clinic system, where amputations were almost done unnecessarily and cancer remained undiagnoseduntil dangerously late. These outcomes were not race neutral. In NewYork, people of color are farmore likely to have public insurance than whites, which means that when hospitals create two sys-tems of care based on insurance they are also perpetuating a de facto segregation based on race.

Under federal law, hospitals are required to open their doors to Medicaid beneficiaries and providethem care without discrimination. To this end, NewYork Lawyers for the Public Interest successfullyadvocated for the introduction of State Senate Bill S7807 and Assembly Bill A10988 which will, ifpassed, amend the state’s public health law to ensure that all patients receive affordable, qualityhealth care at NewYork City academic-medical centers, regardless of their type of insurance. This billrequires three main changes. First, it requires hospitals to treat patients in an integrated setting whereall patients are seen in the same place with the same technologies and staff, regardless of their pay-ment type. Second, all patients must be informed about the availability of hospital financial assistanceprograms. Finally, academic-medical centers must make their best efforts to negotiate with Medicaidmanaged care plans so more providers can care for Medicaid patients. The increased resources andmixed patient population would help ensure that the quality of clinic care would improve dramati-cally and that high-quality care would be equally accessible to all patients.

The fight to integrate our health care system and to reduce racial and ethnic health disparities is goingto be just as messy as the historic battles to integrate our educational system or our housing. But fightis what Bronx residents and NYLPI will do, even in the face of uncertainty and resistance. As one faithleader said at the town hall meeting, quoting a song from the civil rights movement of the deep South,we must “run on and see where it ends.”

A YEAR LATER: NEWYORK LAWYERS FORTHE PUBLIC INTEREST STILL AT THE FORE-FRONT OF IMMIGRANT CIVIL RIGHTSIn 2008, NYLPI brought state-wide attention to the pressing issue of languageaccess in pharmacies by filing a civil rights complaint with the New York StateOffice of the Attorney General on behalf of Make the Road New York. Thiswork culminated in settlement agreements with Wal-mart, Duane Reade,Costco, Target, CVS, Rite Aid and A&P-owned pharmacies. In September 2009,we went on to lobby successfully for the passage of the Language Access andPharmacies Act in the New York City Council, which requires all major phar-macy chains in New York City to provide translation in the six most prevalent

foreign languages in the city and oral interpretation in all languages for all limited-English proficientpatients.

But our work on behalf of immigrants and those with limited English proficiency is not done. A yearlater, we have launched a citywide monitoring campaign to measure the effectiveness of the settle-ment agreement as well as the local law. We are also working actively to push a bill we helped draftand champion in the State Legislature that seeks to codify the language access provisions of the At-torney General’s settlement agreements and also calls for the standardization of instructions on medi-cine labels to make them easier to understand for patients with low levels of health literacy, theelderly and people with disabilities. As part of these advocacy efforts, we have begun investigatingthe practices of independent pharmacies around the city, many of which provide models for howlanguage assistance services can be provided at a low cost. By scaling up our efforts and conductingongoing research in language access and surveying pharmacies to ensure compliance, NYLPI is dedi-cated to achieving justice on behalf of millions of immigrants.

NYU CHILD STUDY CENTER OPENS DOORSTO MEDICAID PATIENTSNYLPI, along with co-counsel Cleary Gottlieb Steen & Hamilton LLP and LatinoJustice/PRLDEF, suc-cessfully campaigned for the Child Study Center of the NewYork University Medical Center to desig-nate doctors who will accept Medicaid and other health insurance. Previously, NYU’s Child StudyCenter had a cash-only policy and did not accept any insurance at all. NYU has taken a step in theright direction towards eradicating a few of the many institutional barriers keeping low-income NewYorkers from accessing quality health care.

As part of the advocacy campaign, a group of parents represented by NYLPI and our co-counsel metwith NYU leadership and explained how the cash-only policy impacted them and the thousands ofother families who were unable to access the Center’s state-of-the-art evaluations and medical servicesfor children with disabilities. Without cash to pay forevaluations, many low-income and minority childrenwere unable to obtain the medical attention they neededin times of serious illness.

As a result of NYLPI’s action, the Child Study Center hasannounced that it will designate certain providers whowill begin accepting fee-for-service Medicaid and ChildHealth Plus. According to one parent, Lorraine Ali, “Nomother wants to be told she can’t provide her child withthe medical attention he needs. Now I can finally get myson to a doctor who can treat him. It’s the best newswe’ve gotten in a long time.”

Since the victory NYLPI, along with other advocates, hascontinued to monitor NYU’s compliance and implemen-tation of this new policy. But NYU’s Child Study Center currently does not have plans to accept anyMedicaid managed care plans. “There continues to be an acute shortage of evaluative and medicalservices for children with psychiatric disabilities in NewYork City,” said Kelly McAnnany, Director ofthe Opportunity & Access Program at NYLPI. “We will continue to work with providers and with stateagencies to open the doors to quality health care and educational opportunity for low-income chil-dren with disabilities.”

