    Article1.ThisLawisformulatedinordertostandardizeexitandentryattheborder;

    safeguardsovereignty,safetyandsocialorderofthePeoplesRepublicofChina;and

    promotediplomaticactivitiesandopeningtotheoutsideworld.

    Article2.ThisLawappliestotheadministrationofexitandentryofChinesecitizens,

    entryandexitofaliens,stayandresidenceofaliensinChina,aswellasthefrontier

    inspectionof

    vehicles.

    Article3.ThecountryprotectsthelawfulrightsandinterestsofChinesecitizensto

    enterandexit.

    ThelawfulrightsandinterestsofaliensonChineseterritoryshallbeprotectedbylaw.

    AliensonChineseterritoryshallobserveChineselaws,shallnotendangerChinasnational

    security,harmthepublicinterest,ordestroypublicorder.

    Article4.TheMinistryofPublicSecurityandMinistryofForeignAffairsshall

    administerexitandentryaffairsinaccordancewiththeirrespectiveresponsibilities.

    Residentembassies

    and

    consulates

    outside

    the

    Peoples

    Republic

    of

    China

    or

    other

    residentagenciesabroadentrustedbytheMinistryofForeignAffairs(hereinafterreferred

    toastheresidentvisagrantingofficesabroad)areresponsibleforissuingentryvisasfor

    aliensabroad.ExitEntryFrontierInspectionStationshallimplementexitentryfrontier

    inspection.Publicsecurityorgansandtheirexitandentryadministrationauthoritiesof

    localpeoplesgovernmentsatandabovethecountylevelshallcontrolthestayand

    residenceofaliens.

    TheMinistryofPublicSecurityandMinistryofForeignAffairsmayentrustexitand

    entryadministrationauthoritiesinpublicsecurityorgansoflocalpeoplesgovernmentsat

    andabovethecountylevel,foreignaffairsdepartmentoflocalpeoplesgovernmentsat

    andabove

    the

    county

    level

    to

    accept

    application

    of

    aliens

    for

    entry,

    stay

    and

    residence

    in

    Chinawithintheirscopeofresponsibility.

    TheMinistryofPublicSecurityandMinistryofForeignAffairsshallstrengthen

    communicationandcoordinationinthecontrolofexitandentryaffairs,cooperateclosely

    withrelevantdepartmentsoftheStateCouncil,exercisethefunctionsandpowers

    accordingtolawandtheirownfunctionalassignments,andshallassumerelevant

    responsibilities.

    Article5.Thestateshallestablishauniformexitandentrycontrolinformation

    platformtoshareinformationamongadministrativedepartments.

    Article6.

    The

    state

    shall

    establish

    Exit

    Entry

    Frontier

    Inspection

    Station

    at

    open

    ports.

    Forexitandentry,Chinesecitizens,aliensandvehiclesshallpassthroughopenports,

    andmaypassthroughotherplacesapprovedbytheStateCouncilorthecompetent

    departmentsempoweredbytheStateCouncilunderspecialconditions.Personsand

    vehiclesshallbesubjecttoinspectionbythefrontierinspectionofficesincaseofexitand

    entry.

    TheExitEntryFrontierInspectionStationshallmanagerestrictedareasoftheports.

    Forpurposeofsafeguardingnationalsecurityandcontrollingexitandentryorder,theExit

    EntryFrontierInspectionStationmayinspectarticlescarriedbypersonsleavingorentering

    thecountry.ExitEntryFrontierInspectionStationmayinspectthegoodsonvehicles

    leavingor

    entering

    the

    country

    if

    necessary,

    but

    customs

    should

    be

    notified.

    Article7.UponapprovedbytheStateCouncil,theMinistryofPublicSecurityand

    MinistryofForeignAffairsmaycollectfingerprintsandotherbiometricdataofpersons

    leavingorenteringthecountry,asrequiredforexitandentrycontrol.

    Ifaforeigngovernmenthasspecialprovisionsforvisaissuance,exitand,entrythat

    applytoChinesecitizens,theChinesegovernmentmaytakecorrespondingreciprocal

    measures.

    Article8.Departmentsandagenciesthatcontrolexitandentryshouldtakepractical

    measures,enhanceserviceandmanagementlevelcontinuously,enforcelawsimpartially,

    provideconvenienceforthepeoplewithhighefficiency,safeguardsafe,convenientexit

    andentryorder.

    Chapter2.ExitandEntryofChineseCitizens

    Article9.Chinesecitizensshallapplyforpassportorothertravelcertificatesfortheir

    exitandentryaccordingtolaw.

    Chinesecitizensmustgetvisaorotherentrypermitsbeforegoingtoanyothercountry

    orregion.UnlessvisaexemptionagreementissignedbetweentheChinesegovernment

    andthegovernmentofanyothercountryorotherwisespecifiedbytheMinistryofPublic

    Security,Ministry

    of

    Foreign

    Affairs.

    IfanyChinesecitizenleavesorentersChinaintheidentityofaseamanorworksona

    foreignship,heshallapplyforseamenspapersaccordingtolaw.

    Article10.Chinesecitizensshallapplyforpassforthetravelbetweenthemainland

    andHongKongSpecialAdministrativeRegion,MacaoSpecialAdministrativeRegion,and

    forthetravelbetweenthemainlandandTaiwanRegionaccordingtolaw,abidebyrelevant

    provisionsinthisLaw.SpecificadministrativemeasuresshallbestipulatedbytheState

    Council..

    Article11.Fortheexitandentry,Chinesecitizensshallsubmittheirpassportsorother

    travelcertificates

    to

    the

    Exit

    Entry

    Frontier

    Inspection

    Station,

    go

    through

    the

    specified

    procedures,mayleaveorenterChinaonlyafterapproved.

