SECOND READINGS – ORDINANCES The City Manager recommends passage of the following legislation, presented for a second time: 238-13 Authorizing the City Manager to enter into a Mutual Contract Rescission to terminate the Employment Incentive Agreement with Certified Heat Treating, Inc.

116-18 Authorizing the City Manager to enter into an Intergovernmental Agreement by and between the City of Springfield, Ohio (“City”), and The Board of Clark County Commissioners (“County”), for the use of City Service Center refueling station. 266-14 Dedicating certain rights in real estate owned by the City for the purpose of making and repairing roads which shall be open to the public, without charge in relation to the CLA Belmont Avenue Reconstruction, Phase 2 Project, PID NO. 94814. 117-18 Adopting a policy to assist owners of certain residential property needing to replace their septic systems and connect to the City's public sewer system.

EMERGENCY ORDINANCES The following emergency legislation is being presented for the first time. The City Manager recommends passage upon approval: 014-18 Providing for Supplemental Appropriations within various funds. 272-00 Authorizing the City Manager to enter into Amendment No. 6 to the Radio Maintenance and Tower Construction Agreement with Michael Wolf dba WS Electronics to increase the contract amount in an amount not to exceed $20,000.00, for a total amount not to exceed $150,000.00 for the period of April 1, 2018 through December 31, 2018. 110-17 Authorizing the City Manager to enter into Amendment No. 2 to the Subrecipient Funding Agreement [Small Business Development Center 2017-2018] between the City and SBDC, Inc. in an amount not to exceed $10,000.00 for a total agreement amount not to exceed $90,000.00.

EMERGENCY RESOLUTION The following emergency legislation is being presented for the first time. The City Manager recommends passage upon approval: 079-18 Ordering the construction or reconstruction of curbs, gutters and sidewalks at Section No. 1 of STREETS of the 2018 Sidewalk, Curb, and Gutter Program, as enumerated in Resolution No. 6002.

MOTION

The City Manager recommends that the City Commission, by motion, authorize the following: 130-18 To formalize timeframes for the remainder of the calendar year 2018 in connection with Commission Goals and budgetary decisions per attached motion.

LIQUOR PERMITS

The City Manager recommends that the following report be received and filed with the City Clerk and the Clerk is directed to request a hearing, as there is a concern or issue associated with this request. 112-18 Notification from the Ohio Department of Liquor Control of a request for transfer of a liquor permit from 3ND LLC, 1251 N. AN ORDINANCE NO. _________________ Amending and restating provisions regarding the Center City Community Reinvestment Area in The City of Springfield, Ohio, Implementing Sections 3735.65 through 3735.70 of the Ohio Revised Code.

WHEREAS, the City Commission of The City of Springfield, Ohio of (hereinafter "this Commission") desires to pursue all reasonable and legitimate incentive measures to assist and encourage development in specific areas of The City of Springfield, Ohio that have not enjoyed reinvestment from remodeling or new construction; and, WHEREAS, the City established a Center City Community Reinvestment Area in Ordinance No. 04-280, expanded that community reinvestment area in Ordinance No. 09-212 and amended that community reinvestment area in Ordinance No. 14-293; and,

WHEREAS, a survey of housing as required by Ohio Revised Code (ORC) Section 3735.66 had been prepared for the original and expansion area to be included in the Center City Community Reinvestment Area; and,

WHEREAS, the maintenance of existing structures and construction of new structures in such area would serve to encourage economic stability, maintain real property values, and generate new employment opportunities within The City of Springfield, Ohio; and, WHEREAS, the remodeling of existing structures and the construction of new structures in the Center City Community Reinvestment Area Expansion constitutes a public purpose for which real property exemptions may be granted: NOW, THEREFORE: BE IT ORDAINED by the City Commission of The City of Springfield, Ohio. Section 1. That this Commission adopts the findings set forth in the recitals to this Ordinance which are incorporated herein and made a part of this Ordinance. Section 2. That the area designated as the Center City Community Reinvestment Area constitutes an area in which housing facilities or structures of historical significance are located, and in which new construction or repair of existing facilities has been discouraged.

