RESOLUTION NO. 14-230

RECOGNIZING THE 85TH ANNIVERSARY OF THE ELBURN LION'S CLUB

WHEREAS, this year the Elbum Lion's Club is celebrating its 85th year of service to KaneCounty and to the surrounding area including DuPage, DeKaIb, and part of McHenry counties; and

WHEREAS, the Elburn Lion's Club has grown to become the largest Lion's Club Organization inthe State of Illinois; and

WHEREAS, services of the Elburn Lion's Club to Kane County and surrounding area residentsinclude providing service dogs to youngsters in the Kaneland School District at a typical cost of $15,000each, equipping and maintain a popular 26-acre park in Elburn including the recent installation of$15,000 worth of new playground equipment, and $10,000 donated to Gifford, IL following the severetornado damage to that village last fall; and

WHEREAS, the International President of Lion's Club International will visit the Elburn Lion'sClub on August 9, 2014, to commemorate the occasion of their 85th Anniversary; and

WHEREAS, the County of Kane wishes to express its appreciation for the many services of theElbum Lion's Club over the past 85 years and to congratulate this volunteer group on this milestoneanniversary.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that congratulations andbest wishes be extended to the leadership and volunteers of the Elburn Lion's Club along with oursincere thank you.

RESOLUTION NO. 14-231

RECOGNIZING THE 60TH ANNIVERSARY OF MARKLUND

WHEREAS, Marklund was organized as a result of nurse Claire and Stan Haverkampf providingfoster care for a newborn baby born with Down Syndrome and severe cardiac issues on December 26,1954; and

WHEREAS, Claire and Stan Haverkampf began taking more medically fragile babies into theirNorthlake home, eventually seeing the need to expand and built Marklund Children's Home inBloomingdale in 1957; and

WHEREAS, as time went on, children were living longer than doctors predicted due tospecialized care being provided, and now outgrew their Bloomingdale location; and

WHEREAS, group homes were established in various suburbs; and

WHEREAS, adult clients were brought together in one location and twenty-five acres werepurchased on the western edge of Geneva; and

WHEREAS, Marklund at Mill Creek was opened in 2002 and today cares for ninety-sixresidential clients in addition to green space, a Miracle League ball field, Marklund Hyde Centerbuilding including developmental training classrooms, therapy rooms, an aquatic therapy pool, andadministrative offices; and

WHEREAS, Marklund employs 225 employees at the Geneva campus, making everyday lifepossible for individuals with profound disabilities.

NOW, THEREFORE, the Kane County Board extends its gratitude and appreciation to GilbertFonger, President and CEO of Marklund, and recognizes Marklund for its sixty years of distinguishedand dedicated service to those in need, from infancy to adulthood.

AUTHORIZING THE EXECUTION ON AN INTERGOVERNMENTAL AGREEMENT TO FUNDIMPROVEMENTS AT SETTLER'S HILL GOLF COURSE

WHEREAS, the Forest Preserve District of Kane County ("District"), and the County of Kane("County") desire to enter into an Intergovernmental Agreement; and

WHEREAS, the District owns and licenses certain property on Fabyan Parkway, Geneva,Illinois, known as Settler's Hill Golf Course, which is also the location of the closed Midway Landfill andSettler's Hill Landfill; and

WHEREAS, the County holds certain funds intended to be used for improvements at the LandfillSites under the "Landfill Fund"; and

WHEREAS, the District and County are authorized to enter into this Agreement by Article VII,Section 10 of the Illinois Constitution of 1970, and the Illinois Intergovernmental Cooperation Act, 5ILCS 200/1 et seq., provisions of the County Code, and the Downstate Forest Preserve Act; and

WHEREAS, said Intergovernmental Agreement further calls for the County to contribute funds inthe amount of Five Hundred Fifty Thousand Dollars ($550,000.00) to the District for improvements tothe golf course at the Landfill Sites.

NOW, THEREFORE, BE IT RESOLVED by the County of Kane Board that the Chairman of saidBoard be, and hereby authorized to execute and deliver on be behalf of the County of Kane thisIntergovernmental Agreement, which is on file with the County Clerk.

