PREAMBLE & ARTICLES

PREAMBLEThis Agreement is entered into by and betweenthe Board of Trustees of State Colleges and theBoston State College Faculty Federation, AFTLocal 1943, AFL-CIO, as the exclusive collectivebargaining agent for faculty members in the bar-gaining unit as described in Article 1, Section A.Boston State College is on important part of astatewide system of institutions of higher learningoperat: 4 through the Board of Trustees of StateColleges under the laws of the Commonwealth ofMassachusetts.The participation of Faculty, together with Stu-dents and Administrators, in the goverr'ment ofBoston State College is essential to its develop-ment as an emerging multi-purpose college withinthe system of Stnte Colleges under the jurisdictionof the Board of Trustees of State Colleges.The basic functions of instruction, research andservice at Boston State College are Performed bya community of men and women who are mem-bers of a profession dedicated to the advancementof learning, instruction, scholarship and service,and it is therefore fitting that they shore in theformulation of plans and policies which affect theirprofessional activities.Accordingly, this Aoreement between the Board ofTrustees of State Colleges and the Boston StateCollege Faculty Federation seeks to establish afirm basis for expanded faculty participation incampus governance and to describe more preciselythe scope of that participation.The parties to this Agreement recognize both theneed and the opportunity for improvement andgrowth at Boston State College: they pledge them-selves cooperatively therefore to the task of re-assessing the goals and objectives of the Collegethrough an alliance of students, faculty and ad-ministration committed to the attainment of thehighest standards in teaching, research and serviceto the community. The faculty, moreover, assumesa special and continuing responsibility to theirmembers for the attainment and application ofsuch standards.

ARTICLE IRECOGNITION AND DEFINITIONSA. RecognitionThe Board of Trustees of State Colleges (herein-

after referred to as the "Board") recognizes theBoston State College Faculty Federation AFT Local1943, AFL-C10 (hereinafter referred to co, the"Federation") as the exclusive collective bargain-ing representative with respect to the conditionsof employment of a unit which comprises:

All faculty who hold a full-time appointmentfrom the Board as Professor, Associate Pro-fessor, Assistant Professor, Instructor, andLibrarians I-V.

B. JurisdictionDuring the term of this Agreement, the jurisdic-tion of the Faculty Federction shall extend tothose faculty who now or hereafter hold full-timeappointments to the positions included in the bar-gaining unit.C. Dues Cheek-OffThe Faculty Federation shall be permitted author-ization for payroll deductions as set forth in Ap-pendix A.O. Definitions1. Academic Year, The term "academic year"as used in this Agreement comprises the inclusivedotes from. September 1 to June 30. (See Appen-dix B).2. Administration. The term "administration" asused in this Agreement shall mean the Presidentand other principal administrative officers of theCollege appointed by the Boord from time to time:such designation shall not include individuals andpositions as defined in Article I, Section A of thisAgreement.3. Board. The term "Board" as used in thisAgreement refers to the Board of Trustees ofState Colleges as defined in Mass. G. L. C. 15,Section 20A.4. Campus. The term "campus" as used in thisAgreement refers to any site or location of thefacilities or properties of Boston State College.5. College. The term "College" as used in thisAgreement refers collectively to all facilities andproperiies which are now or shall hereafter bedesignated by the Board for the use of BostonState College.6. Dean. The term "Dean" as used in this Agree-ment shall mean the Academic Dean or the personholding the equivalent position as may be desig-nated from time to time by the Board.

7. Department. The term "Department" as usedin this Agreement refers to organizational unitsof the faculty as may from time to time be ap-proved by the President and recognized by theBoard. The existing Departments are (I) Art, (2)Biology, (3) Physics-Chemistry, (4) History, (5) So-ciology-Anthropology. (6) Geography, (7) Elemen-tary Education, (8) English (including Speech andCommunications), (9) Foreign Language, (10)Mathematics, (11) Music, (12) Philosophy, (13)Physical Education (Men), (14) Physical Education(Women), (15) Political Science, (16) Psychology,and (17) Secondary Education. Moreover, solelyfor the purposes of this Agreement, the term De-partment shall also include the programs of Afro-American Studies and Economics, and in addition,the College Library.8. Faculty. The term "faculty" as used in thisAgreement means any member of the bargainingunit.9. Federation. The term "Federation" as used inthis Agreement refers to the Boston State CollegeFaculty Federation, AFT Local 1943, AFL -CIO.

10. Federation Representative. The term "Feder-ation Representative" as used in this Agreementmeans any representative of the Federation whoIs a member thereof, and has been officially sodesignated In writing to the President of theCollege, or a representative of the MassachusettsFederation of Teachers or the American Federa-tion of Teachers who has been officially so desig-nated in writing to the President of the College bythe President of the Federation.11. Grievance. The term "grievance" as ;Ised Inthis Agreement means a complaint by a memberor members of the faculty, or the Federation, upona majority vote of a duly constituted meeting ofthe Executive Council thereof, brought during theterm of this Agreement, that an express provisionof this Agreement, or of any of the policies of theBoard which are expressly incorporated by refer-ence in Article XVII of this Agreement, has beenviolated in its application to him, or the Federa-tion, as the case may be.12. President. The terra "President" as used inthis Agreement means the chief executive officerof Bi.,-,ton State College, or o person acting in thatcapacity, duly appointed and authorized by theBoard.

13. Promotion. The term "promotion" as used inthis Agreement means advancement to a higherfaculty rank.14. Rank. The term "rank" as used in thisAgreement means any one of the four academicranks of instructor, Assistant Professor, AssociateProfessor, and Professor, and also Librarians I

through V.15. Wherever the singular is used and the con-text clearly so requires, it shall include the plural.

E. Faculty Entitlement Undek This AgreementEvery member of the faculty within the bargainingunit as described in Article I, A, shall be entitledto the applicable benefits set forth in this Agree-ment and shall have the right to participate in theelections in the manner provided in this Agree-ment.

ARTICLE 11RELATIONSHIP BETWEEN THEBOARD AND THE FEDERATIONA. Fair Practices1. As sole bargaining agent the Faculty Federa-tion shall continue its policy of accepting intomembership all eligible persons in the unit with-out regard to age, race, color, creed, nationalorigin, sex or marital status. The Federation shallrepresent equally all faculty without regard tomembership or participation in the activities ofany employee organization.2. The Trustees agree to continue their policy ofnon-discrimination against any person on the basisof race, color, creed, national origin, sex, maritalstatus, age or participation in or association withthe activities of any employee organization.

Moreover, the Federation agrees to cooperatewith the Board in the implementation of the Af-firmative Action Program.B. Individual ContractsThis Agreement shall be incorporated into employ-ment contracts hereafter issued to faculty mem-bers, and no contract hereafter entered into witha member of the faculty shall be contrary to theterms contained herein. Rights and benefits offaculty members set forth in this Agreement shallbe incorporated by reference Into and mode partof any individual academic year or calendar year

contract of employment with the Board of Trus-tees, except that in the case of individual con-tracts of employment existing as of the dote ofthis Agreement, this Agreement shall not be in-corporated by reference therein, without the assentand approval of each such faculty member. Uponsuch approval, in the event of conflict betweenthe terms of an individual contract and the termsof this Agreement, the latter shall be controlling.

C. ConsultationOn behalf of the Board, the Director of the Divi-sion of State Colleges, or his designee, and thePresident of Boston State College shall meet withrepresentatives of the Federation twice each semes-ter for the purpose of maintaining good relation-ships through regular communication and for dis-cussing those matters necessary to the implemen-tation of this Agreement; the President of theCollege shall meet with representatives of theFederation once each month during the ocodemicyear; and at such other times within five (5) daysafter a request of either the President of theCollege or of the Faculty Federation President forthe purpose of maintaining and improving rela-tionships:

D. InformationThe Board shall make available to the Federationupon its written request within cr reasonable timethereafter, such statistics and information relatedto the collective bargaining unit in the possessionof the Board of Trustees as are necessary for theimplementation of this Agreement. It is under-stood that this shall not require the Board tocompile information and statistics in the formrequested unless already compiled in that form, orto supply any information deemed confidential.

ARTICLE HIUSE OF COLLEGE FACILITIESUpon request to the President of the College orhis designee, the Federation shall be permitted tomeet of the College if appropriate facilities areavailable. All requests must be in writing at leasttwenty-four (24) hours prior to the requestedmeeting. The parties agree to use their best effortsto schedule meetings involving fa=ulty in a man-ner designed to ovoid conflicts between such dulyrequested and previously sneduled meetings.

The Federation shall be provided with on officeon the Campus.

The President or his designee shall assign twobulletin boards for the exclusive use of the Federa-tion for the purpose of posting Federation notices.One such bulletin board shall be made available atthe Huntington Avenue Campus and one at theIpswich Street Campus of the College.The Federation shall be permitted the right toplace Federation notices in Faculty mailboxes.Federation members within their respective De-partments shall be entitled to use telephonesexisting within their respective Departments forpurposes of intro - college communication of officialFederation or Departmental business.

ARTICLE IVFACULTY FRINGE BENEFITSA. Paid Leaves of Absence1. Sick Leave

(a) All faculty members shall be entitled toten (10) days sick leave for each academicyear of service. Sick leave credit will begin onthe first of the month following employmentand will accumulate monthly. A renewal ofcontract will be deemed a continuation ofservice, Credits for periods of less than onemonth's employment with pay shall not beallowed.(b) Sick leave not used in any year may beaccumulated.