Lawyers Respond to the Crisis in HaitiBy JoannaWasick, Litigation and Pro Bono Associate of Hogan Lovells US LLP,and member of NYLPI’s Pro Bono Advisory CouncilIn May, I travelled to Haiti with a team of NewYork attorneys1 led by Jayne Fleming, pro bono counsel to ReedSmith, to interview women living in Internally Displaced Persons Camps. We were there in response to thecatastrophic earthquake and our project focused on identifying potential candidates for humanitarian parole –a means for temporary entry into the United States for “compelling” reasons – and documenting conditions to

support those applications. While I had seen post-earthquake images in the media, noth-ing could have prepared me for the absolute devastation we witnessed the moment wetouched down in Port-au-Prince. There was rubble and trash everywhere, the few buildingsthat were still standing were just barely so, and the smell of corpses was palpable eventhrough the closed windows of our car. “Look at the people’s faces,” our driver told us.“You used to hear music in the streets – see people smiling. Now everyone is empty.” Hewas right. Four months later, the people were still in absolute shock.

Our team spent each day interviewing women living in the camps. Everyone told us of in-sufficient food supplies, scarce clean water, and the many horrors of living in “tents” thatwere nothing more than sheets and sticks. But, by far, the most shocking accounts werethose of rape. I heard account after account by women who were attacked in their tentslate at night by groups of men, usually armed with machetes and machine guns. Womenbrave enough to report the crimes were often turned away by the police or camp guardsand told there was nothing that could be done. I did not hear of one attack that had beenprosecuted or even investigated. The vast majority of victims also went without any mean-ingful medical care. One woman I interviewed walked miles from her tent so she couldtell us about how she and her daughter were raped, and then how both, along with her 16year old son, were savagely beaten. When I asked about her most immediate needs, she

lifted her skirt up so I could see her leg, which had tripled in size and had turned a deep shade of purple.“They hurt my leg. Maybe you can find a doctor to look at it.”

By the end of our week in Haiti, we had collected data and helped some get basic medical attention, includingthe mother with the broken leg. We also identified a number of humanitarian parole candidates who we arenow representing. But it is a drop in the bucket. Progress on Policing and Mental IllnessIn April 2010, NYLPI with the Law Office of Carmen Giordano andMayer Brown LLP, reached a settlement with the NYPD in thewrongful death lawsuit brought in the matter of Kevin Cerbelli, whohad been diagnosed with schizophrenia and who was fatally shot bypolice officers in 1998. The settlement provides for a meeting withthe NYPD and Kevin’s mother, Loretta Cerbelli, which will focus onpolice interactions with Emotionally Disturbed Persons (EDPs). TheNYPD has never before met with a plaintiff in a wrongful death law-suit to discuss policy reform.

NYLPI seeks to urge the NYPD to review its practices and close thegaps between its much improved training on EDP issues and imple-mentation of that training in the field. Maintaining the safety of everyone involved is paramountand current practices have too often fallen short. Many police departments across the country

have implementedmethods to defusepotentially volatilesituations. For exam-ple, an emphasis ondecelerating the po-lice response to EDPsituations can estab-lish safer conditions.It is the hope ofNYLPI that thismeeting will bringNewYorkers onestep closer to pre-venting such atragedy from hap-pening again.

Farewell to Yoonmee Cho andPeggy Germain of the ClearinghouseFor two years, Yoonmee Cho contributed greatly to our organization as a Program Associate

for the Pro Bono Clearinghouse. This fall she began her studies as a law student at Fordham

School of Law in the Stein Scholars Program. Her strong inter-

est in the law led Yoonmee to public interest after working in

corporate communications. Yoonmee helped transform our

communications by overseeing a complete overhaul of our

newsletter, Pro Bono Matters, now circulated to over 8,000

lawyers across the country. She also helped preside over a

major upgrade to our database, making it easier for us to place

and track pro bono cases and volunteer attorneys.

For three years, Peggy Germain worked as the Program Assis-

tance for the Pro Bono Clearinghouse. She is now working to

complete her master’s degree in social work at the Fordham

Graduate School of Social Service. Peggy contributed greatly to

the organization through her work with the Pro Bono Advisory

Council, which works to strengthen the Pro Bono Clearing-

house’s efforts. She also created and produced the e-newsletter,

which provides valuable information and resources to hun-

dreds of Clearinghouse clients.

During their tenures, Yoonmee and Peggy were instrumental in

connecting hundreds of nonprofits and community groups with

volunteer attorneys from NYLPI’s member law firms while en-

suring the highest quality legal services. We at NYLPI wish

them the best of luck at school and in their future endeavors. Yoonmee is replaced by Heidi

Kim, who comes to us from the NewYork County District Attorney’s office. Peggy is replaced

Our mission is to advance equality and civil rights, with

Through community lawyering, NYLPI puts its legal,

policy and community organizing expertise at the serv-

ice of New York City communities and individuals.

NYLPI’s partnership with the private bar strengthens its

advocacy and connects community groups and non-

This summer, the leadership of NYLPI and our Boardturned the lens inward to draft a new mission state-ment for the organization. It was a challenge to findthe right words to describe what this incredible teamdoes, day after day, for the underrepresented in NewYork.
