Hofmans. "But he's shown now that he can run long,

and even (jockey Joe) Talamo thinks the mile and a

quarter is better for him than a mile and an eighth.

He said he's a true stayer, and that surprises me."

If 1 1/4 miles truly is his sweet spot, Melatonin

should be primed for another big run in the $500,000

Gold Cup at Santa Anita (gr. I) June 25, a "Win and

You're In" event for the Breeders' Cup Classic (gr. I).

But it's Karl Watson, Mike Pegram, and Paul

Weitman's Hoppertunity who garners the 3-1 morn-

ing-line favoritism in the eight-horse field (Melatonin

is second choice at 7-2). In preparation for his first

start stateside since a third-place in the world's rich-

est race, the 5-year-old Any Given Saturday horse has

worked six times at Santa Anita, including a six-fur-

long move in 1:12 1/5 June 18. Prior to his Dubai trip,

Hoppertunity nosed out fellow Gold Cup entrant

Imperative in the San Antonio Stakes (gr. II).

Hoppertunity is winless in three starts at 1 1/4

miles, but he was only a nose short in last year's Gold

Cup, when Hard Aces closed from last place to win.

Hard Aces, a 6-year-old son of Hard Spun, is back to

defend his Gold Cup title. In his eight starts since,

he's yet to return to the winner's circle (he finished

second to Melatonin in the Big 'Cap), but had argu-

ably his most encouraging run in his last start—the

Californian (gr. II) May 22.

Second Summer, who won the Californian by a

length, will take his first step up to the top level in

the Gold Cup, which also will be his first try beyond

1 1/8 miles. The Summer Bird gelding has won three

straight races, with two conditional optional-claiming

allowances preceding his Californian victory.

An unknown commodity in the field is 2014 Brazil-

ian Triple Crown winner Bal a Bali, who will be mak-

ing the first dirt start of his 21-race career. BH

INTERNET POKER CLEARS CALIFORNIA COMMITTEEBy Tom LaMarra

Legislation that would divert up to $57 million a

year to horse racing from Internet poker opera-

tions cleared the California Assembly Committee on

Appropriations June 22.

The bill, which authorizes card rooms and cer-

tain Indian tribes to apply for licenses to operate

intrastate online poker, has broad support from the

horseracing and breeding industry as well as tribes—

but not all of them. Representatives of some tribal

entities told the committee that "suitability" language

in the bill isn't strong enough to protect against

"tainted assets," primarily service providers found to

have been operating illegally in the past.

The measure now heads to the full Assembly for

consideration.

The committee dealt with an amended version of

the bill, which sets a tax rate of 8.847% for aggregate

gross revenue below $150 million and up to 15%

for gross revenue above $350 million. It also sets a

license fee of $12.5 million.

In exchange for not having rights to Internet poker

licenses, the original bill mandat-

ed the first $60 million in revenue

and the $12.5 million license fee

go to the California Horse Racing

Internet Poker Account ($57 mil-

lion) and the Fair and Exposition

Fund ($3 million).

A fiscal analysis notes that with

a 15% tax rate, gross revenue

would have to be at least $400

million for any money to go to the

state general fund for budgetary

purposes. An amendment states

that 10% of gross revenue, no

matter how much, will go the gen-

eral fund and the remaining 90%

to racing and fairs until the $60

million threshold is reached.

Thoroughbred Breeders Association, Del Mar, and

the Oak Tree Racing Association are among racing

organizations that spoke in favor of the bill.

Assemblyman Adam Gray, who sponsored the In-

ternet poker bill, acknowledged concerns from tribal

interests regarding language for suitability of service

providers, particularly those that operated after the

federal Unlawful Internet Gambling and Enforcement

Act took effect in 2006.

"I am willing to strengthen this bill," Gray said. "I'm

sure we will amend the bill further on the (Assembly)

floor and in the Senate. This is probably the most-vet-

ted bill this legislative session."

Assemblywoman Lorena Gonzalez, who chairs the

committee, expects further discussion on the floor.

