from the landward levee toe. After construction is substantially complete, all stakes shall be removed and the levee slope and landward surface restored after stakes are removed.”

OPW 52534B – Levee Recertification: Relief Wells and Grading  SUBJECT: Pre‐Bid Meeting 

MEETING DATE: November 20, 2019

2. Project Overview-Discussed by Vicki Twerdochlib

Project Overview o The project includes work in three distinct areas along the Omaha Levee. The three areas

are distinguished by “Relief Well Area” designations, which were assigned by USACE. These areas are referred to as Area D1, D2 and F. o Area D1 is located south of the airport and east of the Omaha Correctional Center. The

work being conducted here includes grading and modifications to a storm sewer system. Coordination is required at this work location with both the security teams at the Omaha Airport Authority and with the Omaha Correctional Center.

o Area D2 is located south of the Monarch Oil facility and west of the Omaha Correctional Center. The work being conducted here includes tree removal and grading. Coordination is required at this work location with both the Monarch Oil Facility and with the Omaha Correctional Center.

o Area F is located just north of Abbott Drive, south of the Magellan Tank Farm. The work being conducted here includes the installation of two new relief wells. Coordination is required at this work location with Magellan.

Existing site Important Design and Construction Issues

o Pilot Hole o In accordance with the requirements in Specification Section 33 26 00, the Contractor is

required to submit a relief well design. The information to support this design is detailed further in this same Specification Section – the information included in Appendix A can be used for design, the driller may elect to utilize the same procedures provided in the drilling program plan attached in that appendix for an additional pilot hole, or the driller may elect to submit a new drilling program plan. Submitting a new drilling program plan would be done at the Contractor’s risk with regards to schedule.

o Relief Well Drilling and Development o Contractor will provide the City’s inspector the schedule on the drilling. City is

providing the resident project representative (RPR) and HDR is providing design milestone field visits. A geotechnical engineer from HDR needs to be on site for the

relief well drilling and development. o Tree Removal

o Contractor NTP is expected in February 2020. Migratory Bird Treaty Act (MBTA) requires trees to be removed prior to March 1 without a biologist on site to comply with MBTA requirements. Removing trees after March 1 requires the Contractor to have a biologist on site to comply with MBTA requirements.

3. General Services Discussion Items (by Heather Tippey Pierce) Bid Opening Date, Place and Time (Section 00 11 13 Invitation To Bid)

Bid opening to be held December 11, 2019 at Omaha/Douglas Civic Center. Time of opening 11:00 AM Local Time. This revised bid opening date will be reflected in the addendum.

Contracting Requirements Funds for the Project will come from the City of Omaha Fund Allowances (Section 01 22 00, Measurement and Payment).

o SWPPP Allowance - $16,550 o Environmental Allowance - $49,651 o Missouri River High Water Allowance - $33,100 o Monarch Coordination Allowance - $49,651 (the bid form will be revised to reflect this

pay item as an allowance and to reflect the allowance dollar amount. The measurement and payment Division 1 section will be revised to reflect this pay item as an allowance)

SEB and Economic Inclusion Small and Emerging Businesses (Instructions to Bidders 00 21 13, Item 24. Utilization of

Small and Emerging Small Businesses). Contractors are required to comply with the Instructions to Bidders.

o Work equivalent to a minimum of 4% of the total contract amount must be subcontracted with and self-performed by registered SBEs.

o For questions on certification, including a listing of the SEB Program Participants, please see the City of Omaha Human Rights & Relations website at www.cityofomaha.org/humanrights/contract-compliance or contact via phone: 402- 444-5055. The SEB has to be registered with the City prior to bid opening.

o Bidders must complete the Participation Utilization Form & Participation Disclosure Form and submit with their bid/agreement documentation in order to be considered.

