Uplift of health care servicesthrough Myanmatraditional medicine Myanma traditional medical science pos-

sesses effective treatments and potent medi-

cines. Myanma traditional medical practi-

tioners have been providing health care serv-

ices to the people in the successive periods.

The government is giving special priority

to uplift the standard of Myanma traditional

medicine and its development. It has also

opened the University of Traditional Medi-

cine, traditional medicine hospital and clin-

ics and produced potent medicines and con-

ducted research and promoted public health

care services.

The government is now launching the pi-

lot project to distribute traditional medicine

kits to the people in rural areas. The kit

includes medicines for common ailments,

bandage and reference manual.

At present the kits are being distributed to

13 villages in Nay Pyi Taw Pyinmana, Nay

Pyi Taw Lewe and Nay Pyi Taw Tatkon

Townships. In the future, these kits will be

distributed to all parts of the nation through

proper programmes combined with experi-

ences gained.

With the cooperation among the Ministry

of Health, authorities concerned, related min-

istries, social organizations and wellwishers,

the distribution of traditional medicine kits

will surely contribute towards the uplift of

health standard in rural areas.

YANGON, 13 Aug — Two members ofSagaing Division National League for DemocracyParty of Sagaing Division resigned from the party oftheir own accord on 25 July.

U San Lwin and U Win Bo of Sagaing Town-ship NLD resigned from the party and sent theirresignation letters to the NLD (Headquarters) andSagaing Division Multi-party Democracy GeneralElection Subcommission. In the letters, they said theNLD (Central) is lack of definite political programme.The leaders of the party are disunity and they arefocusing on coming to power with self-interest. Theparty leaders are opportunists without political expe-rience and the party never participate in carrying outregional development tasks. They no longer stand asmembers of the party, and that is why they resignedfrom the party, they said.

Sri Lanka unhappy withUN envoy’s remarks

COLOMBO, 13 Aug— Sri Lankan Prime MinisterRatnasiri Wickramanayake said Saturday that theremarks of the top United Nations humanitarianofficial on Sri Lanka’s humanitarian situation wasunbecoming.

John Holmes, the United Nations Emergency ReliefCoordinator and Under Secretary General ofHumanitarian Affairs said here Thursday that “there isa concern about the safety of humanitarian workersthemselves and the record here is one of the worst in theworld.”

“This is most unbecoming because when he met thePresident (Mahinda Rajapakse) or when he attendedthe Press conference he did not make such comments,”said Wickramanayake in addressing a public gatheringat his Horana constituency, about 40 kilometres east ofhere.

He said that the government was baffled byHolmes' action to make the comments at a private Pressinterview.

Echoing the Prime Minister’s views the Ministry ofForeign Affairs in a release said that Holmes during hismeetings with officials had taken the view that despiteinitial concerns on the safety of aid workers in theisland the things were getting better.

The ministry blamed Holmes for his “indiscreet andirresponsible comment.”

During his three-day visit to the island country,Holmes visited the northern town of Jaffna and parts ofEastern Province to assess the situation and the reliefwork.

YANGON 13 Aug—The following is the suggestionsof National Unity Party on matters concerning theamendments, the additions, the repeals and the transferout of the fundamental principles and detailed basicprinciples that have been adopted by NationalConvention.

I wish health and happiness for all the esteemedChairman and members of the Panel of Chairmen, theesteemed Chairman and members of the NationalConvention Convening Commission, the esteemedChairman and members of the National ConventionConvening Work Committee, the esteemed Chairmanand members of the National Convention ConveningManagement Committee, and delegates.