"We have to ensure this is really going to work,

and work for everybody," she said. "There is a mar-

ket-share component that needs to be addressed. "

Gonzalez acknowledged the popularity of racing

in California but noted the bill contains no provisions

for using racing's share of poker revenue should

racing cease.

"We need to make sure in the bill it's clear that it's

not a right of the (racing) industry to take this money

if horse racing does not continue," she said. BH

REQUEST FOR STAY IN SUSPENSION OF UMAROVBy Frank Angst

Franklin, Ky., Circuit Court Judge Phillip Shepherd

said June 22 he plans to issue a ruling in the next

day or two on a request for a stay by suspended

owner/trainer Otabek Umarov.

The Kentucky Horse Racing Commission suspend-

ed Umarov after he refused to allow out-of-compe-

tition testing on one of his horses—stakes winner

Looks to Spare—April 30 at Churchill Downs. The

stewards issued a 10-year suspension and $10,000

fine for violations of out-of-competition testing rules

and possession of hypodermic needles.

Umarov's attorney, Justin Fowles, requested the

stay during a June 22 hearing, in which KHRC general

counsel John Forgy outlined the commission's oppo-

sition. Shepherd hinted some type of stay would be

granted.

"I have a concern about the penalty being in effect

while Mr. Umarov awaits his day in court," Shepherd

said, noting he needed to review the case and plans

to rule June 23 or 24.

Shepherd said he could issue a temporary re-

straining order while a more formal hearing on an

injunction is conducted.

Forgy said because Umarov already requested

a stay that was denied by the KHRC, state statute

requires requests for stays from a court go to the ju-

risdiction in which the alleged violation occurred—in

this case Jefferson County, where Churchill is located.

Fowles said the way he reads the statute, the

ultimate arbiter would still be Franklin Circuit Court.

He claims his client would suffer significant financial

strain, his continued operations would not negatively

impact the commission, and there are substantial

questions of fact to be addressed in the hearing be-

fore punishment begins.

Forgy said the KHRC typically doesn't deny re-

quests for stays, but the circumstances are unique.

The KHRC claims Umarov refused to allow a blood

sample to be collected and then removed the horse

from the Churchill backstretch while officials attempt-

ed to explain and enforce the rules.

"It's unusual to deny a stay, but there is an unu-

sual set of circumstances and unusual violation of

rules," Forgy said.

Forgy added the racing commission would be

undermined if Umarov is allowed to continue training

while an administrative hearing is conducted on the

case.

"When the vet arrived to collect the sample, (Uma-

rov) was obligated—at that moment—to consent

to out-of-competition testing just as everybody else

does," Forgy said. "It's just unprecedented. We have

a deep interest that everybody complies with the

drug rules, especially out-of-competition testing. Our

concern is the integrity of the sport."

Fowles suggested Umarov didn't immediately

allow out-of-competition testing because Looks to

Spare was ill. He also said the vet making the request

did not present proper identification.

Forgy said Looks to Spare was on Churchill

grounds and therefore subject to testing, and that

Umarov knew Nick Smith, the vet who made the

request. He also noted Umarov has been banned

by Churchill, and a court ruling may not relieve his

financial hardship. BH

The most expensive juvenile at last year's Ocala

Breeders' Sales Co.'s March sale races for only

the second time in his career at Churchill Downs

June 23.

Bred by Summer Wind Farm, Zero Hour was a

$1.4 million purchase by Live Oak Plantation from

the SGV Thoroughbreds consignment at the OBS

sale after bringing $650,000 at the 2014 Keeneland

September yearling sale.

After hitting the starting gate hard, the son of

Bernardini finished ninth out of 10 at Saratoga Race

Course Aug. 22 in his sole juvenile start.

Zero Hour is out of the stakes-winning Miswaki

mare Misty Hour. She has produced grade II winner

India (Hennessy) and the stakes-winning mare Pilfer

(Deputy Minister). Pilfer's progeny include the dual

grade I winner To Honor and Serve and grade I-win-

ning Angela Renee (both by Bernardini).

