ECLAA Summary Report to Donors – FY2015 Page 1 of 7 Essex County Legal Aid Association (ECLAA) Summary Report to Our Donors in 2015 Executive Summary ECLAA, founded in 1906, is a 501(c)(3) nonprofit organization that provides free emergency legal services on civil matters to income-eligible residents of Essex County, NJ. ECLAA’s two staff attorneys and one paralegal provide immediate advice to such clients at our small office in the Hall of Records building at 465 Dr. Martin Luther King, Jr. Boulevard in downtown Newark. In 2015, ECLAA helped 1,444 low-income clients, all of whom lived in Essex County. 82% of our cases last year were housing matters, largely landlord/tenant issues. 69% of our clients last year were women. 55% of our clients lived in Newark, 15% in East Orange, 11% in Irvington; we also helped residents of 13 other Essex County municipalities. We helped clients from 18 to 85 years old. Their household incomes were each less than 250% of Federal poverty guidelines. Each client was helped for free by an ECLAA staff attorney – working face-to-face and one-on- one – who counseled that client professionally and with respect, candor and empathy. ECLAA was able to be both effective and increasingly efficient in 2015, by doing more with less: We provided ECLAA’s court-based legal services four days a week last year for $171,940. Our average cost of helping each client was $119 in 2015 (vs. $142 in 2014 and $164 in 2013). Our cost per person in clients’ households was $45 in 2015 (vs. $56 in 2014 and $64 in 2013.) As a 501(c)(3) nonprofit organization, the Essex County Legal Aid Association is totally dependent on donor support – and we are honored to report that we have been able to stretch our dollars year over year, with that efficiency allowing us to increase the number of low-income clients we help year after year. We thank all ECLAA’s 2015 donors. We received $75,000 from the Legal Services Foundation of Essex County and $40,760 from the IOLTA Fund of the Bar of New Jersey in 2015 – down a total of about $15,000 from the prior year. The Thomas and Agnes Carvel Foundation made a first-time $10,000 donation to ECLAA in 2015. During our 2015 Campaign for ECLAA, we also received donations totaling $37,251 from 43 law firms, 12 attorneys, 8 generous non-attorney individuals, the legal department of one large NJ corporation, one vendor to the legal community, and some miscellaneous donation matching programs. Each of these donors is acknowledged on page 7. We are grateful to them all. You can make a difference in 2016. Your meaningful donation can assure that poor clients in desperate need of emergency legal advice about civil law crises will get ECLAA’s free help! To date for 2016, we have received pledges of $110,760, and this total accounts for about 63% of our 2016 operating budget of $177,100. EssexCountyLegalAidAssociation:SomeSpecificClientsWeHelpedin2015Wehighlightbelow19ofourcasesforindividualclientsoverthecourseoftheyear.Morethanmeredatasummaries,thesecasesshowtheimpactECLAAhadonthelivesofat-riskclientsandtheirfamilies.Thesecivillawcrisesallrepresentedimminentthreatstoourclients’wellbeing:1. Anelderlytenant’sgrandson,whilevisitingher,attackedthebuildingmanager.Onceshewas

notifiedoftheviolation,ourclientimmediatelyceasedallowingvisitsbyhergrandson.Evenso,shewasevicted.WefiledanAffidavitonherbehalf,whichledtotheevictionbeingvacated.

2. Theconditionsofourclient’sapartmentwereegregiousandunsafe.Thetownclosedthebuilding.Ratinfestationwaspervasive,withratnestsinplainsight.Thebuildingmanagermadeanattemptatrelocation,butthenewapartmentwassimilarlyunsuitable.Afterwepreparedpaperworkandworkedwiththebuildingmanager,amoreappropriatedwellingwassecuredforourclient.

3. Apre-medstudent’shousingfeeswerepartofheracademicscholarship.Duetoherfather’sdeportation,someelementsofherscholarshipwerebeingreviewed.Paymentonherhousingwastemporarilyhalted.WepreparedanAffidavitonherbehalfdelineatingtheuniqueissuesandobtainedaone-monthrespitefromevictionwhilereviewofherscholarshipwaspending.

4. Wehelpedamentallyillclientwhothreatenedothertenantsinthebuilding.Shehadreceivedanoticeterminatinghertenancy.WiththehelpofEssexCountyMentalHealthServices,wewereabletoobtainanextensionontheevictionuntilamentalhealthadvocatecouldbeappointed.

5. WepreparedaCertificationinOppositiontoanEjectmentonbehalfofourclients.Thelandlordallegedthattheclientsweresquattersandhadnotenancyrightsintheapartment.Ourcertificationaddressedourclients’agreementtopaythelandlordrent,attachedtheirreceiptsforrentalpaymentsplusareceiptshowingclient’spaymentforthetotalcostofanewboilerontherentalproperty.TheEjectmentwasdismissed.

6. WepreparedaMotiontoVacatethelandlord’spossessionduetothelandlord’slackofcompliancewithSection8recertificationrequirements.Theclientwasuptodatewithherportionoftherentbutwasneverthelessevicted.OurmotioncontainedaletterbrieftothecourtoutliningthegoalsofSection8topreventhomelessnessandindicatingthatanevictionbasedonthelandlord’sfailuretocomplywiththeirrequirementsrancontrarytothepublicpolicyunderlyingsubsidizedhousing.Thatevictionwasvacated.ThelandlordwasdirectedtocomplywithSection8.ThisclienthadlivedintheapartmentasaSection8tenantforfiveyears.