SUMMARY: The Illinois Power Agency Act, Chapter 20, Illinois Compiled Statutes, Act 3855, added Section 1-92 entitled Aggregation ofElectrical Load by Municipalities, Townships, and Counties (hereinafter referred to as the "Act"), under the Act, the County ofKane, Illinois may operate the aggregation program under the Act as an opt-out program for residential and smallcommercial retail customers in the unincorporated areas of Kane County (not including Aurora and Dundee Townships) thatare supplied electricity by Commonwealth Edison Company.

WHEREAS, the Act requires that prior to the implementation of an opt-out electrical aggregationprogram by the County; the County must adopt an electrical power aggregation plan of operation andgovernance and hold not less than two (2) public hearings. The County held the required PublicHearings for the Electrical Power Aggregation Plan of Operation and Governance on June 24, 2014and June 25, 2014, and provided the required public notices; and

WHEREAS, the County Board of the County of Kane hereby are authorized to aggregate inaccordance with the terms of the Act residential and small commercial retail electrical loads locatedwithin the unincorporated areas of Kane County with the exception of Aurora and Dundee Townships,that are supplied electricity by Commonwealth Edison Company, and for that purpose may solicit bidsand enter into service agreements to facilitate for those loads the sale and purchase of electricity andrelated services and equipment; and

WHEREAS, the County Board is granted the authority to exercise such authority jointly with anyother municipality, township or county and, in combination with two or more municipalities, townships orcounties, may initiate a process jointly to authorize aggregation by a majority vote of each particularmunicipality, township or county as required by the Act; and

WHEREAS, the County Board with the assistance from the Illinois Power Agency hasdeveloped a plan of operation and governance for the Aggregation Program and has conducted suchpublic hearings and provided such public notices as required under the Act. The Electrical PowerAggregation Plan of Operation and Governance shall provide for universal access to all applicable

WHEREAS, as an opt-out program, the County Board shall fully inform residential and smallcommercial retail customers in the unincorporated areas of the County (with the exception of Auroraand Dundee Townships), in advance that they have the right to opt-out of the Aggregation Program.The disclosure and information provided to the customers shall comply with the requirements of theAct; and

WHEREAS, the electrical aggregation shall occur automatically for each person owning,occupying, controlling, or using an electrical load center proposed to be aggregated in theunincorporated areas of the County (with the exception of Aurora and Dundee Townships), subject to aright to opt-out of the program as described under this ordinance and the Act.

NOW, THEREFORE, BE IT ORDAINED the County Board hereby adopts the Electrical PowerAggregation Plan of Operation and Governance for unincorporated Kane County (with the exception ofAurora and Dundee Townships) as set forth in Exhibit "A" which is on file with the County Clerk. Thisordinance shall be in full force and effect after its passage, approval and publication in pamphlet formas provided by law.

WHEREAS, the County of Kane has undertaken a program to collect delinquent taxes and toperfect titles to real property in cases where the taxes on the same have not been paid pursuant to 35 ILCS200/21-90; and

WHEREAS, pursuant to this program the County of Kane, as trustee for the taxing districts involved,has acquired an interest in the real estate described on the attached exhibit; and

WHEREAS, it appears to the Kane County Board that it would be to the best interest of the taxingdistricts of Kane County to dispose of this interest in said property.

SUMMARY: Over the past several years, Kane County has been working on a solution for replacement of its current JANO court casemanagement system which has reached its end of life. The Judicial and Public Safety Strategic Planning and TechnologyCommission was formed to review technology-related decisions and to make recommendations to the County Board. ThisCommission is currently comprised of the Circuit Clerk, Public Defender, State's Attorney, the Chief Judge, a judge in the16th Circuit, the County Board Chairman, the Chairs of the Finance, Judicial and Public Safety Committees, 2 additionalCounty Board members, the Sheriff, a member of the Kane County Bar Association, and 2 public members.

After a review that has taken almost an entire year since the issuance of the RFP in August of 2013, the Commission isproposing that Tyler Technologies, Inc. be selected as the single vendor to provide a court case management system foreach of the offices. This has resulted in savings of millions of dollars and will include an 18-month implementation scheduleat a cost not to exceed $6,866,582.

