1he Public Hearing was called to consider amending the official zoning map pursuant to section 11.1 of Ordinance # 67 to rezone the following described property from R-la and R-2 to B-3 for the purpose of issuing a special use permit to establish, construct and maintain

Acting Mayor Rustad closed the hearing at 7:10 P.M.

Motion by Blanchard to direct the Engineer to prepare a change \ order on street resurfacing under the. sewer contracts. \Seconded by La Vaque. 3 Ayes.

Motion by Blanchard to set a Public Hearing for the water improvement extension on Arden Avenue between Long Lake Road and Eastwood Road in conjunction with street improvement hearing August 9, 1965 at 9:00 P.M. and directing the Engineer to prepare preliminary report. Seconded by La Vaque. . 3 Ayes.

The regular meeting of the Mounds View Village Council was called to order by Acting Mayor Rustad at 8:00 P.M. on July 26. 1965 at 2401 Highway # 10.

Motion by Malvin to approve minutes of July 12 as ~resented, Seconded by La Vaque. 3 Ayes. Motion Carried.

Motion by La Vaque to approve minutes of July 19 as presented. Seconded by Rustad. 3 Ayes. Motion Carried.

(\ Mr. Donald Sohm - 8206 Groveland Road requested information ) about storm sewer construction. This matter was referred to the Engineer.

Mr. John Pittman - 2208 Lois Drive requested information about the ~ossibility of tiling judicial Ditch # 1. He was told that no such plans were ever discussed by the Village.

Mr. Pittman complained that the plot stakes on his property were accidently removed by the sewer contractors. . this matter was referred to the Engineer.

Motion by Malvin to allow Calrence P. No~dstrom - 8205 Eastwood Road preliminary approval for subdividing plat - two lots to be 75feet and one lot to be 78 feet , upon acceptance of a quick claim deed of 25 feet street easement for the extension of Greenwood Dr~ve. Seconded by La Vaque. 3 Ayes. Motion Carried.

Trustee La Vaque read the minutes of the Planning Commi~sion Meeting of July 20. . . .. .., o . 0. . ...

Motion by La Vaque to delete from the Nodland Construction Company Sewer Contract and add to the C.S. McCrossan Inc. Sewer Contract the street resurfacing of Terrace Drive from Quincy Street to Highway # 8. The Engineer is instructed to submit a change order to cover this transfer of work and costs. Seconded by Malvin. 3 Ayes. Motion Carried.

Motion by La Vaque to grant a variance request - a five foot side yard set back from Mr. David M. Burg - 2291 Lois Drive. Seconded by Malvin. 3 Ayes. Motion Carried.

Motion by La Vactue to ·grant a sub-division request frmm Mr. James R. Tobiason - 7601 Groveland Road to divide his lot into

( ) two sections. The West to be 132' x 200' and the East to be 132' X /' 217.2 feet - Lot 5 Knoll Addition~ Seconded by Rustad. 3 Ayes.

Trustee Malvin reporting on Public Welfare stated that he had received a letter from Dr. Houle about piegons in Mounds View. Attorn,y Meyers gave a legal opinion on this matter. Rustad stated he had received complaints about water in some of the basements in the disaster area. La Vaque volunteered to investigate the disaster area and check out these complaints.

Engineer Comstock reported on the underground telephone cables being installed. He reported that sewer on County Road H would be completed this week. Fairchild Avenue the one block from County Road H to Woodcrest Drive would begin sodn :ahd take two weeks to complete.

Attorney Meyers submitted a proposed sewer ordinance. Meyers submitted the final bill from Herbst Construction Company for disaster clean-up.

Motion by Rustad to approve the bills submitted tetaling $56,438.28. Seconded by La Vaque. 3 Ayes. Motion Carried.

. Motion by Rustad to approve the licenses submitted. ( ) Seconded by Malvin. 3 Ayes. Motion Carried.

Village financial reports for the first six months of 1965 plus a construction report of improvement projects in progress were submitted by Adm. Clerk Boog.

Motion by Malvin to approve minutes of July 26, 1965 as presented. Seconded by La Vaque. 5 Ayes.

Motion by Rustad to approve sub-division as requested by A.L. Ahlstrom - 16Ll5 75th Avenue N.E. affecting L.V. Anderson property · at 2031 County Road H. Seconded by Hodges. 5 Ayes.

Mr. Ralph bickinson. neW owner of the local bus company \(formerlY Anoka-Minneapolis Bus Company) appeared requesting a route

( f hange. ~ Motion by Hodges to ~pprove the change requested allowing the

bus to travel on Eastwood Road from Sherwood to Highway # 10 and deleting the Long Lake Road portion of former route and to send a letter to this effect to the Minnesota Railroad and Warehouse Commission. Seconded by Malvin. 5 Aues.