Section 3. That pursuant to ORC Section 3735.66, Center City Community Reinvestment Area, is determined to be the following described area:

CENTER CITY COMMUNITY REINVESTMENT AREA

Description:

Beginning at the convergence of the south line of W. North Street and the north line of W. Columbia Street;

1 thence measure in an easterly direction along the north line of W. North Street

approximately 3765 feet to the east line of N. Yellow Springs Street; 2 thence measure in a northerly direction along the east line of N. Yellow Springs

Street approximately 1422 feet to the street’s dead end;

3 thence measure in an easterly direction approximately 472 feet to the south line of the Indiana & Ohio Railroad;

4 thence measure in a predominantly easterly direction along the south line of said

railroad approximately 3475 feet to the west line of N. Spring Street;

5 thence measure in a southerly direction along the west line of N. Spring Street approximately 3280 feet to the north line of E. Pleasant Street;

6 thence measure in a westerly direction along the north line of Pleasant Street

approximately 3780 feet to the east line of S. Yellow Springs Street;

7 thence measure in a northerly direction along the east line of S. Yellow Springs Street approximately 1535 feet to the north line of the Indiana & Ohio Railroad;

8 thence measure in a northwesterly direction along the north line of said railroad

approximately 901 feet to the north line of W. High Street;

9 thence measure in a westerly direction along the north line of W. High Street approximately 1786 feet to the east line of Bell Avenue;

10 thence measure in a northerly direction along the east line of Bell Avenue

approximately 916 feet to the north line of W. Columbia Street;

11 thence measure in a predominantly westerly direction along the north line of W. Columbia Street approximately 1190 feet to the original place of beginning.

Indiana & Ohio Railroad and N. Spring Street, measure in a easterly direction approximately 2644 feet to the north line of Sycamore Street;

13 thence measure in a southerly direction along the east line of Sycamore Street approximately 2597 feet to the south line of East High Street;

14 thence measure in a predominantly northwesterly direction along the south line of

East High Street approximately 2650 feet to the west line of S. Spring Street;

15 thence measure in a northerly direction 1662 feet to the place of beginning for the expanded area.

The Center City Community Reinvestment Area is approximately depicted as the

shaded area on the map attached to this Ordinance, marked Exhibit A and by this reference incorporated herein.

Section 4. Only development that is consistent with the applicable zoning

regulations within the designated Center City Community Reinvestment Area will be eligible for exemptions under this Program. Section 5. Except as stated in Section 4 above, all properties within the designated Center City Community Reinvestment Area are eligible for this program. This program is intended to promote and expand conforming uses in the designated Center City Community Reinvestment Area. As part of the project, The City of Springfield, Ohio has undertaken to improve the streetscape in the core block area and made other improvements throughout the area. Section 6. Properties within the Center City Community Reinvestment Area shall be eligible for a real estate tax abatement based on the value of improvements made to such property.

A. Commercial or Industrial Property.

(i) The percentage of the tax exemption on the increase in the assessed valuation resulting from improvements to commercial and industrial real property and the term of those exemptions shall be negotiated, subject to the following limitations, on a case-by-case basis in advance of construction or remodeling occurring according to the rules outlined in the ORC Section 3765.67. The results of the negotiation as approved by this Commission will be set out in writing in a Community Reinvestment Area Agreement as outlined in ORC Section 3735.67.

(ii) Remodeling – The percentage abated shall be applied to the increased market value resulting from the remodeling to determine the

amount of the exemption. Remodeling that increases market value by $5,000 or less shall not be eligible for an exemption. (ii) Exemptions with regard to remodeling of existing commercial or industrial property shall not exceed 12 years. (iv) New construction - The exempted percentage of the newly constructed structure shall not be considered to be an improvement on the land on which it is located for the purpose of real property taxation. (v) Exemptions with regard to new construction of commercial or industrial property shall not exceed 15 years.