AUTHORIZING CONTRACT FOR COURT CASE MANAGEMENT SYSTEM

WHEREAS, the current court case management system utilized by the Circuit Clerk, the 16th JudicialCircuit, the Public Defender's and State's Attorney's Office has reached its end of life and will requirereplacement and updated capability to meet the current demands of those offices; and

WHEREAS, on August 30, 2013, the County issued RFP-27-013 for Justice Case ManagementSystems for each of the Circuit Clerk/Judiciary, Public Defender, and State's Attorney's Offices; and

WHEREAS, the Judicial and Public Safety Strategic Planning and Technology Commission wasformed to review and make recommendations on court technology issues; and.

WHEREAS, after reviewing the various bids, going through extensive demonstrations, site visits,evaluations, and review of the various office requirements of the system, the Public Defender, State'sAttorney, Circuit Clerk, and Judiciary in conjunction with the balance of the Commission found it in the bestinterests of the County to select a single vendor to resulting in significant cost savings; and

WHEREAS, Tyler Technologies, Inc. was selected as the vendor that could provide a court casemanagement system for each of those offices that best meet their requirements.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the County authorize theChairman of the Kane County Board to execute an agreement with Tyler Technologies, Inc. for an amount notto exceed $6,025,925 plus project-related travel expenses and a 10% project contingency of $602,592 for atotal of $6,866,582.

SUMMARY: The County will be entering into a contract with Fiscal Choice Consulting to perform a cost of service study for certainservices for which user fees are collected. Based on an analysis of the proposals received, Fiscal Choice was chosen due totheir experience in the requirements of developing such governmental cost determination studies. This independent studywill determine whether the user fees are sufficient to cover the cost of providing the related services. The results of thestudy will provide the justification required by state statute for any increases in user fees that may be deemed necessary tocover the cost of providing the related services.

The cost of this "Cost of Service Study" is fixed at $23,500. This resolution will authorize a budget transfer of $23,500 fromthe contingency account to the county-wide contractual and consulting line item.

AMENDING THE PERSONNAL POLICY HANDBOOK(DRIVING VEHICLES WHILE ON COUNTY BUSINESS)

WHEREAS, from time to time, the Human Services Committee, recommends that policiesaffecting employee conduct, behavior and adherence to certain rules are promulgated and published inthe Kane County Personnel Policy Handbook; and

WHEREAS, the Human Services Committee deems it appropriate to recommend amendmentof the Driving Vehicles While on County Business Policy.

NOW, THEREFORE, BE IT FURTHER RESOLVED by the Kane County Board that the DrivingVehicles While on County Business policy be approved as amended and published in the Kane CountyPersonnel Policy Handbook as set forth below.

DRIVING VEHICLES WHILE ON COUNTY BUSINESS

It shall be the policy of the County to check driving records and proof of auto liability insuranceof all employees hired on or after June 1, 2008. The Department of Human Resource Managementshall conduct the initial check when the employee is first hired; thereafter driving records and proof ofinsurance shall be randomly checked one time each year by the Department of Human ResourceManagement from a pool comprised of employees that have submitted travel reimbursement requestsand employees who have driven a County-owned vehicles within the past 12 months.

The County's insurance rates are highly affected by the employee's driving record. The Countymay consider an acceptable driving record to be no more than two (2) accidents and/or convictions formoving violations in the previous year and no convictions within the prior year for the offenses ofreckless homicide, reckless driving, driving with a suspended or revoked license, hit and run, drivingwhile under the influence of intoxicants or fleeing or attempting to elude a police officer.

An employee or student intern/volunteer who does not have a valid Illinois driver's licenseissued by the Illinois Secretary of State or the authorized official from another state will not be allowedto drive a County vehicle or an employee's personal vehicle on authorized County business. Anemployee's use of a vehicle for authorized County business is a privilege, not a right. The Countyreserves the right to prohibit an employee's use of a vehicle for authorized County business in cases ofrepeat violations of this policy or for an unacceptable driving record.

