INFORMATION

The undersigned Associate Prosecution Attorney II accuses Apipa G. Guro of the crime of Estafa, defined and penalized under Article 315, paragraph 1b, of the Revised Penal Code, committed as follows: That on the 31st of October, 2010 in the City of Manila, Philippines, and within the jurisdiction of the Honorable Court, the plaintiff, NATHAN N. NOONAN, under a duly notarized Commission Agreement, gave the accused, DANA D. DONOVAN ten pieces of jewelry (three gold rings with diamonds, a Mikimoto black pearl necklace, two platinum bracelets encrusted with amethysts and sapphires, two gold earring sets encrusted with turquoise and pearls, collectively worth P10 million), to sell them on commission. The accused should have turned over and accounted for the proceeds of the sale, and returned the unsold items within thirty (30) days from turnover. The accused then wilfully, unlawfully, and feloniously, failed to account for the sale of all the jewels, and misappropriated the proceeds for her personal use, to the damage and prejudice of the plaintiff in the sum of P 10 million.