    Atproperlyqualifiedports,theExitEntryFrontierInspectionStationshallprovide

    privatechannelsandotherfacilitiesforChinesecitizenstoleaveorenterthecountry.

    Article12.ChinesecitizensshallnotbeallowedtoleaveChinaunderanyofthe

    followingcircumstances:

    (I)failtoholdvalidexitorentrycertificatesorrefuse,evadeacceptingfrontier

    inspection;

    (II)convictedpersonsservingtheirsentenceordefendantsorcriminalsuspectsin

    criminalcases;

    (III)personswho,asdecidedbyapeople'scourt,shallbedeniedexitowingto

    involvementinunresolvedcivilcases;

    (IV)subjecttocriminalpunishmentduetoimpairingbordercontrolorrepatriatedby

    othercountriesorregionsowingtoillegalexit,illegalresidence,illegalemployment,when

    thespecifiedperiodofnoexithasnotexpired;

    (V)notallowedtoleaveChinabyrelevantauthoritiesoftheStateCouncilbecauseof

    possibleendangerment

    on

    the

    national

    security

    and

    interests;

    (VI)othersituationsthatdonotallowexitasspecifiedinthelaws,administrativerules

    andregulations.

    Article13.ChinesecitizensresidingabroadwhodesiretoreturntoChinafor

    permanentresidenceshallcompletetherelevantproceduresattheresidentembassiesand

    consulatesofthePeoplesRepublicofChinaabroadorputforwardapplicationtoother

    residentagenciesabroadentrustedbytheMinistryofForeignAffairsbeforeentry,or

    submitanapplicationtotheOverseasChineseAffairsDepartmentoflocalpeoples

    governmentsatorabovethecountylevelattheplacewheretheyintendtoresideby

    themselvesor

    via

    their

    domestic

    relatives.

    Article14.Chinesecitizensresidingabroadmayprovetheiridentitywithpersonal

    passportwhentransactingfinancial,education,medicaltreatment,transport,

    telecommunication,socialinsurance,propertyregistrationandotheraffairsinChinawhere

    identificationisrequired.

    Chapter3.EntryandExitofAliens

    Section1.Visa

    Article15.

    To

    enter

    China,

    an

    aliens

    shall

    apply

    for

    avisa

    from

    an

    overseas

    visa

    office,

    unlessotherwisespecifiedinthisLaw.

    Article16.Visasmaybecategorizedasdiplomaticvisas,courtesyvisas,businessvisas

    andordinaryvisas.

    DiplomaticandbusinessvisaswillbeissuedtothealienswhoenterChinafor

    diplomaticandpublicaffairs;courtesyvisawillbeissuedtoalienswithspecialidentity,to

    whomcourteousreceptionshouldbeoffered.Thescopeandmethodsofissuingdiplomatic

    visas,courtesyvisas,andbusinessvisasshallbespecifiedbytheMinistryofForeignAffairs.

    OrdinaryvisaofcorrespondingtypewillbeissuedtothealienswhoenterChinafor

    thepurposeofwork,study,familyvisit,tourism,businessactivities,talentintroductionand

    otherpurposes

    besides

    diplomatic

    or

    public

    affairs.

    Type

    and

    issuing

    methods

    of

    ordinary

    visashallbestipulatedbytheStateCouncil.

    Article17.Theregistereditemsonvisasinclude:visatype,name,gender,birthdateof

    theholder,numberofentries,validityperiodofentry,stayperiod,issuedate,place,

    passportnumberorotherinternationaltravelcertificatenumber,andsoon.

    Article18.Toapplyforavisa,analienshallsubmithisorherpersonalpassportor

    otherinternationaltravelcertificate,relevantwrittenapplicationreasonstoanoverseas

    visaoffice,undergorelevantproceduresoftheoverseasvisaoffice,andsubmittoan

    interview.

    Article19.Alienswhoapplyforvisasshallprovideinvitationlettersissuedby

    organizationsorindividualsinChina.Applicantsshallprovideallmaterialsrequiredbythe

    overseasvisaoffice.Organizationsorindividualswhoissueinvitationlettersare

    responsibleforauthenticityofthecontents.

    Article20.Alienswhoapplyforemergencyentryforhumanitarianreasons,emergency

    business,emergencyengineeringrepairinChinaoninvitationorforotheremergencyentry

    requirements,andholdevidentiarymaterialsofrelevantauthoritiestoagreetheissuance

    ofportvisa,mayapplyforportvisaattheportvisaagenciesentrustedbytheMinistryof

    PublicSecurity(hereinafterreferredtoastheportvisaagencies)atportsapprovedbythe

    StateCounciltotransactportvisa.

    Travelagenciesthatorganizeinboundtourismmayapplyforgroupvisitorvisasatport

    visaagenciesinaccordancewithrelevantprovisionsoftheState.

    Analienswhoappliesforavisaataportvisaagenciyshallsubmitapersonalpassport

    orotherinternationaltravelcertificate,relevantwrittenapplicationreasonsaccordingto

    therequirementsofportvisaagencies,andenterChinafromtheportwherethevisa

    applicationissubmitted.

    Avisaissuedbyaportvisaagencyisvalidforoneentry.Theperiodofstayonthevisa

    shouldnotexceed30days.

    Article21.

    Visas

    will

    not

    be

    issued

    to

    aliens

    under

    any

    of

    the

    following

    circumstances:

    (I)ifanalienhasbeendeportedorexpelledbutnotfulfilledtherequirednumberof

    yearsabroadbeforeseekingreadmission;

    (II)infectioustuberculosisorotherinfectiousdiseasesthatmightendangerpublic

    healthseriously;

    (III)mightendangerChinasnationalsecurityandinterests,destroysocialpublicorder

    ormightbeengagedinotherillegalcriminalactivities;

    (IV)practisefraudinvisaapplicationprocessorcouldnotaffordtherequiredcostin

    China;

    (V)couldnotsubmitrelevantmaterialsrequiredbythevisagrantingoffice;

    (VI)otherconditionsunderwhichthevisaofficethinksinappropriatetoissuevisa.

