    I S CN THIT V C S PHP L

    I.1 S CN THIT

    thc hin cng tc quan trc mi trng Thnh ph H Ch Minh; hng nm Trung tm Quan trc v Phn tch mi trng

    (trc y l Chi cc bo v mi trng) u phi xy dng k hoch quan trc trnh S Ti nguyn v Mi trng ph duyt

    trc khi thc hin. Trong ni dung ca k hoch hng nm khng th thiu mc kinh ph thc hin.

    Trc y, khi xy dng kinh ph thc hin k hoch quan trc hng nm, chi ph phn tch mu thc hin theo Thng t s

    83/2002/TT-BTC ngy 25/9/2002 ca B Ti Chnh v quy nh ch thu, np v qun l s dng ph, l ph v tiu chun o lng

    cht lng. T nm 2010, Thng t s 83/2002/TT-BTC ngy 25/9/2002 ca B Ti Chnh ht hiu lc, v vy chi ph phn tch

    mu khng p dng theo Thng t s 83/2002/TT-BTC nu trn m thc hin theo Thng t 232/2009/TT-BTC ngy 09/12/2009 v

    Quy nh mc thu, ch thu, np, qun l v s dng ph y t d phng v ph kim dch y t bin gii. n ngy 15 thng 01 nm

    2014, B ti chnh ban hnh Thng t s 08/2014/TT-BTC v vic quy nh mc thu, ch thu, np, qun l v s dng ph y t d

    phng, kim dch y t. V vy t u nm 2014 n nay, chi ph phn tch cc thng s mi trng c p dng theo thng t nu

    trn. Tuy nhin, vic p dng theo Thng t 232/2009/TT-BTC trc y v thng t s 08/2014/TT-BTC ca B Ti chnh khng

    thc s ph hp vi hot ng quan trc v phn tch mi trng.

    Trong hot ng quan trc v phn tch mi trng Anh v cc nc theo h tiu chun Anh (nh c, Hng Kng, Thailand,

    Malaysia, Singapore...), nh mc quan trc v phn tch mi trng c xc nh theo thnh phn v tnh cht ca mi cng vic.

    Cc ch tiu nh lng v hao ph lao ng, hao ph thi gian s dng my mc thit b, hao ph vt t ho cht, dng c v cc yu t u vo khc hon thnh 1 n v sn phm (1 thng s phn tch mi trng) theo ng tiu chun cht lng quy nh, c

    thc hin theo 2 giai on: giai on quan trc ly mu hin trng v giai on phn tch x l, tnh ton kt qu trong phng th

    nghim. Trong giai on quan trc o c v ly mu hin trng c tnh ton bng phng php thng k cc ngun lc theo t in

    thc hin ti hin trng i vi cc mu chn. Cn giai on phn tch v x l s liu, tnh ton kt qu trong phng th

    nghim c thc hin trn c s xy dng tiu chun phn cp phng th nghim v c xc nh bng phng php phn tch tnh

    ton kt hp vi phng php th nghim. Cc ch tiu nh lng ny do cc Hip hi hoc T chc chuyn ngnh bin son, cn cc

    C quan c thm quyn ca Nh nc ch ban hnh cc ch tiu gi.

    BTNMT ngy 18/4/2008); tnh n thng 06/2014 c khong 20 tnh/thnh ph ban hnh n gi sn phm hot ng quan trc v

    phn tch mi trng thc hin cng tc quan trc hng nm trong tnh/thnh ph, c th: tnh ng Nai (nm 2009); Bnh nh,

    Bnh Dng, ng Thp, H Tnh, Lm ng, Nam nh (nm 2011); Bc Ninh, Ha Bnh, Ninh Thun, Qung Nam, Qung Ninh,

    Thi Bnh, (nm 2012); Bc Giang, Nng, Tr Vinh, Sc Trng (nm 2013), H Ni nm (2014).

    Thnh ph H Ch Minh c nhng c trng ring v mi trng cng nh n gi nhn cng cng khc so vi cc tnh, v

    vy vic xy dng b n gi quan trc mi trng ring cho Thnh ph H Ch Minh l cn thit thc hin cng tc quan trc mi

    trng ca Thnh ph.

