    DOMESTIC ENQUIRIES, CHARGE SHEETS, CONDUCT OF

    ENQUIRY AND AWARD OF PUNISHMENT

    The first and prime step is to have preliminary investigation to find out the prime-faciecase of misconduct against the delinquent employee.

    When prime-facie case of misconduct is established, the following stages of disciplinary

    action should be followed: -

    1. Show-cause otice

    !. "ssue of #harge Sheet and calling upon e$planation%. #onsideration of e$planation

    &. 'iving otice of (nquiry into the charges when e$planation found unsatisfactory). (nquiry into the #harges*. +eciding as to who should conduct enquiry

    a +eciding how to proceed

    b +eciding about e$amination of evidence

    c ecording /indingd 0n conclusion of enquiry, asing 2resenting 0fficer and +efence

    epresentative to submit arguments

    e Submission of (nquiry 2roceedings to +isciplinary 3uthority

    4. +ecision of punishment

    5. #ommunicating punishment decision to delinquent employee and giving anopportunity to present himself before +isciplinary 3uthority to hear the

    punishment,

    6. /inal 0rder of 2unishment.

    Issue ! Char"e Sheet #

    1. The #harge Sheet Should be properly worded

    !. +ate, time, place of its commission and other relevant facts should be given%. "f standing orders are in force, the #harge Sheet should be in consonance with the

    standing orders.

    &. The proposed punishment may be mentioned). The employee should be ased to submit e$planation within specified period.

    *. The #harge Sheet should be issued under the signature of +isciplinary 3uthority

    4. The #harge should be properly served.a When the worman is present, it should be handed over and his signature

    should be obtained.

    b "f he refuses, the duplicate may be signed by the person who is authori7ed

    to handover the #harge Sheet , recording therein the fact of refusal andsignature of two persons should be obtained, confirming the above fact.

    The letter communicating punishment should contain:-

    a eference to the letter of #harge Sheet issued to the delinquent employee,

    b eference to the finding of the enquiry,c +ecision to punish or not and

    d +ate from which the punishment shall ne effective.