    Visagrantingofficemaynotgivereasonsforrejectiontovisaapplication.

    Article22.Visaisnotrequiredforaliensunderanyofthefollowingcircumstances:

    (I)personswhoareexemptedfromvisaapplicationaccordingtothevisaexemption

    agreementsignedbetweentheChinesegovernmentandgovernmentsofothercountries;

    (II)aliens

    who

    hold

    valid

    residence

    certificate;

    (III)alienswhoholdconnectedinternationalticketsofinternationalflights,vessels,

    trainstoathirdcountryorregionthroughChina,stayinChinadoesnotexceed24hours,

    withoutleavingtheport,orstayinspecificareasapprovedbytheStateCouncildoesnot

    exceedthespecifiedtimelimit;

    (IV)otherconditionsspecifiedbytheStateCouncilforexemptionofvisa.

    Article23.AlienswhointendtoenterChinatemporarilyunderanyofthefollowing

    circumstances,shallapplyfortemporaryentryproceduresatExitEntryFrontierInspection

    Station:

    (I)foreignseamenandaccompanyingfamilymemberslandinthecitywheretheport

    islocated;

    (II)personsshouldleavetheportasspecifiedinItem3,Article22ofthisLaw

    (III)temporaryentryisrequiredduetoforcemajeureorotheremergencyreasons.

    Temporaryentryperiodshouldnotexceed15days.

    Foralienswhoapplyfortemporaryentryprocedures,theExitEntryFrontier

    InspectionStationmayaskthealiensthemselves,theresponsiblepersonofthevehicle

    thatcarries

    the

    aliens

    to

    enter

    China

    or

    exit

    and

    entry

    agency

    of

    the

    vehicle

    to

    provide

    necessaryassurancemeasures.

    Section2.EntryandExit

    Article24.ToenterChina,aliensshallsubmitpersonalpassportorotherinternational

    travelcertificates,visaorotherentrypermitstotheExitEntryFrontierInspectionStation,

    gothroughallspecifiedprocedures,mayenterChinaonlyafterapproved.

    Article25. AliensshallnotbepermittedtoenterChinaunderanyofthefollowing

    circumstances:

    (I)withoutvalidexit,entrycertificatesorreject,evadefrontierinspection;

    (II)undertheconditionsspecifiedinItems14inArticle21ofthisLaw;

    (III)whomightbeengagedinactivitiesinconsistentwiththeirvisatypesafterentering

    China;

    (IV)otherconditionsunderwhichentryisnotallowedasspecifiedinthelaws,

    administrativerulesandregulations.

    ExitEntryFrontierInspectionStationmaynotgiveanyreasonfortherejectionto

    entry.

    Article26.Foralienswhoarenotpermittedforentry,theExitEntryFrontier

    InspectionStationshallorderthemtoreturn;andshallforcethemtoreturniftheyrefuse

    todoso.Aliensshallnotleavetherestrictedareawhilewaitingforreturn.

    Article27.ToleaveChina,aliensshallsubmitpersonalpassportorotherinternational

    travelcertificatestotheExitEntryFrontierInspectionStation,gothroughallspecified

    procedures,mayleaveChinaonlyafterapproved.

    Article28.AliensshallnotbeallowedtoleaveChinaunderanyofthefollowing

    circumstances:

    (I)convictedpersonsservingtheirsentencesordefendantsorcriminalsuspectsin

    criminalcases,exceptthetransferofsentencedpersonsaccordingtotheagreementsigned

    betweenChinaandanyothercountry;

    (II)personswho,asdecidedbyapeople'scourt,shallbedeniedexitowingto

    involvementinunresolvedcivilcases;

    (III)personswhodefaultedonthepaymentofremunerationtolaborers,shallnotbe

    allowedtoleaveChinaifsodecidedbyrelevantdepartmentsoftheStateCouncilorthe

    peoplesgovernmentsofprovinces,autonomousregionsormunicipalitiesdirectlyunder

    theCentralGovernment;

    (IV)otherconditionsunderwhichexitisnotallowedaccordingtothelaws,

    administrativerulesandregulations.

    Article29.Alienswithvisasforstaynomorethan180daysshallstayinChina

    accordingtothestayperiodontheirvisas.

    Toextendstayperiodonvisa,aliensshallapplytolocalexitandentryadministration

    authoritiesinpublicsecurityorgansoflocalpeoplesgovernmentsatandabovethecounty

    levelsevendaysbeforethestayperiodonvisaexpires,submitapplicationmaterialsas

    required.Extensionofstayperiodwillbepermittedifthepostponereasonsareexamined

    asreasonableandsufficient;ifextensionofstayperiodisrejected,aliensshallleaveChina

    ontime.

    Theaccumulatedextensionofstayperiodonvisa,shouldnotexceedtheoriginalstay

    periodonvisa.

    Article30.IfresidencecertificateisrequiredforvisasofthealiensafterenteringChina,

    thealiensshallapplyforresidencecertificateforaliensattheexitandentryadministration

    authoritiesinpublicsecurityorgansoflocalpeoplesgovernmentsatandabovethecounty

    levelintheintendedresidenceplacewithinthirtydayssincethedateofentry.

    Alienswhoapplyforresidencecertificateshallsubmitpersonalpassportorother

    internationaltravelcertificates,aswellasrelevantwrittenapplicationreasons,leave

    biometricinformationsuchasfingerprint.Exitandentryadministrationauthoritiesin

    publicsecurityorgansshallexamineandgivedecisionwithinfifteendaysafterreceiving

    theapplicationmaterials,issueresidencecertificateofcorrespondingtypeandperiodfor

    thealiensaccordingtotheresidencereasons.

