Three of these bills are intended to help contractors by: Streamlining residential notice requirements; Eliminating duplication in contracts; and Protecting contractor’s personal identifying information. The other two bills will help clarify existing law. These bills first go to the state senate. Each bill is identified by “Senate Bill” (or “SB”) and a corresponding number. If the state senate passes the bill (with or without amendments) it goes to the House. If the House passes the bill (with or without amendments) it goes to the floor of both the House and Senate for a vote. The following is a summary of the content of the bills. SB 202 clarifies law. SB 202 moves cleaning or servicing chimneys from the overall definition of “contractor” to the list of persons who are contractors. The change has no effect chimney sweeps. SB 202 also removes the reference to the total cost of contracts from the definition of “general contractor.” SB 202 defines “general contractor” by work performed rather than the cost of the project. SB 203 makes Oregon’s consumer lien notice requirement consistent with other CCB’s laws. CCB’s laws require a written contract for construction of $2,000 or more. The lien law requires a notice about construction liens for construction of $1,000 or more. SB 203 would establish a $2,000 threshold for lien notices. This would make the threshold the same as for the written contract. SB 203 also makes some “housekeeping” changes for terms used in the lien statute. SB 204 clarifies law. SB 204 explicitly provides that residential bonds will pay complaints against residential contractors. Commercial bonds will pay complaints against commercial contractors.

The 2009 legislature is in session inSalem. CCB, with approval of theGovernor’s office, has submitted fivebills this session. Three of these billsare intended to help contractors by: • Streamlining residential notice

Governor’s Safety & Health (GOSH) Conference

If you read the headlines, then youknow 2007 was a dangerous year forconstruction in Oregon. Twelve peoplein the construction industry died on thejob, with falls being the leading causeof accidents that year. The Office of State Fire Marshal(OSFM) recently became aware of acontractor performing propaneequipment and piping work in Oregonwithout appropriate licenses requiredby the OSFM.

The contractor was unaware of theOSFM requirements regarding propaneequipment installation.

The OSFM reminds contractors whoinstall or work on propane equipmentof the necessity of holding theappropriate licenses.

Contractors can find the OSFMlicensing requirements in the “boxnotes” in their current fuel gas sectionsof Oregon Residential Specialty Code& Oregon Mechanical Specialty Code.Contractors installing propaneequipment under these codes should beaware of OSFM licensingrequirements.

Continuing education requirementswere made part of Oregon law duringthe 2007 Legislative session. The CCBspent the past year researchingcontinuing education in other states,listening to contractors andstakeholders, and working to tackle theissues brought forth by theConstruction Claims Task Force.

To begin such a big task, the CCBdivided the continuing education intotwo programs: Commercial ContinuingEducation (CCE) and ResidentialContinuing Education (RCE). CCE isestablished and contractors that arecommercially endorsed should betaking continuing education. The RCEis still being developed. The followingis information on both programs.

Commercial ContractorsAs of July 1, 2008 newly licensedcontractors or contractors that renewedwith a commercial endorsement aresubject to the commercial continuingeducation requirements. They mustcomplete the required CCE hoursbefore their next renewal.

Contractors that are still licensed underthe category system, and plan to get acommercial endorsement, will besubject to the CCE requirements after

they renew their license and choose thecommercial endorsement. They willhave the two-year licensing period totake the qualifying CCE.

Residential ContractorsContinuing education for contractorsthat have or will have a residentialendorsement is getting closer tocompletion.

Committee members and CCB staffhave been meeting for several monthsdiscussing the mandates in ORS701.126, the elements of a program thatwould make sense for businesses andhelp consumers and the logistics ofimplementing such a program.

Information on all the continuingeducation meetings is available on theCCB website under StakeholderMeetings. The residential continuingeducation program remains pendingand will have final recommendation,discussion and approval by the Board.

OR- OSHA: Changes to Safety Committee Rules

A key Oregon Occupational Safety andHealth Division (Oregon OSHA) rulehas been revised to provide greaterclarity and flexibility to employersseeking to involve their workers indiscussions of health and safety on thejob.

The rule requires all employers to havea safety committee or hold safetymeetings with their employees.Previously, a stricter set of safetycommittee requirements applied toemployers with more than 10employees. Smaller employers also hadto have a safety committee, regardlessof size, if they were in a high-riskindustry (such as construction) or ifthey had a high rate of claims requiringtime off work, compared to theirindustry as a whole.

“Almost all construction employershad to have a safety committee, evenif they had only one part-timeemployee,” said Michael Wood,administrator of Oregon OSHA. “And

the rule didn’t allow employers tocomply using on-site “all hands”meetings – which many of those in theconstruction industry have told us workbetter than a monthly or quarterlymeeting. .”