I am U Tun Yi of National Unity Party.Mr Chairman,

At the plenary session of the National Conventionheld on 6 August 2007, the Chairman of the NationalConvention Convening Work Committee explained theadopted fundamental principles and detailed basicprinciples that should be amended, added, transferredand repealed. The Work Committee Chairman invitedsuggestions on the matter. In this regard, the NUPcompiled and presented this paper.Mr Chairman,

The State will carry out the legislative and executivefunctions in accord with the fundamental principles.The running of the legislative and administrativemachinery may face disturbances and obstacles if alawsuit is filed against the State while taking advantageof its failure to implement the task in accord with saidprinciples as time and situation is not ripe yet. Myopinion is that if a detailed basic principle regarding thematter should be adopted an addition should be made tothe para (3) of the Chapter—General Provisions, whichsays “The State fundamental principles are theguidelines to be followed by the legislative Hluttawsin enacting laws and interpreting provisions of theState Constitution and of other laws.”

In our view, the expression “The application ofthese principles in legislation and administration shallbe the care of the State but shall not be enforceable inany court or law” should be added to the said detailedbasic principle.Mr Chairman,

The plenary session of the National Convention heldon 27 October 2006, adopted the detailed basic principlesincluding the para (50) which states “In this Chapter “TheState” means a body that exercises legislative andexecutive powers according to this Constitution.” for theChapter “Citizenship, Fundamental Rights and Dutiesof Citizens”. According to the statement, it is as if thatthe term “State” contained in the detailed basic principleconcerns only with the Chapter “Citizenship, FundamentalRights and Duties of Citizens”.

The term “State” can be found in the Chapter I“State Fundamental Principles” for many times. In ourassumption, an addition should be made to the para 50 for

the detailed basic principle to cover the interpretationand definition of the term “State” of the given chapter.The para refers only to the term “body”. There may beoccasions in which the legislative power and executivepower are exercised by an organization or by a person. Inthis situation there may be a constitutional problem.They may be no reason for the occurrence of any disputesif the stipulations contained in the detailed basic principleare fully comprehensive.

We agree that the para (50) of the Chapter“Citizenship, Fundamental Rights and Duties of Citizens”should be amended as follows:

“In this Chapter and the Chapter on StateFundamental Principles, “The State” means a bodyor a person that exercises legislative and executivepowers according to this Constitution.”Mr Chairman,

To ensure a harmonious context and to prevent againstoccurrence of disputes in the future, the detailed basicprinciple 11 (c) (ii) for the formation of judiciary in connectionwith the qualifications of judges of the High Court of theRegion or State should be amended as “a person who hasserved as advocate for at least 15 years”.Mr Chairman,

The subpara (a) of para 2 of the adopted detailedbasic principles for the chapter “Political Parties” states“A political party shall: (a) accept and practisediscipline-flourishing genuine multipartydemocracy.” The expression emphasizes in allseriousness that the democracy Myanmar will practise inthe future is a discipline-flourishing genuine multipartydemocracy system. In our view, there should be acontextual uniformity in drafting the Constitution. Hence,the usage “discipline-flourishing genuine multipartydemocracy” should be used in para 2 subpara (d), para3 and para 28 of the Chapter “State FundamentalPrinciples”.Mr Chairman,

In our view, to have a uniformed context and toprevent occurrence of disputes in the future, the term“Pyidaungsu Taya Hluttaw” in the subparas (a), (b)and (c) of para 9 of the Chapter “State FundamentalPrinciples” should be substituted with the term “SupremeCourt of the Union”.Mr Chairman,

In adopting the detailed basic principles for theformation of executive the subpara (h) of para 22 has theexpression which states “The President of the State mayexercise relaxation of stipulation on age limit in theState Constitution”. As the para states “The Presidentof the State may exercise relaxation of stipulation onage limit”, he may or may not exercise relaxation on agelimit. To be able to clearly express the essence and aim ofthe given detailed basic principle and to prevent occurrenceof constitutional disputes in the future, the expression“may exercise relaxation of stipulation on age limit”should be substituted with the expression “shall exerciserelaxation of stipulation on age limit”.Mr Chairman,

To ensure a contextual uniformity and to have a cleardefinition in drafting the Constitution, subpara (f) para28 and subpara (e) para 31 should be amended as follows:

