THE PURPOSE OF THE CCTS DORMSThe purpose of the CCTS Dorms is to provide a traditional home-living environment to students attending Crow Creek High School. We are not a Therapeutic dormitory, so we may not be able to meet the needs of all students. All student applications will be reviewed by a dormitory committee to determine if the CCTS Residential Program can meet each student’s residential needs. A waiting list will be used as applications come in to the CCTS Dorms for the new school year.

PHILOSPHY OF THE CROW CREEK DORMITORYIt is the Philosophy of the Crow Creek’s residential life program that every resident, employee and guest, possesses the right to reside within a safe and healthy living environment that is conducive to motivating and supporting the personal, social, mental and spiritual growth and development of its residents.It is the unethical responsibility of the entire residential living community to protect and promote the values underlying the principle and to participate in creating, developing and exhibiting the positive attitude necessary and creating a home-like atmosphere with the foremost care and concern of the students within every action demonstrated and taken within the residential community.To make this Philosophy come alive, all Dormitory Staff and Administration will focus their efforts on the following objectives:

1. To help students acquire and appreciate of their Native Culture identity; to identify and encourage the development of a positive self-identity.

2. To help students develop and acquire a sense of personal pride, high self-esteem and self-worth by increasing their personal and cultural self-awareness.

3. To help student with their emotional growth and development as part of their personal well-being experience.

4. To help students develop an ability to get along with others, relate to other students, to be respectful of others and their belongings and be recognized as socially responsible individuals.

5. To help students learn to relate and trust adults and be respectful of adults.6. To prepare students in becoming responsible citizens.7. To help students learn to become productive, independent and self-sufficient individuals.8. To help students develop good home-living skills and learn to accept personal responsibility.9. To create and sustain an environment that is safe, caring and nurturing for the students who live within the

dormitory.

RIGHT TO AMENDThe Administration, in conjunction with the CCTS School Board reserves the right to amend this handbook at any time during the school year. Parents/Guardians will be informed about any amendments that may be adopted.

ELASTIC CAUSEIt is understood that this handbook cannot cover the myriad of events that may arise. If the case is not covered in this handbook, the Home Living Specialist and the Dorm Counselor will deal with it in the best of interests of the dorm and the student and in accordance with the Tribal and Federal Laws. All students and staff are expected to display the values of Respect, Generosity, Wisdom and Courage.

FAMILY EDUCATION RIGHTS AND PRIVACY ACTIn compliance with the provisions and confidentiality granted under the Family Education and Privacy Act of 1974 (FERPA), the Crow Creek Tribal School and Dormitory have the following policy regarding parents’ access to students’ records.The purpose of this policy is to provide you with information regarding your rights under the Family Education and Privacy Act (FERPA). Parents of students, CCTS adult students (FERPA), parents of students, CCTS adult students (those 18 or over), and former students who wish to review any or all of the school records pertaining to the student should contact the building principal for an appointment. The records will be reviewed with school personnel and parents may have copies of the records at no cost. If parents or adult students believe something in the records is inaccurate or misleading, they may request that it be corrected or they may have comments added to the record. If the principal and the parent or adult student (18 years of age or older) cannot agree, the parent or adult student may contact the superintendent for a hearing.

FERPA also allows school districts to identify certain information as “directory information” which may be released without prior consent by a parent or an adult student. Crow Creek Tribal Schools considers the following to be directory information: A students’ name, address, telephone number, date and place of birth, dates of attendance, participation in extra-curricular activities, degrees, honors, exams, etc.If you do not wish this information released without consent, please contact the building principal by September 15th

of each school year. If the Crow Creek Tribal School Principal or Designee is not contacted by September 15th, it will be considered that this means you have no objections to the release of information.

RIGHTS OF STUDENT & STAFFEvery student/staff has the right to be in an environment that is safe and conducive to learning in which he or she feels respected and protected.

PARENT/GUARDIAN RESPONSIBILITYIt is important for the Parent/Guardian to encourage their child to achieve by doing the following:

1. Encourage their child to attend school regularly and arrive on time.2. Supports the school in its efforts to maintain proper discipline. 3. Encourage their child to do homework.4. Encourage their Childs’ efforts and is aware of his/her interests and keeps the lines of

communication open.

EMERGENCY BEHAVIORAL HEALTH/MEDICAL PROCEDURES1.) Dormitory staff must address immediate needs of students, making sure they are not injuring

themselves or others.2.) Dormitory staff must immediately contact appropriate behavioral health professionals, EMT’s (as

appropriate), I.H.S., and/or Law Enforcement.3.) Dormitory staff shall attempt to contact Family/Guardian as soon as possible and appropriate.4.) Dormitory staff must provide continuous supervision of student until the emergency is resolved; or the

student is removed by Law Enforcement, EMT’s or proper Social Services staff.5.) Dormitory staff must contact Home Living Specialist and complete appropriate Paperwork/Reports

concerning the Incident.