The County cannot list rules to cover every situation. The County requires all employees whodrive a County vehicle or an employee's personal vehicle, volunteers, consultants, vendors and anyother person on authorized County business to:

• Abide by all traffic laws• Heed all traffic signs and signals• Practice defensive driving• Abstain from smoking in all County-owned vehicles

• Refrain from carrying non-employee passengers in the vehicle, unless required• Lock unattended vehicles at all times to prevent theft of County and/or personal property.• Make sure that the vehicle is equipped with proof of insurance, current registration, and state

inspection reports• Pay any tickets, fines or other penalties assessed against the employee• Refrain from establishing personal [-PASS accounts using the County-owned vehicle• Refrain from carrying a concealed firearm in the County-owned or the employee's personal

vehicle

Reporting Accidents and InjuriesAll accidents and injuries that occur while the employee is on authorized County business

should be immediately reported to the employee's supervisor, to the employee's insurance companyand to the Department of Human Resource Management within 48 hours of the occurrence. Workerscompensation and incident report forms are available from the Department of Human ResourceManagement or may be downloaded from the County's intranet site. Any damage to the vehicle orinjury to the employee must be noted on the report forms.

Insurance Coverage and Expense ReimbursementThe County provides workers' compensation insurance on every employee to protect the

employee for loss of pay and time and for the cost of medical care for injuries sustained while onauthorized County business.

An employee required to use their own vehicle on authorized County business must have anautomobile liability policy issued in amounts no less than the minimum amounts set for bodily injury ordeath and destruction of property under the 625 ILCS 5/7-601 and 625 ILCS 5/7-203 of the IllinoisVehicle Code. It is the responsibility of each employee to maintain coverage as specified and bydriving a personal vehicle while on authorized County business, it is presumed that coverage is in force.

In Illinois, insurance follows the vehicle as it is titled. Therefore, if an accident occurs when theemployee is driving their personal vehicle, the employee's personal insurance coverage shall beprimary. The defense and indemnity by the County will be, in all cases, secondary to the coveragemandated by Illinois law.

An employee who drives their personal vehicle on authorized County business will bereimbursed according to the County's Travel Expenses policy as set forth in Sec. 2-72 of the KaneCounty Code. Travel expenses between home and the workplace are not reimbursable. If anemployee driving their own vehicle on authorized County business has an accident that damages theemployee's vehicle, the County will reimburse the insurance deductible that is paid by the employee torepair the employee's vehicle.

Statements Re garding Accidents/LitigationIn the event that any employee is involved in a motor vehicle accident while on authorized

County business, the employee may furnish such information as his name, address and the registrationnumber of the vehicle, and may exhibit his driver's license upon request to any other person involved in

the accident or to law enforcement officers. Obtain all information relating to the accident in aprofessional manner, including the names and addresses of any witnesses. Do not negotiate thesettlement of any claim, promise payment for any injury or damage, or admit liability.

Except as required by law, the County requires that employees do not give any written, verbal orsigned statement about liability at any time, regarding:

1. Any accident that involves a Kane County employee of agent, or property which is owned, controlledor maintained by Kane County.

2. Any treatment of any inmate or prisoner under the care or control of any Kane County employeeincluding a Sheriffs correctional officer or deputy Sheriff.

3. Any incident directly or indirectly associated with pending or threatened litigation, to any personexcept with the knowledge or consent of the State's Attorney's Office.

Operation of Emergency VehiclesNotwithstanding the preceding language, the County recognizes that some employees of the

Sheriff's Department, Coroner's Office or Office of Emergency Management may drive County vehicleswhile in pursuit of an actual or suspected violator or while engaged in an emergency response. Whileengaged in these type of activities, employees are required to adhere to all statutory regulations andany policies, procedures, or general orders promulgated by the Kane County Sheriff, County Coroner orDirector of Emergency Management. At all other times, the employees are expected to adhere to thispolicy.

An employee's failure to adhere to this policy or violations of this policy while on authorizedCounty business can result in the loss of driving privileges or the denial of reimbursement of vehicleinsurance deductibles.

WHEREAS, the Illinois Highway Code of the Illinois Compiled Statutes (605 ILCS 120/1 et seq.)

provides for the establishment of Adopt a Highway Programs by Counties and various units ofgovernment throughout the State of Illinois to support anti-litter efforts by allowing groups of privatecitizens to adopt a segment of highway for the purpose of litter and refuse collection; and

WHEREAS, the County has enacted and otherwise established pursuant to Kane County BoardOrdinance No. 13-267, the Kane County Adopt-A-Highway Program in conformance with the IllinoisHighway Code, which program is intended to assist the County in its efforts to remove refuse and litterfrom County highway right of way and otherwise beautify the County Highway System; and

