Blood Alcohol Concentration (BAC)

• amount of alcohol in your system based on a test of your breath, blood or urine.

• Illegal to drive if your BAC is .08 percent or greater

• You can be convicted if your driving ability is impaired.

BAC is Affected by…

• The amount you drink • Your body weight or

size • Food you have eaten• Your tolerance of

alcohol • Any drugs

Other Drugs • prescription and

nonprescription drugs impair safe driving

• It is illegal to operate a motor vehicle on Illinois highways with any trace of a controlled drug, substance, cannabis (marijuana) or intoxicating compounds in your blood.

DUI Laws• If convicted of DUI a violent

crime will permanently remain on your driving record

Implied Consent Law: automatically consent to submit to certain tests

Statutory Summary Suspension Law: arrested for BAC .08 or more = suspended for 3-6 months.If you refuse test = suspended for 6 months to 1 year.

DUI Conviction• 1st DUI conviction = loss of

license for min. 1 yr.

• 2nd DUI (within 20 years ) = No license for min. of 5 yrs.

• 3rd DUI is a Class 2 Felony = No license for min.10 yrs

• 4th DUI = No license for LIFE

Breath Alcohol Ignition Interlock Device (BAIID)

• First-time DUI offender

• BAIID installed and are responsible for all costs.

• Apply for a Restricted Driving Permit (RDP) 5am -9pm

Aggravated DUI

• Death or personal injury crash

• Class 4 felony

• 1-15 years Jail (depending on how many offenses)