VIOLENCE FREE SCHOOL/DORMITORYViolence is any mean word, look and sign or act that hurts a persons’ body, feelings or things. Injury or discomfort is based on how it is received, regardless of the intent. Violence in the School/Dorm is unacceptable and will not be tolerated.

DRESS CODEIt is each student’s responsibility to be clean and neatly dressed while in the school and public places within the dormitory. Apparel must meet with health and safety codes, be in good repair, and not interfere with the educational and residential living processes. Any questions concerning appropriateness of dress will be handled on an individual basis. Failure to meet the dress code will result in the students being asked to change into appropriate clothes provided by the school or dormitory. Dorm Student will be sent back to the dormitory to change. The following list is not all inclusive but gives examples of inappropriate student dress:

Clothing that displays derogatory, obscene, suggestive or off-colored messages or advertises/promotes alcohol, tobacco or drug use.

Clothing that is unnecessarily distracting in the school and learning and/or dormitory environment. Low riding jeans pants or shorts that permits undergarments or skin to show. Even when a shirt is used to

cover the top of the jeans, it is unacceptable to wear jeans with the waist below the bottom of the tailbone. Clothing that is cut up, shredded or full of holes. Undergarments that are worn as outer garments. Tops or shirts that do not touch the top of the jeans or skirt. Tops, such as mesh tops, that permit undergarments to be seen. Tops that are excessively revealing or permit excessive exposure. Tank tops must have high backs, high

necklines, and small arm hole and cover all undergarments and straps. Wearing a hood will not be allowed in the dorms, or in the middle or high school. Bandanas are not allowed and will be confiscated.

Caps may not be worn during meals (in the cafeteria, or when on trips). BODY PIERCING AND TATTOOS ARE PROHIBITED WHILE IN THE DORMITORY.

BULLYING POLICY(CCTS POLICY [approved 9/10/11; amended 11/02/11]-fully policy available at Dorms/School)Everyone at Crow Creek Tribal Schools is committed to making our school and dorms a safe and caring place for all students. We will treat each other with respect, and we will refuses to tolerate bullying. In addition Cyber Bullying even if it occurs off school grounds, which creates a hostile environment at school and at the dorms or school-related activities for the intended victim, infringes their rights at school or materially and substantially disrupts the education process or orderly operation of a school will not be tolerated.

HARASSMENT OR SEXUAL HARASSMENT/VIOLENCEThe school acknowledges its moral and legal obligation to ensure that its students and staff are not subjected to Harassment/Bullying of any kind. The school is committed to providing a safe, secure learning and working environment in which Harassment does not occur; and where all members of the community are treated with Dignity, Courtesy and Respect. All students and employees are required to honor and support this commitment.The school will act to investigate all complaints (formal, verbal or written) of Sexual Harassment or Sexual Violence and to discipline any student or employee who sexually harasses or is sexually violent to a student or employee of the school system. If harassment does occur and is detected or reported, the school is committed to its effect and early invention through the provision of appropriate and the disciplinary action.

STUDENT CHECK OUT PROCEDUREPolicy: Only immediate family members can check-out dorm students. Immediate family is defined (as Mother, Father, Legal Guardian, Sister, brother, Grandparent, aunt or uncle.) This person must be at least 25 years of age [BIE guidelines].

Other Check-Out Procedures: The Parent/Guardian wishing for a student to have a check-out privileges by a family member (in addition

to themselves), agrees to release the CCTS Schools, Dorm and School Board of an liability associated with the check-out.

Check-out requests via telephone will not be approved, except in situations where a family emergency involving a serious illness or death of an immediate family member is involved.

Students who are on Dorm Restriction may only be checked out by the Parent/Legal Guardian. Students are reminded that they may not be check out over-night proceeding a school day unless it is by a

parent or legal guardian. Students who are eighteen (18) year old or older will follow the same checkout guidelines for all dormitory

students. When a student checks out on a Friday (with an immediate family member other than their Parent or Legal

Guardian) he/she should return back to the dormitory on Sunday night no later than 9pm The person checking out the students needs to be on the Notarized Check out list provided by the Parent/Legal Guardian.

The Parent or Legal Guardian must check out local students who leave for an overnight trip to Fort Thompson.

Dorm students may NOT check out with another student, or other students’ parents, unless they are listed on the approved notarized check-out form on file with the dormitory.

During special school events such as Homecoming, Prom, etc., only a Parent or Legal Guardian may check out their own child (ren).

Students cannot check out while they are on a Recreation Trip (off-campus) unless with a Parent or Legal Guardian. Prior arrangements must be made in writing and in advance of the trip, with Dormitory Staff on duty. A Check out form will be given to the Recreation Staff prior to leaving the School Campus for the trip.

If Dorm student will be checking out during school hours the Parent/Guardian must check out student at the Dormitory.

If the Dorm student is involved in a relationship they will not be allowed to check out with Parents/Legal Guardians or family members of the person they are in a relationship with.