Subpara (f) of para (28) “The Advocate-General ofthe Region or State is

(i) responsible to the President of the Statethrough the Chief Minister of the Region orState concerned

(ii) responsible to the Pyidaungsu Attorney-General and to the Chief Minister of theRegion or State concerned

The subpara (e) of para (31) The Auditor-Generalof the Region or State is

(i) responsible to the President through the ChiefMinister of the Region or State concerned

(ii) responsible to the Pyidaungsu Auditor-General and to the Chief Minister of theRegion or State concerned

Mr Chairman,Concerning the formation of Hluttaw, the plenary

session of the National Convention held on 2 September1994, the following detailed basic principle was adopted:

“Pyithu Hluttaw shall be formed with a maximumof 440 Hluttaw representatives as follows:

(a) Not more than 330 Hluttaw representativeselected on the basis of population

(b) Not more than 110 Tatmadaw memberHluttaw representatives nominated in accordwith law by the Commander-in-Chief of theDefence Services.”

If the election of the Pyithu Hluttaw representativesis based on population, Regions will be able to elect 237representatives and the States will be able to elect 93representatives.

If the election of the Pyithu Hluttaw representativesis based on population and township, Regions will be ableto elect 206 representatives and the States, 124 which isplus 31.The original aim can be realized as greaternumber representatives of national races will be able totake part in the Pyithu Hluttaw.

It will not be in a position to elect one representationeach from every township, if the total number of townshipsexceeds 330. So, when the number of townships goesover 330, a newly formed township should be joined withone of the townships adjacent to it to designate a PyithuHluttaw constituency.

To ensure an enduring detailed basic principle, thegiven para should be amended as follows:“Pyithu Hluttaw shall be formed with a maximum of440 Hluttaw representatives as follows:

(a) Not more than 330 Hluttaw representativeselected on the basis of township as well as onthe basis of population from constituenciesdesignated in accord with the law aftercombining a newly formed township with oneof the suitable townships adjacent to it if thetotal number of townships exceeds 330

(b) Not more than 110 Tatmadaw memberHluttaw representatives nominated in accordwith law by the Commander-in-Chief of theDefence Services.”

If the abovementioned detailed basic is adopted theusage “the Hluttaw formed with Hluttawrepresentatives elected on the basis of population”should be substituted with the usage “the Hluttaw formedwith Hluttaw representatives elected on the basis oftownship as well as on the basis of population”.Mr Chairman,

At the plenary session of the National Conventionheld on 28 March 1996, detailed basic principles for theformation of Amyotha Hluttaw were adopted. In ourview, the word “the respective” should be added to theword “Union territories” of the subpara (a) for the usageto be more precise. The expression “inclusive of Unionterritories” means areas that were included in the presentstates and divisions but have been designated as Unionterritories and the areas proclaimed by the PyidaungsuHluttaw as Union territories because of their significantcharacteristics after the promulgation of this Constitution.

Hence, abovementioned detailed basic principleshould be amended as follows:

“Amyotha Hluttaw shall be formed with a maximumof 224 Hluttaw representatives, as follows:

Mr Chairman,Regarding the designation of Union territories, the

National Convention plenary session held on 9 April 1994laid down detailed basic principle para 5 (a), (b) and (c). Thesubpara (a) states, “(a) Yangon City that is the Capital of theUnion, is designated as Union territory placed under directadministration of the President of the Union.” The plenarysession of the National Convention held on 2 August 2007,has designated Nay Pyi Taw as the Capital. Hence, theexpression “Yangon is the Capital is Union” should beamended. The designation of Yangon as a Union territoryunder the direct administration of the President should berevoked. And the municipal area of Nay Pyi Taw, which hasbecome the Capital of the State, should be designated as aUnion territory placed under the direct administration of thePresident. Moreover, the detailed basic principle “CocogyunTownship which has a special situation is designated asUnion territory and placed under direct administration of thePresident of the Union” should be revoked.