    Theshortest

    validity

    period

    for

    an

    aliens

    employment

    based

    residence

    certificate

    is

    90

    days;thelongestis5years.Theshortestvalidityperiodforofnonemploymentbased

    residencecertificatesis180days;thelongestis5years.

    Article31.Residencecertificatewillnotbeissuedtoaliensunderanyofthefollowing

    circumstances:

    (I)thevisatypedoesnotpermitresidencecertificateforaliens;

    (II)practisefraudintheapplicationprocess;

    (III)failtosubmitrelevantevidentiarymaterialsaccordingtotheprovisions;

    (IV)inviolationofrelevantChineselawsandadministrativeregulations,unsuitablefor

    residenceinChina;

    (V)otherconditionsunderwhichtheissuingauthoritythinksinappropriatetoissue

    residencecertificateforaliens.

    Residencecertificatesmaybeissuedtothealienswhoarespecialtalent,investors

    accordingtonationalprovisionsorstayneedstobechangedtoresidencedueto

    humanitarianandotherreasons,afterapprovedbyexitandentryadministration

    authoritiesinpublicsecurityorgansoflocalpeoplesgovernmentsatandabovemunicipal

    levelwithdistricts.

    Article32.Toextendresidenceperiod,thealiensinChinashallsubmitapplicationat

    exitandentryadministrationauthoritiesinpublicsecurityorgansoflocalpeoples

    governmentsatandabovethecountylevel30daysbeforevalidityperiodoftheresidence

    certificateexpires,submitrelevantwrittenapplicationreasonsasrequired.Residence

    periodmaybeextendedifthepostponereasonsareexaminedasreasonableandsufficient;

    ifresidenceperiodisnotextended,thealiensshallleaveChinaontime.

    Article33.Registereditemsontheresidencecertificateforaliensinclude:name,

    gender,birthdateoftheholder,residencereasons,residenceperiod,issuedate,place,

    passportorotherinternationaltravelcertificatenumber,etc.

    Ifanyregistereditemontheresidencecertificateforaliensischanged,thecertificate

    holdershallapplyforchangeatexitandentryadministrationauthoritiesinpublicsecurity

    organsoflocalpeoplesgovernmentsatandabovethecountylevelwithintendaysafter

    theregistereditemischanged.

    Article34.Staycertificateforaliensshouldbeissuedaccordingtotheprovisionsif

    alienswhoareexemptedfromvisaforentryneedtostayinChinabeyondthevisafree

    period,foreignseamenandaccompanyingfamilymembersneedtoleavetheportcity

    duringtheirstayinChina,orotherconditionsunderwhichstaycertificateforaliensis

    required.

    Thelongest

    validity

    period

    of

    stay

    certificate

    for

    aliens

    is

    180

    days.

    Article35.AfterenteringChina,ifordinaryvisa,stay/residencecertificatesofaliens

    needtobereplaced,reissuedduetodamage,loss,stealing,robberyorforreasons

    stipulatedbythestate,thealiensshallputforwardapplicationatexitandentry

    administrationauthoritiesinpublicsecurityorgansoflocalpeoplesgovernmentsatand

    abovethecountylevelaccordingtotheprovisions.

    Article36.Thedecisionofexitandentryadministrationauthoritiesinpublicsecurity

    organsnottoextendvalidityperiod,nottoreplace,reissueordinaryvisa,nottoissue

    stay/residencecertificatesforaliens,nottoextendresidenceperiodshallbefinaldecision.

    Article37.

    The

    aliens

    who

    stay

    and

    reside

    in

    China,

    shall

    not

    be

    enaged

    in

    any

    activity

    inconsistentwiththereasonsofstayandresidence,andshallleaveChinabeforeexpiration

    ofthespecifiedstayandresidenceperiod.

    Article38.Aliensof16yearsoldandaboveshallbringtheirpersonalpassportsor

    otherinternationaltravelcertificates,orstay/residencecertificatesforalienswiththemto

    acceptinspectionofpublicsecurityorgansduringtheirstayandresidenceinChina.

    AlienswhostayinChinashallsubmittheirresidencecertificateforalienstopublic

    securityorgansoflocalpeoplesgovernmentsatandabovethecountylevelwithinthe

    specifiedtime.

    Article39.IfaliensstayinhotelsinChina,thehotelsshallregistertheir

    accommodationaccordingtopublicsecuritymanagementprovisionsforhotels,report

    accommodationregistrationinformationofthealienstolocalpublicsecurityorgans.

    Ifaliensliveorresideindomicilesotherthanhotels,thealiensthemselvesorthe

    receiversshallregisteratlocalpublicsecurityorganswithin24hoursafterresidence.

    Article40.ForforeigninfantsborninChina,theirparentsoragentsshalltakebirth

    certificateoftheinfantstoregistertheirstayorresidenceatexitandentryadministration

    authoritiesinpublicsecurityorgansoflocalpeoplesgovernmentsatandabovethecounty

    levelwheretheirparentsresidewithin60daysafterbirthoftheinfants.

    certificateofthealien,declaretotheexitandentryadministrationauthoritiesinpublic

    securityorgansoflocalpeoplesgovernmentsatandabovethecountylevelaccordingto

    theprovisions,cancelhis(her)stay/residencecertificateforaliens.

    Article41.AlienswhoworkinChinashallgetworkpermitandworkresidence

    certificateaccordingtotheprovisions.Anyorganizationorindividualshallnothireany

    alienwithoutworkpermitandworkresidencecertificate.

    Administrativemeasures

    for

    aliens

    working

    in

    China

    shall

    be

    stipulated

    by

    the

    State

    Council..