Any changes of names being added or deleted from a check-out form must also be notarized and approved by the Home Living Specialist. This notification must be hand-delivered to the dorm or received by mail. Faxes will not

be accepted. Unless there is such documentation on file in the dorms, students will be allowed to leave campus only for scheduled dorm or school activities. Crow Creek Tribal School Staff are not to check out off reservation students from the dorms and keep them over night. Off reservation students can only check out with staff for the day if they are on the students’ approved and notarized check out form. These students must return to the dormitory by 9pm or be counted AWOL.Any staff working here on the Crow Creek Tribal Schools who has a daughter or son who is involved in a relationship with another student residing in the dorms is prohibited from checking out the student who resides in the dorms. Approved by School Board on 2/09.

TRANSPORTING STUDENTSTransporting students home will be determined by the Home Living Specialist and the Superintendent; depending on the emergency or situation. Students will be transported to the point where they are picked up for school and released to their Parent or Legal Guardian.In the event of emergencies involving a Death, Funeral or Critical Illness of an Immediate Family Member (defined as Mother, Father, Legal Guardian, Sister, Brother, Grandparent, Aunt or Uncle), the dorm and school will work with the family to assist when needed.Students will be transported in school vehicles to and from campus for school-related trips, dorm recreation trips, medical appointments and scheduled vacation breaks. The school will not be responsible for transporting non-boarding students when the dorm students are transported home for vacation.

Transportation Note to Parents/GuardiansIf your child is sent home by the school or dorm as consequences involving their behavior, it is your responsibility to bring them back to the dorm.

CANTEEN HOURSOpen daily as posted on bulletin. One recreation staff will always be on duty when opened. Seniors will be given the opportunity to assist in the Recreation Area while it is open. The Recreation Staff may close the Canteen anytime when the students do not adhere to reasonable standards of behavior. When students break the rules, the Recreation Staff person on duty will write an Incident report and give this to the Dorm Staff, placing the student on Restriction, or following guidelines related to the infraction. A copy of the Incident Report will also go to the Dormitory Counselor and Home Living Specialist.The Canteen will be closed during any school-sponsored activity and during recreation trips. The Canteen will close during meal times, during student study times or during recreational activities as scheduled by the Recreation Staff.Recreations trips are scheduled for Fridays or Saturdays, (Sundays may sometimes may be included) unless there are school-sponsored activities or other days when school is not in session as scheduled.

RECREATION PROGRAM & COMMITTEEA Recreation Committee shall be made up of seniors, Recreation Staff & Home Living Specialist to place the upcoming week’s activities on the calendar. The goal of this committee is to have input on the activities that the students will have every two weeks.Off-campus trips are planned for twice-a-month. Students with Minor or Major Infractions during a given week will not be allowed to go on off-campus recreation trips if scheduled on the weekend. Students who, during a recreation trip, (1) go AWOL (leaving the supervision of the Dorm Staff), (2) are caught stealing/shoplifting, or (3) in possession/use of tobacco products, alcohol products, controlled substances or drugs (including prescription drugs not approved by the school nurse and administered by Dorm Staff, will be restricted from attending future trips in addition to other consequences. The length of the restriction will depend upon the severity of the Incident.

HONOR SOCIETYStudents must be in upstanding with their Grades and No Major Infractions to be eligible for Honor Dorm. An Honor Dorm application is made available for them from the Dormitory Counselor. All necessary signatures must be filled out on form from the Teachers, Counselors, and Dorm Staff & Home Living Specialist before returning to the Dorm Counselor. Honor Dorm students will have Honor Dorm privileges and must be in good standing with the Dorm rules as well as maintaining a “B” average.

Each dorm student will be assigned a detail by the Dormitory Staff and it will be necessary that it be completed in time to get to school or other activities on campus during the weekend. Details are changed every two (2) weeks. You will be assigned to help in the Dining Hall, Dormitory and the campus. We must all be courteous and respectful to each other. Details will be monitored by the Dormitory Staff twice a day. Assigned seniors will also check to see that details are satisfactorily completed on a daily basis. Seniors are expected to be positive role models for the under classmen and are expected to supervise the assigned details, seniors deciding to be Supervisors will not be assigned a detail. Should a senior decide that they do not want to be a Supervisor; they will be assigned a detail as well. If students in one room do not complete their assigned details, including their own room, the entire room will be placed on restriction until the details are completed and approved.

STUDY HOUREvery student will be required to attend a study hour from 4:00-5:00 pm from Monday through Thursday, additional time can be requested by student. If students do not have homework to complete, they will be required to read. (Both Educational and Cultural reading materials will be provided for students.) Students will be required to attend an additional student hall (Monday-Thursday) if their names are on the school “D” (deficiency) list. When available, the dorm will provide tutoring between 4:00-5:00. Participation in study hours is not an option. The Dorm Counselor and Recreation staff will assist Dormitory Staff to monitor the study hour(s). Students may be assigned study hall locations by the Dorm Staff.

COMPUTER USEComputers are for school homework assignments and other school related work. Students are no allowed to be on any websites hat have been restricted by the school. Rules for computer use will be posted in the Computer room. Students caught violating Compute Rules will be put on Restriction.

