Tender Notice No-C 741/0/Leasing of SLR/ DHN /05 dated: 06.09.2005 Sealed tenders are invited for leasing out of 04 (four) tonnes parcel space in each compartment

of front SLR of the below mentioned trains for carrying of consignments from originating to destination station for three years. The minimum space for leasing out will be 04 tonnes capacity. ‘Tender Form’ alongwith the entire terms and conditions may be obtained from the office of the Sr Divisional Commercial Manager, East Central Railway, Dhanbad on any working day from 20.09.2005 to 13.10.2005 from 11:00 hrs to 17:00 hrs on production of original Money Receipt of requisite amount as shown below (which is non-refundable), issued from Chief Booking Supervisor, East Central Railway, Dhanbad for the train appended below.

Tender forms are also available on Website http://www.Indianrail.gov.in , which can be

downloaded from 20.09.2005.

This facility is free of cost. But the tenderers will have to submit a non refundable Demand Draft in

favour of “FA & CAO, E C Rly Hajipur”, payable at Patna for the amount as mentioned against the

cost of tender form in addition to the earnest money.

Separate tender form is to be submitted for individual compartment of Front SLR of the trains

appended below. Tender papers shall be dropped in the tender box from 06.10.05 to 14.10.05 from 11:00 hrs to

15.00hrs (on working days) which shall be kept in the Sr Divisional commercial Manager’s office, E. C. Rly, Dhanbad. Tender Box will be opened at 15.30 hrs on 14.10.2005 in presence of tenderer or his representative. If the office remains closed on 14.10.2005 due to any unforeseen reason, the tender will be dropped and opened at the above-mentioned time on the next working day.

Delayed, incomplete and without sufficient earnest money tender forms will summarily be rejected. The Railway administration will not be responsible for any delay or loss in postal transit.

3. I/We have received a copy of “Instructions to Tenderers” attached to the Tender form and I/We

have carefully noted the contents and the terms and condition laid down therein. I/We will abide

by the said terms and conditions irrespective of the fact whether my/our Tender is accepted by

the Railway Administration or not.

4. I/We agree to operate the said services on and from the date as would be communicated to me/us

by the Railway Administration. In case my/our Tender being accepted and if I/We fail to do so,

any deposit made by me/us in connection with this Tender may be forfeited by the Railway

Administration.

5. I/We shall keep the offer open for a period of 120 days from the date of opening of tender. If any

of the tenderer(s) withdraws/refuses his offer or modifies his original offer in a manner not in

conformity with the tender conditions are not acceptable to Railway, his entire earnest money

finalization of the contract.

INSTRUCTIONS TO TENDERERS

1. Tender shall be submitted in the prescribed form in sealed cover superscribed “Tender for leasing of space in front SLR (Brake Van) by Mail/Express/Intercity/Passenger Trains”.

2. Sealed cover containing Tender(s) delivered by hand should be dropped in tender box provided in the Commercial section, DRM office, Dhanbad from 06.10.05 to 14.10.05 between 11.00 hrs. to 15.00 hrs in any working days.

3. Any Tender received after the stipulated time and date will not be considered for any reason whatsoever.

4. Tender(s) may also be sent by Registered post but no Tender, which is received after the time and date specified shall be accepted.

5. Tender(s) will be opened on 14.10.05 at 15.30 hrs in the chamber of Asstt Comml Manager, East Central Railway, Dhanbad in the presence of such Tenderer(s) or his/their Agent(s) as may be present. If the office remains closed on the day of opening of Tender due to any unforeseen circumstances like bandh, holiday etc. the tender will be opened on next working day at the same time.

6. The Railway Administration reserve the right to decide or to reject any Tender or all tenders without assigning any reason whatsoever and does not bind itself to accept the highest or any tender or to assign any reason whatsoever for doing so.

7. Each Tenderer shall be required to deposit Earnest Money as prescribed for each train separately. This earnest money can be deposited either in cash/Bank Draft/Banker cheque in favour of F.A.& C.A.O./E.C.Rly/Hajipur payable at Patna. Cash may be deposited with Divl Cashier/Dhanbad. The number and date of the Money Receipt/Bank Draft/Banker Cheque towards depositing this said amount must be quoted in the Tender form in the appropriated place. The said Money Receipt/Bank Draft/Banker Cheque should also be submitted in original along with each Tender. Any tender which does not contain the Earnest Money mentioned herein above will be rejected; summarily no interest will be paid on the said Earnest money deposited in this purpose.