    I.2 C S PHP L

    - Lut Bo v mi trng ngy 29 thng 11 nm 2005;

    - Ngh nh s 204/2004/N-CP ngy 14 thng 12 nm 2004 ca Chnh ph v ch tin lng i vi cn b, cng chc, vin

    chc v lc lng v trang;

    - Ngh nh s 205/2004/N-CP ngy 14 thng 12 nm 2004 ca Chnh ph quy nh h thng thang lng, bng lng v ch

    ph cp lng trong cc Cng ty Nh nc;

    - Ngh nh s 66/2013/N-CP ngy 27 thng 06 nm 2013 ca Chnh ph quy nh mc lng c s i vi cn b, cng chc, vin chc, v lc lng v trang;

    - Quyt nh s 69/2013/Q-TTg ca Th tng Chnh ph ngy 19 thng 11 nm 2013 Quy nh v c ch iu chnh mc gi

    bn l in bnh qun;

    - Thng t s 05/2005/TT-BNV ngy 05 thng 01 nm 2005 ca B Ni v hng dn thc hin ch ph cp trch nhim cng

    vic i vi cn b, cng chc, vin chc (theo Ngh nh s 204/2004/N-CP ngy 14 thng 12 nm 2004 ca Chnh ph);

    - Thng t lin tch s 01/2008/TTLT-BTNMT-BTC ngy 29 thng 4 nm 2008 ca lin B Ti nguyn v Mi trng B Ti

    chnh v hng dn lp d ton cng tc bo v mi trng thuc ngun kinh ph s nghip mi trng;

    - Thng t s18/2010/TT-BTNMT ngy 04 thng 10 nm 2010 ca B Ti nguyn v Mi trng quy nh v nh mc s dng

    din tch nh xng, thit b v bin ch cho trm quan trc mi trng;

    - Thng t lin tch s 30/2010/TTLT-BTNMT-BNV ngy 25 thng 11 nm 2010 hng dn xp ngch v xp lng vin chc

    ngnh ti nguyn v mi trng;

    - Thng t s 45/2013/TT-BTC ngy 25 thng 04 nm 2013 ca B Ti Chnh hng dn ch qun l, s dng v trch khu hao

    ti sn c nh;

    - Thng t s 07/2013/TT-BNV ngy 31 thng 7 nm 2013 ca B Ni v hng dn thc hin mc lng c s i vi cc i

    tng hng lng, ph cp trong cc c quan, n v s nghip cng lp ca ng, Nh nc, t chc chnh tr - x hi v hi c

    tnh cht c th;

    - Cn c Thng t s 25/2014/TT-BTC ngy 17 thng 02 nm 2014 ca B Ti chnh v quy nh phng php nh gi chung i

    vi hng ha dch v;

    trch nhim cng vic, ph cp lu ng v ph cp c hi, nguy him i vi vin chc quan trc ti nguyn mi trng; iu

    tra c bn Ti nguyn nc;

    - Quyt nh s 32/2008/Q-BTC ngy 29 thng 05 nm 2008 ca B Ti Chnh v ch qun l, tnh hao mn ti sn c nh

    trong cc c quan nh nc, n v s nghip cng lp v cc t chc c s dng ngn sch nh nc;

    - Cc quy nh hin hnh ca Nh nc v mc ng np cc ch bo him bt buc, quy nh v gi bn in bnh qun;

    - Theo chi ao cua Uy ban nhn dn Thanh ph tai cng vn s 5906/UBND-TM ngay 15 thng 11 nm 2012.

    - Theo chi ao cua Uy ban nhn dn Thanh ph tai cng vn s 2339/UBND-TTM ngay 26 thng 05 nm 2014.

    - Theo chi ao cua Lanh ao S tai thng bao s 7879/TB-TNMT -VP ngay 26 thng 12 nm 2012 ca S Ti nguyn v Mi

    trngv vicChi cuc Bao v mi trng nhanh chong xy dng hoan thin va trinh Uy ban nhn dn Thanh ph ban hanh n

    TM ngay 15/11/2012.

