Monroe County Community College (Owner) invites bids to provide furniture for the East/West

Technology Buildings Renovations and Additional Project (Project).

Refer to the enclosed bid package including Furniture Plans, the Specifications, form of

agreement, general conditions, and other Bid Proposal Requirements to furnish and install

furniture for the Project.

Proposal Requirements

Failure to include any of the following documents in the submitted proposal will result in

disqualification:

Instruction to Bidders

1. The Owner reserves the following rights: to accept or reject any bid; to reject all

bids; to waive any formalities or irregularities contained in a bid that do not comply

with the terms and conditions of the invitation to bid, modifications to the invitation

to bid, or specification; to select the bid and/or items that in the sole and absolute

discretion of the Owner are in their best interest whether or not the bid selected is

the lowest monetary bid received.

2. The Owner reserves the right to evaluate and award this bid by manufacture-

product group. Partial bids may not be accepted. Bidders are required to provide

a complete bid per package. Owner reserves the right to award the packages per

best value as they see fit.

3. This RFP in no manner obligates the Owner to the purchase of any products or

services described, implied, or which may be proposed, until confirmed by written

agreement, and may be withdrawn by the Owner without penalty or obligation at

any time prior to the signing of the agreement or purchase order.

4. Expenses for developing and presenting proposals are the responsibility of the

Vendor and shall not be charged to the Owner. Supporting documentation and

manuals submitted with this proposal become the property of the Owner.

5. Questions regarding the Furniture Specifications and Plans are to be directed to

Bethany Janik of Stantec via email, copying the Kelly Heinzerling. All questions must

be submitted by 10/31/2019:3:00pm]. Questions will be compiled as they are

received, and a response including answers to all questions will be emailed to all

vendors on 11/06/2019. Responses will be provided to all Vendors bidding the

project. It is each Vendor’s responsibility to review these clarifications and

incorporate into their bid accordingly. Vendors, manufacturers, installation

companies and any related parties may contact the client directly.

6. By submitting a proposal, each Vendor affirms that they have examined the

documents presented herein and satisfied itself as to the conditions under which it

will be obligated to provide new furniture, fixtures and equipment in accordance

with this RFP. Vendors are required to view drawings and specifications to insure

they are adhered to exactly when quotes are submitted. No claim for additional

compensation will be allowed due to unfamiliarity with the documents.

7. There will be no substitutions to any of the specified items (unless items can be

proven to substantially meet requirements of quality, functionality and aesthetics.

For proposed substitutes, Vendor must supply a sample of each furniture piece that

differs from the specified design basis for Owner evaluation at the time proposals

are submitted. Swatches or chips of manufacturer’s standard finish options must

also be provided. All samples shall be delivered to Kelly Heinzerling’s attention.)

8. No changes to the contract shall be made, nor invoices for extra charges,

alterations, modifications, deviations, and extra orders be recognized or paid

except upon a written change order from the Owner. The Owner will not authorize

payment for changes, alterations, modifications, deviations, etc. that are a result of

Vendor error.

9. Client will pay a deposit on applicable items only. Paperwork substantiating the

need will be required. Client will pay final invoices within [45 days] of delivery

pending any outstanding punch list issues.

10. The Owner in conjunction with Stantec reserves the right to adjust the quantities

required for this project as best meets its needs. The Owner reserves the right to

deduct TWENTY PERCENT (20%), in cost terms, from the original specification

quantities without any effect on discounts on all products or the unit prices

submitted.

11. On the Bid Summary Form, please provide the following line items: proposed

manufacturer, proposed product, model number, quantity, unit sell price, unit list

price, discount percentage, extended sell price, delivery, freight, installation, fees,

and labor.

12. Should a Vendor find discrepancies in or omissions from the specifications,

quantities, drawings, instructions and bid proposal form, or should he/she be in

doubt as to the meaning, he/she should notify Stantec, via email by date and time

indicated on the Schedule.