8. The said Earnest Money of unsuccessful Tenderer(s) may be refunded after finalization of the tender.

9. The successful Tenderer(s) shall be required to submit the Bank guarantee as performance guarantee (equivalent to five days freight at the accepted rates i.e. the rates at which SLR is to be leased out) On receipt of Bank guarantee the amount already collected as Earnest money may be treated as advance freight and adjusted against the freight payable by the successful Tender(s). All Bank guarantee should be valid for the period of contract + 3 months.

10. The successful Tenderer(s) shall be required to execute a lease agreement with the Railway Administration within ten days from the date of such a offer by the Railway Administration, failure to do so shall result in forfeiture of aforesaid earnest money and the offer will be treated as cancelled. The Tenderer(s) shall in addition to the earnest money simultaneously deposit advance freight which will be equal to minimum of 05 days accepted leased freight which he had bid in the Tender for SLR space in a particular train and shall always maintain this minimum being advance freight with Railway Administration. This amount will be in the form of cash deposit with the Chief Parcel Supervisor of the originating station as notified. The originating station shall maintain the running balance per leasee and take appropriate steps in case this running advance freight position falls below the prescribed minima.

11. The lessee shall be advised the date from which a particular SLR space has been leased in his favour and the originating station shall adjust Railway dues of lump sum rate from the lessee’s advance deposit standing at credit from the said date of lease and shall continue doing so irrespective of the fact whether the lessee avails the said leased SLR space or not.

12. No Tender(s) containing erasures and alterations in the Tender documents will be considered. 13. If any of the foregoing instructions are not complied with by any Tender(s) his/their tender(s)

will be liable to reject. No interview or correspondence in this connection will be entertained. 14. The accepted rate shall be binding upon the successful tenderer(s) for the entire leased period. 15. Tenderer(s) will be required to submit the current license documents (if any), for registration of

his/their establishment(s) under the contract labour (Regulation & Abolition) 1970 within 3 months from the date of commencement of that work.

16. Tenderer(s) must quote rates both in figures as well as in words for the work mentioned in this agreement. The tender will be invalid if the rate quoted for the work mentioned in the schedule is omitted or if any discrepancy is found between the rate quoted in figures and in words.

17. One tender form will be valid for one train only. 18. Lease to be effective within ten days from the signing of the agreement. 19. Only the highest bidder quoting the rate above reserve prices will be accepted as successful

lessee if other condition is fulfilled. 20. Earnest Money of successful bidder may be treated as advance freight and adjusted against the

freight payable. 21. Earnest Money will be applicable to concerned train in which the space is leased out. Earnest

Money of various trains is tabulated in Page Annexed. 22. The tenderer must sign each and every page of the tender paper. 23. The cost of tender form for different trains is different. The tenderer must ensure that he use the

tender form for the trains according to the cost of form as prescribed in Annexure ‘A’ ---------------

PROCEDURAL ORDER

1. The service will be start from originating station in front SLR with C.C. as indicated on SLR will be offered for utilizing by the lease holder for loading of parcel packages for a period of three years and freight will be charged as per contractual rate on daily basis for 4.00 tonnes/8.00 tonnes.

2. Party will load/unload parcel from the leased SLR with their own labour force. Railway will not be responsible for any compensation/claims on the parcels. Packages to be unloaded from the leased SLR within 30 minutes from the arrival of the train at destination.

3. Freight will be paid daily. An extra, five days freight at contractual rate to be deposited in advance with the originating station. In case of failure to load packages freight may be adjusted from the amount deposited to originating station as advance freight which is required to be replenished simultaneously.

4. SLR will be leased out from train originating point to terminating point. 5. In case of any failure on the part of the party to load/unload freight will be forfeited and no claim

will lie on the Railway either for refund of freight or for compensation claims. 6. Commodities listed in red tariff and of offensive nature, contraband, dangerous, explosive etc.

would not be accepted. 7. The P.W.Bill will be issued on ‘Said-to-contain’ basis. 8. The packages will be weighed by the leasee prior to booking/loading and no over loading is

permissible. 9. Detention to train for loading/unloading is not permitted. In case of detention the following fine

will be imposed against the leasee. (a) Up to extra 10 mts. Rs. 1,000/- (b) For ll mts. To 20 mts. Rs. 3,000/- (c) More than 20 mts.& upto 30 mts. Rs. 5,000/- (d) Above 30 mts. Rs. 10,000/- And liable for Penal action also as deem fit by the Railway Administration.

10. Booking under this scheme would be on freight prepaid basis. 11. The party must use his own seal and padlock. 12. No check of packing condition will be made by the Railway at the time of booking and it will be

the sole responsibility of the party to ensure that packing is such as would with stand normal transport hazards and Railway will not accept any liability for any damage for loss in this regard.

