SUBJECT Addendum to Division Memorandum No. 027, s. 2020 re: School Site Complete Set of Documents

Please refer to the following points below regarding the clarification of Division Memorandum No. 027, s. 2020: .

1.) Please submit only the following to the School Sites Task Force (SSTF) before March 6, 2020, instead of the earlier deadline of March 4, 2020:

•

a. Historical background of the school (schools with pending applications for school sitepatent and/or Presidential Proclamation and those with pending court cases areexempted from this requirement).

b. Original and photocopy of school site documents pertaining to the school's ownershipand/or possession and occupation.

c. Brief background of the existing claims against the school (schools with pending casesare exempted from this).

d. Technical Description of the School Site (if available).

e. Approved Survey Plan ( if available).

f. Updated Site Development Plan ( if available)

g. Cadastral Plans.

h. If the school site was acquired via donation/sale and the land is titled, please indicateif the donated/sold school site is simply a portion of the titled land.

1. If only a portion of the titled land was donated/sold to the school, please indicate if theportion that was donated/sold has been surveyed and if surveyed, please note if thesurvey plan has been approved .

2.) The attached templates and fonns from DENR Administrative Order No. 2015-01 1 (March 4,20 I 5) were intended to serve as guide only for schools who are qualified to apply for a special school site patent with the DENR and should not be filled up and submitted to the SSTF.

3.) For your guidance on how the historical background of the school should be written, please refer to the following:

a. Discuss in a concise manner the history of the school site. You may omit the history ofthe barangay or municipality wherein the school site is located for purposes of brevity.

b. Briefly discuss how and when the possession of the site by the school began.

c. End with the current status of the school site occupation and possession, especiallyreferring to the current basis of ownership and/or possession by the school.

To serve as your guide, please see the attached Historical Background of Aramaywan Elementary School and Pulot National High School.

4.) In special cases as discussed below, please see the herewith attached "transmittal" and mark the appropriate column to indicate:

a. If the school site has been donated to the school by the registered owner but theBarangay/Municipality has not yet donated the land to the school via aResolution/Ordinance which authorized the Barangay Chairman/Mayor to execute a Deedof Donation in favor of the school. The mark for this instance should he in the columnpertaining to: Donated to Barangay/Municipality but not Donated to the School.

b. If the school site was donated via an extrajudicial settlement with simultaneous Donationplease put mark on the: Affidavit of publication.

c. For schools whose sites are covered by an Original Certificate of Title (OCT) or TransferCertificate of Title (TCT), please also indicate in your note if the Deed of Donation or Deedof Absolute Sale has been annotated on the OCT or TCT, as the case may be. If there is noannotation on the OCT or TCT, please put a mark in the column pertaining to: Titled land- Donated but not annotated.

d. If the original copy of Deed of Donation, Deed of Sale, Waiver of Right, Usufruct, Deedof Exchange or other documents upon which the school is basing its ownership is missing,please put a mark in the column pertaining to: Missing Deed of Donation/Deed ofSale/Waiver of Right/Usufruct/Deed of Exchange.

e. In case the donated / sold land to the school is titled, please indicate if the copy of theOCT or TCT is available. If not, please indicate the same by putting a mark in the columnpertaining to: No Copy of OCT ff CT.

f. For schools with tax declarations not yet transferred to the name of the school, please puta mark in the column pertaining to: Tax Dec not in the name of school.

g. If the tax declaration is in the name of the school but the school is still paying realproperty taxes, please put mark in the column pertaining to: Tax Dec in the name ofschool, but not yet exempted.

5) In submitting your set of documents, please use red folder (or red covered folder), if your schoolsite has an existing adverse claims/ claims against the school.