RETURNING TO THE DORM DURING SCHOOL DAYStudents will not be allowed in the dormitory during school hours unless they have a statement (or telephone call) from a School Administrator requesting that the student be allowed to enter the dorm for a specific reason. Day students are not allowed to return with a dorm student if dorm student does need to return to the dormitory for any reason. A dorm student dismissed for medical reasons from school will be able to return to the dormitory for the remainder of the school day. When the student returns to the dormitory, the student will remain in their room. These students will not be allowed to attend after school activities or participate in Canteen/Recreation activities.

PHONE SERVICECell phones and/or any electronic devices (iPods’, iPads, Tablets, etc.,) must be turned into the Dorm Staff no later than 9:00pm on school nights and 12:00am on non-school nights (e.g. weekends). This applies to all students who do not have Senior Status or Honor Dorm privileges. Phones and electronic equipment may be checked back out after 6:00am on weekends or after school. Students who do not follow these guidelines in regards to the phones, the following rules will be applied:

1st time-Student will be placed on Restriction n for one (1) to three (3) days. Phone will not be returned to student while he/she is on Restriction.

2nd time-Student will be placed on Restriction for three (3) to seven (7) days. Phone will be sent home to Parent/Guardian. Student will lose “Phone Privileges” for the remainder of semester.

These cell phones, phone numbers and electronic devices (iPods, iPads, Tablets, etc.,) must be registered with the Dorm Staff. Failure to register your phones and electronic equipment or to check them in as required will result in the loss of privileges to use your equipment. Office phones and cordless phones are for the parents to call dorms or for business calls. The Dorm Staff on duty can assist the students who are requesting to call home. Each student is allowed to two (2) phone calls per week with a limit of five (5) minutes. Students who do not limit their phone calls to five (5) minutes will lose phone privileges. Dorm Staff/Counselor on duty will allow any other urgent phone calls at his/her discretion Dorm Staff/Counselor will use one (1) telephone log to monitor weekly phone calls per student. Cyber-bullying via texting will result in loss of phone privileges.

The Crow Creek Tribal Schools are not responsible for any Electronic Equipment, such as Televisions, DVD players, Stereos, iPods, iPads, Tablets, etc., that are brought into the school/Dormitory. If you choose to have these items in the Dormitory, you will be responsible for them. They need to be locked up or taken with you when you leave the Dormitory. Please mark them appropriately for identification purposes. If they are stolen, broken, damaged or marred in any way, it is NOT the responsibility of the school to monitor, replace or repair them. Crow Creek Tribal Schools/Dormitory is not responsible for replacing stolen items.Only students who have earned their Senior Status privileges or Honor Dorm Status privileges will be allowed to have TV’s/Game boxes in their dormitory rooms.

MEALSAll students will be required to attend all meals served in the cafeteria. (Breakfast and Supper during the week, and both Brunch and Supper on weekends or when school is not in session.) This ensures that the students are eating nutritious meals daily.

BULLETIN BOARDRead the notices, which are posted on the bulletin boards for student information. It is the student’s responsibility to read the information that is posted. An annual calendar listing important dates, activities, athletic events and holidays for the year will be available on the bulletin boards located in the Dormitories, in the Hallways and in the Recreation Area.

RECEIVING AND SENDING MAILWhile you are at Crow Creek Tribal School, your mail should be addressed as follows:

Students should not receive cash in the mail. Have parents send money orders in the mail. The Crow Creek Tribal School is not responsible for cash sent through the mail.

MEDICATIONAll medications must be checked in to the Dorm Staff on duty. The staff will make sure the Nurse gets the prescribed medications so they can be logged into a medication chart. It will be the student’s responsibility to be at the office to get their medication during the times posted. If the student fails to arrive for his/her medication or refuses to take the medication, the Dorm Staff should document this on the Medication Chart and write a referral to the Nurse’s department.Non-prescription medications also need to be turned in to the Dorm Staff or Nurse. No type of medications should be kept in dorm room. This includes; Tylenol, Midol, any Pain Relievers of any type, Diet Pills, or any Over-The-Counter drugs. No non-prescription drugs will be dispersed by the Dorm Staff. Dorm Staff should review the medication chart daily per shift. Students using inhalers will be responsible for their own use.

ENERGY DRINKSAny form of Energy Drinks is prohibited in the dorms due to health concerns. Any student having Energy Drinks in their possession will result in the following:

Written Verbal Warning. Placed on Restriction after a Verbal Warning.

SEARCH & SEIZURE POLICYUnder no circumstances will School/Dorm staff conduct a strip search.