B. Residential property.

(i) Residential applications must be filed with the Housing Officer no later than six months after construction completion. Upon certification of the designated Housing Officer, a Residential Project shall be granted an exemption of 100%; however, remodeling that increases market value by less than $2,500 shall not be eligible for an exemption, as provided in ORC Section 3735.67..

(ii) Remodeling – The percentage abated shall be applied to the increased market value resulting from the remodeling to determine the amount of the exemption.

(iii) Exemptions with regard to remodeling of existing residential property shall be fore 10 years; however, remodeling of existing residential property comprised of two or more family units when the remodeling increases the market value by $5,000.00 or more shall be for 12 years, as permitted under ORC Section 3735.67.

(iv) New construction - The exempted percentage of the newly constructed residential structure shall not be considered to be an improvement on the land on which it is located for the purpose of real property taxation.

(v) Exemptions with regard to new construction of residential property shall be for 15 years, as permitted under ORC Section 3735.67.

Section 7. All commercial and industrial projects are required to comply with the state application fee requirements of ORC Section 3735.672 (C), pay a local application fee of $250.00 and the local annual monitoring fee of one percent of the amount of taxes exempted under the agreement - a minimum of $500 up to a maximum of $2,500 annually. Section 8. To administer and implement the provisions of this Ordinance, the Director of the City of Springfield’s Economic Development Office, or the Director’s designee, is designated as the Housing Officer as described in ORC Sections 3735.65 through 3735.70. Section 9. The Community Reinvestment Area Housing Council shall serve as the community reinvestment area housing council for the Center City Community Reinvestment Area established by this Ordinance.

Section 10. The “Tax Incentive Review Council” established pursuant to ORC Section 5709.85 and Springfield Ordinance No. 04-280 shall serve as the tax incentive review council for the Center City Community Reinvestment Area. The Tax Incentive Review Council shall review annually the compliance of all agreements involving the granting of exemptions for commercial or industrial real property improvements under Section 3735.671, of the ORC and make written recommendations to the Tax Incentive Review Council as to continuing, modifying or terminating said agreement based upon the performance of the agreement. Section 11. This Commission reserves the right to re-evaluate the designation of the Center City Community Reinvestment Area after December 31, 2019, and annually thereafter, at which times this Commission may direct the Housing Officer not to accept any new applications for exemptions as described in Section 3735.67 of the ORC. Section 12. The Community Reinvestment Area Housing Council shall make an annual inspection of the properties within the district for which an exemption has been granted under Section 3735.67 of the ORC. The Community Reinvestment Area Council shall also hear appeals under 3735.70, of the ORC. Section 13. This Commission hereby finds and determines that all formal actions relative to the passage of this Ordinance were taken in an open meeting of this Commission, that all deliberations of this Commission which resulted in formal action were taken in meetings open to the public, in full compliance with the applicable legal requirements, including Section 121.22 of the ORC.

Section 14. The City Manager is hereby directed and authorized to petition the Director of Development, State of Ohio on behalf of the City Commission to confirm the findings contained within this Ordinance. Section 15. That this Ordinance shall take effect and be in force from and after fourteen (14) days from the date of its passage and upon confirmation by the Director of Development, State of Ohio of the findings in this Ordinance. The results of the negotiation as approved by this Commission will be set out in writing in a Community Reinvestment Area Agreement as outlined in ORC Section 3735.67.

(ii) Remodeling – The percentage abated shall be applied to the increased market value resulting from the remodeling to determine the amount of the exemption. Remodeling that increases market value by $5,000 or less shall not be eligible for an exemption. (iii) Exemptions with regard to remodeling of existing commercial or industrial property shall not exceed 12 years.

(iv) New construction - The exempted percentage of the newly constructed structure shall not be considered to be an improvement on the land on which it is located for the purpose of real property taxation. (v) Exemptions with regard to new construction of commercial or industrial property shall not exceed 15 years.