The problem of rain washed tar or oil in residents yards along Terrace is a matter between the homeowner and the contractor, Mr. Meyers reported.

The Council informed interested residents that they would accept petitions for storm sewer along Terrace Drive to correct the water problem there.

The Clerk announced that he had received a petition for Sanitary Sewer and wat.er service for the "E" area of the Village. (southeast corner)

Motion by La Vaque to order preliminary plans for Area "E" Sanitary sewer and water improvement from the Village Engineer. Seconded by Malvin. 5 Ayes.

, Motion by Rustad to rezone from R-LA to B-3 the East ~ of the East ~ of the Northeast ~ of Section # 8, township 30, Range # 23

'Cxcept the North 8 acres thereof and except Norsemans First Addition, f nd subject to State Trunk Highway &~ From R-2 to B-3 the West 150 feet of the East ~ of the Northeast ~ of Section 8, Township 30, Range 23 except the North 8 acres thereof and except that part platted as Norsemans First Addition, with a special use permit for operation of a Mobile Home Park conditioned as specified in the original rezonine of July 6, 196Ll. The Attorney was directed to prepare an agreement with National Funds, Inc. regarding the construction of above mentioned \property for Council approval. \

J At 9:00 P.M. the Public Hearing for the Arden Avenue , improvements (street and water) was opened by the Mayor.

TQe Clerk read the legal notices as published and certified to the mailing of the same.

The following are listed as objectors to the project: 1. Mr. Strong - 8230 Long Lake Road - Cost to high - no benefit 2. Mr. Spagenski - 8231 Eastwood Road - Cost to high for benefit recd.

Mr. Charles Larson, developer. appeared in favor of the improvements stating that the other properties involved could be sub-divided also. as was the portion of Nordstroms property that Mr. Larson was involved with.

The Engineer stated that cost estimates were made on the high side and actual cost would certainly be lower.

The Mayor called three times for further objectors and there were none.

Hearing closed at 9:35 P.M. The Council agreed to reach a decision on the matter by

Monday. August 16, 1965.

Mr.Rustad presented the Police Report for July and the Band E Patrol report for July. (on file)

\ ~. La Vaque presented the water department report for July.

I A request to regr~de Oakwood Drive was referred to Mr. La Vaque.

Motion by La Vaque to allow a variance (side yard set-back) requested leaving 5' (five feet) on East side of house. Five foot variance allowed for Mr. E. Johnson - 2278 Lois Drive. Seconded by Malvin. 5 Ayes.

Mr. Malvin reported that seven property owners in the Lois - Knoll disaster area had been orderd to cleanup their basements due to water. trash etc. as well as the County Road I apartments.

Mr. Robert Edmond, Electrical Inspector. reported that there were only four trailers left in the disaster struck homes.

The Council announced that all permits for temporary trailer parking would be issued by the Council from this date on.

The Attorney was directed to investigate a solution to the problem created by the Hamilton house on Knoll Drive which is becoming a nuisance and a health hazard.

The building inspector reported that approximately 20 homes were under construction in the tornado area.

) The Clerk's Officw was directed to attach to all new heating permits the new requirement for 6" flu pipe as per Ordinance # 125.

The new Civil Defense Ordinance and operational plan will be presented for a~tion at the next meeting.

The street surfacing is stili under negotiation according to the Engineer.

The Attorney was instructed to assis the Engineer in negotiating with the sewer contractors regarding street resurfacing.

The Council ~eceived the preliminary plans for water , ,improvement project 1965-3. ( / Motion by Blanchard to hereafter require a 10.% bid

, surety rather than the 5% formerly required and to instruct the Clerk to so advertise from now on. Seconded by La Vaque. 5 Ayes.

Motion by Blanchard to accept the final plans and specs. for 1965-3 and to direct the Clerk to advertise for bids for water project 1965-3 with bid closing date 7:00 P.M. on September 7, 1965. Seconded by Rustad. 5 Ayes.

Motion by La Vaque to direct the Engineer to prepare the necessary change orders to have streets 30 feet wide instead of 22 feet and to change from dust coat to three inch stabilized base, authorized only where contractors agree to no increase in unit price on certain designated streets. Seconded by Hodges. 5 Ayes.

A preliminary date for all Sanitary Sewer and street assessments was set for September 15, 1965.

The Clerk's Office was directed to determine the status of the agreement with Spring Lake Park regarding sewer on Hillview Road.

Motion by Blanchard to adopt Ordinance # 128, the Sanitary Sewer Ordinance. Seconded by Rustad.