All students have the right to a reasonable degree of Privacy, but the Privacy does not extend to the endangerment of the Health and Safety of other students and staff. The school recognizes and will preserve the student’s right to privacy and security of personal effects. However, it is the inherent right of the Crow Creek Tribal School Officials or Dormitory Personnel to inspect each room, student locker and other storage spaces for safety and health hazards and/or violation of school/dormitory regulations. School Officials or Dormitory Personnel have the authority to conduct searches of individual student(s) and the student’s property. Authority for these searches may be exercised

as needed in the interest of safeguarding students, staff, student’s property and school property. The student’s personal effects including suitcases, bags, storage containers backpacks, purses, or wallets will not be searched without the student’s presence and permission unless there is a clear indication with reasonable suspicion that a Law or School Regulation has been broken. Reasonable suspicion provides that School/Dormitory Officials are not under more stringent conditions of Probable Cause as are Law Enforcement Officials. A School Resource Officer is also covered under the conditions of reasonable suspicion when directed by a School Administrator.If an actual student search is deemed necessary, a staff member of the same sex as the student and with the same sex witness must do the search. If probable cause exists, Law Enforcement will decide if a strip search is required. School officials may grant Law Enforcement or school resource official’s permission to use Drug Dogs on property owned and/or controlled by the Crow Creek Tribal Schools.

BANKINGMoney should NEVER be kept in the dormitory. We suggest students deposit any large amount of money in the Finance Office. If for some reason this cannot be done, the Dorm Staff on duty will put the money in a safe place, document the amount and where the money is located in the Logbook with another Dorm Staff verifying the amount of money in the student’s presence. The money should be deposited upon the next business day at the Finance Office, as soon as possible. If funds are needed before the weekend or a holiday it is the student’s responsibility to withdraw the funds before the Finance Office is closed. The school will not be responsible for money lost or stolen while in the student’s possession.

VISITORS STAYINGThe Crow Creek Tribal School staff encourage visitation from family. Visitors shall report to the Administration Office during school hours. After school hours, visitors will report to the Dorm Staff on duty. Visitation will be limited to family members only and will be limited to Recreation Area in dormitory.

BORROWING MONEY AND CLOTHING Borrowing money – do no ask employees or students to loan you money. Each student is expected to have their clothing marked when they arrive at school. When you buy new

clothing; you will be expected to mark them immediately. Loaning and/or borrowing clothing, shoes, tapes, etc., is strongly discouraged. Hard feelings are created

when items are not returned in the same condition as when loaned. The school is not responsible for borrowed or loaned items that are lost, stolen or damaged.

AEROSOL & ALCOHOL BASED LIQUIDS [No Aerosols!]Any Aerosol Sprays or Body Sprays are not allowed in the dorm. Absolutely no Canned Hair Spray is allowed in the Dormitory. If Canned Hair Spray is brought into the dorms it will be taken away and destroyed. Pump Hair Spray is allowed.Any Perfumes, Colognes or other items containing or based with Alcohol, or any items can be used as an Inhalant is not allowed.Any student having in their possession another student’s Aerosol or Alcohol based liquids without permission will constitute stealing and will be addressed according to the CCTS Dormitory Handbook.

STUDENT’S DUE PROCESS RIGHT (25 CFR, Part 42)A formal disciplinary hearing is required before a suspension in excess of 10 days or an expulsion. The due process proceedings at Crow Creek Tribal Schools include the following:

Crow Creek Tribal School/Dormitory gives the student written notice of charges within a reasonable tine before the hearing. Notice of the charges includes:

A copy of the Crow Creek Tribal School/Dormitory Policy allegedly violated; The facts related to the alleged violation Information about any statements that the school has received relating to the charge and

instructions on how to obtain copies of those statements; and Information regarding those parts of the student’s record that the CCTS will consider in rendering

a disciplinary decision.

Crow Creek Tribal School /Dormitory will hold fair and impartial hearing before imposing disciplinary action. The Hearing Panel will include Dorm Counselor, Superintendent, and Home Living Specialist. Exceptions to this include:

If the student’s action requires immediate removal (such as, if the student brought a firearm to school) or if there is some other statutory basis for removal;

If an emergency situation that seriously and immediately endangers the health or safety of the student or others; or

If the student (or student’s Parent or Guardian if the student is less than 18 years old) chooses to waive entitlement to a Hearing.

If an emergency situation that seriously and immediately endangers the health or safety of the student or others, CCTS:

May temporarily remove the student; Must immediately document for the records the facts giving rise to the emergency; and Must afford the student a Hearing that follows Due Process, as described within 10 days.

A student has the following Due Process Rights in a formal disciplinary proceeding: The right to have present at the Hearing the student’s Parents o Guardians (or their designee); The right to be represented by Counsel (Legal Counsel will not be paid for by Crow Creek Tribal

Schools/Dormitory or the Bureau of Indian Education); The right to produce and have produced, witnesses on the student’s behalf and the right to confront and

examine all witnesses; The right to the record of the Disciplinary Action including written finding of fact and conclusions; The right to administrative review and appeal under the CCTS policy; The right not to be compelled to testify against himself or herself; and The right to have an allegation of misconduct and related information expunged from the student’s school

record if the student is found not guilty of the charges.