13. It will be the Vendor’s responsibility to verify all quantities required for the items

specified. For the purpose of a level bid Vendors must use the quantities outlined in

this RFP. If the vendor notes a discrepancy (as noted above) they are to inform

Stantec and note the discrepancy in their bid response.

14. It is the Vendor’s responsibility to note in their proposal, any detail or specification

that would void any warranty or disrupt the product’s structural integrity.

15. Vendor is required to verify all model numbers to written description. Description

shall take precedence over model numbers. Notify Stantec of any discrepancies

during verification.

16. The Vendor warrants to Owner that all materials, furniture, furnishings and

equipment furnished under this contract will be new (unless noted as relocated

from current Owner’s facilities, or as specified to be bought as used per

specifications) and that work will be of industry standard quality, free from defects

and faults, and in conformance with the contract documents and specifications.

All work not conforming to these requirements may be considered defective. If

required by Owner, the Vendor shall furnish satisfactory evidence as to the kind

and quality of materials and equipment.

17. Bids are to be held open for 120 days. The Vendor selected to provide and/or

install the furniture specified in this document shall guarantee all unit prices for

twelve (12) months from date of the Vendors proposal.

18. The Vendor shall furnish a guarantee from each manufacturer guaranteeing the

availability of specified products for ten (10) years from date of original delivery

and/or provide non-obsolence clauses.

19. The vendor shall reference the front-end specifications of the architectural contract

documents for the construction of the building or space and comply with the

general conditions detailed therein.

20.

Confidentiality

1. This RFP is both confidential and propriety to Owner and the Owner reserves the

right to recall the RFP in its entirety or in part. Vendors shall return (or destroy at

Owner’s direction) all originals and copies of the RFP upon Owner’s request. At all

times, this RFP shall be deemed to be the property of the Owner. Vendors must not,

and agree that they will not, duplicate, distribute or otherwise disseminate or make

available this document or the information contained in it to a third-party without

the prior can written consent of Owner. Notwithstanding the foregoing, Vendors

may make this document available to those employees who have a need to know

its contents in order to participate in response to this RFP, and who are informed of

confidentiality restriction.

2. Without limiting the confidentiality and non-use obligations set forth in this RFP,

Owner may require that Vendors sign a detailed confidentiality and non-disclosure

agreement either prior to or subsequent to submitting a proposal.

3. Owner shall not be obligated to return the information and materials provided by

Vendor in connection with this RFP. If Vendor wishes any information that is

submitted in response to this RFP to be considered confidential and/or proprietary,

Owner must be advised of this in writing at the time the Proposal is submitted. Any

and all material that Vendor is to be considered and treated as confidential must

be clearly marked "confidential" and/or "proprietary property of [name of Vendor]"

prior to submission. Owner shall not be obligated to maintain the confidentiality of

any materials and information (i) are already in its possession, as evidenced by

records, prior to receipt or disclosure hereunder; (ii) is or becomes public

knowledge through no fault of Owner; (iii) is disclosed to client by a third-party who,

to Owner knowledge, is not bound by any confidentiality restriction and does not

bind Owner to such restriction; or (iv) is required to be disclosed by applicable law,

rule, regulation or judicial process.

4. Suppliers must accept all of the foregoing terms and conditions without exception.

Failure to comply with these provisions may serve to disqualify your proposal, and

Client deserves the right to pursue any right or remedy in law or at equity, including,

without limitation, injunctive relief.

5. No written publication or photographs will be allowed without the written approval

of Owner and Stantec. Owner and Stantec shall not be used as a reference for

any manufacturer, vendor, contractor or dealer without the prior written approval

from Owner and Stantec.

Proposal Award Criteria

Proposals will be evaluated and award will be based on the vendor’s ability to offer

the best value (productivity improvement, service, cost), and on anticipated

quality of service for the following principal elements:

• How well the Proposal meets the Owner’s needs.

• Cost, both furniture and installation (installation includes, but is not limited to,

unpacking, assembly, and locating the furniture to the appropriate space as

specified).

• Vendor’s relevant experience and reliability.

• Vendor references.