Economic Equity and Inclusion Plan (EEIP) Requirements. o This plan is good for a year. If one has already been submitted this year and

approved, include the certificate of approval in the submitted bid. o If an EEIP has not been submitted this year, one must be drafted and included in

the bid. o Questions on your specific EEIP plan can be sent to Jared Anderson (402-555-5053,

[email protected]) Failure to properly follow and meet the Small and Emerging Businesses & EIP

requirements as part of the bid will result in your entire bid being non-responsive. Sales and Use Tax

Reference Article 22. Project exempt from Nebraska State Sales and Use Taxes on materials and

equipment incorporated into Work. Said taxes shall not be included in the Contract Price. City will provide Form 92 to successful contractor.

Clarifications All contractors must read the Instructions to Bidders. This is a line item bid. Allowances are built into the proposal sheet. Please add your

allowances into your total bid price. Total bid price is the final price. Unit price controls. Two alternates listed. Alternates do not count in the SEB percentage. The SEB

requirements count against the base bid, not the alternates. Paragraph 7 of the bid form is your bid day resource. Double check that paragraph to make

sure everything is included and identified. Municipal code requires the RC1 form be included. Municipal code also stipulates that if

this form is not included that the bid has to be rejected and considered to be non-responsive.

Contractors need to have their W9 in place with the City by bid opening date.

4. Contract Times (Section 00 52 13, Agreement)-Discussed by Vicki Twerdochlib Reference Article 4. Notice-To-Proceed expected to be provided by February 2020

Traffic Control and Parking- Contractor will be able to park in staging areas; no traffic controls are anticipated.

The Omaha Airport Authority will not require the contractors to have background checks on their workers, but they will still need to notify OAA when on site.

9. Substitutions and “or Equals” (Section 00 21 13 Instructions To Bidders)-Discussed by Vicki Twerdochlib No substitution requests will be considered during the bidding period. Reference Article 11. Procedure for submission and consideration after award of Contract is set forth in

Paragraphs 6.05A, 6.05B, and 6.05C of the General Conditions.

Reference Article 6. Retainage will be ten percent of the cost of the work completed until 50% completed if

character and progress of work is satisfactory, per Agreement paragraph 6.2. Ten percent retainage for stored materials not incorporated into the Work. Upon Substantial Completion, retainage may be reduced to 125 percent of the cost of the

remaining work on the contract as estimated by the Engineer.

conduct all field concrete testing. See the addendum for the modifications to the testing requirements. City will take care of all

field testing for concrete and earthwork.

14. Permits and Environmental Items-Discussed by Vicki Twerdochlib Permits (Section 01 41 26)

o NDEQ Stormwater Permit / City of Omaha Grading Permit (Obtained by City, includes contractor responsibilities)

o Dewatering Permit (contractor responsibility) Can discharge to stormwater line. The contractor will need to acquire a permit from NDEQ in order to discharge.

o FAA Airspace Permit – (already obtained by City) o USACE 408 Authorization (Will be obtained by City prior to NTP) Contractor requirements

include: EAP, pilot hole drilling program plan only if other information provided do not provide sufficient information for the relief well design and USACE shop drawing approval for relief well construction.

• If Contractor elects to submit new drilling program plan with new drilling procedures, Contractor accepts schedule risk.

o Need DNR permits for new wells (contactor responsibility) • One well in NE and one in IA. Licensed drillers required in each state of application.

15. Working hours- 7:00am-6:00pm Monday thru Friday/Weekends and Holidays with Owner’s

approval. Reimbursement by Contractor to the Owner per General Conditions 7.02.C may apply.

Questions During Pre-Bid Contractors have had issues with SEB contractors not being responsive. If this happens, let the

City know as soon as possible. Provide documentation of your good faith efforts to obtain SEB prices in support of the bids. Provide this information to the Project Team to help General Services make a case.

There was a question on railroad flagging and train timing. It is within the railroad’s rights to request flagging if work is being done within 25 feet of the closest track. CN has provided the City with the project-specific ROE agreement. The Contractor is required to obtain their own. CN has not provided any information to us on train schedules. Request this information directly from CN or from the property owners the trains serve.

There was a question on whether other methods were acceptable for relief well drilling on other projects for the City. It was stipulated that no substitutions can be considered during the advertisement process. That question can be posed to the Project Team after award.