Alternative dispute resolution (ADR) processes are formal or informal processes that may allow resolution of the violation without recourse to punitive action. ADR processes may:

Include peer adjudication, mediation and conciliation; and Involve appropriate customs and practices of the Indian Tribes to the extent that these practices are readily

identifiable.

Informal disciplinary proceedings, Crow Creek Tribal School will consider the victim’s rights when appropriate. The victims’ rights may include a right to:

Participate in disciplinary proceedings whether in writing or in person; Provide a statement concerning the impact of the incident on the victim; and Have the outcome explained to the victim and to his or her Parents or Guardian by a School Official,

consistent with confidentiality.

For the purposes of this part, the victim is the actual victim, not his or her Parents or Guardians. Each school and dormitory must:

Develop a Student Handbook that includes local school policies, definitions of suspension, expulsion, zero tolerance, and other appropriate terms, and a copy of the regulations regarding these Due Process Rights;

Provide all School and Dormitory Staff a current and updated copy of the Student Rights and responsibilities before the first day of each school year;

Provide all students and their Parents or Guardians a current updated copy of Student Rights and Responsibilities every school year upon enrollment; and

Require students, school and dormitory staff, and to the extent possible, Parents or Guardians, to confirm in writing that they have received a copy and understand the Student Rights and Responsibilities.

COUNSELING SERVICESCounseling services are available to all Dorm Students in order to provide for their needs. These include any combination of services from the Dorm Counselor, School Counselors, and I.H.S. Behavioral Health, Drug & Alcohol Counseling/Programs and Capital Area Counseling.

DISCIPLINE OF STUDENTS WITH DISABILITIESDiscipline of student with disabilities who have an Individualized Education Plan (IEP) will follow the regulations and procedures outlines in IDEA, the BIE Special Education Policies and Procedures, and the Crow Creek tribal School Special Education Policies and Procedures. Students with disabilities will be disciplined in the same manner as non-disabled students in most cases. In the case of a behavioral infraction, which requires more than a 10-day suspension, the school, parent and relevant members of the IEP team meet to determine if the behavior, which resulted in the disciplinary action, is related to the student’s disability; this meeting is called a manifestation determination. The manifestation determination team makes this determination and also determines appropriate actions and consequences. The Special Education Policies and Procedures include a menu of possible actions and supports which may be considered, including: behavioral assessment, behavior improvement plans, IEP goals related to behavior and related services such as counseling.

DISCIPLINARY ACTIONS**MINOR INFRACTIONS**

First time & infrequent Minor Infractions:It is the belief of the Crow Creek Tribal School and Dormitory that misbehavior should also be an opportunity or time for staff to teach or demonstrate appropriate behaviors. Options available for Dormitory Staff in addressing the first-time or infrequent Minor Infractions include:

Immediate discussion between Dormitory Staff and the Student involved, emphasizing the appropriate behavior expected.

A meeting with the Dormitory Counselor, Dormitory Attendant and Student to review the behavioral expectations.

A meeting with the student and the Home Living Specialist. Other interventions as determined appropriate by the Dormitory Staff and Home Living Specialist.

What are examples of Minor Infractions? (Three (3) Minor Infractions do equal one (1) Major Infraction)Examples of Minor Infractions include, but are not limited to:

Misuse of school/dormitory property, i.e., furniture, equipment, buildings. Failure to complete assigned details. (repeated incidents can become a Major) Leaving the dormitory late for school (after 7:45am) Failure to attend dormitory meetings or study hall (Refusing to participate in the learning and dormitory

community process. Repeated incidents can become a Major)

Talking back to staff. If this is repeated, or if student uses profanity language or gestures, or displays rebellious behavior (insubordinate – unwilling to accept authority, this is a Major Infraction).

Being out of bounds, in a restricted area, such as another dormitory room (or having another student in their room), without approval.

Playing music, considered to contain inappropriate messages or words to include: profanity, promotion of alcohol or drugs, encouraging violence, lyrics which are degrading of others or promote discrimination, or sexual exploitation of others. (Music will be confiscated and returned to the student upon checking out at the end of the year, or to a Parent/Guardian in person).

Refusing to leave dormitory room door open at all times. Being inappropriately dressed, such as baggy clothes, not dressed for the current weather, not dressed in

accordance with campus dress code. Possession of energy drink

Repeated (or habitual) Minor Infractions:Options for Dormitory Staff in addressing repeated or Habitual Minor Infractions by the same student include:

Any of the options listed above pertaining to first-time or infrequent Minor Infractions. An incident report is completed and submitted to Dorm Counselor and Home Living Specialist thus, keeping track/making a record of the Incident.

Student will be placed on restriction from 1-3 days. (Only the Dorm Staff making the referral may approve a student working off his/her last day of restriction for a Minor Incident).

Dorm Counselor and Student will develop and implementation of a personalized student behavior plan.

Parent, Student and Dormitory staff meeting to discuss the incident (conference call, face-to-face, etc.).

Others as determined appropriate by the Dormitory Supervisor and Staff.