• Delivery and installation schedule and support.

• Work statement summary demonstrating a thorough understanding of

requirements and specifications.

• Assurance that the quality and functionality of the product is the same or equal

to the products specified in the bidding documents.

NOTE: Evaluation criteria are not stated in order of preference.

Vendor proposals will be reviewed and evaluated by the Owner with the

assistance of Stantec. If there are portions of any proposal the Owner finds

unacceptable or otherwise in need of clarification or revision, the Owner reserves

the right to negotiate with any or all Vendors.

References

Vendors are to furnish a minimum of three (3) qualified references to support their

proposals. References are to be from organizations that are not part of the

vendor’s organization and that closely parallel the needs stated in this RFP.

References shall be from organizations that have successfully utilized the products

and services which the Vendor has offered in its proposal(s).

The references supplied should include the name and address of the organization,

the name(s), titles, and the telephone numbers of the persons to be contacted and

a general scope of the product or services provided including the approximate

annual aggregate dollar volume involved.

Installation and Scheduling

1. The Vendor shall install all furniture using their own installation crew or shall identify

the name of the installation company in their proposal. Include appropriate

experience and reference information and union affiliation, if applicable, for the

same.

2. Dimensions supplied in these specifications and drawings are approximate. The

Furniture Vendor shall carefully check all dimensions and other conditions affecting

the work in the field and shall be responsible for proper installation in the required

areas.

3. Installers are required to “chalk” out all workstations, files and conference room

table bases to assist the general contractor in locating walls, demountable

partitions, aisle and electrical feed locations during the framing of the space.

4. Installers must coordinate final core locations and confirm furniture is in compliance

with applicable codes prior to commencing.

5. The Vendor/Installer will be responsible for the protection of Owner’s property

during the period of installation and shall exercise care to prevent damage to the

interior and the exterior of the buildings, lawns, trees, plant material, fences, walks,

drives, roadways, signs, light poles, utilities and other improvements in and adjacent

to the area of work. Damage to Owner’s property resulting from the

Vendor/Installer’s operations shall be repaired or replaced by the Vendor/Installer

without additional cost to the Owner.

6. The Owner reserves the right to identify the damages for “Immediate Repair”

resulting from the Vendor/Installer’s operations. Such damages will be repaired

within three working days, at the Vendor/Installer’s expense. If the Vendor/installer

fails to repair such damages within the three-day period, the Owner will proceed to

have the same repaired. The Vendor/Installer shall reimburse the Owner for the

same. Payments in the amount of the Owner’s expenditures for “Immediate

Repair” will be withheld until the Vendor/Installer has repaired all damages and has

made all reimbursements to the Owner.

7. A loading dock and an elevator is not available for vendor use to move furniture.

Wall and floor protection must be utilized and is the vendor responsibility to provide.

The furniture vendor must review the existing loading dock, freight elevator, and

freight elevator usage schedule and include any special handling if required in

their bid submission.

8. Each Vendor shall provide with their proposal response a schedule showing time

required completing installation plans, shop drawings, production runs, shipping

and complete delivery in a manner that coordinates with the construction and

occupancy of the project. Awarded vendor shall be responsible for schedule

coordination throughout the project.

9. The Vendor in conjunction with the Owner and General Contractor shall provide a

written plan of installation within 30 days of being awarded the project and graph

type schedule (MS Project) which will establish a flow and milestones of installation

at the site starting with the initial deliveries through final fine tuning and punch list.

The written plan and schedule will provide a description of stages, phases, major

activities, installation crew capacities installation activities. The schedule must

include point which electrician retained by the general contractor will be required

to finalize electrical connections and installation and termination of low voltage

voice/data cabling in systems furniture.

10. The Vendor shall confirm manufactures acknowledgements of purchase orders to

ensure accuracy, count and delivery, advise of any long lead times, and provide

information and viable alternatives.

11. The Vendor will monitor the fabrication and delivery of all specified items. Every

effort shall be made to assure that schedules will be met and that specifications

are being accurately followed.