    - Theo chi ao cua Lanh ao S tai thng bao s 417/TB-TNMT -VP ngay 16 thng 01 nm 2014 ca S Ti nguyn v Mi trng

    v vic Trung tm nhanh chng xem xt, hon thin B n gi Quan trc cht lng mi trng Thnh ph H Ch Minh trnh

    Ban gim c S t chc hp thm nh, trnh Uy ban Nhn dn Thnh ph ph duyt.

    II MC CH CA VIC XY DNG B N GI

    - Nhm xy dng b n gi quan trc mi trng ph hp vi yu cu php l v thc tin qun l mi trng ca Thnh ph H Ch Minh theo ng vi cc quy nh hin hnh ca Nh nc Cng ha X hi Ch ngha Vit Nam.

    - L c s php l p dng n gi quan trc (bao gm ly mu v phn tch) cho cc chng trnh quan trc mi trng c s

    dng ngun vn ngn sch v ph dch v quan trc mi trng i vi cc ngun ngoi ngn sch.

    III NI DUNG CA B N GIA

    III.1 CC HOAT NG MI TRNG V CC THNG S TRONG B N GI

    Tnh n thi im hin ti, B Ti nguyn v Mi trng ban hnh 08 thnh phn mi tr ng bao gm : Khng kh xung

    quanh , nc mt lc a , t , nc di t , nc ma a xt , nc bin (nc bin ven b v nc bin xa b ), kh thi v phng x .

    Trong b n gia quan trc mi trng thanh ph H Chi Minh ch tp trung xy dng n gi cho 7 hot ng quan trc mi trng

    cn thit nht 01 thnh phn cn li (t) s c xy dng b sung sau.

    So snh cc thng s quan trc c quy nh trong cc nh mc kinh t k thut ban hnh vi cc thng s quan trc quy nh

    trong cc Quy chun Vit Nam v mi trng tng ng (QCVN 05:2013, QCVN 26:2010, QCVN 08:2008, QCVN 09:2008, QCVN

    19:2008, QCVN 43:2012, QCVN 44:2012,) thy c s chnh v thng s quan trc nh ghi phn ph lc 1.

    Tuy nhin, c y c s tnh ton, trong b n gi quan trc mi trng Thanh ph ch thc hin xy dng cho 7

    thnh phn mi trng vi s lng 291 thng s c quy nh trong cc nh mc kinh t - k thut ban hnh km theo Thng t

    s 18/2014/TT-BTNMT ngy 22 thng 04 nm 2014 ca B Ti nguyn v Mi. Cc thnh phn mi trng vi cc thng s quy

    nh nh sau:

    (1) Khng kh xung quanh va ting n : 17 thng s (nh du ct s 3 trong bng ghi phn ph lc 1);

    (2) Kh thi cng nghip: 22 thng s trong co 3 thng s kh tng, 17 thng s kh thi, 2 thng s c tnh ngun thi;

    (3) Nc mt lc a: 30 thng s trong c xy dng thm: 05 thng s hin trng thc hin ly mu ng thi (nhit ,

    pH, DO, c v EC) v 8 thng s kim loi nng thc hin phn tch ng thi (Pb, Cd, Hg, As, Fe, Cu, Zn, Mn, Cr);

    (4) Nc di t: 32 thng s trong c xy dng thm: 05 thng s hin trng thc hin ly mu ng thi (nhit , pH,

    DO, c v EC) v 9 thng s kim loi nng thc hin phn tch ng thi (Pb, Cd, Hg, As, Fe, Cu, Zn, Mn, Cr);

    (5) Nc bin (128 thng s):

    + Nc bin ven b (64 thng s): 34 thng s trong nc bin trong c xy dng thm: 03 thng s hin trng thc hin

    ly mu ng thi (pH, DO v EC) v 11 thng s kim loi nng thc hin phn tch ng thi (Pb, Cd, Hg, As, Fe, Cu, Zn,

    Mn, Mg, Ni, Cr (IV), Cr (VI)), 19 thng s trong trm tch, 11 thng s sinh vt bin;