7. Atenantlivedwithoutheatorwaterfortwoyearsbutwasafraidtoconfrontthelandlordorreportthemattertothetown.Withourassistance,theclientwasabletoaddressthismatterwithcodeenforcement,whichimposedfinesonthelandlorduntiltheutilitieswererestored.

8. Aclientwasdisplacedbyafireintheapartmentbutwasnotrelocatedbythelandlord.Sheincurredsignificantcoststomoveheritemsfromtheapartmentandplacetheminstorage.Shealsoneededtorentanotherapartmentwhilethefire-damageddwellingwasremediated.Thesecostsexceededherpreviousmonthlyrent.Weassistedtheclientinobtaininganimmediatereturnofhersecuritydepositandacredittowardshermonthlyrentoncethefire-damagedpremiseswererestored.

9. InaHUDmatter,weassistedtheclientwhowaschargedanexcessiverentincreasedespitethecertificationprocessineffectattherentalsite.Wecontactedthelandlord/agencyandnegotiatedapaymentplanforthearrearsandestablishedarevisedmonthlyrentreflectingthenewcertification.

10. Weassistedafamilywhohadpaidthelandlord’srealestateagentasecuritydeposittoholdanapartment.Afterourclientmadethedeposit,thelandlordrefusedtorenttheapartmentbecauseofpriorlandlord/tenantcomplaints.However,thelandlordwasnotvoluntarilyreturningthesecuritydepositmoney.Wecontactedtheagent,spoketoandnegotiatedwiththelandlord,andourclientwasallowedtorenttheunitasinitiallypromised.

11. Ourclientwasafirstfloortenantwhereheandhiswiferesidedforthirtyyears.Theclientcomplainedaboutexcessivenoiseandunauthorizedvisitorstothepropertythatdirectly

impactedhisWarrantyofHabitability.Wehelpeddraftalettertothelandlord,settingforththetenant’srightstoquietuseandenjoymentofthepremises,andconsequencesofbreakingthisWarranty.

12. InanotherWarrantyofHabitabilitycase,wereviewedaleaseandthetermsthereintoaddresscertaincomplaintsfromtheclient/tenant.Theclientcomplainedaboutdefectsintheapartment–includingbutnotlimitedtodefectivedoors,adefectiveintercomsystemanddamagedwindowsandscreens.Wepreparedalettertothelandlordaddressingthesedeficiencieswhileplacingthelandlordonnoticethattheybreachedthelease.

13. Weassistedatenantwhoclaimedanadditionalsurchargewasaddedtohermonthlystatementwithoutexplanation.Wecontactedthepropertymanageranddraftedaletterseekinganaccountingofthesechargesandareimbursementofoverpaidmonies.

14. Weassistedaclientfacingevictionforcriminalactivityallegedbyanothertenant.Thecasewasbasedonlyonthehearsayofthatothertenant,whohadrepeatedlyfiledfrivolouscomplaintsinmunicipalcourt.Theclientsoughtadviceonpreparingfortrial.WeguidedherinobtainingcopiesofthecriminalcomplaintsandthesubsequentdismissalsfromtheCourt.Weinstructedtheclienttobringrelevantwitnessestocourttodisputetheallegationsinthecomplaint.

15. Weaddressedthecontractualliabilityassociatedwithsigningayearlylease.Thetenantallegedthatunsafeconditionsoftheapartmentbuildinghadledhimtoberobbedonmultipleoccasions.Thetenanthadsignedaone-yearleaseandsoughttoproperlyterminatethelease.Wedraftedalettertothelandlordexplainingthat,asaresultoftheirfailuretoprovidesafehousing,thelandlordhadbreachedtheWarrantyofHabitabilityaffordedtoalltenants.Thisletterhelpedourclientproperlybreaktheleasewithoutenduringthecontractualliabilityattachedtosigningthatlease.

16. Weassistedaclientwhowasimproperlybilledforworkconductedbyasuperintendentintheregularcourseofthebuilding’smaintenanceandrepair.Wepreparedaletterpointingouttheunreasonabledemandassociatedwiththesuperintendent’slimitedwork.

17. OurhelpwassoughtinamatterwherethelandlordobtainedajudgmentofevictionbutfailedtohonortheOrderforOrderlyremovalobtainedbythetenant.Wecontactedthelandlord’sattorneyandfacilitatedtheclient’sre-entryintotheapartment.

18. Weassistedaclientwhoresidedinaroominghouseandfacedexcessiverentincreases.WeresearchedandadvisedtheclientregardingherrightsundertheAnti-Evictionstatutethatextendedtoroominghouses,andthus,protectedherfromunlawfulexcessiverentincreases.

19. WeprotectedaclientwhoseSSIpaymentswereimproperlyleviedcontraryto42USC407(a)bypreparinganexplanatorylettertoopposingcounselwithsupportingdocumentsofSSIpayments.ThroughECLAA’shelp,theclient’srightstoherSSIpaymentswereprotected.