13. The party shall bring the Parcels/Packages in Rly premises five hours (over night in case of early morning trains leaving before 8 hrs.) in advance of the schedule departure of the train to the extent of permissible limit of CC of SLR only at the originating station and shall remove Parcels/Packages within five hours from arrival of the train at destination stations, failing which they shall pay the panel wharfage charges as in vogue.

14. Any commodity whose movement is restricted by the Central or State Govt or by any legal authority is not allowed to be loaded except when covered by a valid permit for movement of the commodity.

15. Party will be responsible for any loss/damage caused to Railway Goods or property or any injury to person by reason of bringing such goods to the Railway.

16. No compensation on claim will be entertained by the Railway on account of shortage, damage and loss either partial or total of the parcel carried in the leased SLR. A declaration to this effect will be recorded by the lease holder on each Forwarding Note.

17. In order to facilitate distinction of lease goods/packages with goods booking departmentally a separate marking norms has to be followed and proposed as under for example :

Code of originating station/L-SLR/Code of destination station. 18. In case of ordinary passenger train the lease holder shall be permitted to load/unload the parcels

from/to all intermediate station coming in the way of the journey of that specific ordinary passenger train irrespective

of the stoppage time of trains at that station(s). Loading/Unloading of parcel at all stations will be carried out by leaseholder within the stoppage time.

19. The lease holder shall give the following declaration in prescribed proforma in triplicate before sealing the SLR Van.

It is also declared that the packages/parcels loaded in the vehicles do not include explosive/dangerous/contraband/offensive & other banded goods. Signature of the consignor or his authorized agent: Name & Full address of the lease holder or consignor with date:

The purpose of the list is to help in dealing with contingencies of the SLR being tampered with

while in transit of the SLR getting involved in an accident on the Railway and similar other eventualities. The list will also help the Railway staff to exercise a super check that offensive, dangerous or contraband goods etc. are not included in the consignment, does not exceed the maximum carrying capacity of the SLR. Out of the three copies of the list, one will be retained as record, second will be placed in the SLR along with the consignment and third copy will be sent to destination, along with the guard. It will be the responsibility of the lease holder to see that prohibited goods are not included in the consignment offered by him for dispatch by leased SLR.

20. The Railway staff will not supervise the loading and unloading at originating and destination station. However, if the Rly seals and padlocks provided by the party are found tampered with at the destination station the unloading in such cases will be done in the presence of CPS, RPF and the lease holder or their representative, packages, will be compared from the list of pkgs. Accompanied by the guard or Brake van. A Certificate of discrepancies found if any, will be prepared in triplicate and signed by CPS, RPF and lease holder or their representative.

21. The scheme will be enforce for three years in case of M/Exp/intercity/passenger train from the date of introduction.

22. Platform permits will be issued to the lease holders labourers both for loading and unloading if required.

23. In case leased SLR being not handled by the party on account of unforeseen circumstances at the terminating point for the release of the SLR and to ensure proper custody of the consignment after unloading Railway reserves the right to unload the leased SLR at party’s cost with necessary precautions.

24. Leasing of SLR is not permitted for such destination where there is no direct train service i.e. enroute transshipment will not be allowed.

25. Apart from parcel even bulk commodities of freight traffic may also be permitted to be carried by the leased SLR’s. Commodities would comprise of either bagged consignment (foodgrain, cement, fertilizer etc.) or packaged consignment. Loose consignments such as coal sand etc. would not be permitted.

26. Railway should ensure that the space leased out is made available without fail to the leasing parties. In rare circumstances freight charges deposited in advance may be refunded by the zonal Railways for non-loading of leased space of SLR in following circumstances:- i) When the leased space is not made available by the railways due to unavoidable reasons

(which should be very rare). ii) When the party is not able to load the SLR due to Railway staff agitation, Bandh, Publec

agitation etc. Both these cases should be certified by the ACM concerned before refund is entertained. In such

cases the advance freight deposited may be refunded for the days on which loading could not be done by the party in leased SLR due to aforesaid reasons. However, the refund may be given with the approval of Chief Commercial Manager and FA & CAO following due procedure.

27. If such goods (offensive, dangerous, contraband) are detected by the Railway Authorities or by Excise, Customs, Police Department, the consignment may be seized and penalty imposed by the competent authority will be paid by Lease holder who will be personally liable for all consequences as embodied under IRA and other laws.

