Comprehensive Plan

CP Amendments (Large-Scale, Small-Scale, and DRI Related)

*The processing of CP Amendment applications will be done by consultants who will act as adjunct staff to the Planning and Growth Management Department. The consultants will be totally responsible for the processing of CP Amendment applications from the Proposed Stage (transmittal to the Florida Department of Community Affairs [FDCA] for their review and Objections, Recommendations, and Comments [ORC] Report) through the Adoption Stage (transmittal to the FDCA for Notice of Intent determination).

The applicant will pay the fee after the County has determined the application is acceptable for processing and a lump-sum fee has been negotiated with a planning consultant and a transportation consultant for processing the CP Amendment applications through the Proposed Stage (transmittal to the FDCA for their review and ORC Report). The CP Amendment application will be considered withdrawn if an applicant chooses not to pay the processing fee.

Once the ORC Report is received from the FDCA, and the County and consultant have reviewed it, a second lump-sum fee will be negotiated with the consultants for processing the CP Amendment applications through the Adoption Stage (transmittal to the FDCA for Notice of Intent determination). The CP Amendment application will be considered withdrawn if an applicant chooses not to pay the processing fee.

Should the FDCA issue a Notice of Intent finding a CP Amendment application not in compliance, a third lump-sum fee will be negotiated with the consultants to either enter into a settlement agreement with the FDCA to resolve the Notice of Intent or go through a Florida Department of Administrative Hearing determination.

Traffic Impact Study/Substandard Road Analysis

A consultant review fee shall be paid to the appropriate County department, along with a minimum of two copies of the TIS and/or methodology statement. On the page following the cover page of the TIS Report, the applicant shall provide a list of, and indicate the number of intersections studied in the TIS, for the purpose of establishing the review fee. Projects subject to a detailed or special access management study in accordance with Section 618.3 of the LDC shall pay the additional review fee set forth in Exhibit “E”. DRI projects are subject to the analysis/review fees as set forth in Exhibit “F”. The parameters of the special access management study are usually different than a standard TIS or DRI traffic study, including but not limited to, background growth or committed improvements assumptions. The amount of the review/analysis fee in Exhibit “F” can be reduced by the amount of such fee that will be paid by another review agency for the same review.

General Notes:

Plats submitted with deficient Supporting Data will be placed on hold for a period of ten (10) days; during the ten day hold period should the deficient documentation not be submitted or the plat not picked-up by the submitting entity the preliminary plat package will be deemed incomplete and the plat withdrawn from review and discarded. The plat review fee will be returned if not previously deposited in the Board of County Commissioners account. The review fee deposit receipt will be sent to the submitting surveyor. To be credited for the plat review fee, the receipt must be retained and attached to the resubmittal plat package or an additional review fee will be charged. The County is not responsible for maintaining an accounting system as to which plats are withdrawn from review and have paid their review fees.

C. The Additional Fee shown is for each additional PRM re-inspection and Permanent Control

Point (PCP) – Lot Corner re-inspection:

D. Plats are reviewed for general, technical, statutory and conditional content and accuracy. Plats

are reviewed and compared with the Development Review Division stipulations, Rezoning Petition conditions, Southwest Florida Water Management District (SWFWMD) specific conditions, DRC and/or DRD approved construction plans, SWFWMD approved construction plans and Florida Statutes, Chapter 177 Part I (Plat Law). The required boundary survey submitted with the plat must conform to Florida Administrative Code 61G17-6, Minimum Technical Standards.

E. Plat review fees are payable at the time of plat submittal. PRM and PCP – Lot Corner re-

inspection fees are payable prior to each re-inspection.
