Bioethics 2011 Jan; 25(1): 18 Abstract: Most life science research entails dualuse complexity and may be misused for harmful purposes, e.g. biological weapons. The Precautionary Principle applies to special problems characterized by complexity in the relationship between human activities and their consequences. This article examines whether the principle, so far mainly used in environmental and public health issues, is applicable and suitable to the field of dualuse life science research. Four central elements of the principle are examined: threat, uncertainty, prescription and action. Although charges against the principle exist for example that it stifles scientific development, lacks practical applicability and is poorly defined and vague the analysis concludes that a Precautionary Principle is applicable to the field. Certain factors such as credibility of the threat, availability of information, clear prescriptive demands on responsibility and directives on how to act, determine the suitability and success of a Precautionary Principle. Moreover, policymakers and researchers share a responsibility for providing and seeking information about potential sources of harm. A central conclusion is that the principle is meaningful and useful if applied as a context dependent moral principle and allowed flexibility in its practical use. The principle may then inspire awarenessraising and the establishment of practical routines which appropriately reflect the fact that life science research may be misused for harmful purposes. Politics and the life sciences : the journal of the Association for Politics and the Life Sciences 2010 Mar; 29(1): 2­23 Abstract: The German army's 1943 flooding of the Pontine Marshes south of Rome, which later caused a sharp rise in malaria cases amongItalian civilians, has recently been described by historian Frank Snowden as a unique instance of biological warfare and bioterrorism in theEuropean theater of war and, consequently, as a violation of the 1925 Geneva Protocol prohibiting chemical and biological warfare. We arguethat archival documents fail to support this allegation, on several counts. As a matter of historical record, Hitler prohibited German biologicalweapons (BW) development and consistently adhered to the Geneva Protocol. Rather than biological warfare against civilians, theWehrmacht used flooding, land mines, and the destruction of vital infrastructure to obstruct the Allied advance. To protect its own troops inthe area, the German army sought to contain the increased mosquito breeding likely to be caused by the flooding. Italians returning to thePontine Marshes after the German retreat in 1944 suffered malaria as a result of environmental destruction, which was banned by the 1899and 1907 Hague Conventions and by subsequent treaties. In contrast, a state's violation of the Geneva Protocol, whether past or present,involves the use of germ weapons and, by inference, a state­level capability. Any allegation of such a serious violation demands credibleevidence that meets high scientific and legal standards of proof.

Science and engineering ethics 2010 Mar ; 16(1): 85­97 Abstract: Israel has a long history of concern with chemical and biological threats, since several hostile states in the Middle East are likelyto possess such weapons. The Twin­Tower terrorist attacks and Anthrax envelope scares of 2001 were a watershed for public perceptions ofthe threat of unconventional terror in general and of biological terror in particular. New advances in biotechnology will only increase the abilityof terrorists to exploit the burgeoning availability of related information to develop ever­more destructive bioweapons. Many areas of modernbiological research are unavoidably dual­use by nature. They thus have a great potential for both help and harm; and facilitating the formerwhile preventing the latter remains a serious challenge to researchers and governments alike. This article addresses how Israel might best(1) prevent hostile elements from obtaining, from Israel's biological research system, materials, information and technologies that mightfacilitate their carrying out a biological attack, while (2) continuing to promote academic openness, excellence and other hallmarks of thatsystem. This important and sensitive issue was assessed by a special national committee, and their recommendations are presented anddiscussed. One particularly innovative element is the restructuring and use of Israel's extensive biosafety system to also address biosecuritygoals, with minimal disruption or delay.

American anthropologist 2010; 112(4): 563­75 Abstract: Here I detail violence in South Sudan by first discussing a specific Dinka Agaar practice alongside existing discourses on thesocial aspects of violence and universal human rights, then I show how these acts had meaning and purpose using data from personalaccounts of violence. I posit that the violence described was consistent with Dinka Agaar concepts of justice and basic human rights andthat it cannot be judged against any universal human rights standard, devoid of local context or of an overarching metanarrative. Theseevents highlight conflicting subjectivities, ethical norms, and the painful difficulties inherent to advocacy in areas of conflict. Viewed from theperspective of the larger social unit, it is easy to see how violence was required to end violence. However, witnessing punitive violencepurposefully enacted on innocent individuals to achieve peace has the potential to create conflicting positions that modern anthropologicaldiscourse cannot reconcile.