Concerning the designating of Union territories, thefollowing detailed basic principles should be adopted:“(a)Nay Pyi Taw, that is the Capital of the Union, isdesignated as Union territory placed under directadministration of the President of the Union.(b) if need arises to designate areas that have specialsituation in connection with national defence, security,administration and economy etc. as Union territoriesthey may be so designated as Union territories afterenacting laws”Mr Chairman,

If we agree to the proposal of designating Nay PyiTaw, the Capital of the Union of Myanmar, as a Unionterritory placed under direct administration of the President,detailed basic principles to be adopted for Nay Pyi Tawshould be the same, as that for Yangon Council.

Therefore, we made a suggestion that the term “CapitalYangon” prescribed in the detailed basic principles onadministration of Capital Yangon, a Union territory,

prescribed in para 35 and the detailed basic principles ondesignation of the status of the Chairman and members ofYangon Council prescribed in para 36 of the detailed basicprinciples adopted at the plenary session held from 28 to 30March 1996, should be replaced with the term “Nay PyiTaw”, and the term “Chairman of Yangon Council”prescribed in sub-para (c) 6 of para 16 of detailed basicprinciple for Formation of Financial Commission with theterm “Chairman of Nay Pyi Taw Council”.

We agree that it is no longer needed to prescribe thedetailed basic principles on administration of CocogyunTownship, a Union territory, prescribed in para 37. So theywill not be prescribed any longer.Mr Chairman,

The plenary session of the National Convention heldon 12 December 2005 laid down detailed basic principlesfor the sharing of judicial power. In this regard, sub-para 4(a) of para 6 says, “With regard to the judicial matter,Yangon Region High Court is the high court of thecourts situated in Yangon City and CocogyunTownship”.

After the designation of Capital Nay Pyi Taw as aUnion territory and revoking the designation of Yangonand Cocogyun Township as Union territories, it will needto amend the detailed basic principle, as appropriate.

Therefore, the sub-para 4 (a) of para 6 “With regardto the judicial matter, Yangon Region High Court is thehigh court of the courts situated in Yangon City andCocogyun Township” should be amended as “Withregard to the judicial matter, Mandalay Region HighCourt is the high court of the courts situated in Nay PyiTaw”.Mr Chairman,

Of the 15 Chapter headings to be included in formulatingthe Constitution, some of the detailed basic principles of theChapter “State Fundamental Principles” were transferredto the respective chapters. It is appropriate that the twofundamental principles that have been transferred to theChapter “Head of State”, the 11 fundamental principles,transferred to the Chapter “ “Citizenship, FundamentalRights and Duties of Citizens”, and the two fundamentalprinciples, transferred to the Chapter “General Provisions”totalling 15 will no longer be stated in the Chapter “StateFundamental Principles”.Mr Chairman,

The plenary session of the National Convention heldon 3 March 2005 laid down detailed basic principles for thesharing of legislative power. In this regard, para 15, sub-para 5 says, “The existing laws are still in force until theyare revoked or amended by the Pyidaungsu Hluttaw,and unless they are in contrary to the Constitution”.

Moreover, the plenary session of the NationalConvention held on 2 August 2007 adopted detailed basicprinciples for the Chapter “Transitory Provisions”. Inthis regard, para 5 says, “The existing laws are still inforce until they are revoked or amended by thePyidaungsu Hluttaw, and unless they are in contrary tothe Constitution”.

The two detailed basic principles are exactly the same,in word and in essence. We agree that it is more appropriatethat the detailed basic principle should be prescribed in theChapter “Transitory Provisions”. Therefore, we alsoagree that the detailed basic principle para 15, sub-para 5in the sharing of legislative power no longer needs to beprescribed, and it will be revoked.Mr Chairman,

It is appropriate that the NC to make necessaryamendments to the terms, dictation and word orders withouthaving any adverse effects to the aims and essence of thebasic principles and detailed basic principles adoptedaccording to the minutes of the NC in drafting the StateConstitution.