    + Nc bin xa b (64 thng s): 34 thng s trong nc bin trong c xy dng thm: 03 thng s hin trng thc hin

    ly mu ng thi (pH, DO v EC) v 11 thng s kim loi nng thc hin phn tch ng thi (Pb, Cd, Hg, As, Fe, Cu, Zn,

    Mn, Mg, Ni, Cr (IV), Cr (VI)), 19 thng s trong trm tch, 11 thng s sinh vt bin;

    (6) Nc ma axit: 15 thng s trong c xy dng thm: 03 thng s hin trng thc hin ly mu ng thi (nhit , pH,

    v EC) v 5 anion thc hin phn tch ng thi (Cl-, F, NO2

    -, NO3

    -, SO4

    2-);

    (7) Phng x (47 thng s): 11 thng s ng v phng x trong sol kh, 09 thng s ng v phng x trong ri lng, 08 thng s

    ng v phng x trong mu t, 10 ng v phng x trong mu nc v 09 ng v phng x trong mu sinh vt, thc

    phm.

    Da theo cac cng thc tinh toan ghi muc III.2, kt qua tinh toan b n gia c th hin chi tit trong phn ph lc 2 vi

    kt cu gm 07 thnh phn mi trng (khng kh xung quanh v ting n, kh thi cng nghip, nc mt lc a, nc di t ,

    nc bin (nc bin ven b v nc bin xa b), phng x v nc ma a xt). n gi tng thng s ca cc thnh phn mi

    trng c tng hp t 4 nh mc sau:

    o nh mc kinh t k thut v nhn cng;

    o nh mc kinh t k thut v dng c;

    o nh mc kinh t k thut v thit b;

    o nh mc kinh t k thut v vt liu,

    1. KT LUN

    B n gia quan trc mi trng Thanh ph H Chi Minh c xy dng da trn cac inh mc kinh t k thut ca B Ti nguyn va Mi trng ; da trn n gia dung cu , thit bi , vt t do cac cng ty cung ng trn ia ban Thanh ph cung cp .

    Trong qua trinh thc hin xy dng b n gia quan trc mi trng Thanh ph H Chi Minh , chng ti gp phi mt s kh

    - Xin bao gia t cac Cng ty cung ng thit bi , dng c , vt t : V Trung tm Quan trc v Phn tch Mi tr ng mi c thanh

    lp, cha co phong thi nghim nn it giao dich vi cac Cng ty cung ng cac dich vu nu trn . Do o , vic xin bao gia gp nhiu kho khn va chm tr .

    - Cc chuyn vin tham gia xy dng b n gi ca Trung tm hu ht cha tri qua cng tc trong phng th nghim quan trc

    mi trng nn kho phat hin ra nhng bt hp ly trong cc bng nh mc tnh n gi .

    - Cc nh mc kinh t k thut cho hot ng quan trc mi trng theo Thng t 18/2014/TT-BTNMT con co mt s im

    cha hp ly . V d nh mc vt liu kh Argon trong quan tr c ni nghip mi trng nc mt, nc bin ven b qu cao v khng

    ng nht, hay inh mc vt liu canh thang lactose LT , canh thang BGBL i vi thng s Coliform trong quan trc ni nghip mi

    trng nc cao gp hn 10 ln so vi thc t , nh mc ca giy lc bng xanh cho mt s ch tiu cng cao rt nhiu ln lm nh

    hng trc tip n gi thnh ca tng ch tiu, cc nh mc v nin hn khu hao dng c cng khng ng nht nh Micropipet

    - Qu trnh xy dng B n gi chc chn khng trnh khoi nhiu sai st , rt mong c s x em xt, thm nh ca cc c

    quan chc nng c thm quyn chnh sa v hon thnh b n gi chnh thc trnh Uy ban nhn dn thnh ph ph duyt. - Qu trnh thm nh v ph duyt b n gi phi tri qua s xem xt, thm nh ca nhiu c quan chc nng ca Thnh ph.

    Do thc y nhanh tin hon thnh vic ph duyt, S Ti nguyn v Mi trng cn nhn c s hp tc, h tr ca cc

    c quan ban ngnh c lin quan.