2. Sabbatical LeaveAny faculty member who has served as such inthe state colleges for at least seven (7) consecutiveyears after entering such service, or if a leave ofabsence has previously been granted to him, afterthe termination of the last such leave may, uponwritten recommendation of the President of theCollege, be granted by the Director of the Divisionof State Colleges o leave of absence, for studyresearch; for a period of one (1) year at half payor for a period of a half year at full pay for suchperiod; provided, that prior to the granting ofsuch leave said teacher shall enter into a writtenagreement with the Board of Trustees that uponthe termination of such leave he will return to theState College service and serve as a teacher in

the same or another State College for a periodequal to twice the length of such leave and that,in default of completing such service, he willrefund to the Commonwealth, unless excusedtherefrom by the Board for reasons satisfactoryto it, an amount equal to such proportion of thesalary received by him while on leave as theamount of service not actually rendered as agreedbears to the whole amount of service agreed to berendered.

3. Funeral LeaveUpon evidence satisfactory to the Board or itsdesignee of the death of the husband, wife, child,parent, spouse's parent, brother or sister of anyfaculty member, or of a person living in his orher immediate household, funeral leave with fullpay shall be granted for a period not exceedingfour (4) days.4. Other LeavesOther leaves, as authorized and set forth in the"Rules and Regulations Governing Vacation Leave,Sick Leave, Travel, Overtime, Military Leave,Court Leave, and Other Leave" (Red Book) shallalso be available to foculty members in accordancewith the provisions thereof.5. Exclusions from Leave DeductionUpon the written application of a faculty memberthrough his Department Chairman, the Presidentof the College or his designee may grant suchfaculty member permission to attend a convention,meeting of a learned society, or other professionalfunction without loss of compensation or otherpenalty and such attendance shall be deemed tobe a part of the professional duties of such facultymembers.

B. Unpaid Leaves of AbsenceUpon the application of a faculty member, and arecommendation by the President of the College,the Board or its designee may grant to such facultymember leave without pay for such term, uponsuch condition, and for such purpose as the Boardor its designee may determine. The purposes forwhich o faculty member may submit his applica-tion for such unpaid leave may include, but shallnot be limited to, (a) advanced study, (b) partici-pation in exchange teaching prooroms in otherstates, territories, countries, and (c) participationin a cultural program related to his professionalresponsibilities, and for such other purposes os

may be allowed under the laws of the Common-wealth.Any faculty member granted an unpaid leave ofabsence shall retain those benefits accrued duringthe period of his leave which are permitted bystatute and the policies of the Board of Trustees.

C. Insurance1. Life InsuranceThe Board shall continue to cover all employeesof the bargaining unit under the plan now ineffect during the term of this Agreement pur-suant to the provisions of M.G.L.A. Ch. 32A,§5, 6, 8, 10 and 10A.2. Health and Accident InsuranceThe Board shall continue to cover all employeesof the bargaining unit under the plan now ineffect during the term of this Agreement pur-suant to the provisions of M.G.L.A. Ch. 32A,§5, 6, 8 and 10.3. Workmen's CompensationThe members of the bargaining unit shall becovered by the provisions of Chapter 152 ofthe General Laws to the extent that the Com-monwealth has acted pursuant to Section 69thereof to include them within the coverage ofsaid Chapter 152.

D. Tax Sheltered AnnuitiesThe Board of Trustees shall continue its policy ofpermitting the purchase of annuities by facultymembers pursuant to the provisions of M.G.L.A.C. 15, §18A.

E. Changes in BenefitsThe foregoing provisions of this Article notwith-standing, the parties agree that during the termof this Agreement if changes in the benefits pro-vided in this Article are authorized and funds pro-vided therefor by the General Court, or are dulyestablished by administrative action applicable tosuch benefits then, upon such event the benefitsshall be increased, or decreased, or terminated asthe case may be, after conference between theparties, from the effective data of such increase,decrease or termination during the balance of theterm of this Agreement.F. Changes in the AgreementThe parties further agree that should the provi-sions of Massachusetts G.L. Ch. 149, § 178 exist-ing as of the date hereof be amended by the

General Court, the parties shall upon thirty (3o)days written notice of either meet and confer withrespect to such amendment and may incorporateany written agreement mutually agreed upon intothis Agreement. The provisions of this section,however, shall not be deemed to impair any termin this Agreement contained.

ARTICLESTATEMENT ON ACADEMICFREEDnM AND RESPONSIBILITYThe purpose of this statement is to promote publicunderstanding and support of academic freedomand tenure and agreement upon procedures toassure them in colleges and universities. Institu-tions of higher education are conducted for thecommon good and not to further the interest ofeither the individual teacher or the institution asa whole. The common good depends upon the fresearch for truth and its free exposition.Institutions of higher education are committed tothe solution of problems and controversies by themethod of rational discussion. Acts of physicalforce or disruptive acts which interfere with uni-versity activities, freedom of movement on thecampus, or freedom for students to pursue theirstudies are the antithesis of academic freedomand responsibility and are acts which in effectdeny freedom of speech, freedom to be heard andfreedom to pursue research of their own choosingto members of the academic community or toinvited visitors to that community.Academic freedom is the right of scholars in insti-tutions of higher education freely to study, dis-cuss, investigate, teach and publish.Academic freedom applies to both teaching andresearch. Freedom in research is fundamental tothe advancement of truth. Academic freedom inits teaching ospect is fundamental for the protec-tion of the rights of the teacher in teaching andof the student to freedom in learning. It carrieswith it duties correlative with rights.

Academic Freedom(1) The teacher is entitled to full freedom in re-search and in the publication of the results, sub-ject to the adequate performance of his other

academic duties; but research for pecuniary returnshould be based upon on understanding with theauthorities of the institution. 'I-

(2) The teacher is entitled to freedom in theclassroom in discussing his subject, but he shouldbe careful to present various scholarly views re-lated to his subject and avoid presenting totallyunrelated material.

Academic ResponsibilityThe concept of freedom should be accompanied

by an equally demanding concept of responsibility.The college or university teacher is a citizen, amember of a learned profession, and an officer ofan educational institution. When he speaks orwrites as a citizen, he should be free from Insti-tutional censorship or discipline, but his specialposition in the community imposes special obliga-tions. As a man of learning and an educationalofficer, he should remember that the public mayjudge his profession and his institution by his ut-terances. Hence he should at all times be accurate,should exercise appropriate restraint, should showrespect for the opinions of others, and should makeevery effort to indicate that he is not on institu-tional spokesman.

ARTICLE VISELECTION OFDEPARTMENT CHAIRMEN .

Department Chairmen shall serve for o term ofthree (3) years unless a vacuity is declared toexist by the President of the College, or unless theChairman is recalled in accordance with the pro-visions of this Article, or unless he resigns. `-ExclusiveExclusive of the Programs of Afro-American --Studies, Economics, and the College Library, theChairmanship of Departments shall be filled inthe manner described In numbers 1 thru 8 below:

1. An election shall be held in each Deport-ment at the call of the Academic Dean on orMore May 15, 1972 for the purpose of nomi-Latir' three (3) or more persons who would beacceptable to the members of the Departmentus Chairman. Each such election shall be heldunder the auspices of the Federation. .

2. Any faculty member within the Deportment

shall be eligible for election as DepartmentChairman.3. All faculty members within the Departmentshall be eligible to vote in the election forDepartment Chairman.4. After each election, the President of theFederation shall submit a list of three (3) nomi-nees to the President of the College.5. Within seven (7) working days of the receiptof such list of nominees, the President of theCollege shall either (a) appoint a DepartmentChairman from the list of nominees or (b) notifythe President of the Federation that he declinesto appoint any of the nominees on the list. Ifthe President declines the list of nominees, asecond election shall be held forthwith in ac-cordance with the provisions of this Article;within seven (7) working days of the receipt ofthe second list of three (3) nominees, the Presi-dent shall appoint a Deportment Chairman fromsaid list.

6. Recall by Vote of the DepartmentThe following procedures shall be used for therecall of a Chairman:

a. A Department meeting shall be held afterfiling with the Dean, a petition signed by atleast one-third (VD of the members of aDepartment setting forth a statement of thedesire to recall the Chairman of that Depart-ment provided that such petition may befiled only within the academic year.b. Upon receipt of such petition, the Deanshall promptly give fourteen (14) days writ-ten notice to all members of the Department,and to the President of the Federation, set-ting forth the time, date, place and purposeof such meeting.c. The President of the Federotion shallforthwith appoint on impartial faculty mem-ber or members to conduct the recall meetingand the vote within the Department.d. A vote of two-thirds (%) of all the mem-bers of the Department shall be required torecommend to the President that he declarea vacancy to exist in the Department Chair-manship. Upon receipt of such recommenda-tion from the President of the Federation to-gether with a written record of the minutesof such meeting and a record of the votes

cast, the President shall call for o new elec-tion under the procedures described in thisArticle.