Under the new rules, all employers willneed either to have a safety committeeor to use the less formal option of safetymeetings to involve their employees inaddressing jobsite safety. Constructionemployers will have the option of usingsafety meetings. Even largeconstruction companies can choose torely upon the safety meeting model.

According to the Oregon EmploymentDepartment, small businessesemploying 10 or fewer employeesrepresent 80 percent of the state’semployers.

“In order to effectively prevent injuryand illness on the job, you needmeaningful involvement byemployees,” Wood said. “The rules

before were confusing for smallemployers. This change not onlyprovides greater clarity and increasesflexibility, we also believe it willpromote more conversation abouthealth and safety issues on the job. Thathas always been the purpose of thesafety committee requirement.”

The new rule takes effect on Jan. 1,2009, for large employers andemployers in the construction industry.The rule change also eliminates themandatory penalty of at least $100 fornot having a safety committee.

Submitting Court Judgements to CCBA previous CCB newsletter madecontractors aware of a law aboutreporting court judgments that wentinto effect this past year.

The article explained that beginningJanuary 1, 2008, Oregon law requirescontractors to send the Board a copyof unpaid court judgments ordering thecontractor to pay damages relating toconstruction or proposed construction(ORS 701.109). This requirementapplies if the damages are for:

• Breach of contract• Negligent work or• Improper work

The requirement includes courtjudgments and court orders upholdingarbitration awards.

You must send CCB a copy of thejudgment within 45 days after it isrecorded, unless you pay the judgmentwithin 30 days or have properlyappealed the judgment.

In addition to accepting the copy of thecourt judgment by mail, the agency hasdeveloped an online solution throughCCB “My License” to deliver the copyof the court judgment. Visitwww.oregon.gov/CCB. Click on CCB“My License” to access.

Contractors planning to mail the copyof the court judgment should downloador call for the required accompanyingform. The form can be found underContractor Forms/ MiscellaneousForms.

Amendment: An alteration made or proposed to be madeto a measure. Measures may be amended more than once.

Bill: A measure that creates a new law, amends or repealsand existing law, appropriates money, prescribes fees or takesother action.

Do Pass: The recommendation by a committee for passage,abbreviated as DP. DPA means “do pass with amendments”.

Drop: Refers to submitting a committee report to theappropriate desk.

Effective Date: ORS 171.022 reads that except as otherwiseprovided in an Act, an Act of the Legislative Assembly takeseffect January 1 of the year after the passage of the Act.

Engrossed Bill: A measure that is printed with itsamendments included. It will have “A” (or B, or C, etc.)Engrossed at the top which signals that the bill has changedfrom its original form.

Enrolled Bill: The final copy of the bill which has passedboth houses of Legislature and has been specially reprintedfor the signatures of President of the Senate and Speaker ofthe House. After these confirmatory signatures, the enrolledbill goes to the Governor.

Readings: The recitation of the measure’s number, title andsponsor. The First reading the measure is referred to acommittee by the Speaker or the President. The Secondreading occurs after the measure has been referred to thecommittee, worked on and reported back to the floor of thehouse it originated in for a vote. The Third reading occurson the floor by either house usually before the final vote.

SB 205 eliminates duplication of required noticesinformation. Written contracts must containsummaries of CCB’s notices. However, contractorsare required to provide consumers a copy of the actualnotices. Contracts must refer to a maintenanceschedule when constructing new residential structures,however, contractors are required to provide the actualmaintenance schedules. SB 205 streamlines the lawand eliminates duplication.

SB 206 protects contractor’s personalidentification. A contractor obtaining or renewing alicense must provide personal identification, includinga birth date and a driver’s license number. SB 206would make that information confidential. SB 206also excludes large, SEC-registered companies fromproviding such information.

Civil Penalties Issued October 01, 2008 - December 31, 2008The Oregon Construction Contractors Board (CCB) recently announced final orders assessing civil penalties issued to Oregon contractors forviolation of the Construction Contractors Law (ORS 701). Oregon law requires all construction contractors to be licensed with the CCBbefore they advertise, bid on, or perform construction, remodeling, or repair work.

The CCB issued 589 penalties between October 1, 2008 and December 31, 2008. Contractors receiving penalties include the following:(See Violations Key at the end of the list for violation and description).

What’s the buzz?

How do I know which endorsement to chose?Choose your endorsement based on the type of structures you will beworking on.A contractor with a residential endorsement can work on residential and smallcommercial structure types; a contractor with a commercial endorsement canwork on large and small commercial structure types. A chart explaining thesethree structures types is available on the CCB website.

Will I pay more for endorsements?No. Contractors only pay the non-refundable application fee for their license.

When do I have to choose an endorsement?Endorsements became part of CCB law July 1, 2008. At that time all newlicensees began choosing an endorsement. Beginning July 1, 2008, when acontractor receives their renewal form, they also must choose an endorsement fortheir license. All contractors will be phased in to new endorsement system byJuly 1, 2010.