    Article42.Humanresourceandsocialsecurityauthorities,foreignexpertauthorities

    undertheStateCouncilshallformulateguidancelistforaliensworkinginChinaandmake

    adjustmentperiodicallytogetherwithrelevantdepartmentsoftheStateCouncilaccording

    totheeconomicandsocialdevelopmentrequirements,supplyanddemandstatusof

    humanresources.

    EducationauthoritiesundertheStateCouncilshallestablishpartworkandpartstudy

    managementsystemforoverseasstudentstogetherwithrelevantdepartmentsofthe

    StateCouncil,specifythepostscopeandtimelimitofpartworkandpartstudyfor

    overseasstudents.

    Article43.Thealienswillbedeemedasillegalemploymentiftheyhaveoneofthe

    followingbehaviors:

    (I)workinginChinawithoutthespecifiedworkpermitandworkresidencecertificate;

    (II)workinginChinaoutofthescoperestrictedbytheworkpermit;

    (III)overseasstudentsviolateadministrativeprovisionsforpartworkandpartstudy,

    Article44.Inordertomaintainnationalsecurityandinaccordancewithpublicsafety

    needs,publicsecurityorgansandnationalsecurityorgansmayrestrictaliensandforeign

    institutionsfromestablishingresidencesorofficesincertainlocations;ifalready

    established,adeadlinemaybesetforthemtovacate.

    Withoutapproval,aliensshallnotenteranylocationthatwherealiensentryis

    restricted.

    Article45.Workunitsthatemployaliensorrecruitoverseasstudentsmustreport

    relevantinformationtolocalpublicsecurityorgansinaccordancewithregulations.

    Citizens,legal

    persons

    or

    other

    organizations

    shall

    report

    to

    local

    public

    security

    organstimelyiftheydiscovertheillegalentry,illegalresidence,orillegalemploymentof

    aliens.

    Article46.AlienswhoapplyforstatusofrefugeesmaystayinChinawithtemporaryID

    certificateissuedbythepublicsecurityorgansduringthediscriminationforstatusof

    refugees;alienswhoareassessedasrefugeesmaystayandresideinChinawithrefugee

    identitycertificateissuedbythepublicsecurityorgans.

    Section2.PermanentResidence

    Article47.AlienswhohavemadeoutstandingcontributionstoChinaseconomicand

    socialdevelopmentormeetotherpermanentresidenceconditionsinChina,mayget

    permanentresidencequalificationsafterpersonalapplicationissubmittedtoandapproved

    bytheMinistryofPublicSecurity.

    AdministrativemeasuresfortheapprovalofpermanentresidenceofaliensinChina

    shallbestipulatedbytheMinistryofPublicSecurity,MinistryofForeignAffairstogether

    withrelevantdepartmentsundertheStateCouncil.

    Article48.

    Aliens

    with

    permanent

    residence

    qualifications

    may

    reside

    and

    work

    in

    Chinawiththeirpermanentresidencecertificates,mayleaveorenterChinawiththeir

    personalpassportsandpermanentresidencecertificates.

    Article49.TheMinistryofPublicSecuritymaydecidetocancelpermanentresidence

    qualificationsofaliensinChinaunderanyofthefollowingcircumstances:

    (I)endangerChinasnationalsecurityandinterests;

    (II)subjecttobanishment;

    Chapter5.ExitEntryFrontierInspectionofVehicles

    Article50.Whenvehiclesleaveorarriveatportsforexitandentry,theyshallsubmit

    tofrontierinspection.Entryfrontierinspectionforvehiclesshallbecarriedoutatthefirst

    arrivalport;exitfrontierinspectionforvehiclesshallbecarriedoutatthefinaldepartureport.Frontierinspectionmaybecarriedoutinplacesdesignatedbycompetentauthorities

    underspecialconditions.

    Nopersons,cargoesorarticlesmaybetakenonboardordischargedfromvehicles

    withoutapprovaloftheExitEntryFrontierInspectionStationaccordingtothespecified

    proceduresafterexitinspectionofvehiclesandbeforeexit,aswellasafterentryof

    vehiclesuntilentryinspection.

    Article51.Thersponsiblepersonforvehiclesorexitentryagenciesforvehiclesshall

    reportthearrival,departuretimeattheportandstayplaceofthevehiclesforentry,exitto

    theExit

    Inspection

    Station

    in

    advance

    according

    to

    the

    provisions,

    declare

    employees,passengers,goodsorarticlesfaithfully.

    Article52.Theresponsiblepersonsforvehiclesandexitentryagenciesforvehicles

    shallcoordinatewithexitentryfrontierinspection,shallreportandassistinvestigationand

    handlingimmediatelyifanybehaviorviolatestheprovisionsofthisLaw.

    IfanyvehiclecarriesanypersonwhoisnotpermittedtoenterChina,theresponsible

    personofthevehicleshalltakehim(her)away.

    Article53.ExitEntryFrontierInspectionStationshallsupervisevehiclesforexitand

    entryinanyofthefollowingconditions:

    (I)afterexitfrontierinspectionofvehiclesbegins,beforeactualexit,aswellasafter

    theentryofvehicles,beforetheentryfrontierinspectioniscompleted;

    (II)duringnavigationofforeignshipsinChineseinlandrivers;

    (III)otherconditionsthatrequiresupervision.

    Article54.Thepersonswhoneedtoembark,disembarkforeignshipsowingto

    handlingofarticles,repairjob,visitsandotherreasonsshall,applyforboardcardfromthe

    ExitEntry

    Frontier

    Inspection

    Station.

    WhereChineseshipsneedtomakefasttoforeignshipsormakingfastisrequired

    betweenforeignships,thecaptainsortheiragenciesshallapplytogothroughmakingfast

    formalitiesattheExitEntryFrontierInspectionStation.

    Article55.Foreignships,aircraftsshallmoveinthespecifiedroutes,coursesinChina.