DISCIPLINARY ACTIONS**MAJOR INFRACTIONS**

The Dorms handle dormitory Major Infractions separate from school Major Infractions, with the exception of both Zero Tolerance Violations, and Use or Possession of Drugs and Alcohol Violations. Major dorm infractions will affect the eligibility of a student to participate in a school activity or trip, depending on school policy. Major Infractions carry from three to seven (3-7) days of restriction. Students are no allowed to work “work off” Major infractions. Examples of Major Infractions include, but are not limited to:

Promiscuous behavior-body contact between students that is inappropriate for the school/dormitory setting (examples, but not limited to, include; kissing, giving or receiving hickies, sexually explicit behavior and/or dress).

Middle school students are not encouraged to be in a relationship while in the dormitory Use or possession of tobacco products while on campus or attending or participating in any school

activity – cigarettes, chew, papers (zigzag). Possession of lighters, matches or any flammable material is also considered Major Infraction due to the serious safety issues involved. Students involved in repeated instances of being “suspected” of this violation will be written up and parents will be notified.

Horseplay, i.e., wrestling, jumping on furniture, teasing, tickling, running in buildings. (Horseplay can get out of hand and student can get hurt).

Stealing or shoplifting- Students caught stealing or with stolen items in their possession will replace the item(s) taken, and also be placed on restriction and/or suspension or expulsion from the dorm. (Board approved 01/2011).

AWOL-leaving the school grounds or a school/dorm trip without permission, or leaving campus without proper checkout form. Going AWOL is serious and will result in the student being taken home and given a Due Process hearing within ten (10) days, with a possible expulsion from dorm for the balance of the school year.

Vandalism-intentional damage to another student’s property, the dormitory or school property. (Major vandalism or breaking and entering is Zero Tolerance Policy incident).

Bullying, Sexual Harassment or Physical Harassment. (For consequences see the new policy on bullying).

Body Piercing and Tattoos (prohibited while in the dormitory) Exiting thru the Fire Exit doors is prohibited.

Burning candles or any other flammable items. Burning of Sweet Grass or Sage for spiritual purposes must be pre-arranged with Dorm Staff and done in their presence.

Insubordination-Repeated incidents of talking back to staff, use of profane language or gestures with staff, unwillingness to accept authority, or rebellious behavior is a Major Incident. (Approved by School Board, Jan. 2011)

Fighting-Student intimidating or threatening a student or staff member, instigating a fight or near fight, or being involved in a fight.

1 ST OFFENSE: a. Dorm Suspension of three to five (3-5) days. Off-reservation dorm students will be placed on full

restriction at the dorms. This includes no participating in school and dorm activitiesb. Behavior Contract with the Dorm Counselor or on a Final Behavior Contract if student is already on a

Behavior Contract.c. Mandatory one-on-one sessions with Dorm Counselor.d. Notification to Parent and/or Legal Guardian. (Phone call and/or letter)

2 ND OFFENSE: a. Dorm Suspension of five to seven (5-7) days. Off-reservation dorm students will be placed on full

restriction at the dorms. This includes no participation in school and dorm activities.b. Student will be placed on a Final Behavior Contract.c. Mandatory one-on-one sessions with Dom Counselor.d. Notification to Parent and/or Legal Guardian. (Phone call and/or letter)

3RD OFFENSE:a. 10 days Dorm Suspensionb. Expulsion Hearing

SUBSTANCE ABUSE – Drugs (Illegal, OTC & Rx) and Alcohol(Note: Incident reports, whether in the middle school, high school, alternative school or dorms will be handled together. For example a student written up at school for substance abuse might be a 1st offense; if the same student is then written up at the dorm, this would be a 2nd offense. For Dorm students, consequences related to suspensions will be handled at both the school and dorm, regardless of whether the incident took place in the dorm or school).

Use or possession of Alcohol, Marijuana, other Illegal Drugs, Harmful Inhalants, Prescription or OTC (over-the-counter) drugs in the school building, on the school campus, in the dormitory or during school or dorm activities or outings/trips.

Under the Influence (Definition)“Under the Influence of” will be determined by the Supervisor in charge. It is defined by the CCTS Board of Education such as; any physical symptoms such as odor, pupil, dilation, breathing difficulties, difficulty in walking or performing other tasks that require coordination and/or stamina, admission of use or other overt characteristics (including appearance, behavior, speech or body odors). The odor from handling such drugs on hands, clothing or breath, or behavior that is out of the norm is; sufficient to complete this offense for the purpose of school or dorm consequences.

Possession of Substances and/or Paraphernalia (Definition)The possession of drug paraphernalia or drugs such as; alcohol, marijuana, cocaine, heroin, amphetamines, certain cold medicines, synthetic drugs, prescription drugs, OTC (over-the-counter) drugs and all other mood altering substances used for intoxication, to get “high,” etc., is illegal and/or in violation of school/dorm policy. These included substances or items found on a student, concealed in their clothing or within any students’ personal belongings such as school lockers, dormitory lockers/wardrobes, train-cases, suitcases, foot lockers and/or clothing etc., shall be in violation of the possession offense.Specific Consequences Related to the Use or Possession of Drugs, Drug Paraphernalia and Alcohol.The use and/or possession of drugs, drug paraphernalia, alcohol or other intoxicating substances in the school dormitory, on the school campus or during dorm outings/activities, are considered a Major Infraction. These will result in the following:

a. Dorm Suspension of ten (10) daysb. Notification to Parent and/or Legal Guardian/Scheduling of an Expulsion Hearing for the remainder of the

semester.c. Law Enforcement will be notified.

