Transformation of Ontario’s occupational health and safety system and what it means for construction

Bill 160 introduced signifi cant changes to the Occupa-tional Health and Safety Act. Some of these include the establishment of a Prevention Council, Chief Prevention Offi cer, training standards, new reprisal provisions, and changes to the powers and functions of joint health and safety committees. In addition, the prevention mandate was transferred from the Workplace Safety and Insur-ance Board to the Ministry of Labour. Ontario’s fi rst Chief Prevention Offi cer, George Gritziotis, will speak to con-struction leaders about the vision and strategy for safer workplaces across the Province.

Managing Construction Risk after the Metron Construction Conviction (Owner/SO)Norm Keith – Gowlings

In this session, Mr. Keith, a leading occupational health and safety lawyer in Canada, will provide a factual, le-gal and practical analysis of the Christmas Eve, 2009, quadruple fatality that resulted in the prosecution of the President of Metron Construction and the fi rst conviction of an employer in Ontario for the new crime of Occupa-tional Health and Safety Criminal Negligence (Bill C-45).

Mr. Keith will provide details on the circumstances sur-rounding the accident, the dual prosecution under the Criminal Code and the Occupational Health and Safety Act, and the legal resolution, as well as practical lessons learned.
