected candidates will be required to provide an official,final law school transcript, not a photocopy, which includesthe date of graduation from their law school at the time ofhire. Excellent writing and analytical skills are essential.

MEDIATION TRAINING: It is helpful to have completed acourse in mediation prior to the start of the clerkship. Under

Court Rule, all trial court law clerks who will serve asmediators must first complete the Judiciary sponsored12-hour mediation training or its equivalent. Applicantsselected for clerkships can request a waiver from attendingthe Judiciary’s training program at the start of the courtterm by providing documentation that confirms that theysuccessfully completed an approved alternative disputeresolution course.

DRIVER’S LICENSE: Appointee will be required to possess adriver's license valid in New Jersey only if the operation of avehicle, rather than employee mobility, is necessary toperform the essential duties of the position.

SPECIAL NOTE: Individuals selected for clerkships mustagree to a thorough background check, which will includefingerprinting. All data received will be kept in the strictestconfidence except to inform the individual of the findingsand what action will be taken as a result of this information.

AUTHORIZATION TO WORK: US citizenship is not required.Selected candidate must be authorized to work in the USaccording to Department of Homeland Security, USCitizenship and Immigration Services regulations.

RESIDENCY LAW: Pursuant to N.J.S.A. 52:14-7 (L. 2011,Chapter 70), also known as the “New Jersey First Act,”which became effective September 1, 2011, all personsnewly hired by the Judiciary on or after that date shall haveone year from the date of employment to establish, andthen maintain, principal residence in the State of NewJersey. Law clerks are not subject to the residency lawduring their 53 week term. Additionally, law clerks whoserve a second clerkship in a higher court are exempt fromthe residency requirement. New Jersey state employeeshired prior to September 1, 2011 who transfer from withinthe Judiciary or from another State of New Jersey appointingauthority without a break in service greater than seven daysbut who reside outside the State of New Jersey are notrequired to change their principal residence to New Jersey inorder to comply with the Act. Clerks who anticipate movinginto another state position immediately following theirclerkship(s) must be mindful that, upon conclusion of theirclerkship term, they will need to be New Jersey residents.

The Court of Claims is given original jurisdiction to hearand determine all civil actions filed against the State ofOhio and its agencies. The court also hears appeals fromdecisions made by the Attorney General on claimsallowed under the Victims of Crime Act.

The Court of Claims decides civil claims that typicallyinvolve contract disputes, property damage, personalinjury, immunity of state officers and employees,discrimination, and wrongful imprisonment. The ChiefJustice assigns judges to hear such cases. In almostevery instance, a single judge will hear a case, but theChief Justice may assign a panel of three judges to a civilaction that presents novel or complex issues of law andfact.

Civil complaints filed for $10,000 or less are decided onthe contents of the case file or "administratively" by theclerk of the court or a deputy clerk. Appeals from thosedecisions ("administrative determinations") may be takento a judge of the court upon motion for court review. Thecourt’s judgment cannot be the subject of further appeal.

Crime victims' appeals are heard and determined by apanel of three commissioners who are appointed by theSupreme Court for a six-year term. A further and finalappeal from the panel’s decisions may be taken to ajudge of the court. As in the case of administrativedeterminations, the judge's decision is final.

The OCC is seeking two 2D/3E for a part-time clerkshipopportunity. This unique experience will provide anopportunity to review two parties cases includinginvestigations and to draft opinions.