7, The President may at his discretion declarea vacancy to exist.8. The President of the College may appointan Acting Chairman when the Chairman shallbe on leave, incapacitated, or otherwise unableto fulfill his duties, or upon the declaration ofa vacancy, recall, or resignation.9. Solely for purposes of this Agreement,the Dean of Undergraduate Studies shall for theterm of this Agreement discharge with respectto the programs of Afro-American Studies andEconomics those duties of the Department Chair-men as are set forth in this Agreement. Ifeither or both of these programs shall, duringthe term of this Agreement become Depart-ments approved by the President and recognizedby the Board, then the procedures for selectionof Department Chairman as set forth in num-bers 1 through 8 of this Article shall becomeapplicable. Similiarly, for purposes of this Agree-ment the head librarian shall, for the term ofthis Agreement, discharge with respect to Libra-rians i thru V, those duties of DepartmentChairman as are set forth in this Agreement.

ARTICLE VIIPARTICIPATION INDECISION MAKINGA. Committees of the College Administration and

the Federation: Organization and MembershipThe following Committees shall be established onor before May 15, 1972 to insure substantialparticipation of all faculty in the formulation ofdecisions affecting the conditions of their employ-ment and related professional interests as providedin this Agreement.

1. Faculty Committees DepartmentalThere shall be three (3) types of Faculty Com-mittees within each Deportment:

(a) Faculty Committee on Faculty Evaluation(b) Faculty Committee on Curriculum(c) Faculty Committee on Faculty Workload,

Scheduling and Course Assignmentsexcept that members of a Department shallhave the option prior to May 15, 1972, of corn-

bining the Committees in (b) and (c) above, andexcept that the College Library shall be requiredto establish only the Faculty Committee onFaculty Evaluation in (a) above.

The membership of each of the separate Com-mittees within each Department shall be drawnfrom the membership thereof. However, eachfaculty member who holds a joint appointment toc Department and to the Afro-A'terican StudiesProgram shall (1) elect whether he wishes to beeligible to participate in the three (3) Depart-mental Committees (on Faculty Evaluation, onCurriculum; on Faculty Workload, Scheduling andCourse Assignments) within the Afro-American Program or within the Department ofhis joint appointment, and (2) elect whether hewishes to be evaluated either as a member of theAfro-American Studies Program or as a memberof the Deportment of his joint appointment. Theelection made under (1) and (2) above shall befor the duration of this Agreement and shall bemade in writing to the Academic Dean withinthirty (30) days of the execution of this Agree-ment. In the event such election is not made bythe faculty member, the Academic Dean shallassign such faculty member either to the Afro-American Program or the Department of his jointappointment for the purposes of entitling suchfaculty member to Committee participation andfor purposes of evaluation.The manner of selecting membership and theterms to be served on each Departmental Com-mittee shall be determined not later than May 15,1972 in a meeting of the members of the De-portment called by the Department Chairman forthat purpose, provided, however, that the mem-bership of the Departmental Committee on FacultyEvaluation shall consist, wherever possible, of bothtenured and non-tenured faculty.

2. 4,aculty Committees Campus-WideThere shall be three (3) Campus-Wide Com-mittees:

(a) A Campus -Wide Committee onCurriculum

(b) A Campus-Wide Committee on CollegeDevelopment

(c) A Campus-Wide Committee on BudgetConsultation

Each of the three (3) Campus-Wide Committeesshall be composed of members of the Departments

as defined in this Agreement In the definitionssection. Each such Department shall elect one (1)representative to each of the three (3) Campus-Wide Committees. All members of each such De-portment who have completed at least one (1)academic year of service at the College shall beeligible both to vote in such elections and to beelected to any Campus-Wide Committee.All elections for Campus-Wide Committees shallbe held within each such Department under theauspices of the Federation prior to May 15 ofeach academic year. The terms of office of eachsuch representative shall be for one (1) year com-mencing immediately upon election, except thatthe terms of office of representatives to theCampus-Wide Committee on Curriculum shall befor two (2) years. In the event any such dulyelected representative is =able or unwilling toserve, the Federation shall hold a special electionwithin the appropriate Deportment in accordancewith the foregoing procedures in order to chooseanother faculty representative to complete theterm of the retiring member.

3. Faculty Committees DivisionalThere shall be four (4) separate Divisional Com-mittees on Re-Appointment, Promotion arid Tenurerepresenting the following divisions of the College;the Humanities Division, the Social Sciences Divi-sion, the Physical and Biological Sciences Division,and the Professional Education Division.* *The Humanities Division

A Committee on Re-Appointment, Promotionand Tenure shall be established for the Hu-manities Division whose members shall bechosen from the Departments of (1) Art, (2)English (including Speech and Communica-tions)., (3) Foreign Language, (4) Music and(5) Philosophy.

"The Social Sciences DivisionA Committee on Re-Appointment, Promotionand Tenure shall be established for the SocialSciences Division whose members shall bechosen from the Departments of (1) History,(2) Sociology-Anthropology, (3) Psychologyand (4) Political Science and frcm the Pro-grams of (1) Afro-American Studies and (2)Economics.

end Tenure shall be established for the Physi-cal and Biological Sciences Division whosemembers shall be chosen from the Depart-ments of (1) Biology, (2) Physics-Chemistry,(3) Mathematics and (4) Geography.

The Professional Education DivisionA Committee an Re-Appointment, Promotionand Tenure shall be established for the Pro-fessional Education Division whose membersshall be chosen from the Departments of (1)Elementary Education, (2) Secondary Educa-tion, (3) Physical Education (Men) and (4)Physical Education (Women).

All such faculty representatives to the four (4)Divisional Committees on Re-Appointment, Promo-tion and Tenure shall be chosen prior to May 15,1972 as follows. Each Departmental Faculty Com-mittee on Faculty Evaluation, established underArticle VII A, 1. of this Agreement, shall electone (1) member of that Committee to membershipon the appropriate Divisional Committee whoseservice shall commence immediately upon elec-tion, provided, however, that only tenured mem-bers of the Departmental Evaluation Committeeand non-tenured members who have completed atleast two (2) years of service at the College, shallbe eligible for such membership on a DivisionalCommittee. Moreover, only those members of eachDivisional Committee v.ho are tenured shall beentitled to consider and vote on the cases offaculty who are candidates for tenure. DeportmentChairmen shall not be eligible for membershipon the Divisional Committees.Each representative to a Divisional Committee onRe-Appointment, Promotion and Tenure shall servein that cap:.-Ay for so long as he or she continuesto serve as a member of the Departmental FacultyCommittee on Faculty Evaluation.In the event such representative is unable or un-willing to serve, the Departmental Faculty Com-mittee on Faculty Evaluation shall promptly electanother of its members to represent the depart-ment on the Divisional Committee,

4. Faculty Committees The All CampusCommittee

Membership:The All Campus Committee shall be establislledto coordinate the activities of the three (3)Campus-Wide Committees and the Committee

on Governance Review, established below. TheMI-Campus Committee shall consist of nine (9)faculty members, together with five (5) studentsand one (1) administrator as set forth in C andD in Article VII. Faculty membership shall bechosen as follows: The President of the Federa-tion who shall serve as Chairman and eight (8)faculty members appointed by the President ofthe Federation with the approval of the Federa-tion's Executive Council.All appointments to the All-Campus Committeeshall be completed by May 15 of each academicyear and representatives shall serve on the All-Campus Committee for one (1) calendar yearcommencing immediately upon appointment.In no event, however, shall any representativeappointed to the All-Campus Committee by thePresident of the Federation serve simultaneouslyon any other Campus -Wide, Divisional or Stand-ing Committee described in this Agreement. Inthe event any representative appointed by thePresident of the Federation to the All-CampusCommittee shall be unable to serve, the Presi-dent of the Federation shall forthwith appointanother faculty representative to complete theterm of the retiring member.

Responsibilities:The All-Campus Committee shall, within thirty(30) days of the execution of this Agreement,establish a standing Committee on GovernanceReview which shall' consist of four (4) faculty,four (4) student cnd four (4) administrativerepresentatives as follows:The four (4) faculty members shall be appointedby the President of the Federation, upon ap-proval of its Executive Council; the four (4)students shall be oppointed by the President ofthe Student Government Association, upon op--proval of the Executive Council; and the four (4)administrative representatives shall be appointedby the President of the College. The terms ofoffice of each such representative shall be forthe term of this Agreement commencingmediately upon appointment. At the first me,ing of the Committee on Governance Revie%a Chairman of the Committee shall be electedby and from the member thereof.The Committee on Governance Review shall1) conduct an on-going study of the processesof governance and participation in decision

making which are set forth in this Agreement.2) by January 15 of each academic year,submit to the AO-Campus Committee on annualreport assessing the effectiveness of the proc-esses of governance set forth in this Agreementtogether with any recommendations by theCommittee on Governance Review for the im-provement of such processes.

Reporting ProceduresMoreover, each of lie three (3) Campus-WideCommittees and the Committee on GovernanceReview shall transmit all reports and recom-mendations directly to the All-Campus Com-mittee. Within thirty (30) calendar days of thereceipt of any report or recommendations of aCampus-Wide Committee, or any report orrecommendation of the Committee on Govern-ance Review, the All-Campus Committee shalltransmit such report or recommendations, to-gether with any comment or recommendation ofits, own, to the Dean and to the President of theCollege.

B. Post Election ProceduresThe Federation shall, within five (5) days aftereach and any of the aforementioned elections inArticle VII of this Agreement, give written noticeto the President of the names of each memberof each Committee so elected. The Federationshall likewise give written notice within five (5)days of the appointment or election of any personchosen to serve on a Committee in lieu of aresigned or disabled member.