Zero Hour, who is trained by Mark Casse and will

be ridden by Florent Geroux, has recorded bullet

works for three of his past four breezes over five fur-

longs at Churchill Downs. He is the 3-1 morning-line

favorite for the seven-furlong maiden race.

Among the well-related horses challenging Zero

Hour are Go Ghetto (a Bernardini half brother to

grade I winner Kodiak Kowboy), Goats Town (a Dublin

half brother to grade II winner S'maverlous), and Run-

ning Back (a Hold Me Back half brother to two graded

CITATION'S HOLLYWOOD GOLD CUPBy Tom Hall

July 14, 1951 was a usual sunny Southern California

day in the Los Angeles area.

At Hollywood Park, 50,625 racing fans had poured

through the turnstiles in anticipation of the seventh

race on the card, the 12th running of the Hollywood

Gold Cup. One of the 10 entrants stood on the

threshold of a singular accomplishment. A victory

would make Calumet Farm’s Citation racing’s first

millionaire.

Major accomplishments were nothing new for the

handsome son of Bull Lea—Hydroplane II, by Hyper-

ion. From the outset of his juvenile championship

season in 1947, he had done little wrong. In nine

starts at 2, he had been defeated only once—by his

stablemate Bewitch, a champion filly in her own right

that year.

At 3 Citation slipped (perhaps literally as well as

figuratively) only once, losing the Chesapeake Trial

Stakes on a muddy track to a horse named Saggy.

Citation’s revenge victory in the Chesapeake

Stakes put him on a Shermanesque march through

the rest of the year. Major stakes victories piled up

like leaves behind a rake. He became the eighth

horse to win a Triple Crown.

He met older horses and took them to task in the

Stars and Stripes Handicap, the Sysonby Mile, two

Gold Cups, and a walkover in the Pimlico Special. So

dominant was he that he added three champion-

ships, including Horse of the Year.

With only two losses in 29 starts and a 15-race win

streak, seemingly, the only horse that could defeat Ci-

tation would be Citation. And so it was. He developed

an osselet—an arthritic condition of the fetlocks—

that forced him to miss the entire 1949 season.

Rather than retire Citation to the Calumet stallion

barn, the farm returned the handsome bay to the

races in 1950 with the goal of earning a million. He

picked up where he had left off, winning a Santa An-

ita allowance race for his 16th consecutive victory, a

record not equaled until Cigar in the mid-nineties.

However, the rigors of racing took their toll and

though still valiant, Citation was a lesser shade. That

year he won only two of his nine starts and finished

second in the others. Four of his losses were to im-

ported Noor, whose prowess was so noteworthy he

was named champion older male in 1950.

Back again in 1951, Citation bounced about in the

minor places through most of his

starts but began finding the win-

ner’s circle in June. Coming into

the Gold Cup off two successive

wins, “racing as if best” as the

chart stated, Citation won by four

lengths from his old stablemate

nemesis Bewitch.

Citation retired immediate-

ly with $1,085,760 in earnings.

That’s $10,272,375 today, folks.

Saturday marks the 77th

renewal of the Gold Cup, which

since the demise of Hollywood

Park and the move from Ingle-

wood to Arcadia is known as the

Gold Cup at Santa Anita. BH

AQUIS FARM RAMPS UP AUSTRALIAN PRESENCEBy Tara Madgwick

Aquis Farm, which has quickly positioned itself at

the forefront of Queensland's racing and breed-

ing industry, will start key runner Cradle Me in the

June 25 Tatts Club Tiara, the last Australian group I

race of the season.

Acquired in January 2015 and wholly owned by

the Hong Kong-based Fung family, Aquis Farm is

a 447-hectare Thoroughbred racing, boarding and

breeding facility at Canungra on the Gold Coast.

Under the guidance of chief operating manager

Marcus Langer, Aquis Farm significantly ramped up

its commercial activities this year and will stand four

stallions in 2016.

Heading the roster is the brilliant Snitzel colt Spill

The Beans (Aus$11,000), who retired from racing with

a win in the group II Mirvac Queensland Turf Club Cup.