B. Residential property.

(i) Residential applications must be filed with the Housing Officer no later than six months after construction completion. Upon certification of the designated Housing Officer, a Residential Project shall be granted an exemption of 100%; however, remodeling that increases market value by less than $2,500 shall not be eligible for an exemption, as provided in ORC Section 3735.67.

(ii) Remodeling – The percentage abated shall be applied to the increased market value resulting from the remodeling to determine the amount of the exemption.

(iii) Exemptions with regard to remodeling of existing residential property shall be fore 10 years; however, remodeling of existing residential property comprised of two or more family units when the remodeling increases the market value by $5,000.00 or more shall be for 12 years, as permitted under ORC Section 3735.67.

(iv) New construction - The exempted percentage of the newly constructed residential structure shall not be considered to be an improvement on the land on which it is located for the purpose of real property taxation.

(v) Exemptions with regard to new construction of residential property shall be for 15 years, as permitted under ORC Section 3735.67.

Section 7. All commercial and industrial projects are required to comply with the state application fee requirements of ORC Section 3735.672 (C), pay a local application fee of $250.00 and the local annual monitoring fee of one percent of the amount of taxes exempted under the agreement - a minimum of $500 up to a maximum of $2,500 annually.

Section 8. To administer and implement the provisions of this Ordinance, the Director of the City of Springfield’s Economic Development Office, or the Director’s designee, is designated as the Housing Officer as described in ORC Sections 3735.65 through 3735.70. Section 9. The Community Reinvestment Area Housing Council shall serve as the community reinvestment area housing council for the South Limestone Community Reinvestment Area established by this Ordinance.

Section 10. The “Tax Incentive Review Council” established pursuant to ORC Section 5709.85 and Springfield Ordinance No. 04-280 shall serve as the tax incentive review council for the South Limestone Community Reinvestment Area. The Tax Incentive Review Council shall review annually the compliance of all agreements involving the granting of exemptions for commercial or industrial real property improvements under Section 3735.671, of the ORC and make written recommendations to the Tax Incentive Review Council as to continuing, modifying or terminating said agreement based upon the performance of the agreement. Section 11. This Commission reserves the right to re-evaluate the designation of the South Limestone Community Reinvestment Area after December 31, 2019, and annually thereafter, at which times this Commission may direct the Housing Officer not to accept any new applications for exemptions as described in Section 3735.67 of the ORC. Section 12. The Community Reinvestment Area Housing Council shall make an annual inspection of the properties within the district for which an exemption has been granted under Section 3735.67 of the ORC. The Community Reinvestment Area Council shall also hear appeals under 3735.70, of the ORC. Section 13. This Commission hereby finds and determines that all formal actions relative to the passage of this Ordinance were taken in an open meeting of this Commission, that all deliberations of this Commission which resulted in formal action were taken in meetings open to the public, in full compliance with the applicable legal requirements, including Section 121.22 of the ORC. Section 14. The City Manager is hereby directed and authorized to petition the Director of Development, State of Ohio on behalf of the City Commission to confirm the findings contained within this Ordinance. Section 15. That this Ordinance shall take effect and be in force from and after fourteen (14) days from the date of its passage and upon confirmation by the Director of Development, State of Ohio of the findings in this Ordinance.

AN ORDINANCE NO. ______________ Amending and restating provisions regarding the Burnett and High Community Reinvestment Area in The City of Springfield, Ohio, Implementing Sections 3735.65 through 3735.70 of the Ohio Revised Code.