28. If over loading is detected at destination / en-route in excess of the carrying capacity of the SLR, the excess weight will be charged at six times of the scale –R rates and the party shall be bound to pay such charges. In addition action as per extent rules will be taken against tender holder and the Railway Administration may impose a minimum fine of Rs.500/- and maximum of Rs5000/-.

29. The packages / contents loaded in SLR can be checked at any time by the Railway, Excise department or any other Government officials who is authorized to do so with the permission of Railway Administration in presence of leaseholder or its representatives. In case the leaseholder fails co-operate, then the Railway Administration is free to check the consignment in presence of RPF, GRP, Police, Excise or other such Government officials as the situation warrants.

30. The leaseholder shall transfer/handle, load/unload packages/parcel in a manner that does not cause any damage to the SLR or to any structure of the station premises. The leaseholder will indemnify the loss suffered by Railway on this account.

31. Any damage caused to the SLR or to any other Railway property by the lease holder or by his staff/representatives, while handling parcel, either at booking station or at destination will be paid to the Railways by the lease holder and assessment of damages made by Railway Administration, will be final and binding on the leaseholder.

32. The Railway Administration reserves the right to terminate the agreement at any time for any reason whatsoever after giving one month’s notice to this effect to the party without being liable for any loss or damage caused to the contractor.

33. The entire responsibility of canvassing for traffic, booking, handling documentation and delivery of packages to the individual consignee will be that of the leaseholder.

34. Railway will not pay claim for loss or damage in transit of for non-delivery of parcels booked by the party under this scheme, if SLR reached the destination with Railway seal intact.

35. a) Any disputes of claim arising between the leaseholder and the cargo owner shall be settled by the leasee as a principal vis-à-vis the cargo owner. The Railway will have no contractual or other obligation towards cargo owner. Any alternation /detention to the agreement can be made with mutual consent of both parties.

b) While asking for re-weighment of leased SLR by Railway Officials, providing of labour assistance is the sole responsibility of the leaseholder, failing which his security money will be forfeited.

36. At the time of executing the agreement, photograph & specimen signature of the leaseholder will be got verified.

37. If the lease holder fails to unload the packages from the leased SLR at destination station, resulting over carried of SLR to any other station, the entire weight & distance of SLR will be charged at double the scale- R.

38. Leaseholder will not transfer or sublet the contract to any other party, failing which contract is liable to be terminated without any notice to the party and security shall also be forfeited in such eventuality.

39. Railway Administration reserves the right for deduction of Railway dues from leaseholder’s security amount on the following grounds:-

a. Any amount, which is imposed by Railway Administration as a fine, demurrage, wharf age, loading and unloading charges freight etc.

b. Recovery of costs on account of loss caused to Railway property due to any direct or indirect action of the leaseholder.

c. Any amount, which Railway becomes liable to the Govt./Third Party on behalf of any default of the leaseholder or any servant/agent.

d. Any payment/fine made under the order of law enforcing agency or e. Any person working on his behalf. f. Once the amount under this clause is debited the leaseholder shall reimburse the same by

depositing to the extent the amount is debited within 15 days period failing, which it will be treated as breach of agreement.

40 .(i) The lease holder shall not load the packages in excess of marked carrying capacity. (ii) The Lease holder shall not do the uneven loading. (iii) The lease holder shall do the loading in such a manner that there is no possibility of load

shifting. (iv) The lease holder shall ensure that the number of packages loaded is not in excess of the

number of packages declared at the time of loading. (v) In case of over loading by the lease holder thereby endangering the safety of

passengers/track/rolling stock, he is liable to be taken up under 153 of Railway Act, 1989.

41. If excess packages unloaded at the destination station than shown in the Parcel Way Bill a normal parcel tariff rate for the weight of excess packages may be collected from the leaseholder before delivery. Provided the weight of all unloaded packages is within the permissible limit. However, if the weight of all the unloaded packages is detected excess than permissible limit, the same will be charged six times the scale –R.

42 i) The labour employed by leaseholder for loading/unloading any purpose will be employees of the leaseholder and they may in no way whatsoever claim to be employees of the Railways. If Railway is liable to pay claim to the labour of any ground the leaseholder will indemnify the Railway Administration for the same.

ii) Leaseholder will indemnify the Railway Administration for loss and damages suffered in the violation of any provisions of the Contract Labour (Regulation and Abolition Act)

iii) In case of loss or profit in the future market due to any reason, the Railway Administration will not take any responsibility for the same.

iv) If contractor/agent/labour/staff meets with any injury or loss or death due to any reason during the loading/unloading process the railway will not be liable for the same and the leaseholder will indemnify the Railway Administration for such acts.