C. Administrative MembershipFor the purpose of promoting good communicationand understanding, the President of the Collegeshall designate, at his discretion, one (1) repre-sentative of the College administration to eachof the three (3) Campus -Wide Committees and tothe All-Campus Committee. The Administrativerepresentative to the All-Campus Committee shallserve with vote; the administrative representativesto the three Campus-Wide Committees shall servewithout vote.

D. Student Participation in Decision Making1. Student Membership on Faculty CommitteesSubject to the conditions set forth in "3" and "4"below, full-time students in good standing shall

be eligible to be elected as members of the fol-lowing faculty committees:

(a) five (5) students shall be members of theCampus-Wide Faculty Committee on Curricu-lum established under Article VII A (2) hereof.(b) fifteen (15) students shall be members ofthe Campus-Wide Faculty Committee on Col-lege Development established under Article VIIA (2) hereof.(c) five (5) students shall be members of theCampus-Wide Faculty Committee on BudgetConsultation established under Article VII A (2)hereof.

(d) five (5) students shall be members of theAll-Campus Committee established under Arti-cle VII A (4) hereof.

Student membership on each Committee aforesaid,except the Committee on Governance Reviewwhose members shall be appointed, shall be deter-mined by a campus wide election to be conductedby the Student Government Association prior toMay 15 of each academic year. The student re-ceiving the highest number of votes cost for eachof the three campus wide committees and the All-Campus Committee shall be elected. Each studentelected shall serve a term of one (1) year com-mencing on May 15. If such student shall beunable or unwilling to serve, the President of theStudent Government Association shall appoint theperson who received the next highest number ofvotes in such election, or in the event there willbe no such person, the Student Government Asso-ciation shall hold a special campus wide electionin order to choose another student representativeto complete the term of the retiring member. Eachfull-time student shall be eligible to vote in thecampus wide election. The names and addressesof the students duly elected to membership on theCommittee aforesaid shall be transmitted in writ-ing by the Student Government Association tothe President of the Federation and the Presidentof the College within five (5) days of such election.

2. Student Committee on Faculty EvaluationThe parties recognize the contribution which stu-dent evaluation of teaching effectiveness maymake to the process of faculty evaluation. Ac-cordingly, the following provisions for such stu-dent evaluation hove been incorporated into this

Agreement. These provisions, however, are at theoption of the students, and any lock of partici-pation by students, following an affirmative voteder section 3 hereof, "Acceptance," shall natimpair any other provisions contained in thisAoreernent.hi addition to membership on Faculty Committeeses provided for In subsection D 1. above, students,except in the case of the College Library, also have

opportunity to establish Student Committeesas follows:

students who constitute the duly registeredmajors and minors within each Department,shall upon written petition of at least twentyper cent (20%) of such students to the StudentGovernment Association presented on or beforeOctober 15 of each academic year causethe Student Government Association to conducton election forthwith for the purpose of estab-lishing, within each such Department, a StudentCommittee on Faculty Evaluation. This Com-mittee shall consist of not more than five (5)students who hove received the highest num-ber of votes cast from the majors and minorswithin the Department. Each such student shallserve a term on the Student Committee onFaculty Evaluation of one (1) calendar yearcommencing immediately upon election. If anysuch student shall be unable or unwilling toserve, the President of the Student GovernmentAssociation shall appoint the person who re-ceived the next highest number of votes in suchelection, or In the event there shall be no suchperson, the Student Government Associationshall hold a special departmental wide electionin order to choose another student representa-tive to complete the term of the retiring mem-ber. The Committee shall elect its own Chair-man.The results of each such election shall be trans-mitted in writing to the Chairman of the De-partment for his information as well os to thePresident of the College and the President ofthe Federation within five (5) days of suchelection.

At the end of each semester, each departmentalStudent Committee on Faculty Evaluation shallcollect the results of student evaluation of theclassroom (i.e. teaching) effectiveness of facultymembers within the Deportment.

The Student Committee on Faculty Evaluationshall base its evaluation solely on the classroom(I.e. teaching) effectiveness.of faculty members.The results of the departmental Student Com-mittee's evaluation of each faculty member'steaching effectiveness shall be transmitted inwriting to the appropriate Faculty Committeeon Evaluation within each Department.Any faculty member whose teaching effective-ness is evaluated by a Student Committee onFaculty Evaluation, shall, upon request, be af-forded on opportunity to review any writtenmaterials pertaining to his evaluation, and toappear in person before the Student Committeeprior to the transmittal of the Student Com-mittee's evaluations to the appropriate depart-mental Faculty Committee on Evaluation. Theparties hereto expressly agree that the provi-sions of Article VII D (2) shall not be applica-ble to Librarians I thru V.

3. AcceptanceThe parties hereto expressly agree that the processof student participation as provided in this Articleshall be subject to acceptance of the terms of thisArticle to be evidenced by a vote of the studentbody which shall be determined by a referehdumto be conducted by the Student Government Asso-ciation at the College on or before May 1, 1972.Each full-time student shall be eligible to vote.A majority of those voting shall be required foracceptance.

Acceptance by such vote shall be for the termof this Agreement.The referendum question shall be as follows:

"Shall the students of Boston State Collegeparticipate in the governance of the College asset forth in the contract executed between theBoston State College Faculty Federation, Local1943, AFL-CIO and the Trustees? YesNo(Acceptance or rejection shall in no way effectthe status or entitlement of students to partici.pate in other duly authorized student or cam-pus organizations.)

4. EffectivenessAcceptance of this proposal by the Students ofBoston State College in accordance with the pro-visions of this Article VII, subsection D shall be a

condition precedent to the effectiveness of theterms of the said subsection D. Such non-accept-ance shall make the terms of Article VII, sub-section D null and void but shall in no way other-wise impair any other term of this Agreement.

E. Committee MeetingsEach of the Committees established in accordancewith the provisions of this Article shall meet regu-larly and at a time and place convenient to itsmembers in such a manner so as to permit it todiligently complete the work of the Committee.Each Committee shall elect a Chairman, and shallelect a secretary who shall maintain minutes,records, and reports of the Committee. Copies ofsuch minutes, records and reports shall be madeavailable to the Federation and the President ofthe College.Commencing May, 1972, no classes shall bescheduled by the College on any Wednesday dur-ing the academic year between the hours of 2:33p.m. and 4:30 p.m. for the purpose of providinga convenient time to the faculty to hold meetingsof the Committees described in Article VII of thisAgreement, or of any Committees of the FacultyFederation.

F. Compliance With Board Time SchedulesThe parties agree that any assignment, report,recommendation, or other action of any committeeprovided for in this Agreement shall be completedin compliance with the time schedules as may beestablished from time to time by the Board.Written notice of such time schedules shall beprovided by the President of the College to theChairman of the All-Campus Committee, the Presi-dent of the Federation, and the President of theStudent Government Association. Notice to theAll-Campus Committee shall be deemed to benotice to all other committees established in thisAgreement. In the event that any committee, hav-ing received such written notice, shall not haveso completed its work, the President, or the Board,as the case may be, may in the;r discretion makesuch recommendations, or take such action asthey deem to be required and the making of suchrecommendations or the taking of such actionshall not be in violation of the procedures setforth in this Agreement.

ARTICLE VIIIFACULTY APPOINTMENT,PROMOTION AND TENURE

A. The Process

(1) Departmental Committee.Each Department shall establish a Faculty Com-mittee on Faculty Evaluation consisting of theDepartment Chairman, ex-officio, and wheneverpossible, of tenured and non-tenured members asprovided in Article VII A (1); this Committee shallbe responsible for the annual evaluation of facultymembers within that Department. These Depart-mental Committees shall submit to the Chairmanwritten evaluations and may, in addition, includesuch recommendations, based on these evalua-tions, as they deem appropriate.Each faculty member within a Department shallbe evaluated at least annually on the basis of thefollowing criteria by the respective Faculty Corn-mittees on Faculty Evaluation: (a) classroom effec-tiveness, (b) professional activities including posi-tion of leadership, (c) research and publications,(d) contribution to the College community, (e) ad-vanced study and (f) leadership in communityaffairs. In the case of the evaluation of LibrariansI through V criterion (a) above shall mean profes-sional effectiveness.Each Faculty Committee on Faculty Evaluationwithin a Department, except the College Library,shall receive all evaluations and reports transmittedto it from time to time by the Student Committeeon Faculty Evaluation in the Department. It shalltake such student evaluation into account in per-forming its own evaluation of faculty members. Inthe case of a faculty member holding a joint ap-pointment who shall have elected to be evaluatedin accordance with the provisions of Article VIIA (1), such student evaluation shall be transmittedto the Department so elected by such facultymember. After completion of its work, the FacultyCommittee on Faculty Evaluation shall transmitits evaluations, and any recommendations, to-gether with the evaluations of the Student Commit-tee on Faculty Evaluation, directly to the Deport-ment Chairman.Any member of the faculty, upon a request inwriting to the Committee, may examine materials

pertaining to his evaluation, and shall be allowedto submit to the Committee any additional writteninformation relating to his evaluation; he shallalso be entitled to a conference with the FacultyCommittee on Faculty Evaluation to hear and dis-cuss the Committee's final evaluation prior to thetransmittal of such evaluation to the DepartmentChairman.(2) The Role of Department Chairmen in the

Process of Re-Appointment, Promotion andTenure

Each Deportment Chairman shall be responsiblefor transmitting annually in writing to the appro-priate Divisional Committee on Re-Appointment,Promotion and Tenure (a) all evaluation reportsand any recommendations from the Faculty Com-mittee on Faculty Evaluation and any evaluationsfrom the Student Committee on Faculty Evalua-tion, together with (b) all moteriols used by theDepartment Chairman in his evaluation and (c) hisown recommendations, os Chairman, concerningthe retention in rank, reappointment, promotionto a higher rank, tenuring, sabbatical leave, andseparation from service at the College of anyfaculty member. Any faculty member within theDepartment, upon a request in writing by suchfaculty member to the Deportment Chairman, maybe entitled to a conference with the DeportmentChairman to hear and discuss the Chairman'sevaluation and recommendation.

