If a permit is pulled A building permit will be obtained for this

project. Case will obtain the permit and present owners with receipts for the permit and/or permit service, which will be reimbursable upon presentation. Permit drawings of this project will be presented for the owners approval within ten (10) working days of the signing of this contract and receipt of its first payment. This contract is contingent upon the owners approval of said drawings. If the owner decides to cancel this agreement subject to this contingency, Case will retain $500 dollars for the costs associated with preparing the drawings.

1 1.) NEW PORCH ROOF ON EXISTING SLAB: Remove existing

awning and prepare existing exterior wall, eves and roof to receive new porch. We assume existing house foundation, walls and roof are sound and will require no structural reworking. No work has been included for existing landscaping, windows, doors, siding, soffit, fascia, roofing, gutters and downspouts. No work has been included to rework / relocate existing electric service or H.V.A.C. Systems. Construct a 200sf, gable style roof, approx. 10' x 20', per plans. Roof to be built over new PTP-2x10 wood beams set on 4x4 ptp wood posts. Posts to be set on existing slab foundation.. Porch ceiling to be flat 2x6 joists. Roof to be 2x8 rafters with 1/2" CDX sheathing, 30# felt and 25yr fiberglass shingles. Install new 5" aluminum gutters and downspouts on addition only. Screens are not included. Porch rail to be colonial fir. Porch finishes to include MDO finished ceiling, with wrapped posts and beams. Roof trim to be primed pine, (soffits, fascia, rake, & frieze boards). Painting / staining has / not been included. ( see ALLOWANCES & EXCLUSIONS ). Total: $10,942.00

ACCEPTANCE: The above prices, specifications, conditions, and Terms and Conditions on the reverse side are hereby accepted. You are authorized to perform the work specified.

PAYMENT, will be made as follows:1/3 upon signing / 1/3 upon start / 1/3 upon completionSTART DATE: CASE will contact the owner within three business days upon receipt of this signed contract and it’s first payment, to schedule the work.

GENERAL CONDITIONS

1. GENERAL This contract may be withdrawn by CASE unless signed by theOwner and received with the first payment, by CASE. The Ownermay cancel this contract at any time prior to midnight of the thirdbusiness day after the date of this agreement, without penaltyCASE shall not be liable for damages resulting from, or for, anydelay or inability to perform due to strikes, fire, acts of God, othernatural causes (including weather conditions), acts of publicauthorities or enemies, availability of materials, or any other causesbeyond the control of CASE.

2. PERMITS

CASE shall obtain and pay for permits, as noted, for theexecution of the work. This contract is subject to issuanceof such permits and other required approvals by localbuilding inspectors based on the contract. We assume nowork will be required due to existing code violations

3. TIME AND MATERIAL

If “Time and Materials” work is specified in the contract, or approved in an addendum, labor will be charged at a predetermined hourly rate and materials will be charged at CASE cost plus twenty-five percent (25%). Upon completion of the work, the actual costs will be compiled and billed to the Owner through a contract addendum

4. ALLOWANCE

- An allowance is a specified sum of money setaside for an item about which there is not enoughinformation to establish an accurate price. Thespecified sum is an educated guess and the actualcost may vary. Once an actual cost is established,owner will be charged/credited any differencethrough a contract addendum. Allowances asnoted, are at CASE cost plus twenty-five percent(25%).

6. PROTECTION

CASE will provide dust protection as practical. Owner agrees to remove and protect all personal property from area(s) to be affected prior to commencement. Movement and/or protection of personal belongings by CASE personnel, if required, will be charged on a time basis. Care will be taken, but CASE will not be responsible for damage or loss, if any.

8. STRUCTURAL WORK

CASE assumes the existing structure scheduled to remain is in good condition and will not require work except as noted. Structural work/repairs, if required/specified, will be limited to replacing or reinforcing the existing structure using standard building practices. Structural engineering has not been anticipated and/or included unless specifically stated. Case may elect to retain a structural engineer if concealed or unusual conditions are found during construction. Owners will be charged for the cost of the engineer and any additional work through a contract addendum.

9. CONCEALED CONDITIONS

- If there are walls to be removed/altered, we assume them to be non-bearing, and that adjoining rooms are on the same plane. We assume the existing floors, walls, ceilings and roofs, to be level, plumb, and conceal no structural damage/problems, pipes, electrical feeder lines or ducts. Work, if required, for re-framing, re-routing, relocation or replacement of studs, joists, rafters, beams, posts, wires, vents, pipes, ducts, or conduits that may be encountered in the areas of alteration or excavation, has not been included and will be quoted upon discovery in an addendum. Areas disturbed by construction will be patched to blend with the existing as practical. If specified, repairs for any rotted or decayed materials are limited to visually apparent conditions. If concealed damage is found, CASE will present an addendum to repair the additional work.

10. ELECTRICAL

New switches and devices are to be stock ivory, unless otherwise specified. Recessed light locations are subject to joist location and/or existing conditions. Security, fire system, telephone, antenna, and cable wiring or relocation, as well as utility company charges, if required, are to be arranged and paid for by the Owner.

12. MATERIALS

Case assumes any Owner provided items will be on site and in working condition prior to the start of work. Additional costs to reschedule, rework or reinstall owner provided items will be billed to the Owner at T&M rates. Trim carpentry to be stock, one-piece, finger-jointed, unless otherwise specified (note: finger-jointed material does not lend itself to stain).

14. CLEAN UP

CASE will haul all construction debris caused by construction. Upon completion, CASE will leave job in a broom clean condition. All material removed in the course of alterations shall be disposed of by CASE, except those items designated by the Owner in writing prior to commencement of construction.

15. SUBSTANTIAL COMPLETION

- “Substantial Completion” as defined by AIA, is the date when Work is sufficiently complete in accordance with the contract so that the Owner can occupy or utilize the Work or designated portion thereof, for the use for which it is intended. Notice of substantial completion will be provided to the Owner in the form of an invoice less twice the value of unfinished details, if any. Upon completion of any unfinished details, Owner will be presented with a final bill for the balance, which is due upon presentation.

16. WARRANTY

CASE shall remedy any defects due to faulty materials or workmanship which appear within a period of two (2) years from the date of substantial completion. With respect to materials and equipment, any warranty furnished by a manufacturer will be provided to the Owner. This contract excludes any other warranty, expressed or implied

16. WARRANTY

CASE cannot warrant any work done to repair any type of leak including, roofs, chimneys, gutters & downspouts, skylights, doors, windows, plumbing fixtures, showers, tubs, foundations, and basements. CASE will make every attempt to find and resolve the cause of the leak but will not be held liable if the attempt fails to correct the problem.