The holding of the National Convention began in 1993to adopt fundamental principles and detailed basic principlesto draft the Constitution, really required for the nation.Now the NC has already adopted the fundamental principlesand detailed basic principles chapter heading wise. Wehave found that the National Convention ConveningCommission and the NCC Work Committee complied andlaid down the said principles in conformity with ourtraditions and culture and customs after thoroughly studyingthe 1947 Constitution, the 1974 Constitution andconstitutions of some world nations.

It is appropriate that the Work Committee explainedthe matter concerning the amendment, the repeal, thetransfer and the addition of the fundamental principles anddetailed basic principles as necessary after assessing themto be in accord with the time and situation, to define thefundamental principles and detailed basic principles moreclearly, to draft the Constitution more precisely and clearly,to have a uniformed context and to prevent occurrenceconstitutional disputes in the future.Esteemed Mr Chairman and delegates,

The National Convention began in 1993 with the aimof drafting a constitution for emergence of a peaceful,modern and developed discipline-flourishing democraticstate. The NC will successfully conclude soon. It is aprestige for the delegates to serve the interest of nation andpeople while sacrificing their own interest for the successof the NC.

The National Unity Party too has continuously takenpart in the National Convention from the stage of makingpreparations to convene the NC till its successful completionto lay down and adopt the objectives, fundamental principlesand detailed basic principles.

Of the seven points of the Road Map, the successfulcompletion of the National Convention is the most basicpart for the emergence of a democratic state in the future.Hence, based on the already-achieved sound foundations,the entire nation should take part in implementing theremaining stages.

The NUP always places in the fore the national interestwhile harmoniously implementing the party politics andnational politics. Hence, we have made a serious pledge tojoin hands with the people and to play a part in implementingthe remaining stages.—MNA

Sovereignty is eternal truth. Discovering the truthshould not be based on violent acts or the wish of themajority, but on reasoning. Error is man. It is absolutelyimpossible that a man has never made a single mistake.According to a political scientist, there will turn out aperfect and appropriate constitution only through suchkinds of basic principles that are based on consideration.It is needed to respect the freedom of each person. Noone has the right to oppose the government, and thesovereignty is something formed politically in theinterests of the entire people. The Constitution plays acrucial role in ensuring stability of a country. Without aconstitution, there cannot be a stable government. TheConstitution is the basic law of laws of the State, so itcan be said the mother law. If necessary, the StateConstitution is to be adopted and exercised and some ofthe basic principles are to be amended. Some countries’incidents have revealed that defects and loopholes oftheir constitutions caused political, economic and social

crises. When the crises were reinforced by alieninstigation, the countries faced a variety of havoc rangingfrom civil war to collapse of the nation concerned.There have been changes in the social-economic systemand social political science based on passage of time andregion. Therefore, it is required to prescribe necessarylaws that are in conformity with the changes.

It is State Constitution that can remove the doubtsand suspicions among the national races and guaranteetheir secure life. Only when the State Constitution isdrafted completely and exactly without mistakes andcan guarantee justice, freedom and prosperity, willthere be no defects and loopholes in it. The term“legislation” covers enacting, revoking, adding,amending or transferring the laws. All the Stateconstitutions are designed to ensure prosperity,development, stability and peace of the nationconcerned. We witness that the National ConventionCommission and the National Convention ConveningWork Committee are working hard day in, day out intheir tasks to ensure that the forthcoming StateConstitution can guarantee national reconsolidation,help national races join hands in harmony and keepcheck and balance among themselves, and turn out aState Constitution with no weaknesses that can servethe public interests.

In connection with the qualifications of the judgesof the High Court of the Region or State prescribed inFormation of Judiciary, para 11 (c) (ii) states “a personwho has served as advocate for 15 years”. It should be“a person who has served as advocate for at least 15years”.