Joining him are former Darley sires Domesday

(Aus$8,800) and Benfica (Aus$4,400) while interna-

tionally recognized Holy Roman Emperor (Aus$9,900)

will shuttle this year from Coolmore in Ireland.

Carrying the Aquis colors, Cradle Me (Easy Rock-

ing), a Aus$300,000 ($216,960) purchase from the re-

cent Magic Millions National broodmare sale, became

a group II winner in the Bundaberg Rum Dane Ripper

Stakes June 11. BH

'OPERATION GELDING' TO EXPANDBy Blood-Horse Staff

Representatives of the Unwanted Horse Coalition

plan to expand the organization's "Operation

Gelding" program, given results of a recent survey.

The UHC met June 13 in Washington, D.C., focus-

ing on a three-year strategic plan to "expand educa-

tional efforts, enhance key programs, increase visibil-

ity, and develop a strategic fundraising campaign to

support current and future initiatives."

"The UHC has not surveyed Operation Gelding

clinic organizers since the program began in 2010, so

this was clearly the first step in our plan to expand

the program," UHC director Jennifer Purcell said.

The UHC said 50% of the surveyed clinic organiz-

ers from 18 states responded and reported lack of

advertising, costs of travel, and inconvenient dates as

primary reasons horse owners do not participate in

Operating Gelding clinics. In addition, 70% said they

would plan a second clinic if funds were available,

and 81% expressed interest in a voucher option.

Based on the results, the UHC approved expan-

sion of the program effective Jan. 1, 2017, by in-

creasing the funding per horse gelded to $100,

approving two clinics per calendar year for qualified

organizations, and offering a voucher option.

"The program is working, but there is a clear

demand for additional castration clinics across the

country, and the UHC is ready to assist organizations

in meeting that need," UHC chairman Dr. Doug Corey

ON-TRACK, ADW CLASH IN CALIFORNIA

California regulators appear prepared to have

further discussions about the impact that

on-track use of advance deposit wagering ser-

vices is having on on-track pari-mutuel handle.

A lengthy back-and-forth during the June

California Horse Racing Board meeting revealed

a fairly deep divide: The Thoroughbred Owners

of California wants the information, but ADW

providers said additional "geolocation" functions

could be costly and inconvenience bettors.

ADW providers already know the jurisdiction

in which wagers are generated. At issue is how

much money is wagered on live races via mobile

devices by people at the racetrack; bets made at

the windows for the most part generate more

revenue for purses than those made through

ADW services.

"This is not a minor issue. At the macro level

there has been a seismic shift in the wagering

customer," said TOC chief executive officer

Greg Avioli, who notes on-track handle fell 9%

at the recent Golden Gate Fields meet, but ADW

handle increased 11%. "Is this a coincidence? It

could be, but we don't think it is.

"We don't know how many people are betting

with devices on track. We should use technology

to address the questions and get the facts. This

should not be taken as the TOC taking a stand

against ADW. We need an economic model for

this type of betting."

John Hindman, general counsel for TVG, said

the company had talks with the TOC to "reach

an acceptable answer" to the questions. He said

it would be premature for the CHRB to start a

rule-making process.

Hindman said California "already receives

a healthy cut of ADW revenue" and should be

careful to maintain it. "We deeply care about

California," he said. "The benefit we've provided

to California has grown over the years."

outweigh the potential upside." Blackwell didn't

elaborate on the costs of additional bet-tracking

but said the ADW provider isn't paid much for

the services it provides to California bettors.

"We feel ADW provides a lot of value," Black-

well told the CHRB. "If the issue is that you are

losing money to ADW, look for ways to work

with ADWs."

Judging by comments from CHRB members,

the issue isn't going away.

"We appreciate the ADWs but the incon-

venience to ADWs is not as much a concern as

where the money goes," CHRB chairman Chuck

Winner said. "There are conflicting issues here."

According to the 2015 CHRB annual report,

ADW in California accounted for $610.6 million

in handle. For fiscal 2014-15, on-track handle

constituted 12.7% of total wagering, much less

than 22.4% for in-state simulcast outlets, 28.4%

for six ADW providers licensed in California; and

36.4% from out-of-state locations. BH