12. The Vendor must provide updates on production status, lead times and COM status

and ship dates on all furniture items to the Owner and Stantec at a minimum of

every thirty (30) days from the point of award until forty-five (45) days before

delivery at which point attendance at weekly project meetings will be required.

Additional updates are required for all occurrences that may affect production

status and ship date regardless of the point in the schedule which they occur.

13. All COM fabrics shall be purchased, or placed on reserve, within 15 Business Days of

the issuance of the Owner’s purchase order. Vendor will furnish an

acknowledgement list that all COM fabrics have been coordinated.

14. The Vendor shall notify the Owner, Stantec, the general contractor and the project

team forty-five (45) days in advance of the date installation is to commence. At

this point the Vendor and project manager from the Owner contracted installation

team will be required to attend, at a minimum, weekly project meetings at the

project site.

15. The Vendor will be required to store furniture and furnishings if shipped earlier than

required per the construction schedule until the general contractor has completed

construction. The client will not pay for any storage if items are shipped early.

16. The Vendor shall ensure that all items delivered are in accordance with the

documents and shall notify the Manufacturer in the event of any discrepancies.

17. Damaged or defective furniture shall be replaced and/or repaired at no cost to

the Owner.

18. Freight charges are to be included in Vendor’s proposal. Freight to be FOB to the

Project Location. Arrangements for all freight charges must be made with the

Owner prior to shipping. Furniture may not be drop shipped without prior written

approval by the Owner. Installers must meet all trucks onsite and unload materials.

Owner is not responsible or costs incurred to redirect trucks due to schedule

changes.

19. The Vendor is responsible for material damage and loss until the installation is

complete and accepted by the Owner. Damage attributed to the Installer shall be

corrected by the Installer. The Owner will determine acceptance or rejection of

damaged items.

20. The Owner reserves the authority to stop work on a given segment of work or item

to ensure the proper interpretation and execution of the requirements of this

specification.

21. A representative of the Vendor must be onsite at all times for the duration of the

installation.

22. The on-site work to be performed under this purchase agreement will be

completed by the date indicated on the Schedule.

23. Unless otherwise agreed by the parties in writing, the date of substantial completion

of the work is the date determined by the Owner when all of the Specifications of

Work have been completed. Failure to achieve substantial completion shall not

prevent the Owner from using or occupying all or a portion of the project

workspace or the facility being altered, nor shall this usage or occupancy

constitute substantial completion.

24. The substantial completion date may be extended upon approval of the Owner.

25. Installer requirements:

• Furnish labor, incidental materials, equipment, supplies, and supervision to

receive, inspect, assemble, place, level and clean furniture in specified

locations in the Owner’s buildings, and to perform a complete installation of

items under this agreement.

• Identify one person, who shall act as liaison with the Owner and Stantec.

This individual must have the authority to make decisions on behalf of the

Installer.

• Ensure that all items are installed level, properly aligned and true, and

located as shown on the furniture plans.

• All packaging and protective coverings must be removed and seating

inspected for damage and dirt. Vendor is required to clean or replace any

soiled fabrics or finishes found prior to occupancy of the space by Owner.

Remove from the project waste materials and rubbish resulting from his work

and including packing cartons and other debris.

• Execute final cleaning just prior to acceptance of the entire work. Remove

all protective materials; clean all surfaces of dirt, smears, finger marks,

stickers, and all other contamination and foreign or extraneous matter.

• Installer shall leave chair operation instruction cards attached to task chairs

for removal by owner.

• Use cleaning agents and solvents which will not damage material and

finishes, as recommended for the purpose by the manufacturer of the

material to be cleaned.

• Inspect, test, lubricate, and adjust all operating hardware. Repair, or

replace defective or damaged parts, components, and other items at no

cost to the Owner.

• Vendor is responsible for removing their own trash from the site daily.

Dumpsters already onsite for construction purpose may not be used by the

vendor.

• The vendor is responsible for any furniture items damaged during the

process of installation.