The expression “genuine multiparty democracysystem” contained in para (b), sub-para 4 (c) and (d)should be “discipline-flourishing genuine multipartydemocracy”.

The term Pyidaungsu Taya Hluttaw (Supreme Courtof the Union) prescribed in the sub-paras 1, 2 and 3 of para(i) of the Chapter “State Fundamental Principles” shouldbe substituted with the term Pyidaungsu TayaHluttawgyoke (Supreme Court of the Union).Esteemed Mr Chairman,

The expression “The President of the State mayexercise relaxation of stipulation on age limit in the StateConstitution” prescribed in sub-para (h) of para 22 shouldbe “The President of the State shall exercise relaxation ofstipulation on age limit in the State Constitution”.Mr Chairman,

We support the amendment of sub-para (f) of para 28:“The Advocate-General of the Region or State is

responsible:(1) to the President of the State through the Chief

When the points about addition, amendment, repealand transfer the Work Committee chairman haspresented are approved, the National Convention willadopt the basic principles and detailed basic principlesfor 15 chapters to be included in the State Constitution.Then, necessary measures will be taken for step-by-step implementation of the State’s seven-step RoadMap. And the State Constitution will be drafted basedon the basic principles and detailed basic principles. Ithink the present Work Committee should be vestedwith the duties to draft the State Constitution inaccordance with the objectives and essence of thebasic principles and detailed basic principles.

The State will carry out the legislative and executivefunctions in accord with the fundamental principles.In doing so, the State will implement the functions inaccord with the nation’s prevailing situation and time.The running of the legislative and administrativemachinery may face disturbances and obstacles if alawsuit is filed against the State while taking advantageof its failure to implement the task in accord with saidprinciples as time and situation is not ripe yet. In ourview, it is necessary to adopt a detailed basic principlethat will protect the State.

National Convention adopted the detailed basicprinciples including the para (50) for the Chapter“Citizenship, Fundamental Rights and Duties ofCitizens”. According to the para, it is as if that the term“State” contained in the detailed basic principleconcerns only with the Chapter “Citizenship,Fundamental Rights and Duties of Citizens”. Weon our part have agreed to amend the given detailedbasic principle as follows:

“In this Chapter and the Chapter one on StateFundamental Principles, “The State” means a bodyor a person that exercises legislative and executivepowers according to this Constitution.”Mr Chairman,

In connection with the qualifications of the ChiefJustice of the Union and Judges of the Supreme Courtof the Union, it is stated “have been an advocate of

a High Court of at least 20 years’ standings”. Thestatement was to indicate the least required period forthe said matter.

In connection with the qualifications of the ChiefJustice of the High Court of Region or State ChiefJustice and judges of the High Court of the Region orState, it is stated “a person who has served asadvocate for 15 years”.

In layind down the State Fundamental Principles,the subpara (b) states “(b) in the Pyidaungsu isconstituted one Pyidaungsu Taya Hluttaw.Pyidaungsu Taya Hluttaw is the supreme law courtof State”. To have a contextual uniformity in draftingthe Constitution, the term should be used “SupremeCourt of the Union”.

Now, we are going to discuss the term “mayexercise relaxation of stipulation on age limit”. Wehave already studied the clarification made by theWork Committee Chairman concerning the matter.

As the subpara (h) of para 22 states “The Presidentof the State may exercise relaxation of stipulationon age limit”, he may or may not exercise relaxation onage limit. To be able to clearly express the essence andaim of the given detailed basic principle and to preventconstitutional disputes in the future, it should be used“shall exercise relaxation of stipulation on age limit”.Mr Chairman,

The plenary session of the National Conventionheld on 29 March 1996, adopted detailed basic principlesfor the formation of executive. In the detailed basicprinciples, subpara (l) of para 22 states as follows:

(i) The Region or State Chief Minister shall beresponsible to the President of the State

(ii) The Region or State Minister shall beresponsible to the Region or State ChiefMinister concerned and through the ChiefMinister, to the President of the State.