All students suspected of use, possession, distributing or selling of any harmful or illegal drugs, including intoxicating substances, either on campus or at school/dorm sponsored activities will be referred to local Law Enforcement for investigation and formal charges.

ZERO TOLERANCE POLICYThe following violations will result in immediate expulsion from the School/Dormitory for the remainder of the semester. The administration will take every step necessary to investigate each incident in a fair and impartial manner before a decision is handed down. All students will be afforded their rights for Due Process proceedings (25 CFR, part 42) described within this handbook. Please Note: should this expulsion happen within the final four week of the semester, the student will also be expelled for the next full semester.

Gang Activity – Student affiliating himself or herself with a gang or identifying himself or herself as a member of a gang who tries to threaten or intimidate other students. Sleeping room violations (girls or boys in the opposite genders room).

Graffiti – Students who reportedly tag (mark up) the school or dorm building or buildings will also be dropped from school for the remainder of the semester.

Weapons – Students are forbidden to possess, transmit, buy or sell, or assist other persons in obtaining firearms of any kinds. Weapons include, but are not limited to, firearms, pocketknives, tools with a knife blade, metallic knuckles, ammunition, club, bats, sticks, chains, pipes, razors, made or other harmful chemicals or any other object used in a way that threatens to inflict bodily injury on another person.

Serious bodily injury to another student or staff member – Serious bodily injury means bodily injury that involves a substantial risk of death, extreme physical pain, protracted and obvious disfigurement or protracted loss or impairment of the function of a bodily member, organ or mental faculty (19USC 1365). Serious bodily injury does not include a cut, abrasion, bruise, burn, disfigurement, physical pain, illness or impairment of the function of a bodily member, organ or mental faculty that is temporary (20 USC 1365). However, if these incidents occur in the dormitory it will be considered Zero Tolerance and student will be sent home for the remainder of the semester.

Blacking out self or another student (any student in dormitory who witnesses incident can and will be sent home as this is a serious situation)

Self harm (cutting of self on arms, legs or any area on their body) Making a death threat or bomb threat to any students or staff. In the case of a death or bomb threat, the

Law Enforcement Agency will be notified. Arson or use of any flammable materials or device. Grand theft – is defined as items stolen which value in excel of $500.00 Breaking and Entering of School Property – When a student is involved with an incident in breaking and

entering of a building on school property the Police Department will be notified and charges will be filed against the student(s). An emergency meeting will be held with the Home Living Specialist, Dorm Counselor and Superintendant for immediate expulsion. Approved by School Board 11/29/09.

Videotaping – When a student from the Dorm or School is involved with an incident of taking video clips or pictures of fights, other illegal activities or for the purpose of intimidating another person, and putting these video clips or pictures on the Internet, the student will be immediately expelled for the reminder of the school year. The police department will be notified and charges may be filed against the student, depending on the seriousness of the situation. There will be an emergency meeting held between the Home Living Specialist, Dorm Counselor, Dean of Students, Principal and Superintendent on the immediate expulsion. Approved by School Board 11/29/09.

Cell phone or camera memory card – When a student refuses to turn in a memory card from cell phone or camera the student will be suspended from the dorms/school up to nine (9) days and on the 10th day if there is still no memory card and any recording device turned over to staff, then immediate expulsion hearing will be held and the student will be expelled for the remainder of the semester. Approved by School Board 01/22/09.

Fire alarms and/or fire extinguishers – Destroying fire extinguishers, fire alarms, and/or setting off fire extinguishers and/or alarms (false alarm).

Boys in Girls’ Dorm/Girls in Boys Dorms – Boys found in a girls dorm room (or in the hallway outside the rooms), or girls found in a boys dorm room (or in the hallway outside the rooms), will be expelled

Making a threat of serious bodily injury a threat indicating an intent to fight or a threat with the intent of intimidating a CCTS staff member/employee will result in an expulsion hearing. A resulting expulsion will be in effect through the end of this school year.

CONFIDENTIALITYThe Dorm Staff will respect the confidentiality of all students and families. We will not discuss or give out private, confidential information about any student unless it is directly with the student’s Parent(s)/Guardian.

ISOLATION/SEPARATION POLICYBoth the Boys’ Dorm and the Girls’ Dorm have an Isolation room. This room will be used to separate any student who might be ill, or in some instances, a student who needs to be separated due to behavioral issues. These rooms are clean and have a limited number of beds in them. If a student’s is placed in the Isolation Room, the Dorm Staff will notify the Parent(s)/Guardian.