(3) The Divisional Committee on Re-Appointment,Promotion and Tenure

Each of the four (4) Divisional Committees on Re-Appointment, Promotion and Tenure shall reviewthe departmental evaluation reports and thespecific recommendations of the Chairman con-cerning each faculty member evaluated. If theDivisional Committee disapproves the recommen-dation of any Deportment Chairman, it shall meetwith such Chairman in conference to discuss thereasons therefor. If the Committee's decision ad-versely affects any faculty member, the Commit-tee shall provide on opportunity to such facultymember to meet privately to hear the Committee'srecommendations and reasons therefor.Within a reasonable time thereafter, the DivisionalCommittee on Re-Appointment, Promotion andTenure shall prepore in writing its own recom-mendations concerning the retention in rank, re-oppointment, promotion to a higher rank, tenur-

ing, sabbatical leave and separation from serviceof the College of any faculty member and shallforthwith transmit them to the Academic Dean to-gether with (a) the evaluation reports of the Stu-dent and Faculty Evaluation Committees withineach Department and (b) the evaluations andthe specific recommendations of the DepartmentChairman.Recommendations, however, concerning the grant-ing of tenure shall be transmitted by the Dirt.sional Committee to the Special Committee onTenure set forth in sub-section 6 of this article.

(4) The Academic DeanThe Academic Dean shall review the reports andrecommendations transmitted to him as aforesaid,and shall indicate in writing to the Divisional Com-mittee, without reasons, whether he disapprovesany specific recommendation made by that Com-mittee. The Dean, or his designee, shall meet,upon request with the Divisional Committee Inexecutive session to discuss his decision to disap-prove any specific recommendation of the Com-mittee. Following such conference, the Dean shalltransmit his own recommendation to the Presidentof the College together with (a) oll prior evalua-tion reports of bo.h the Student and FacultyEvaluation Committees within each Department and(b) the evaluations and specific recommendationsof the Deportment Chairman and (c) all specificrecommendations of the Divisional Committee onRe-Appointment, Promotion and Tenure.

(5) The President of the CollegeThe President of the College shell, at his discre-tion, transmit to the Board of Trustees any recom-mendations concerning the initial appointment,reappointment, retention in rank, promotion to ahigher rank, tenuring, sabbatical leave, separationfrom service at the College, or any other matterconcerning any faculty member.If, after conferring with the Personnel Com-mittee of the Board of Trustees, the Presidentshall decide to submit a final recommendationto the full Board which is contrary to the recom-mendations of the Divisional Committee, thePresident shall (a) duly note in his recommenda-tion to the Board the fact that it is contrary to theprior recommendation of the Divisional Commit-tee, (b) provide the Divisional Committee and the

Special Committee on Tenure by the Chair-man of the appropriate Divisional Committee. inon exceptional case the President of the Collegemay of his discretion appoint to the Special Com-mittee on Tenure one tenured person from an-other Institution of higher learning but in thesame academic discipline of the candidate.In the event that the Specie! Committee on Tenuredoes not concur with any recommendation modeby the Divisional' Committee, the 4ecial Com-mittee on Tenure shall confer with the DivisionalCommittee and provide the candidate for tenurewith an opportunity to meet with it privately todiscuss its decision.The final recommendation for granting tenureshall be made by the President to the Board.

B. Criteria for Re-Appointmert, Promotionand Tenure

In evaluating and/or recommending faculty forappointment, reappointment, promotion, retention,separation from the College, sabbatical leave, ortenure, the Departmental Committees, the De-portment Chairman, the Divisional Committee, theDean, the President, the Special Committee onTenure, and others shall at all times apply thosepolicies of the Board on Appointment, Promotionand Tenure wh:h ore expressly incorporated InArticle XVII of this agreement.

ARTICLE SXFACULTY WORKLOAD, SCHEDULINGAND COURSE ASSIGNMENTSMembers of teaching staff of the Collegeshall riot be required to teach an excessive number

of semester hours of teaching, assume an exces-sive student load, or be assigned an unreasonableschedule, it being recognized by the parties thatthe teaching staff has the obl!ootion among othersto be available to students, to assume committeeassignments, and to engage in research and/orcommunity service. For purposes of this Agree-ment twelve (12) semester hours of Instructionshall be considered the normal average facultyworkload in academic subject areas; efforts shallbe mode to assign faculty workloads on this bogsprovided it is feasible or possible to do so In thejudgment of the President or his designee; simi-larly, the normal average class size shall be con-sidered thirty (30) students per section; effortsshall be mode to schedule class size on this basisprovided it is, in the judgment of the Presidentor his designee, possible or feasible to do so.Moreover, efforts shall be mode to establish teach-ing schedules, so that the time between the be-ginning of the first teaching period and the endof the lost for any one day does not exceed eight(8) hours. In addition, where special equipment isrequired for classes, efforts shed, be made, whenpossible, to limit the number of students to theamount of this special equipment( available.

The determination of faculty workload" includingthe assignment of specific courses art schedulesshall be mode by the Chairman of each ekcodemicDepartment respectively, after consultation withthe Departmental Committee on Faculty Work-load, Scheduling and Course Assignments as estab-lished under Article VII A (1). Each such Depart-mental Committee shall prepare a table showingclearly the relation of noeteoching equivalencyassignments to the heads of teaching sections andshall submit it for approval to the DeportmentChairman.In determining faculty workloads and In makingassignments the Chairman shall consider:

(a) The Qualifications and Preferences of theFaculty.

(b) The Character of the Course as to whetherit Is being offered he the first time or withextensive revision, and the number of timesthe faulty member hos taught it in the post.kJ Semester Hours of Instruction as to whetherthey are lectures, recitations or laboratorieswhich require a great deal of preparation.

(d) Number of Students as to whether the timerequired by the course is directly related to thenumber of students (e.g. if term papers arerequired, the number of students is directlyrelated).(e) The Number of Preparations. Where possi-ble, the number of preparations of an individualfaculty member should not exceed two.(f) Special Courses and Projects. Joint Coursestaught by two or more faculty members orspecial problem courses for individual studentsmust be related to overall teaching load.(9) Other Duties. Due consideration will begiven to equivalent non-teaching duties includ-ing Department Chairmanship, Presidency ofFederation, Administration or other Committees,special administrative duties, or in-service workwith groups in the State.(h) Seniority. Tho krgth of service of the indi-vidual faculty n -.tuber within the State Col-leges or any other regionally accredited insti-tution of higher education shall be a positivefactor for consideration in the assignment ofcourses and schedules.

ARTICLE XCURRICULUMEach Departmental Committee on Curriculum asestablished in Article VII A (1), shall formulateproposals from time to time with respect to thecurriculum needs within its own Department in-cluding proposals for the development of newacademic courses and programs and any changesin Departmental structures.

The Committee shall consider suggestions for cur-riculum development from the administration, theDeportment Chairman, individual faculty membersand students, and shall, from time to time, makesuch recommendations to the Campus Wide Corn-mitte. on Curriculum os it deems appropriate.The Campus Wide Committee on Curriculum,as established under Article VII A (2), herein,Shall review oll recommendations from the respec-tive Departmental Committees on Curriculum andshall act as a coordinating agency for curriculumdevelopment among all Departments at the Col-

lege. If the Campus Wide Committee on Curricu-lum shall disapprove a recommendation of anyDepartment, it shall meet with the DepartmentalCurriculum Committee to discuss its decision. TheCampus Wide Committee on Curriculum shalltransmit to the All Campus Committee any recom-mendation of its own affecting curriculum.If the All Campus Committee shall disapproveany recommendation of the Campus Wide Com-mittee on Curriculum, the Chairmen of both Com-mittees together with at least two (2) membersthereof shall meet to discuss the decision. TheAll Campus Committee shall tronsmit in writingany recommendation of its own concerning cur-riculum to the Deon and to the President of theCollege. If the President of the College shall dis-approve any recommendation of the All CampusCommittee, he shall meet with the Chairman ofthe All Campus Commit/cc and at least two (2)members thereof in conference to discuss his de-cision. The President shall, within his discretion,make any recommendations affecting curriculumto the Board as he deems appropriate.