WHEREAS, the City Commission of The City of Springfield, Ohio of (hereinafter "this Commission") desires to pursue all reasonable and legitimate incentive measures to assist and encourage development in specific areas of The City of Springfield, Ohio that have not enjoyed reinvestment from remodeling or new construction; and, WHEREAS, the City established a Burnett and High Community Reinvestment Area in Ordinance No. 15-098; and,

WHEREAS, a survey of housing as required by Ohio Revised Code (ORC) Section 3735.66 had been prepared for the original area to be included in the Burnett and High Community Reinvestment Area; and,

WHEREAS, the maintenance of existing structures and construction of new structures in such area would serve to encourage economic stability, maintain real property values, and generate new employment opportunities within The City of Springfield, Ohio; and, WHEREAS, the remodeling of existing structures and the construction of new structures in the Burnett and High Community Reinvestment Area constitutes a public purpose for which real property exemptions may be granted: NOW, THEREFORE: BE IT ORDAINED by the City Commission of The City of Springfield, Ohio. Section 1. That this Commission adopts the findings set forth in the recitals to this Ordinance which are incorporated herein and made a part of this Ordinance. Section 2. That the area designated as the Burnett and High Community Reinvestment Area constitutes an area in which housing facilities or structures of historical significance are located, and in which new construction or repair of existing facilities are discouraged. Section 3. That pursuant to ORC Section 3735.66, Burnett and High Community Reinvestment Area, is hereby established in the following described area:

BURNETT AND HIGH

COMMUNITY REINVESTMENT AREA

Located in the State of Ohio, County of Clark and in the City of Springfield and being described as follows: Beginning at a point at the centerline intersection of S Burnett Rd and E High St; thence in a northwesterly direction, following with and along the centerline of E High St, to a point at the intersection of the centerline of E High St and the east line of a north-south alley between Buxton Ave and S Burnett Rd; thence in a southerly direction, following with and along the east line of said north-south alley, to a point on the centerline of Lexington Ave; thence in a southeasterly direction, approximately 82 feet, to a point, said point being the northwesterly corner of Lot #13152 of the Cape Cod Addition (PB 8, PG 3A); thence following with and along the west line of said Lot #13152, in a southerly direction, approximately 392.7 feet to a point at the southeast corner of said Cape Cod Addition; thence in an easterly direction, a distance of approximately 326 feet, to a point on the centerline of S Burnett Rd; thence in a southerly direction, following with and along the centerline of S Burnett Rd, a distance of approximately 1050 feet to a point, said point being the centerline intersection of S Burnett Rd and Elmore Dr; thence in an easterly direction, following with and along the centerline of said Elmore Dr, a distance of approximately 296 feet to a point, said point being the centerline intersection of said Elmore Dr. and Allen Dr. (PB 8, PG 19), as recorded on the plat for Laynes Second Addition thence in a northerly direction, following with and along the centerline of said Allen Dr, a distance of approximately 167 feet to a point, said point being on the north line of said Laynes Second Addition plat; thence in an easterly direction, following with and along the north line of said Laynes Second Addition Plat, a distance of approximately 295.2 feet to a point, said point being the intersection of said north line of Laynes Second Addition plat and the west line of the Maple Dell Subdivision (PB 10, PG 95);

thence in a northerly direction, following with and along the west line of the said Maple Dell Subdivision, a distance of approximately 1301.1 feet to a point, said point being the intersection of the west line of said Maple Dell Subdivision and the centerline of Lexington Ave; thence continuing in a northerly direction, following with and along the westerly line of said Maple Dell Subdivision and the westerly line of Laynes Third Addition (PB 8, PG 14B), a distance of approximately 829 feet, to a point; thence leaving the westerly line of said Laynes Third Addition, heading in a southeasterly direction, a distance of approximately 50 feet to a point; thence in a northeasterly direction, a distance of approximately 122 feet, to a point; thence in a southeasterly direction, a distance of approximately 199 feet, to a point; thence in a northeasterly direction, a distance of approximately 87 feet, to a point on the northerly plat line of said Laynes Third Addition; thence in a southeasterly direction, following with and along said northerly plat line of Laynes Third Addition, to the southwest corner of Lot 11028 of the Grandview Addition (PB 7, PG 22); thence in a northeasterly direction, following with and along the west property line of Lot 1108 of said Grandview Addition, to a point on the centerline of E High St; thence in a southeasterly direction, following with and along the centerline of said E High St, to a point at the intersection of E High St and S Fostoria Ave; thence in a northeasterly direction, following with and along the centerline of S Fostoria Ave, a distance of approximately 923 feet to a point; thence in a westerly direction, following with and along the south line of an east-west alley, to a point at the intersection of said south line of alley and the centerline of S Burnett Rd; thence in a southerly direction, following with and along the centerline of S Burnett Rd to the place of beginning.