Project Closeout

1. Provide operating and maintenance manuals as approved by each furniture

manufacturer or fabric manufacturer – one electronic (PDF) and two (2) hard

copies must be issued to the Owner after installation as outlined below.

• Product and Manufacturer contact information

• Maintenance Manuals

• Copies of Warrantees

• Wiring Diagrams (if applicable)

• Material Safety Manuals

2. The Manufacturer(s) shall provide the Owner after installation, with written

documentation which guarantees all items against defects in materials,

manufacture and workmanship for the item. Substantial completion shall not

relieve the Manufacturer from liability for such defects, and upon notification from

the Owner, the Manufacturer shall, by repair, replacement, or otherwise, return the

item in condition satisfactory to the Owner in every respect. Usual wear and tear

and results of accidents not chargeable to the Manufacturer and are exempted

from the requirements of this guarantee. Work completed due to this guarantee

shall be done without additional cost to the Owner. The products or workmanship

of any subcontractor are to be covered in the primary Vendor’s guarantee.

3. The Owner shall conduct a final inspection of merchandise ordered to assure that

all items meet specifications, are in new and undamaged condition, are

assembled or installed properly and placed in their properly designated locations.

4. After installation is complete, Stantec will send a punchlist of any incomplete,

missing, or damaged items to the Vendor. Vendor must submit a report of items

corrected no later than one month after the date of substantial completion.

Product Training

1. The Furniture Vendor is required, as part of the scope of this RFP, to provide

instruction to Client personnel for the proper use of ergonomic tools, seating,

lighting, storage components or systems. Furniture Vendor personnel and if required,

Furniture Manufacturer personnel specifically versed in the proper use of products,

shall be present on site for no less than ten business days of accumulated time and

to be scheduled by Client as Client sees fit. The total number of presentations

and/or instruction events and the size of groups of Client personnel is to be

determined by Client

General Specification Notes

1. Pricing for any systems furniture shall include panel to panel connections, code

required electrical components as required, and all brackets and hardware. The

labor required for electrical connections of the whip to activate the electrical system

at the building power demarcation [will be provided by the general contractor].

2. Dimensions supplied in these specifications and drawings are approximate. The

Vendor shall carefully check all dimensions and other conditions affecting the work in

the field and shall be responsible for proper installation in the required areas.

3. The detail layouts will define components within each workstation, office, room or

area. Detail drawings shall take precedence over floor plan graphics. However,

handling of like products shall be taken from the floor plan graphics and confirmed

by the Vendor with the architect prior to order placement by the Vendor with the

manufacturer. Every attempt has been made to fully identify the components and

accessories required for the workstations; however, all accessories, components and

hardware to affix, fully erect and complete these configurations are to be included in

this proposal, regardless of their inclusion.

4. The furniture floor plans will dictate orientation/handling. The Vendor is to field verify

all conditions and advises Stantec and the Owner of any conflict.

5. The specification documents in conjunction with the attached plans shall indicate

the design, finish, components and quality standards required. Proprietary

components shall be the manufacturer’s product or products which meet with the

performance requirements, sizes, shapes, finishes, and colors as shown and specified.

6. Manufacturer’s nameplates shall not be exposed on any item of furniture,

component, finish or hardware provided under this RFP or any future contracts or

orders.

7. All drawers and files to be locking. All locking elements shall be keyed alike per

workstation, office or conference/training room, but each office, workstation or

conference/training room shall be keyed differently.

All general files shall be keyed differently from each other. Provide four (4) master

keys per product family and plug pullers to Client at project completion. Two (2) keys

for each lock shall be provided to Client. All lock cylinders to be keyed to one master,

for all manufactures’ products in the entire project.

All drawers, overhead bins, files, wardrobes and similar items to be provided with

locks. Leave two (2) keys in each office and/or workstation for the end-user. Locks to

be steel/chrome finish. All extra keys are to be turned over to Client.

8. Drawer and file pedestals for all new products provided for the project shall be full

depth of work surfaces which they are beneath, unless noted otherwise, and shall be

provided with full extension extra heavy-duty glides. One convenience tray should

be provided for every pedestal containing a 6” box drawer.