Objective scientific standards are essential for making policy decisions that can stand the test of time. For decades, scholarshave reported that the human anthrax vaccine field trials conducted in the 1950s by Brachman and his colleagues were single­blind ratherthan double­blind. Nevertheless, in March 2005, Dr Philip S Brachman reported in a letter to the US Food and Drug Administration that hisstudy had been double­blind. It is here argued that, rather, the field trial of a human anthrax vaccine should continue to be deemed as single­blind unless more detailed information is provided to explain exactly how the investigators were kept unaware of which subjects were in thetreatment and control groups. Moreover, a number of other questions about the details of this critically important study have remainedunanswered and are discussed. More recently, similar concerns have arisen with respect to more contemporary biodefence research,especially with reference to the Federal Bureau of Investigation's allegations that Dr Bruce Ivins, a US government biodefence researcher,was responsible for the anthrax letter attacks of fall 2001. The medical ethics and related issues involved with continuing to base nationalbiodefence and public health policy on unclear, if not contradictory, research are discussed.

Worries about bioterrorism have thus sparked debate aboutwhether or not the smallpox vaccine, which can be dangerous, should be offered to the general public. Meaningful public debate on this issuerequires expert information about the likelihood that the virus will in fact be used as a weapon. Informed voluntary individual decision making,about whether to get vaccinated if vaccine is made available to the public, would similarly require appreciation of the likelihood of attack.Public deliberation and private deliberation thus both require briefing by the intelligence community.

Manyordinary clinicians would be asked or required to treat unfamiliar yet serious medical conditions in a setting of overwhelming urgency andimpossible odds. Clinical focus would shift from doing good things for a succession of individual patients to considering many patients atonce, a change that could beget loss of trust and rapport with patients. Clinicians might also experience restrictions in personal liberties andappropriation of their property. The purpose of this essay is to develop a teleological framework for undertaking this transformation. Inordinary clinical medicine, the elusiveness of the individual telos (i.e.,the good for the individual) is acknowledged in procedures (such associal history taking,informed consent and outpatient scheduling) designed to protect patients' (and clinicians')prerogatives to interpret thetelos for themselves. In mass casualty scenarios, on the other hand, the telos is standardized and regarded as an Immediate Object (usuallyas a state of affairs in which survival is maximized and permanent disability is minimized). Clinicians who provide mass casualty care willface a number of ethical challenges that can be negotiated by appealing to the political and ethical rationale, and limits, pertaining to thepursuit of aggregate survival as an Immediate Object.

Kennedy Institute of Ethics Journal 2003 June; 13(2): 67­82 Abstract: In June 2002, the Advisory Committee on Immunization Practices (ACIP) approved draft recommendations concerning preparationfor potential biological terror attacks that utilize the smallpox virus. ACIP recommends against both mandatory and voluntary vaccination ofthe general public. The present paper examines the moral and political considerations both for and against each of the general publicvaccination options considered by the ACIP in the context of the state's authority over vaccination for the purposes of protecting publichealth. Although it is clear that compulsory mass vaccination is not justified at this time, the issues surrounding voluntary vaccination aremore complex. Should smallpox vaccination prior to an outbreak be made available to the general public? The paper concludes that thevaccine should not be made available at this time. This conclusion, however, is based upon contingent features of current circumstances,which would change once an outbreak occurred. In the even of a terror­related outbreak of smallpox, the general public's access to voluntaryvaccination would become justified, even in areas beyond where the outbreak has occurred.