ARTICLE XICOLLEGE DEVELOPMENTThe Campus Wide Committee on College Develop-ment as estoblished under Article VII A (2), shollprepare recommendations for:

1. Improving the system and practices used forfor the admission of students to the College.The Committee shall consult with among othersthe President of the College, the Dean, theRegistrar, the Dean of Admissions, DepartmentChairmen, faculty and students and others whocan provide relevant information.2. Improving the practices and policies used inrecruitment of faculty.3. Matters to be included on the CollegeCalendar.4. Improving faculty evaluation procedures.Specifically, the Campus Wide Committee onCollege Development shall:

(a) By October 1, 1972 Develop a question-naire to be used by students to evaluatefaculty members with respect only to theirclassroom (i.e. teaching) effectiveness. Thisquestionnaire shall be submitted not later

than October 1, 1972 to any existing StudentCommittees on Faculty Evaluation and to eachFaculty Committee on Faculty Evaluationwithin each Department, as well as to eachDeportment Chairman for distribution infor-rnationdly to other department members.The Student Committee on Faculty Evalua-tion, if any, and the Faculty Committee onFaculty Evaluation within each Departmentshall meet for the purpose of revising andadopting the questionnaire, if required, tomeet any special needs of that department.Either the original questionnaire developedby the Campus Wide Committee on CollegeDevelopment, or the original questionnaireas revised and/or adapted, shall be used byany Student Committee on Faculty Eva lua-tion for the purpose of obtaining studentevaluation of faculty classroom (i.e. teaching)effectiveness.

(b) By November 1, 1972 Develop and sub-mit to the All Campus Committee proposalsfor the general improvement of the currentprocedures used for evaluating faculty includ-ing, principally, proposals for better measurement of teaching performance of both ten-ured and non-tenured faculty, and proposalsfor improving the participation of students infaculty evaluation.

ARTICLE XIICONSULTATION ON COLLEGEBUDGETThe purpose of the Campus Wide Committee onBudget Consultation, as established under ArticleVII A (2), shall be to provide on opportunity forconsultation with the President of the College orhis designees with respect to the development ofthe College budget as it progresses from the Ad-ministration of the College to the Board of Trus-tees to the Executive and finally to the Legislativebranches of the State Government. Specifically,the Campus Wide Committee on Budget Consul-tation shall assist the Academic Departments inthe preparation of plans and proposals concerning:

(o) The requirement for new teaching staff atthe College in order to meet the anticipatedincrease in student enrollment.

(b) The analysis of cost for new educationalprograms and projects within each Deportment.(c) The expansion of the Department in otheracademic areas commensurate with the statedobjectives of the Department and of the Col-lege.

In addition, the Committee shall develop proposals,based on adequate study and analysis, includingestimates of cost, for the improvement of physicalfacilities and supportive services for faculty. Inpreparing their recommendations, the Committeeshall be guided by the following objectives whichthe parties to this Agreement recognize as desir-able goals to be achieved for the welfare of allfaculty at Boston State College:

(a) To provide substantial reduction in the num-ber of foculty assigned to a single office.(b) To provide on office for each DepartmentChairman.(c) To provide each office with suitable andsufficient desks, choirs, files, bookcases, andother necessary professional equipment.(d) To improve the availability of secretarialservices for individual faculty.(e) To provide efficient telephone services tofaculty and departmental offices so that theability to dial intercom is adequate.(f) To provide suitable, properly maintainedand adequately protected parking focilities forall faculty membere.(g) To provide adequate dining and loungeareas for faculty in the College's several build-ings.(h) To provide separate reading and studyareas for faculty in the library.(i) To provide for adequate heat, light, ventila-tion, janitorial services, security, and surveil-lance of all offices, classrooms, laboratories,and other College facilities.

The Campus Wide Committee on Budget Consul-tation shall transmit any such proposals or plansto the All Campus Committee for review and sub-sequent transmission to the President of the Col-lege.

The Campus Wide Committee on Budget Consul-tation shall meet with the President or his desig-nees from time to time for the purpose of discuss-

ing informationolly the development of the budgetrequests being prepared by the College for submis-sion to the Board of Trustees for any given fiscalperiod.

-ARTICLE XIIIEXTRA DUTIES OF FACULTYA. Qualifications for Program of Continuing

Studies1. The necessary qualifications for teaching anycourse or program in the existing Program of Con-tinuing Studies shall not be less than those re-quired for teaching of the day college, except that,at the discretion of the President, such qualifica-tions may be waived for faculty teaching specialcourses.

B. Student Advising by Faculty1. Faculty Advising assignments will be made byDepartment Chairmen with due consideration tothe interest and competence of the faculty mem-ber in this work.2. Students shall be admitted to on ocodemicmajor by registering with the Deportment Chair-man. No student who possesses the minimumacademic requirements for entry to a major andwho is in good standing or retention status sleollbe denied admittance unless a major is over sub-scribed and has temporarily ceased acceptingmajors.3. Students who ore not admitted as majors in

department shall be advised through the officeof the Dean of Students.

C. Other1. New, inexperienced faculty members, who arepreparing courses for the first time, shall when-ever possible, be exempt from extra duties, exceptof their own request.

ARTICLE XIVFACULTY GRIEVANCE PROCEDUREA. IntentThe Board and the Federation agree that they willuse their best efforts to encourage the informaland prompt settlement of grievances which mayarise between a member of the faculty or the

Federation and the Board by use of the processesset forth below.

B. DiefinitionA grievance is a complaint by a member, or mem-bers, of the faculty or the Federation, upon themajority vote of a duly constituted meeting ofthe Executive Council thereof brought during theterm of this Agreement, that an express provisionof this Agreement, or of any of the written policiesof the Board which are expressly incorporated byreference in Article XVII of this Agreement, hasbeen violated in its application to him or theFederation, as the case may he.

C. Procedures for the Filing of a GrievanceAny aggrieved member or members of the facultyor the Federation filing a grievance under thisArticle shall file it in accordance with the fol-lowing procedures:

STEP 1 (informal): The Academic DeanAn aggrieved member or members of the faculty,or the Federation, as the case may be, shall meetand confer with the Academic Dean, or his desig-nee, within two (2) days of written notice by thegrievant to the Academic Dean of a complaintthat a grievance exists to attempt to resolve suchcomplaint informally. Ao complaint shall be filedmore than fourteen (14) calendar days from theday or event upon which the grievance is basedor from the dote when the faculty member or theFederation hod or sLiould have hod knowledge ofthe event. If the Dean and the grievant shall nothove resolved the complaint within five (5) daysof such notice then the grievant may proceed toStep 2.

STEP 2 (Formal): The Academic DeanThe grievant shall set forth in writing fully andcompletely the complaint, and the remedy re-quested and shall file the some with the AcademicDean. In addition, any and oIl supporting ,docu-ments and materials shall be filed in written format the time of the filing of the complaint. Thecomplaint shall be signed by the member or mem-bers of the faculty. No complaint shall be filedmore than fourteen (14) calendar days from theday or event upon which the grievance is basedor from the dote when the faculty member or the

Federation had or should have had knowledge ofthe event.The Academic Dean and the grievant shall thereupon meet and discuss the complaint and griev-once as presented. If the grievance is not resolvedwithin seven (7) calendar days of such filing withthe Academic Dean to the satisfaction of thegrievant, the grievant may proceed to Step 3.

STEP 3: The President of the CollegeWithin the seven (7) day time limit, the grievantmay file with the President of the College a writ-ten request for a conference together with a copyof the complaint and all other material filed bythe grievont with the Academic Dean, and a copyof any written response or decision by the Aca-demic Dean.

Within seven (7) calendar days of the receipt ofsuch filing by the grievant, the President, or hisdesignee, shall confer with the grievont. The Presi-dent shall within fourteen (14) calendar days ofthe receipt of the grievance render a written de-cision to the grievant setting forth his findingsand the reasons therefor, and shall provide o copyof such decision to the grievant, and to the Presi-dent of the Federation.

STEP 4: The Board of TrusteesThe grievant may within seven (7) days after thereceipt of the decision and finding of the Presi-dent, or upon the failure of the President to actwithin the time specified, file with the Board onlya grievance arising out of or relating to:

1. A failure to comply with any of the follow-ing: a) the procedures set forth in this Agree-ment except as hereinafter provided; b) theprovisions of Article V; c) the written policiesof the Board which ore expressly incorporatedby reference in Article XVII of this Agreement,except those relating to appointment, promo-tion and tenure; d) the procedural due processprovisions expressly set forth in the Board'spolicy on Appointment, Promotion and Tenureincorporated by reference in Article XVII of thisAgreement, provided, however, that grievancesrelating to reappointment, promotion or tenurewhich ore concerned with matters of academic

judgment may not be processed by the grievantbeyond Step 3; or2. A failure of the President of the College tohave recommended the granting of tenure toa faculty member who has met all of the writ-ten requirements for tenure as set forth in theBoard's policy on Appointment, Promotion andTenure incorporated by reference in ArticleXVII of this Agreement, and who has been dulyrecommended for tenure both by the DivisionalCommittee on Reappointment, Promotion andTenture as established in Article VII and bythe Special Committee on Tenure as establishedin Article VIII.

Such grievance shall be filed with the Director ofthe Division of State Colleges, as agent of theBoard, and with the President of the College inthe form and in accordance with the proceduresset forth in Step 2. In addition, the grievant shallfile a copy of the decision and findings of thePresident of the College.

No other grievance may be filed with the Board.

The Board shall consider such grievance and shallwithin sixty (60) days of the receipt thereof asprovided aforesaid render its decision. Writtennotice of its decision shall be provided to the griev-ant, the Federation, and the President of theCollege. Nothing herein contained shall be deemedto require a hearing before the Board, except asexpressly provided in the Board's policy on Ap-pointment, Promotion and Tenure incorporated byreference in Article XVII.