    Ships,aircraftsforexitandentryshallnotmoveoutoftheopenport.Alwaysreportto

    nearbyExitEntryFrontierInspectionStationorlocalpublicsecurityorgansimmediately,

    andacceptsupervisionandmanagementifmovingintounpermittedlocationsdueto

    unforeseeableemergencyorforcemajeure.

    Article56.VehiclesshallnotbeallowedtoleaveorenterChinaunderanyofthe

    followingcircumstances;ifalreadydepartedfromtheport,orderthemtoreturn:

    (I)toleaveorenterChinawithoutapprovalandauthorization,whenleaving,arriving

    attheport;

    (II)changetheportofexit/entrywithoutauthorization;

    (III)suspectedtocarrywithpersonswhoarenotallowedtoleaveorenterChina,so

    inspectionisrequiredforverification;

    (IV)suspected

    to

    carry

    with

    articles

    that

    might

    endanger

    national

    security,

    interests

    andsocialpublicorder,soinspectionisrequiredforverification;

    (V)otherconditionsofrejectingcontrolbytheExitEntryFrontierInspectionStation.

    Aftertheconditionslistedabovedisappear,theExitEntryFrontierInspectionStation

    shallreleaserelevantvehiclesimmediately.

    Article57.Organizationsthatareenagedinexitandentryagencyofvehiclesshall

    reporttotheExitEntryFrontierInspectionStationforarchiving.Personswhoareengaged

    inagencyshallbereportedtotheExitEntryFrontierInspectionStationforarchivingby

    theirorganizations.

    Chapter6.InvestigationandRepatriation

    Article58.Onthespotinterrogation,continuedinterrogation,detentionfor

    investigation,restrictionofactivityscope,deportationmeasuresspecifiedinthischapter

    shallbeimplementedbypublicsecurityorgansoflocalpeoplesgovernmentsatandabove

    thecountylevelorExitEntryFrontierInspectionStation.

    Article59.Onthespotinterrogationmaybecarriedoutforpersonwhoaresuspected

    toviolatethecontroloftheexitandentry;afteronthespotinterrogation,continued

    interrogationmay

    carried

    out

    according

    to

    law

    under

    any

    of

    the

    following

    circumstances:

    (I)suspectedillegalexit/entry;

    (II)suspectedtoassistothersforillegalexit/entry;

    (III)aliensaresuspectedofillegalresidence,illegalemployment;

    (IV)suspectedtoendangernationalsecurityandinterests,destroysocialpublicorder

    orengagedinotherillegalcriminalactivities.

    Onthespotinterrogationandcontinuedinterrogationshallbecarriedoutin

    accordancewith

    the

    procedures

    in

    the

    Peoples

    Police

    Law

    of

    the

    Peoples

    Republic

    of

    China.

    Publicsecurityorgansoflocalpeoplesgovernmentsatandabovethecountylevelor

    ExitEntryFrontierInspectionStationshallsummonthepersonssuspectedinviolationof

    exit/entrycontrol inaccordancewiththeLawofthePeoplesRepublicofChinaonPublic

    SecurityAdministrationPunishments.

    Article60.Ifanyaliencouldnotbeexcludedfromsuspectafteronthespot

    interrogationorcontinuedinterrogationunderanyoftheconditionsspecifiedinClause1

    ofArticle59inthisLaw,he(she)maybedetainedforfurtherinvestigation.

    Ifdetention

    for

    investigation

    is

    implemented,

    the

    decision

    of

    detention

    for

    investigationshallbepresented,andqueryshallbecarriedoutwithin24hours.Ifthe

    detentionforinvestigationisfoundimproper,thedetentionforinvestigationshallbe

    cancelledimmediately.

    Periodofdetentionforinvestigationshallnotexceed30days;andmaybeextendedto

    60daysforcomplicatedcasesafterapprovedbypublicsecurityorgansoflocalpeoples

    governmentsatthenexthigherlevelortheExitEntryFrontierInspectionStation.For

    alienswhosenationality,identityareunknown,periodofdetentionforinvestigationshall

    becountedfromthedatewhentheirnationality,identityareascertained.

    Article61.

    Detention

    for

    investigation

    is

    inapplicable

    to

    the

    aliens

    under

    any

    of

    the

    followingcircumstances,theiractivityscopemayberestricted:

    (I)sufferedfromseriousdiseases;

    (II)duringpregnancyorbreastfeedingofherowninfantunder1yearold;

    (III)under16fullyearsoldorabove70fullyearsold;

    (IV)otherconditionsunderwhichdetentionforinvestigationisinapplicable.

    For

    aliens

    whose

    nationality,

    identity

    are

    unknown,periodforrestrictingactivityscopeshallbecountedfromthedatewhentheir

    nationality,identityareascertained.

    Article62.Aliensmaybedeportedunderanyofthefollowingcircumstances:

    (I)sentencedtoleavethecountrybeforeadeadline,yetfailedtoleavebeforethe

    deadline;

    (II)otherconditionsunderwhichentryintoChinaisnotpermitted;

    (III)illegalresidence,illegalemployment;

    (IV)deportationshallbeperformedduetoviolationofthisLaworotherlaws,

    administrativerulesandregulations.

    Otheroverseaspersonsmaybedeportedaccordingtolawunderoneoftheabove

    mentionedconditions.

    PersonswhoaredeportedshallnotbepermittedtoenterChinaagainwithinoneto

    fiveyearsafterthedateofdeportation.

    Article63.Personswhoaredetainedforinvestigationordecidedfordeportation,yet

    couldnotbeexecutedimmediately,shallbedetainedindetentionhouseorrepatriation

    place.

    Article64.Alienswhorefusetoacceptthecontinuedinterrogation,detentionfor

    investigation,restrictionofactivityscope,deportationmeasuresaccordingtothislaw,may

    applyforadministrativereconsiderationaccordingtolaw,decisionoftheadministrative

    reconsiderationshallbefinaldecision.