* Document 256 Hodge, James G., Jr. Protecting the public's health in an era of bioterrorism: the Model State Emergency Health Powers Act Accountability in Research 2003 April­June; 10(2): 91­107 Abstract: During the fall of 2001, public health law scholars at the Center for Law and the Public's Health at Georgetown and Johns HopkinsUniversities were asked by the Centers for Disease Control and Prevention (CDC) and a series of national partners to develop the ModelState Emergency Health Powers Act (MSEHPA). The MSEHPA provides a series of modern powers for states to consider in responding tocatastrophic public health emergencies, including bioterrorism events. Since December 2001, provisions based on the MSEHPA have beenintroduced in nearly 40 states and passed in 20. Underlying the development of the act is a long­standing debate between legal and ethicalscholars and law­ and policymakers as to the appropriate ways to balance individual and communal rights. The drafting challenge was tocreate a comprehensive model law that provides adequate powers to protect the public's health while also respecting individual and grouprights. The MSEHPA empowers public health agents with broad authority and simultaneously limits the exercise of power in time, duration,and scope to accomplish communal goals of abating serious public health threats. Coercive public health powers, particularly isolation andquarantine, are exercised on a temporary basis, only so long as are reasonably necessary and only among persons who justifiably may posea risk to others because of their contagious conditions. Individual rights to contest the coercive use of public health powers, even during anemergency, are secured.

more people than any infectious disease in history­­and perhaps three times more people in the 20th Century than were killed by all the warsof that period. Following a WHO­sponsored global vaccination campaign, smallpox was officially declared eradicated in 1980. It has sincebeen revealed that the Soviet Union, until its fall in the early 1990s, manufactured tens of tons of smallpox for military purposes. A worry isthat some of this may have fallen into the hands of "rogue" nations or terrorists. Current U.S. debate questions whether smallpox vaccineshould therefore be made available to the American public, which­­like the rest of the world­­now lacks immunity. Because the vaccine isconsiderably dangerous, public dialogue cannot resolve this matter if evidence material to the likelihood of attack is classified (i.e. secret). Iconclude by recommending numerous future areas for ethics research related to the weaponization of smallpox.

The Model State Emergency Health Powers Act: planning for and response to bioterrorism and naturallyoccurring infectious diseases JAMA: The Journal of the American Medical Association 2002 August 7; 288(5): 622­628 Abstract: The Center for Law and the Public's Health at Georgetown and Johns Hopkins Universities drafted theModel State Emergency Health Powers Act (MSEHPA or Model Act) at the request of the Centers for DiseaseControl and Prevention. The Model Act provides state actors with the powers they need to detect and containbioterrorism or a naturally occurring disease outbreak. Legislative bills based on the MSEHPA have been introducedin 34 states. Problems of obsolescence, inconsistency, and inadequacy may render current state laws ineffective oreven counterproductive. State laws often date back to the early 20th century and have been built up in layers overthe years. They frequently predate the vast changes in the public health sciences and constitutional law. The ModelAct is structured to reflect 5 basic public health functions to be facilitated by law: (1) preparedness, comprehensiveplanning for a public health emergency; (2) surveillance, measures to detect and track public health emergencies; (3)management of property, ensuring adequate availability of vaccines, pharmaceuticals, and hospitals, as well asproviding power to abate hazards to the public's health; (4) protection of persons, powers to compel vaccination,testing, treatment, isolation, and quarantine when clearly necessary; and (5) communication, providing clear andauthoritative information to the public. The Model Act also contains a modernized, extensive set of principles and

requirements to safeguard personal rights. Law can be a tool to improve public health preparedness. A constitutionaldemocracy must balance the common good with respect for personal dignity, toleration of groups, and adherence toprinciples of justice.

It is one cause of Gulf War illnesses, andrecent vaccinees report symptoms resembling Gulf War illnesses. The vaccine's production has been substandard.Without adequate evaluation, the Food and Drug Administration recently approved (retrospectively) significantchanges made to the vaccine's composition since 1990. The vaccine's mandatory use for inhalation anthrax is "off­label." A skewed review of the vaccine literature by the Centers for Disease Control and Prevention (CDC) led toremunerative collaborative research with the army, involving civilian volunteers. Despite acknowledging possible fetalharm, the CDC offered the vaccine to children and pregnant women. New trends could weaken prelicensure efficacyand safety review of medical products intended for biodefense and avoid manufacturer liability for their use.