Appointment of e FederationRepresentative

Any member of the faculty may request that theFederation represent him of any step of the griev-once procedure, The Federation shall notify theDean of the College, the President of the Collegeand the Director of the Division of State Colleges,os the case may be, of the name and address ofsuch Federation representative at the time he isso authorized to represent the grievant.

Compliance with ProceduresNo grievance may be filed except in the form andin accordance with the procedures set forth inthis Article.

D. Waiver, Admission, and Termination1. WaiverFailure to comply with any provisions of thisArticle shall be deemed to be a waiver of thegrievance under the terms of the Agreement.The limit specified in the grievance proceduremay, however, be extended in any specific in-stance by mutual written agreement of theparties.

2. AdmissionThe acceptance of a grievance by the Dean ofthe College, the President of the Co liege, orthe Board of Trustees, or their agent, shall notbe deemed to be on admission by the Boardthat the grizvance has, for any other purposeor proceeding, standing as a grievance or con-stitutes on admission of any violation or breachof the terms of this Agreement, or is cognizableor justicable according to any applicable provi-sions of the lows of the Commonwealth.

3. TerminationIf any party to this Agreement or any memberof the faculty shall initiate any proceedingrelating to a grievance in any administrativeor judicial forum while a proceeding relating tosuch grievance is pending under any provisionof sub-section C of this Article, such sub-sectionC proceeding shall terminate as of the dote ofthe initiation of any other administrative orjudicial proceeding and the provisions of thisArticle shall be inapplicable to such grievance.

ARTICLE XVNO STRIKE PLEDGE

The Board agrees that it will nat lock out any orall of its employees for any cause during the termof this Agreement, and the Federation and itsugunts agree that they will not engage in, induce,or encourage any strike, work stoppage, slow-down or withholding of services by the faculty.

Nothing contained in this Article shall be deemedto waive, impair or restrict the right of the Boardto seek or pursue any remedy at low or equityprovided by the Lows of the Commonwealth.

ARTICLE XVISTATUTORY RES PON SI BI LM ESOF THE BOARDAll management rights and functions, except thosewhich are clearly and expressly abridged by thisAgreement, shall remain vested exclusively in theBoard. Nothing contained in this Agreement shallbe deemed or construed to impair or limit thepowers and duties of the Board under the laws ofthe Commonwealth.

ARTICLE XVIITHE POLICY MAKING AUTHORITYOF THE BOARD OF TRUSTEESThe parties hereto expressly agree that the fol-lowing enumerated Board policies are incorporatedinto this Agreement, for the purpose of this Agree-ment, and that these enumerated policies, andthese policies only, shall not be altered or amendedby the Board, as they apply to Boston State Col-lege, during the term of this Agreement withoutthe express consent in writing of the Federation.These policies enumerated below ore attached tothe Agreement as Appendix B and mode o porthereof:

1. The Board's policy on Appointment, Promo-tion and Tenure, os amended and revised toand including March 15, 1972.2. The Board's policy on Non-discrimination.3. The Board's policy on Academic Year.4. The Board's policy on Academic Freedomand Responsibilities as set forth In Article Vof this Agreement.

ARTICLE XVIIIDURATIONA. DurattsaiThis Agreement shall be effective liar the periodfrom April 3, 1972 to June 30, 1974.The parties agree to commence negotiations for arenewal Agreement no later than .one hundred-twenty (120) days prior to the termination doteset forth above.

B. ExtentThe Board and the Federation acknowledge thatduring the negotiations which resulted in thisAgreement, each hod the unlimited right andopportunity to make demands and proposals withrespect to any subject or matter not removed bylow from the applicable area of collective bar-gaining, and that the understandings and agree-ments arrived at by the parties after the exerciseof that right and opportunity o'e set forth in thisAgreement, and shall constitute the sole agree-ment between the parties for the duration thereof.Therefore, the Board and the Federation for thelife of this Agreement each voluntorily and un-qualifiedly waives the right, and agrees that theother shall not be obliged, to bargain collectivelywith respect to any subject or matter not speci-fically referred to or covered in this Agreement,

even though such subject or matter may not havebeen within the knowledge or contemplation ofeither or both parties of the time they negotiated,or signed, this Agreement.

ARTICLE XIXSAVING CLAUSEIf any of the provisions of this Agreement shallin arty manner conflict with or contravene anyFederal Low or Statute, Low or Statute of theCommonwealth of Massachusetts or the rules andregulations promulgated pursuant thereto, suchprovisOns shall be considered null and void andshall no be binding on the parties hereto; in suchevent, the remaining provisions of this Agreementshall remold In full force and effect.

PREAMBLE TO POLICYON APPOINTMENT, PROMOTIONAND TENURE

In adopting and promulgating the attached policyon appointment, promotion and tenure, the Boardof Trustees recognizes that this document is amajor, if somewhat, imperfect step forward indetermining personnel policy for faculty membersin the State Colleges. As changing conditions forfurther clarification require, amendments and fur-ther annexes will be provided.Definition relating to this policy:

"Teaching faculty member" shall mean anymember of the professional staff of the statecolleges of the rank of instructor, assistant pro-fessor, cssociate professor, professor or visitingprofessor whose duties involve the instructionof students in classes, laboratories, seminars orother instructional situations."Termination" shall mean the permanent sever-ance of on existing employment relationshipinitiated by the college or the Board of Trus-tees."Tenure" shall mean the right of the teachingfaculty of the State Colleges to be removedonly upon just cause, to a hearing upon dismis-sal and to such review as is provided in thispolicy.

Furthermore, it is the policy of the Board of Trus-tees of State Colleges not to approve a salary forany faculty member or professional administratorbeyond the maximum salary range for the posi-tion as approved by the Board of Trustees.

Moreover, the attached policy is also based onthe express understanding that

A. Contracts for non-tenured faculty are termagreements subject to renewal by the Board ofTrustees upon recommendation of the President,who makes his recommendation after the com-pletion of the established evaluation procedures.

Appointment and PromotionTeaching faculty members may be appointed initi-ally at any rank in keeping with minimum require-ments. These requirements apply to faculty mem-bers in the nine state colleges and to persons inthe academic departments of the MassachusettsCollege of Art and the Massachusetts MaritimeAcademy. Exceptions to these requirements maybe made in certain specialized areas and underother special circumstances with the approval of.the Board of Trustees. Nothing in these require-ments should be construed to prohibit the appoint-ment or promotion of an individual of exceptionaltalent or accomplishment who does not meet allthe stated criteria. In reviewing such recommen-dations for exceptional appointments, or promo-tions, the Board of Trustees shall give due con-sideration in the alternative to: (a) evidence ofthe ability of the candidate to render a uniqueacademic contribution to the college, or (b) evi-dence of a candidate's extraordinary competencein the area of his discipline or specialty, or (c)evidence that the discipline or specialty of thecandidate does not customarily demand fulfillmentof those academic degree requirements set forthby the Board as minimum criteria for appointmentor promotion to each rank.

C. Associate Professora. A doctor's degree from an institution ac-credited at the doctoral level and in theacademic or professional discipline to betaught.b. Six years' experience of which at leastthree must have been in higher education.

D. Professora. A doctor's degree from an institution oc-credited at the doctoral level and in theacademic or professional discipline to betaught.b. Eight years experience of which at leastfive must hove been in higher education.

E. Academic Dean Some as Professor.

II. Appointment Procedures and Terms1. Instructors will ordinarily be appointed tosuccessive one-year terms with proper noticebeing given in the case of termination (seeSection 111). No one will remain in the rank ofinstructor more than five years. Prior to thebeginning of hie fifth year, an instructor will begiven written notice that:

a. he is to be promoted to the rank of assis-tant professor at the beginning of the nextyear, orb. he is beginning a terminal one-year ap-pointment.

In short, an it. is "up or out" at the endof five years.2. Persons initially appointed above the rankof instructor may be given initial appointments,without tenure, of one, two or three years. Suchcontrocts may be renewed for one, two or threeyears. Those initially appointed as assistant pro-fessors may not be employed beyond six con-secutive years without gaining tenure.

3. Persons initially appointed at the rank ofassociate or full professor may be appointed foran initial one, two or three year term withouttenure, or may be appointed initially withtenure. No person initially so employed mayserve more than three years without gainingtenure.4. Persons appointed as Visiting Professors shallbe employed for a specified period of time andshall not attain tenure.5. Precise conditions of employment shall bestated in writing with a copy to be provided tothe appointee.

.11. TerminationDue notice of intention to terminate non-tenureappointments must be given.

a. Termination after first year notificationby March 1 of first year.b. Termination after second year notifica-tion by December 15 of second year.c. Termination after 3 or more years noti-fication by September 1 of final year.

IV. Promotion1. Promotion elan be based on:

- a. Minimum requirements. (See Section Iabove)b. Annual evaluation of all faculty members.c. Recommendations by local joint facultyand administrative processes.

2. Promotions shall normally take effect at thebeginning of an academic semester or term.

V. Faculty EvaluationA. There will be an annual evaluation madeof each faculty member with a written recordkept of the substance of the evaluation. Theevaluation wil: be mode by a committee whichshall include: the Chairman of the individual'sdeportment, Academic Dean and/or Presidentand one other tenured member of the faculty.Each college has the option of establishing someother evaluation system acceptable to the Trus-tees.B. In general, faculty members will be evalu-ated an the following bases:

1. Classroom effectiveness.2. Professional activities including positionsof leadership.

3. Research and publication.4. Contribution to the college community.5. Advanced study.6. Leadership in community affairs.