The subpara (f) of para (28) states, “The Advocate-General of the Region or State is responsible to thePresident of the State through the Chief Minister ofthe Region or State concerned, to the PyidaungsuAttorney-General and to the Chief Minister of theRegion or State concerned.

The subpara (e) of para 31 states, “The Auditor-General of the Region or State is responsible to thePresident through the Chief Minister of the Regionor State concerned, to the Pyidaungsu Auditor-General and to the Chief Minister of the Region orState concerned.

To ensure a clear meaning and contextualuniformity, subpara (f) para 28 and subpara (e) para 31should be amended as follows:

Subpara (f) of para (28) “The Advocate-Generalof the Region or State is

(i) responsible to the President of the Statethrough the Chief Minister of the Region orState concerned

(ii) responsible to the Pyidaungsu Attorney-General and to the Chief Minister of theRegion or State concerned

The subpara (e) of para (31) “The Auditor-Generalof the Region or State is

(i) responsible to the President through theChief Minister of the Region or State

concerned(ii) responsible to the Pyidaungsu Auditor-

General and to the Chief Minister of theRegion or State concerned.

Mr Chairman,The delegates have witnessed the daily, monthly

and yearly changes in the administrative, economicand social sectors resulting from their rapiddevelopment. We will witness more development inthe future. In this situation, more townships will haveto be formed as necessary. When the total number oftownships exceeds 330, the number of Pyithu Hluttawrepresentatives will also exceed 330.

To ensure an enduring detailed basic principleconcerning the formation of the Pyithu Hluttaw, thedetailed basic principle concerned should be amendedas follows:

“Pyithu Hluttaw shall be formed with amaximum of 440 Hluttaw representatives as follows:

(a) Not more than 330 Hluttaw representativeselected on the basis of township as well as onthe basis of population from constituenciesdesignated in accord with the law aftercombining a newly formed township withone of the suitable townships adjacent to itif the total number of townships exceeds330

(b) Not more than 110 Tatmadaw memberHluttaw representatives nominated inaccord with law by the Commander-in-Chief of the Defence Services.”

Mr Chairman,Now we are going to suggest the matter concerning

the formation of Amyotha Hluttaw. At the plenarysession of the National Convention held on 28 March1996, the Work Committee Chairman explained theadoption of detailed basic principles for the Chapter“Formation of Legislature.” Concerning the AmyothaHluttaw, he explained as follows:“Amyotha Hluttaw shall be formed with a maximumof 224 Hluttaw representatives, as follows:

(a) 168 Amyotha Hluttaw representativeselected in equal numbers of 12 from eachregion or state inclusive of Union territories,and including one representative from eachself-administered division or self-administered zone

(b) 56 Tatmadaw member Amyotha Hluttawrepresentatives nominated by theCommander-in-Chief of Defence Servicesin accord with law at the rate of fourrepresentatives from each region or stateinclusive of Union territories.”

The expression “inclusive of Union territories”means areas that were included in the present statesand divisions but have been designated as Unionterritories and the areas proclaimed by the PyidaungsuHluttaw. Hence the word “the respective” should beadded to the word “Union territories” as follows forthe usage to be more precise.“Amyotha Hluttaw shall be formed with a maximumof 224 Hluttaw representatives, as follows:

(a) 168 Amyotha Hluttaw representativeselected in equal numbers of 12 from eachregion or state inclusive of the respectiveUnion territories, and including onerepresentative from each self-administereddivision or self-administered zone

(b) 56 Tatmadaw member Amyotha Hluttawrepresentatives nominated by theCommander-in-Chief of Defence Servicesin accord with law at the rate of fourrepresentatives from each region or state

inclusive of the respective Union territories.(c) In forming the Amyotha Hluttaw in accord

with the subparas (a) and (b), the words“the respective Union territories” meanUnion territories designated by thisConstitution and Union territoriesproclaimed by Pyidaungsu Hluttaw afterenacting laws concerning the matter to electAmyotha Hluttaw representatives areinclusive in the state or division or theregion or state they are included in.”