The Burnett and High Community Reinvestment Area is approximately depicted

as the bounded area on the map attached to this Ordinance, marked Exhibit A, and by this reference is incorporated herein.

Section 4. Only development that is consistent with the applicable zoning regulations within the designated Burnett and High Community Reinvestment Area will be eligible for exemptions under this Program. Section 5. Except as stated in Section 4 above, all properties within the designated South Limestone Community Reinvestment Area are eligible for this program. This program is intended to promote and expand conforming uses in the designated South Limestone Community Reinvestment Area.

A. Commercial or Industrial Property.

(i) The percentage of the tax exemption on the increase in the assessed valuation resulting from improvements to commercial and industrial real property and the term of those exemptions shall be negotiated, subject to the following limitations, on a case-by-case basis in advance of construction or remodeling occurring according to the rules outlined in the ORC Section 3765.67. The results of the negotiation as approved by this Commission will be set out in writing in a Community Reinvestment Area Agreement as outlined in ORC Section 3735.67.

(ii) Remodeling – The percentage abated shall be applied to the increased market value resulting from the remodeling to determine the amount of the exemption. Remodeling that increases market value by $5,000 or less shall not be eligible for an exemption. (iii) Exemptions with regard to remodeling of existing commercial or industrial property shall not exceed 12 years. (iv) New construction - The exempted percentage of the newly constructed structure shall not be considered to be an improvement on the land on which it is located for the purpose of real property taxation. (v) Exemptions with regard to new construction of commercial or industrial property shall not exceed 15 years.

B. Residential property.

(i) Residential applications must be filed with the Housing Officer no later than six months after construction completion. Upon

Section 7. Fees. (a) That all commercial and industrial projects are required to comply with the state

application fee requirements of ORC Section 3735.672 (C) and the local annual monitoring fee of one percent of the amount of taxes exempted under the agreement - a minimum of $500 up to a maximum of $2,500 annually.

(b) That, in addition to the fee described in subdivision (a) of this Section, the

applicant for a tax exemption for commercial real property, industrial real property or multi-unit residential property under this ordinance shall pay a local application fee of $250 to the city along with its application.

Section 8. That to administer and implement the provisions of this Ordinance, the Director of the City of Springfield Community Development Department, or his/her designee, is designated as the Housing Officer as described in ORC Sections 3735.65 through 3735.70. Section 9. That this Commission reserves the right to re-evaluate the designation of the Burnett and High Community Reinvestment Area after December 31, 2019, and annually thereafter, at which times this Commission may direct the Housing

Officer not to accept any new applications for exemptions as described in Section 3735.67 of the ORC. Section 10. That a “Community Reinvestment Area Housing Council” shall be created, consisting of two members appointed by the Mayor, two members appointed by this Commission and one member appointed by the City Planning Board. The majority of the members shall then appoint two additional members who shall be residents within The City of Springfield, Ohio. Terms of the members of the Community Reinvestment Area Housing Council shall be for three years. An unexpired term resulting from a vacancy in the Community Reinvestment Area Housing Council shall be filled in the same manner as the initial appointment was made. That the Community Reinvestment Area Housing Council shall make an annual inspection of the properties within the district for which an exemption has been granted under Section 3735.67 of the ORC. The Community Reinvestment Area Housing Council shall also hear appeals under 3735.70, of the ORC. Section 11. That this Commission hereby finds and determines that all formal actions relative to the passage of this Ordinance were taken in an open meeting of this Commission, that all deliberations of this Commission and of its committees, if any, which resulted in formal action were taken in meetings open to the public, in full compliance with the applicable legal requirements, including Section 121.22 of the ORC.
