Introduction

• The prime objective of this module is to asses the various dynamics and problems of child labour in Punjab province.

• This module will arrest the information of types of child labour in age cohort of 5-17

• In this module, reason for child labour will also be captured.

(Note: All above information is according to the various convention of UN and child labour laws in Punjab province.)

Definition: Child

• The UN Convention on the Rights of the Child and ILO Convention 182 on the Worst Forms of Child Labour (WFCL) designate individuals under 18 years of age as children.

• Since it is rather uncommon for children younger than 5 years of age to work or start schooling, the CLS only interviews children between the ages of 5 and 17 years.

• CL is defined by its consequences: • Work that is mentally, physically, socially or morally dangerous or harmful to

children

• Work that interferes with their schooling

2. Definitions of child labour in Pakistan

• A child under 12 who is economically active for 1 or more hours per week (Rules of Employment of Children Act 1995 Section 4 Subsection 2, ILO Convention 138, Ratified by Pakistan in 2006)

• A child of age 12 or under 14 who is economically active for 14 or more hours per week (ILO Convention 138 Article 7 Paragraph 1)

• A child of age 14 or under 18 who is economically active for 43 hours or more per week (Employment of Children Act 1991 Section 7 subsection 2, ILO Convention 138, Article 2 Paragraph 4)

2. Definition of worst forms of child labour in Pakistan

• A child under 18 who participates in activities that are "hazardous by nature or circumstance" for 1 or more hours per week (ILO Convention 138 Article 3 Paragraph 1, Convention 182 Worst Forms of Child Labour)

• A child under 18 who participates in an "unconditional worst form of child labour” (ILO Convention 182 Article 3)

Hazardous Work

• Exposes children to physical, psychological or sexual abuse

• Underground, under water, at dangerous heights, and in confined spaces

• With dangerous machinery, or involves manual handling of heavy loads

• In unhealthy environments that expose children to health hazards

• Under particularly difficult conditions (e.g. long hours, heat, cold) or if freedom is confined

Hazardous labour in Punjab

PART-I

OCCUPATIONS

Any occupation connected with:

• (1) transport of passengers, goods or mail;

• (2) work in a catering establishment at a railway station, involving the movement of a vendor or any other employee of the establishment from one platform to another or into or out of a moving train;

• (3) work relating to the construction of a railway station or with any other work where such work is done in close proximity to or between the railway lines; and

• (4) a port authority within the limits of any port.