Mr Chairman,Concerning the designation of Union territory, the

detailed basic principle of the sub-para (b) no longerneeds to be prescribed. However, sub-para (c) shouldstill exist. So, sub-para (c) should be sub-para (b).

As regards the designation of Union territories, thefollowing detailed pasic principle should be adopted:

“(a) Nay Pyi Taw, that is the Capital of theUnion, is designated as Union territoryplaced under direct administration of thePresident of the Union.

(b) if need arises to designate areas that havespecial situation in connection with nationaldefence, security, administration andeconomy etc. as Union territories they maybe so designated as Union territories afterenacting laws”.

Mr Chairman,We agree that the term “Capital Yangon”

prescribed in the detailed basic principles onadministration of Capital Yangon, a Union territory,prescribed in para 35 and the detailed basic principleson designation of the status of the Chairman andmembers of Yangon Council prescribed in para 36 ofthe detailed basic principles adopted at the plenarysession held from 28 to 30 March 1996, should bereplaced with the term “Nay Pyi Taw”, and the term“Chairman of Yangon Council” prescribed in sub-para (c) 6 of para 16 of detailed basic principle forFormation of Financial Commission with the term“Chairman of Nay Pyi Taw Council”.Mr Chairman,

It is explained, “after designating Capital Nay PyiTaw as a Union territory and revoking the designationof Yangon and Cocogyun Township as Unionterritories, it will need to amend the detailed basicprinciple, as appropriate”.

Hence, the point “Yangon Region High Court isthe high court of the courts situated in Yangon City andCocogyun Township” should be amended as “Withregard to the judicial matter, Mandalay RegionHigh Court is the high court of the courts situatedin Nay Pyi Taw”.

The clarification “When detailed basic principleswere laid down according to the chapter headings, theprinciples relevant to respective chapters weretransferred as detailed basic principles. It is assumedthat of the detailed basic principles transferred torespective chapters, some principles should continueto be prescribed in the Chapter “State FundamentalPrinciples” made by Work Committee Chairman isappropriate.Esteemed Mr Chairman and members anddelegates,

Now, we have concluded our suggestionconcerning the matter regarding the amendment, therepeal, the transfer and the addition of the fundamentalprinciples and detailed basic principles as necessaryexplained by the Work Committee Chairman at theplenary session of the National Convention.

Poll shows Australian PM faces election defeat in own seat CANBERRA, 13 Aug — Australian Prime Minister John Howard faces a crushing electoral defeat which

could see him lose his own Sydney-based seat, a poll showed on Sunday. Howard, 11 years in

power and facing re-election in a national votetipped for 10 November,trailed high-profile formertelevision presenter MaxineMcKew, 46 per cent to 53when votes were distributedto the two major parties, aGalaxy poll for The SundayTelegraph newspaper andSBS television showed.

McKew, recruited tothe rival Labour Party totake on the conservativeHoward, was also level withthe veteran prime ministerwhen voters were askedwho would do the best jobfor the seat of Bennelong,

held by Howard since1974.

The poll wasconducted after Aus-tralia’s central bank liftedinterest rates last week to adecade high of 6.50 percent to head off inflationfuelled by strong domesticdemand, unemployment ata 32-year low and rapidglobal growth.

Interest rates havebeen hurting Howard, whosecured his fourth electionvictory in 2004 on theslogan “Keeping interestrates low”. The centralbank has since lifted ratesfive times.

Rates are also bitinginto support for Howard’sLiberal-National coalitionin key fringe suburbs wherevoters are struggling withlarge mortgages and a creditbinge fuelled in part by thelow-interest climate,successive polls show.