    Theabovementionedprovisionsarealsoapplicabletootheroverseaspersons,who

    refusetoacceptthedeportationmeasuresaccordingtothislaw,andapplyfor

    administrativereconsideration.

    Article65.ForthepersonswhoarenotallowedtoleaveorenterChinaaccordingto

    law,thedecisionmakingauthorityshallnotifyExitEntryFrontierInspectionStationtimely

    accordingtotheprovisions;ifconditionsofnoexit,entrydisappear,thedecisionmaking

    authorityshallcancelthedecisionofnoexit,entrytimely,andnotifytheExitEntryFrontier

    InspectionStation.

    Article66.ExitEntryFrontierInspectionStationsmayperformbodysearchesof

    personsexitingorenteringChina,inaccordancewithneedsfornationalsecurityandfor

    preservinganorderlyexitentryprocess.Bodysearchesshallbecarriedoutbytwofrontier

    inspectorsofthesamesexasthepersontobesearched.

    Article67.Ifvisa,stay/residencecertificatesforaliensandotherexit,entrycertificates

    aredamaged,lost,stolen,robbedoranycertificateholderisfoundincompliantwiththe

    issueconditions

    after

    issued,

    the

    issuing

    authority

    shall

    declare

    such

    exit

    and

    entry

    certificatesinvalid.

    Falsified,altered,cheatedexit,entrycertificatesorexit,entrycertificatesthatare

    cancelledbythecertificateissuingauthorityshallbeinvalid.

    Publicsecurityorgansmaycancelorconfiscatetheabovementionedexitandentry

    certificatesorexitandentrycertificatesthatareusedbyothersinstead.

    Article68.Publicsecurityorgansmaydetainvehiclesthatareusedtoorganize,

    transfer,assistothersforillegalexit/entry,aswellasarticlesthatmayserveasevidencesin

    casehandling.

    Ifprohibitedarticles,documents,datainvolvingstatesecrets,toolsforimplementing

    activitiesinviolationofexitandentrycontrolareseized,publicsecurityorgansshall

    distrainthem,andhandlethecasesaccordingtorelevantlaws,administrativerulesand

    regulations.

    Article69.Authenticityoftheexitandentrycertificatesshallbedeterminedbythe

    issuingauthority,ExitEntryFrontierInspectionStationorexitandentryadministration

    authoritiesinpublicsecurityorgans.

    Chapter7.LegalLiabilities

    Article70. Administrativepenaltyspecifiedinthischaptershallbedecidedbypublic

    securityorgansoflocalpeoplesgovernmentsatandabovethecountylevelorExitEntry

    FrontierInspectionStation,unlessotherwisespecifiedinthischapter;inwhichwarningor

    entrycertificatestothemwithinsixmonthstothreeyearsafterthedateofrepatriation.

    Ifanyhoteldoesnotregisteraccommodationinformationofaliensaccordingtothe

    provisions,apenaltyshallbeimposedaccordingtotheLawofthePeoplesRepublicof

    ChinaonPublicSecurityAdministrationPunishments;iffailedtoreportaccommodation

    registrationinformationofalienstopublicsecurityorgansaccordingtotheprovisions,

    warningshallbegiven;inseriouscases,apenaltybetweenRMB1,000Yuanand5,000

    Yuanshallbeimposed.

    Article77.

    Aliens

    shall

    be

    ordered

    to

    leave

    immediately

    ifthey

    enter

    any

    location

    in

    whichaliensareprohibitedwithoutauthorization;inseriouscases,detentionperiodshall

    bebetween5daysand10days.Writtenrecords,acousticimagedata,electronicdataand

    otherarticlesacquiredbyaliensinillegalwaysshallbeconfiscatedordestroyed,toolsshall

    beconfiscated.

    Ifaliens,foreignagenciesviolatetheprovisionsofthisLaw,refusetomoveaway

    accordingtothedecisionofpublicsecurityorgans,nationalsecurityorgansbeforethe

    deadline,warningshallbegiven,forcedmovementawayshallbeimplemented;detention

    periodofrelevantresponsiblepersonsshallbebetween5daysand15days inserious

    cases.

    Article78.Forillegalresidenceofaliens,warningshallbegiven;inseriouscases,a

    penaltyof500yuanperdayshallbeimposedonillegalresidence,nottoexceedatotalof

    10,000yuan,ordetentionperiodshallbebetweenfiveand15days.

    Forillegalresidenceofaliensunder16fullyearsoldbecausetheirguardiansorother

    personswithresponsibilityofguardianshipdonotfulfilltheirguardianobligations,warning

    shallbegiventotheguardiansorotherpersonswithresponsibilityofguardianship,a

    Apersonwhointroducesalienstoillegalworkwillbesubjecttoafineof5000yuan

    peralien,nottoexceedatotalfineshallof50,000yuan. Aworkunitthatintroducesaliens

    toillegalworkwillbesubjecttoafineof5000yuanperalien,nottoexceedatotalfineof

    50,000yuan.Ifthereareillegalearnings,suchearningswillbeconfiscated.

    Apersonwhoemploysaliensillegallyissubjecttoafineof10,000RMBperalien,not

    toexceedatotalfineof100,000RMB.Ifthereareillegalearnings,suchearningswillbe

    confiscated.

    Article81.Ifanalienisengagedinactivitiesthatarenotconsistentwiththetermsof

    theirauthorizedstayorresidence,orthatviolateprovisionsofotherChineselawsor

    regulations,thealienmayberequiredtodepartthecountrywithinaspecifiedperiod,ifit

    isnotappropriateforthealientocontinuestayingorresidinginChina.

    ThePublicSecurityBureaumaydeportanalienwhoviolatesthisLawseriously,evenif

    nocrimehasbeencommitted.ThePublicSecurityBureausdecisionregardingsuchpenalty

    isthefinaldecision.