9. Provide all connectors, end caps, top caps and variable height connectors required

for installation. Provide filler posts at all two way and three way connections. All

connectors shall be securely installed and in alignment. Filler posts show match trim of

panels in top cap paint color.

10. Electrical raceways for all products shall be provided with all components, grounding

systems and other appurtenances and shall comply with all U.L and ASTM standards

applicable to the type of product being provided, as allowed by local electrical

codes. All such costs are to be included in the RFP proposal response.

11. Provide telecommunications panel pathway and in-feed locations capable of

accepting minimum of eighteen Cat 6E cables at 40% fill capacity.

12. Each fabric and paint are to be from one dye lot. Any exception of this must be

reviewed and approved by Stantec.

Submittals

1. After award and specification of furniture, finishes and fixtures, following Submittals

will be required from the Vendor prior to order placement:

• Submit manufacturers’ data, including color graphic representations, written

descriptions, and installation instructions for each product specified.

• Include the manufacturer’s printed instructions and current recommendations

for storage procedures, protection, and final cleaning of the finished

installation.

• Shop drawings for all custom, modular millwork or modified from standard

products shown in the specifications attached to this RFP. Like products with

different orientation or handling must be separately and fully shown in shop

drawings. Submit anchoring details for all wall hung overhead interior

furniture.

• Submit not less than two (2) sets and one (1) Revit file to Stantec indicating

completely out of all systems, office and ancillary furniture accurately

showing all components, accessories, grommets, electrical and telecom

feeds, finishes and related items. For each type of office, workstation and

specialty areas of the Project provide large scale detailed plans and

isometrics of the rooms showing all furniture, components and accessories.

• Submit three (3) samples not less than 12 inches by 12 inches of each fabric,

paint, wood and laminate and three (3) 12 inch lengths of trim finish, properly

identified with the names of the Project, Vendor, Manufacturer and

identifying the specific location and product(s) where the finish is to be

applied and pattern direction.

• Fabric samples will be cuttings from the actual bolts of fabric which will be

shipped to the respective upholsterers unless Vendor guarantees the actual

field supplied products will match the samples provided. In the case of

specially designed fabrics, the manufacturer will submit to Stantec as many

samples as required to show the range within which the final project will fall.

Fabrics outside this range will not be accepted.

All submittals and fully dimensioned shop drawings shall be complete and submitted

to Stantec for formal review within ten (10) working days of contract award. All

submittal corrections shall be made and resubmitted within five (5) working days of

initial return.

The Vendor will not commence the shipment of any item until all related samples

have been reviewed and approved by Stantec.

Insurance Requirements

1. Prior to the commencement of installation, the Vendor and their Installation

Company shall obtain the following insurance, at its own expense, to be maintained

until the completion of the Work and Final Acceptance:

Your firm must submit a copy of your E&O Liability Policies.

The requirements below are the minimums that must be met.

i. Commercial General Liability Insurance (including broad-form contractual

liability and completed operations, explosion, collapse and underground

hazards) in the amount of $1,000,000 single limit.

ii. Comprehensive Automotive Liability Insurance, including hired and non-

owned vehicles, if any, in the amount of $1,000,000 single limit.

iii. Workman's Compensation Insurance in the amount of the statutory

maximum and employer’s liability insurance in the amount of $1,000,000.

iv. See insurance requirements in exhibits for further details.

2. The Landlord, Building Manager and Owner will require certificate of insurance

indicating the job site, additional insured and evidencing all required coverage, and

must be submitted to and approved by the Building Manager and Owner five (5)

business days prior to the commencement of any work.

3. All insurance policies shall expressly require THIRTY (30) DAYS written notice to the

Building Manager and Owner of the cancellation or material alteration of such

policy, and the Certificates of Insurance should so provide.

4. Vendors must provide Certificate of Insurance. During the life of the contract, the

Vendor shall maintain the type of insurance and the insurance limits stated in

Insurance Certificate.