C. Annual faculty evaluations will serve os thebasis for promotion, merit pay and tenure con-sideration.

TenureThe granting of tenure to a faculty member isthe single most important type of decision madeIn on educational institution. Barring unforeseencircumstances, tenure obligates the institution tothe employment of the faculty person for the bal-ance of his professional life. It not only makes amajor financial commitment to the individualuntil retirement, but even beyond. It must be ac-complished with the utmost of care, concern andsearching evoluation by the administration of theinstitution.I. Entitlement

A. No person holding the rank of instructorshall gain tenure.B. Any faculty member other than instructorwho serves the college for more than six con-secutive academic years shall thereby gaintenure.C. Any person promoted from within any insti-tution in the State College system to the rankof Associate or full Professor shall thereby gaintenure without regard to the length of hisservice.D. Persons initially employed as Associate orFull Professors may be granted tenure on ap-pointment. In the event of on initial non-tenureterm appointment to either rank, the individualmay not serve for more than three years with-out thereby gaining tenure.E. No person serving in the capacity of a Visit-ing Professor shall gain tenure.

-F. Once attained, tenure is transferable fromone institution under the Board of Trustees ofState Colleges to another.G. Presidents, Deans, Deportment Chairmln andother administrators do not have tenure in theiradministrative positions although they mayretain tenure as faculty members.

II. Evaluation for TenureA. When a person is being considered for atenure appointment, whether by promotion fromwithin or appointment from outside, a thoroughevaluation of his achievement and potentialshould be made in each case by a special adhoc committee, including: the president, theocadEmic dean, the department head, a tenuredmember of the some department, a tenuredmember of another department. (In an excep-tional case, the president is empowered to em-ploy as c consultant and member of the ad hoccommittee, a tenured person in the same aca-demic discipline in another institution of higherlearning.)

B. Evaluation by the ad hoc committee will beaccomplished in such timely fashion as to pro-vide proper notice to those individuals who arenot to be re-employed.

Ill. Removal of a Tenured PersonA. A tenured person, without regard for themeans through which he attained tenure, shallnot be removed from his position except forjust cause and through due process.B. Removal of a tenured person shall be sub-ject to the following procedures:

1. The person must be advised in writing, atleast ten days in advance of any hearing, ofthe charges to be presented.

2. The charges must be presented at a hear-ing to a committee composed of tenured peersfrom the faculty and representatives fromthe college administration. The person maybe represented by counsel.3. The recommendation of this committeemust be forwarded to the Board of Trusteeswith all necessary records.4. On written request of the individual, theBoard of Trustees will grant the individuala full hearing.5. The individual will be given at least thirtydays notice of the hearing with the Board ofTrustees. He may be represented by counsel.6. A transcript of the proceedings of allhearings will be made available to the indi-vidual upon written request.

IV. Effective bate of Tenure PolicyA. This tenure policy shall apply to all facultymembers whose period of service began afterSeptember 25, 1965.B. Individuals formally granted tenure prior toSeptember 25, 1965, will continue to enjoy therights and privileges accorded them under Sec-tion 48 of Chapter 73 of the General Lows.C. Individuals employed on other than termappointment prior to September 25, 1965, butwho had not formally been granted tenureunder Section 4B of Chapter 73, but who weregranted what is tantamount to tenure byChapter 572 of the Acts of 1965, are deemedby the Board of Trustees to have achievedtenure granting them the following rights:

1. A hearing before the Board of Trusteesconcerning dismissal charges.2. 'Thirty days written notice of such hearing.3. Representation by counsel.4. A transcript of all proceedings to be madeavailable on written request.

D. For those individuals first employed afterSeptember 25, 1965, time served prior to Janu-ary 1, 1968, will be considered as meeting inpart the requirements for academic rank andtenure.

V. Appointment, Promotion and TenurePolicy AmendmentsI. At the time when notice is given to non-tenured faculty members that their contractsare not to be renewed, a statement shall begiven to them setting forth the reasons for suchnon-renewal. Under no circumstances, however,shall either (1) a notice of non-renewal of con-tract, or (2) a statement setting forth the rea-sons therefor, be given to cny non-tenuredfuculty member without prior approval of theBoard of Trustees (eff 1/13/72)II. No faculty member on less than full-timeservice will be eligible for tenure. (eff. 2/12/70)Ill. Full-time public school teachers, who serveas part-time training school teachers for thecolleges, shall not be eligible for tenure at thecollege. (eff. 2/12/70)IV. Leaves of absence for non-tenured personsshall not interrupt service towards tenure, nor

should they count towards tenure. (eff. 2/12/70)

V. Members of the staff at the State Collegeson leaves of absence for whatever reason shallrelinquish their rights to take port in officialcampus activities, inciuding voting privilegesand committee meetings. (eff. 4/9/70)VI. Leaves of absence for professiono! staff atthe State Colleges may be granted for o oneyear period but for not more than two consecu-tive year. (eff. 4/9/70)VII. Professional staff members at the StateColleges on leave of absence shall not be eligi-ble for promotion or merit increase until theirreturn to the college. (eff. 4/9/70)VIII. All professional appointments to thelibraries sholl be on a 12-month basis, effectiveJuly 1, 1971. All persons now on 12-monthoppointments will remain on such a calendar,and those on an academic year calendar mayhave the option of remaining on the academiccalendar or going on to the 12-month calendarwith on appropriate salary adjustment. Libra-rians at ranges V, IV, and Iii shall be eligiblefor tenure and other fringe benefits ordinarilyaccorded teaching faculty in accordant s- withBoard policy. (eff. 1/)4/71)

IX. Special Amendment applicable only tofaculty at the rank of instructor whose initialappointment occurred between September 25,1965 and December 31, 1967.

I. Effective Date. This amendment shall beeffective between February 11, 1971 endDecember 31, 1973 inclusive. As of January1, 1974, thir amendment shall be deemedrepealed, and 1.s provisions shall be null andvoid.II. Authority Granted. During the effectiveperiod of this amendment, ofcresaid, thePresident of any state college is authorizedto recommend to the Trustees, in his abso-lute discretion, the reappointment of afaculty member who meets all of the follow-ing requirements:

1) who was granted an initial full-timeappointment to the rank of instructor be-

tween September 25, 1965 and December31, 1967, and2) who has served continuously and satis-factorily at the rank of instructor since thetime of his initial appointment, and

3) who, prior to the beginning of his fifthyear of continuous service at the college,has mot completed the minimum require-ments for promotion to assistant profes-sor -- namely master's degree in theacademic or professional discipline to hetaught from on accredited institution ofhigher education, plus 30 additionsl grad-sate credits acceptable to the college.

Ill. lesppointnstint Procedures and Conditions.The following special procedures and conditionsshall be controlling in recommending any focultymember for reappointment who meets the re-quirements described In Section II above:

1) notice, if any, of his reappointment atthe rank of instructor shall be given notlater than April 1, 1971, April 1, 1972, andApril 1, 1973, as the case may be.2) each such faculty member shall give writ-ten notice to the President of his agreementto complete at least 12 graduate credithours, acceptable to the college, within 15months after each such notice of reappoint-ment.3) each such foculty member shall be sub-ject to evaluation in February 1972, andFebruary, 1973. Such evaluation will be con-ducted by a committee composed of thefaculty member's deportment chairman, theacademic dean and/or the President, and oneother tenured member of the faculty. In eachsuch evaluation, the committue shall give dueconsideration to the faculty member's prog-ress in satisfactorily completing the minimumdegree and credit requirements as describedaforesaid. os well as to such additional fac-tors as (a) classroom effectiveness; (b) Pro-fessional activities, including positions ofleadership; (c) research and publications; (d)contribution to the college community; le)advanced study; and (f) leadership in com-munity affairs.

4) such evaluation committee shall transmitto the President the results of its evaluation,and a recommendation not later than March1, 1972, and March 1, 1973, as the casemay be, either (a) that the faculty memberbe reappointed for one additional academicyear, of (b) that the faculty member not bereappointed.

5) in the event that the evaluation conanit-test recommends that the faculty member bereappointed for one additional academicyear, the President of the college, if he con-curs with the committee, may transmit hisrecommendation to the Board of Trustees forreappointment provided, however, that suchfoculty member first

(a) gives written notice odor to March 1,1972, and March t, 1973, to the Presi-dent of his agreement to complete at hest12 graduate credit hours, acceptable tothe college within 15 months of notice ofhis reappointment, and(b) agrees to be subject to evaluation inthe following February In accordance withthe terms and procedures, and by a com-mittee composed of those members de.scribed above in subsection 3.

6) in the event that the evaluation commit-tee recommends that the faculty member notbe reappointed, the President shall notifysuch foculty member by April 1, 1972, andApril 1, 1973, as the case may be, that hewill not be reappointed for on additionalacademic year.

7) not later than December 31, 1973, allsuch faculty members shall hove been givenwritten notice, notwithstanding any foregoingprovision of this amendment to the contrary,that:either

(a) he is to be promoted to the rank ofassistant professor;

or(b) he is not to be reappointed for onacklitione.1 acodemic year.

It is the intent of this provision to insurethat all such faculty members at the rank