    Analienwhohasbeendeportedmaynotbereadmittedfor10yearsfromthedateof

    deportation.

    Article82.

    In

    any

    of

    the

    following

    circumstances,

    awarning

    shall

    be

    given,

    and

    afine

    under2000yuanmaybeimposed:

    (I)disturbingtheoperationorderwithintherestrictredareasoftheports.

    (II)anforeignseamanandhisaccompanyingrelativeswhodisembarkwithout

    undergoingtemporaryadmissionprocedures.

    (III)boardingordisembarkingfromaforeignvesselwithoutanyboardingdocuments.

    ViolationofArticle82(I)underseverecircumstances willresultindetentionofmore

    than5daysbutupto10days.

    Article83.Inanyofthefollowingcircumstancesforvehicles,theresponsibleperson

    maybefinedforover5,000yuanbutnotmorethan50,000yuan:

    (I)exitandentertheborderwithoutinspectionandpermission,orchangetheexitand

    entryportwithoutapproval;

    (II)failuretotruthfullyreporttheinformationofemployees,passengers,cargosor

    goods,orrefusetocooperatewiththeexitentryborderinspectionaccordingtothe

    regulation.

    (III)boarding,orloading/unloadingcargosorgoodsinviolationofthestipulationsof

    theexitentyborderinspection.

    Usingexitentryvehiclestotransportpersonswhoarenotallowedtoexitorenterthe

    borderwillresultinafineofover5,000yuanbutupto10,000yuanforeachpersonbeing

    transported. Intheeventthattheresponsiblepersonofthetrasnsportationvehiclescan

    provethathe/shehastakenreasonablepreventivemeasures,thepunishmentcanbe

    relievedorexempted.

    Article84.Inanyofthefollowingcircumstancesonvehicles,afineofover2,000yuan

    butuptounder20,000yuanmaybeimposedontheresponsibleperson:

    (I)aChineseorforeignvesselwhichapproachesaforeignvesselwithoutauthorization.

    (II)any

    foreign

    vessel

    or

    aircraft

    which

    fails

    to

    travel

    along

    the

    stipulated

    sea

    route

    or

    airroutewithintheterritoryofChina.

    (III)anyexitentryvesseloraircraftwhichtravelstoanyareasotherthanthe opening

    portsinviolationoftheregulation.

    Article85.Inanyofthefollowingcircumstances,punishmentwillbeimposedonthe

    exitentryadministrationstaff:

    (I)issuingexitentrydocumentsincludingvisasorresidentdocuments,etc.to

    unqualifiedforeingersinviolationofthelawandadministrativeregulations.

    (2)inspecting

    and

    approving

    unqualified

    persons

    or

    vehicles

    to

    exit

    or

    enter

    the

    border

    inviolationofthelawandadministrativeregulations.

    (3)disclosingpersonalinformationreceivedduringthecourseofexitentry

    administration,infringingthepartyslawfulrightsandinterests.

    (4)failureofturningovertotheStateTreasurythepaymentlegallyreceived, fines

    paid,andtheillegalgainsandpropertiesconfiscatedaccordingtotheregulation.

    (5)illegalsharing,possessionordefalcationofthefeesorgoodswhicharefined,

    confiscatedorseizedorthepaymentsreceived..

    (6)abusing

    authority,

    derelicting

    duty,

    committing

    favoritism

    and

    irregularities,

    and

    anyothernonperformanceofstatutorydutiesaccordingtothelaws.

    Article86.Theexitentryborderinspectionauthoritiesmaymakethepunishment

    decisiononthespotforanyfinesunder500yuanforviolationoftheexitentry

    administrationlaw.

    Article87.Apersonwhoisfinedforviolationoftheexitentryadministrationlawshall

    paythefineatthedesignatedbankwithin15daysuponreceivingthefinenotice.Ifthis

    Article88.Anyviolationofthetheprovisionsofthelawwhichconstitutesacrimeshall

    besubjecttocriminalliabilities.

    Article89.Definitionofthefollowingtermsunderthislaw:

    Exit,meaningtravelfrommainlandChinatoothercountriesorregions;orfrom

    mainlandChinatoHongKongSARorMacauSAR;orfrommainlandChinatoTaiwan.

    Entry,

    meaning

    travel

    from

    other

    countries

    or

    regions

    to

    mainland

    China,

    or

    from

    Hong

    KongSARorMacauSARtomainlandChina;orfromTaiwantomainlandChina.

    Foreigner,meaningpeoplewhoarenotChinesenationals.

    Article90.UponapprovalbyStateCouncil,provincesandautonomousregions

    adjacenttoneighbourcountriesmayformulatelocalregulationsorgovernmental

    provisionstostipulatethevisitsoftheresidentswholiveintheadjacentareasofthe

    borderofthetwocountriesaccordingtotheborderadministrationconventionexecutedby

    Chinaandtherelevantcountry.

    Article91.Theexitentryandresidenceadministrationofdiplomaticrepresentative

    authoritiesand

    members

    from

    consular

    agencies

    of

    foreign

    countries

    in

    China

    as

    well

    as

    otherforeignerswhoenjoyprivilegesandexemptionsshallbegovernedbyother

    regulationsifany.

    Article92.Foreignerswhoapplyforexitentrydocumentsincludingvisas,resident

    documentsetc.,orapplyforextensionorchangeofthedocumentsshallpayvisa

    applicationfeesanddocumentfeesaccordingtotheregulation.

    Article93.ThislawwillbeeffectiveonJuly1,2013.TheLawofThePeoplesRepublic

    ofChinaonControloftheEntryandExitofAliensandtheLawofThePeoplesRepublicof

    ChinaonControloftheEntryandExitofCitizenswillbeabolishedatthesametime.