WHEREAS, those groups whose names are set forth in the exhibit attached hereto (a copy ofwhich is on file in the office of the Kane County Clerk) have submitted applications for participation inthe Kane County Adopt-A-Highway Program; and

WHEREAS, each of the groups' applications have been reviewed and approved by the CountyEngineer of Kane County and have subsequently been approved by the Transportation Committee ofthe Kane County Board; and

SUMMARY: The Chicago Metropolitan Agency for Planning (CMAP) is responsible for regional land use and transportation planning fornortheastern Illinois, including Kane County. Kane County is a voting member of CMAP and a partner agency inimplementing CMAP's 2040 long range land use and transportation plan and numerous other planning and programminginitiatives. These activities are essential in order to receive federal funding in the region, including Kane County.

CMAP is primarily funded by the federal Unified Work Program (UWP), State of Illinois, and local agency contributions. Thecontribution from each of the collar counties is $25,000.00 to support planning and programming services. An additional$5,853.37 is requested from the Kane Kendall Council of Mayors which is staffed by the Division of Transportation andprimarily funded with federal funds disbursed through the UWP process.

CMAP is currently responsible for developing the regions GO TO 2040 plan. The plan guides growth for Cook. DuPage, Kane,Kendall, Lake, McHenry, and Will Counties. GO TO 2040 also addresses the full range of quality-of-life issues, including thenatural environment, economic development, housing, and human services. The implementation of the 2040 regionalvision will be important to the sustainability of our regions future prosperity. All stakeholders in the region - including KaneCounty - have a vested interest in ensuring this effort is successful.

WHEREAS, the west line tracks of the UP carry approximately 111 trains per day, with each trainblowing its locomotive horn at all hours of the day and night as the trains approach LaFox Road from boththe east and the west; generally upsetting the rural peace of Blackberry Township, disturbing resident's livesand causing many to complain about the noise level of the locomotive horns; and

WHEREAS, Federal Regulations and the Rules of the Federal Railway Administration permit theinstallation and operation of wayside horns at approved highway/railroad track crossings to cause thelocomotive to not blow their horns as they approach said crossings; and

WHEREAS, the County of Kane has sought approval of the Illinois Commerce Commission to installwayside horns at the crossing of LaFox Road and the UP railroad tracks in LaFox, Illinois; and

WHEREAS, wayside horns are a fixed automatic system at a railroad/road crossing that soundsstationary crossing horns for approaching trains which provide a localized horn blast that is designed andintended to have an audio impact only within approximately a thousand feet of the crossing and thereforeheard only by those people in the immediate vicinity of the crossing; and

WHEREAS, In order for the County to design, build and operate the wayside horn system, the UPrequires the Country to enter into a Wayside Horn Agreement (a copy of which is on file in the office of theKane County Clerk) which agreement includes various subsidiary agreements for right of entry andpreliminary engineering.

SUMMARY: On June 25th, construction bids were opened at KDOTfor the 2014 Virgil Township Road District Paving ImprovementProject which will involve placement of a chip and seal treatment on portions of Winters Road, Pin Oak and Landrose Lanes.

The apparent low bidder for this project is A C Pavement Striping Co., of Elgin, IL with a proposed contract amount of$105,803.15, which is approximately 17.71% below the engineer's estimate of $128,570.00.

KANE COUNTY SECTION NO. 01-00274-00-BR

WHEREAS, the Illinois Constitution of 1970, Article VII, Section 10 and the Illinois CompiledStatutes, (5 ILCS 220/1, et seq.) authorizes the County of Kane (County) and the State of Illinois (State)to cooperate in the performance of their respective duties and responsibilities by contract and otheragreements; and

WHEREAS, pursuant to Resolution No. 12-233, the County and the State (through its IllinoisDepartment of Transportation) entered into a Phase III Construction and Construction Engineeringagreement (hereinafter the "Agreement") for the construction of the Anderson Road extension(hereinafter referred to as the "Improvement"); and

WHEREAS, the IDOT has requested an amendment to the Agreement (hereinafter"Amendment") that will provide the Illinois Commerce Commission (ICC) funds for reimbursement forthe cost of the bridge structure and approaches associated with this Improvement (a copy of which ison file in the office of the Kane County Clerk).
